House Minority Leader Nancy Pelosi on Sunday said President Barack Obama should avoid a battle with Congress and just use the Constitution to unilaterally raise the debt ceiling.

The California Democrat told CBS’ “Face the Nation” that if she were president, she would invoke the 14th Amendment and raise the limit on her own. The amendment states that “the validity of the public debt … shall not be questioned,” which supporters say enables the president to raise the debt ceiling without input from Congress in order to ensure payments to bondholders are met.

“We always passed the debt ceiling when President Bush was president, as he was incurring these massive debts, and the Republicans weren’t saying ‘boo’ at the time,” Pelosi said of the expected February standoff. “If I were president, I would use the 14th Amendment, which says that the debt of the United States will always be paid.”

She continued, “I would just go do it. But the Congress has incurred much of this debt. And so what are you saying, we incurred it but we’re not going to pay it? If you want to say, ‘We are not going to do it so much in the future,’ well that’s another thing. But you can’t say, ‘I’m not paying my past debts.’”

The White House in December ruled out invoking the 14th Amendment to solve the debt-ceiling crisis, saying such an approach was off the table.

“This administration does not believe that the 14th Amendment gives the president the power to ignore the debt ceiling — period,” White House press secretary Jay Carney said.

Um, incurring these massive debts? Of Bush, not Obammy? The X-leader of the house saying the president should just go around Congress. The country is going to suffer for more than a decade from these RICH radical progressives and their leftist ideology and total disregard for the country. Thanks again to Califreekonia for keeping this thing in power. Couldn’t just destroy your home state of California but just had to unleash the insanity on the rest of the country.

      I implore all Americans to petition Barry to give the State known as “California” to the Mexican Government as a sign of goodwill. Barry ad his band of 40 thieves should do this to make amends for the “Fast and Furious” and vow to never arm Mexican Drug Cartels again.

      I also, implore all Californians to cut off all financial support for: Armed Security, Travel, and Lodging for Pelosi.

      SECTION 1.

      All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside.       The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned. But neither the United States nor any state shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.

      SECTION 5.

      The Congress shall have power to enforce, by appropriate legislation, the provisions of this article.

      Thanks RJ. The relevant part of course is the statement that, “The validity of the public debt of the United States, …, shall not be questioned.” That’s plenty clear don’t you think?

      The Republican strategy is straightforward. The are saying that if they don’t get what they want, and can’t achieve through the normal legislative process, they are going to force the United States to default on it’s debt. That of course would have a terrible effect on the US, every citizen in this country, and probably the world economy. In other words, they’re saying “do what I want or everybody gets it.” That’s known as blackmail.

      The operative part that makes the entre ammendment workable is section 5, “The CONGRESS shall have power to enforce…”

      Congress (both houses) have the power to enforce this, NOT the president. It’s a mistake to take bits and pieces to create something that was never intended.

      We must also remember these ammendments (13, 14, 15) were created at the end of the Civil War. The 14th was meant to punish the South and its Northern supporters, not to surrepticiously use to promote a financial crisis and a debilitating agenda.

      @Enicom – The U.S. didn’t acquire Texas from Mexico. We fought and gained our freedom from an oppressive Mexican government. Then we signed on to join the U.S. A lot of us are questioning that decision now, but get your facts straight: Texas was a sovereign nation, not a territory of the sandbar to the south.

      I don’t know why Nancy doesn’t give the 14th ammendment the finger and raise it to $ 24 Trillion and that will get us covered for the next 5 years.As we go to a barter system, the next president if he is smart will clear the deck. The USA is the biggest landowner in the country. The IRS takes farms all the time because the kids can’t pay taxes when parents die. I read that Uncle owns 90% of Utah. We should be able to swap that to China for what we owe. They can have their own country right in the middle of the country. I bet some country would pay a Trillion for The Grand Canyon. We should just sell all the National Parks for 100% gold bullion. China would probably also buy Death Valley.

