‘Unconstitutional Laws Aren’t Laws’: Marine Who Penned Blistering Letter to Sen. Feinstein Over Gun Control Speaks Out

Cpl. Joshua Boston, the U.S. Marine whose scathing open letter to Sen. Dianne Feinstein (D-Calif.) over proposed new gun control legislation went viral, again vowed not to abide by any new law requiring him to register his firearms.
“Whatever happens happens. I have a right granted to me by the Second Amendment in our bill of rights and it says ‘shall not be infringed,’” Boston said Saturday on CNN. “Unconstitutional laws aren’t laws.”
Boston’s letter, titled “No ma’am,” was first posted on CNN’s iReport on Dec. 27 and quickly made the rounds on social media.
“I am not your subject. I am the man who keeps you free. I am not your servant. I am the person whom you serve. I am not your peasant. I am the flesh and blood of America,” the eight-year Marine Corps veteran wrote.
Boston said he wrote it after seeing all of the “misinformation” and “fear-mongering” coming out of the gun control discussion in the wake of last month’s mass elementary school shooting in Newtown, Conn.
He said that with many gun control laws on the books already, new legislation will do nothing to deter criminals.
“There’s over 2,000 gun laws as it is and the fact of the matter is predators are amongst us and we have to recognize that fact. We don’t live in a utopia. Our citizens have to be armed to protect themselves from these mad men,” Boston said. “People will choose whether or not to carry if they want to. I’ve made that choice as have hundreds of thousands of other Americans should we unfortunately ever find ourselves in a situation to protect others in our lives we will.”
Feinstein’s office said in a statement she “respects Cpl. Boston’s service.”
“She has heard from thousands of people — including many gun owners — who support her plan to stop the sale, transfer, importation and manufacturing of assault weapons and large capacity magazines, strips and drums that hold more than 10 rounds,” the statement said. “As Senator Feinstein has said, the legislation will be carefully focused to protect the rights of existing gun owners by exempting hundreds of weapons used for hunting and sporting purposes.”

I would say it is the last reason, I have the right to bear arms, including the so called “assault” weapons. The second amendment has nothing to say as to which kind of arms. It just says it shall not be infringed, period! There is no way we can legislate enough laws to make people be a moral God fearing people. That is an individual choice. Those of us who choose to be good citizens have the right to protect ourselves against those who do not choose to be good. And the right to choose to protect ourselves from a tyrannical government.

Now in the United States we don’t make retroactive laws and then punish people for a law that didn’t exist at the time. You’re wrong there, that’s not something we want for in this country for obvious reasons. However, to your point of making it illegal to sell weapons to Mexican Cartels or whomever else I agree with. That should be illegal.
Current law allows a person to walk up to anyone selling guns, at a gun show or gun shop, buy as many “weapons of war” as they can afford, and as much ammo as they want, then walk out into the parking lot and sells those guns at a nice profit to any buyer, be they Al Qaeda members, Mexican cartels or the certifiably insane. Gun sales of private individuals aren’t regulated, thanks to the NRA. So people with a clean background can buy all the guns they want and then sell them, legally, to whomever they want. No background check, no nothin’. I agree with you that that kind of activity should be regulated. All a terrorist or criminal organization needs is one patsy, and they’ve got all the guns and ammo they want. All legal. Thanks NRA!

I think 2013 will be the year that people get smart and organize for any number of bad outcomes due to the policies of Obama’s Marxist administration and our idiot Reps in Congress. My suggestions… Join or start a local Militia. Do NOT allow our government to take away ANY of our 2nd Amendment rights, by any means necessary. Buy lot’s of ammo or better yet learn to make your own and buy a lot of the supplies you will need to do it with. Learn to Barter more. And finally… make this the year that you swear to leave the USA better for your offspring than what we were given by our parents. It is after-all an unwritten American rule and always has been, so it has become our patriotic duty!
However it will take a lot of people doing some extraordinary things in 2013 so we can start to take back the Country we all dearly love.

If people study the DOI, Articles-of Confed,Constitution, and other writings of the founders, they will know that the first sentence of the 2nd Amendment..”A well-regulated militia, in order to defend a free state”….. was referring to the INDIVIDUAL STATES.
There were more than a few who felt that creating a central, or”Federal” government, with ANY authority over the states, was a real danger. Therefore, a “militia” of each state would be necessary to defend state freedom against a tyrannical central government. The militia would be a “citizen-militia”, where-by they would have to be armed for immediate action.
The “shall not be infringed” part speaks to the first part. Those two sentences are inseparable.
This is the part which uninformed leftists here do not understand. Are they saying that the all-powerful gov’s of the Soviet’s, Chi-Com’s, Castro, and elsewhere did not suppress freedom? So, were those gov’s OK? Those “subject’s” were unarmed. How many were put to death?

It was meant as a means to deter our new gov’t from becoming tyrannical as King George had become. Evil exists and those who mean to do harm will find a way. I have the right to protect my family, property and those that I care for from evil and oppression.
I feel there is something more sinister behind these plans. We hear daily about those in gov’t wanting to restrict rights and freedoms. They can spy on Americans with no warrant and detain them indefinitely. The NDAA states it can detain Americans who have been labeled as terrorists. If we don’t turn in our weapons could we be labeled as such? Warrantless wiretapping allows them to view our communications and listen to calls without supervision.
I hope I’m wrong but when you look at all of the information and who is running our federal gov’t I would err on the side of caution and have your ducks in a row.

Technically, calling this gentleman a Marine, without saying ex-Marine, implies active duty status.

Exempting antique, manually-operated, and permanently disabled weapons.

Clinton passed a retroactive tax increase. It was passed in March of 1993 7 yet it taxed income going back to January 1st of 1993.

Well if the “EX POST FACTO CLAUSE” only applies to criminal cases because SCOTUS says so, then we can make administrative & civil judgments on many things. We can say the tax deductibility of 401Ks are no longer in force this year or in the future. We can make it retroactive 1 year. If 1 year why not 10?
So if 401 Ks were no longer tax deductible for 10 years, how screwed would people be?
It can’t happen here? Well if you can make a tax rate retroactive a whole calendar year why not for 10. what is stopping them?

Everyone needs to be involved with the tea party, or freedom works, or a 9-12 project, or a militia, or just a group of neighbors. No one will be able to stand alone on this. whatever they choose…..they better do it fast. This is coming soon. My only suggestion would be, that when choosing a group to be involved with, make sure the main thing they have in common with you is to restore the constitution….all of it.eything else, we can deal with later. Before ratification the writers of the constitution had to defend the National Militia from critics. The critics drove the creation of the bill of rights and the 1st 10 amendments to the constitution. A well-regulated militia, being necessary for the security of a free state, the right of the people to keep and bear arms shall not be infringed. We are not given this right so we can join militias. We are given this right to protect ourselves from the militia.

Don’t worry about us DOING something. We will do plenty when the civil war starts over firearms. Pity so many good law enforcement personnel will be hurt/maimed/killed when King Obama and the Dutchess of California order the confiscation of our weapons. We will do much, including killing, being killed, and going to prison, to defend the second amendment.