      @Turkey13, I enjoy the BLM land, the National parks in Utah, and all of the national parks throughout the United States. Exchanging this national treasures to China or anyone we owe money to as a credit against our debt is not an option. Even giving California to Mexico is not an option. This kind of thinking is too extreme, unrealistic, and Anti-American. Maybe you don’t care about our national parks but millions of Americans like me do care!!!

IF you were a business owner and your employees decided to work less than half a year for full pay and did not perform the most basic function of their job would you continue to employ them?

      So your point is that no one should question the Democrats. You appear to accept that debt is acceptable and spending is just a formality. From your comments it is okay for our Government to continue spending as if there are no controls. Just keep spending and if it gets too high then find a tax that will correct the problem.       Did you over look that fact that Barney Frank and Sen. Dodd ignored the warnings of the Bush Administration about the perils of Fanny Mae. Would you even consider the fact that after dire warnings that the Dem. Party which had control of both houses for the last 2 years of the Bush Administration kept pushing on that there was no problem and then the housing market crashed and then the banking industry crashed.

      I say to you that the liberals are the reason it failed. What say you?

      “The validity of the public debt of the United States, AUTHORIZED BY LAW,…..shall not be questioned”
      The debt must be authorized by law and that law must be passed by the legislative branch before the President can give a thumbs-up or thumbs-down – that is his only role in law-making.
      Criticizing that the entire amendment was posted is typical misdirection of the left, when they have no good argument.

      JustMe asks, “I prefer you explain to me why you think it is acceptable that we have the debt that we have?” Why don’t you ask Dick Cheney, who once said, “Reagan proved that deficits don’t matter.” Reagan was mostly okay with a large and increasing deficit (although he did raise taxes a number of times to try to address that issue). Bush certainly was okay with big deficit increases. Why don’t you ask those guys?

      I think Obama said it best, “Unfortunately, Congress consistently brings the government to the edge of default before facing its responsibility. This brinkmanship threatens the holders of government bonds and those who rely on Social Security and veterans benefits. Interest markets would skyrocket. Instability would occur in financial markets and the federal deficit would soar.”

      Oh wait, Reagan said that. The debt limit under Reagan was raised, as you know 18 times, and eight times under Bush.

      Economy was crashed not because of 2 wars (theatres of war really) or the tax cuts. It was crashed by the housing bubble.

      Of course Al Qaeda training 20,000 people in Afghanistan does not concern some dolts. I mean what could they do? Take over Pakistan LULZ?

      Reagan entered into a deal with Tip O’Neil. Like a good (read lying) Democrat, Tip never cut any spending. Thus Reagan was forced to raise taxes.

      Republicans should stare him down on this, then, challenge him to actually raise the debt ceiling by executive order and see how Americans feel about it. Last time this debt ceiling fiasco played out, a big percentage of the country was against raising it. Leave it to the Republicans to snatch defeat from the jaws of victory. They capitulated as they usually do. What they need is some courage to refuse to raise the debt ceiling and cut spending down to a balanced budget, force Barry to make cuts. It’s the responsible thing to do. And for Barry to say that he won’t compromise on paying our bills, you’re not paying your bills when you use your Visa to pay your Master Card. Any thinking human being knows that you don’t go further into debt to pay your bills.

      They all disgust me. Obama, Pelosi, Boehner, McConnell, et al. None of them give a damn about the country, only their hold on political power.

      They are ecstatic and you have nothing to say about it, so stop your whining. The main problem isnt the debt ceiling or the economy or immigration or Iran or Russia or too much guns. The main problem is invisible, the main problem is not much talked about and when it is it is just mentioned as an impedament and not the cancer to this nation that it is. This past November without a real hint of resistance an army marched into your country and took it over. It was against the will of the people but they did it with a slight of hand. OUR COUNTRY WAS STOLEN FROM US!!! They stole your vote and made it theirs. We have no rights anymore, we just don’t know it yet. Until you address this 800 pound gorilla in the room 2014 will see the last vestages of our republic swept away. And what is being said about this? crickets chirping… nothing. Your country has been invaded and conquered and all we do is watch sports and dumb tv shows. No wonder why they want to take our guns away fast, they are aftaid that americans will wake up. Never gonna happen. We will probably dissarm first. So get used to Nancy Palosi verbaly defacating on all of us, there will be plenty more of it in Obamas third and forth term.

      We all know that they are far from being the smart ones, and we all know that the longer things stay the was that they are, the more we lose.

      So let them do as they plase, and we can impeach the lot of them, and inpose some term limits on them to make them see the error of their ways.

    Pelosi is an Idiot!! The 14th Amendment Section 4; says “The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned.” but what Pelosi and other idiots don’t understand about the 14th Amendment Section 4. It doesn’t say that WE HAVE TO TAX MORE AND RAISE THE DEBT LIMIT TO PAY OUR DEBT, we can CUT SPENDING AND DELETE UNCONSTITUTIONAL PROGRAMS TO PAY OUR DEBT RATHER THAN RAISE DEBT LIMITS!! Plus Article I, Section 8; “The Congress shall have Power To borrow Money on the credit of the United States.” So there isn’t any Power given to the President to raise the Debt Limit on his own!!

      UH60L13: You are correct, madam or sir. Geezie Pelosi is puffing some strange ‘shrooms to think the 14th Amendment allows the One to raise the debt limit unilaterally. Indeed, the whole idea of incurring debt beyond the limit could well be construed as a “high crime and misdemeanor” worthy of impeachment. The ‘crats know this, because they have been angling to remove the limit altogether or give the President the authority to exceed it as is seen fit. This must not be allowed to happen!

      REad the 14th Amendment in its entirety. It was passed to deal with the Civil War debt incurred by the Southern States and being refused by the Northern States after the War Between the States. And those from those Northern States refusing to want to pay those debts to countries and companies not on our shores. It had nothing to do with a debt ceiling or ability to pay. We can pay our bills but it will mean doing what we have told others to do through the IMF, reduce/cut borrowing!

    I don’t see how the 14th allows him to spend willy nilly. The House could simply refuse to alot funds for his pet projects and shut him down. I also say it is arguable that the “progressive” tax system is in violation of the equal protection clause. If he wants a Constitutional fight, let’s give it to him.

    First of all Nancy Pelosi has just demonstrated how unamerican she is, telling the President to use a wrongful interpretation of the 14th Amendment to usurp more authority that is not his.

    I expect Obama will do this anyhow, as the groundwork was prepared in the last debt-ceiling battle around the 14th amendment. Now that Pelosi and the other Communists are beginning to say so, they seek to make it reality and thus sunder the Constitution once and for all.

    We have hit the final crossroad where we will either see the pushing back against the madness of Obama, or the rise of our first national dictator.

      If obama invokes the 14th Amendment illicitly, he will own the debt downgrade, the debt, the deficit & everything else.

      WW2 was the best thing that ever happened to FDR. At that time Japan & Germany really could not harm us all that much.

      We get into war now, civilians will feel the heat & sometimes the lack of heat from no energy supplies.

      Show me where,IN THE CONSTITUTION, outside of ten square miles, military bases, federal buildings, federal enclaves,.. the UNITED STATES has the authority to enforce/force any of this bs??

      When you can make trades like turning in $44 a share into $64 a share in 2 days with 5,000 shares, you believe you can run the United States. That is $100,000 before taxes & $85,000 after capital gains taxes are taken out.

      A higher capital gains tax, say 20%, does not hurt an inside trader. They just make more or larger “sure thing” insider trades.

      If insider trading gets too hot because the hoi poloi are up in arms, then the avaricious, greedy, grasping political princess Pelosi merely speaks before a union or other body & collects $100,000 to $200,000 in speaking fees.
