Ted Cruz Comes Out Guns Blazing on ‘Unconstitutional’ Gun Control Proposals

Newly minted Texas Senator Ted Cruz has barely been in office for a weekend, and has already displayed his characteristic capacity for rhetorical sharpness combined with constitutionalism. Appearing on Fox News Sunday today, Senator Cruz was asked about gun control proposals being offered in the wake of the Newtown, Connecticut shooting, and whether he could support any of them. Cruz’s reply, while empathetic to the victims, was quite firm.

“The reason we’re discussing this is because of the tragedy in Newtown. And every parent – my wife and I, we’ve got two little girls, age 4 and age 2 – every parent was horrified by what happened there. To see twenty children, six adults senselessly murdered, it takes your breath away,” Cruz began, before pivoting to the political question.

“But within minutes,” Cruz continued, “we saw politicians run out and try to exploit this tragedy, try to push their political agenda of gun control. I do not support their gun control agenda for two reasons: Number one, it’s unconstitutional.”

When the host pressed Cruz on whether there was anything he could support, Cruz said he supported using measures to update the Federal database of who was ineligible to own a firearm. However, he took special aim at a proposal by Senator Dianne Feinstein (D-CA) to create a national registry of who owns guns, saying the Federal government had no business keeping a list of who chooses to exercise their Second Amendment rights.

Cruz’s constitutional critique is a fairly common talking point among Republican legislators. However, coming from Cruz, it may carry additional weight, as the former Texas Solicitor General has won multiple cases arguing before the Supreme Court itself, and clerked for former Chief Justice William Rehnquist.

    Senator Cruz I do so thoroughly enjoy hearing you speak about gun control issues as if you have a say in the matter. I know you’re new to this so I’ll explain,I am your ruler and I’ll be in control for the duration and the senate and the house are simply window dressing. I will let you know what is law and what isn’t,capice? I have rendered congress irrelevant with my various EO’s and regulations. My loyal subjects just can’t get enough of me and kept me in power so thanks for your input it’s so quaint.

      I do not agree with “mental illness” as a means to regulate the ownership of guns. First off, define “mental illness” because recently the definition of ADD, ADHD and autism has been dramatically redefined. It is the reasoning for these “1 and every 100 people have autism” commercials.

      Using mental illness as a guise to regulate guns is still regulating our 2nd amendment right.

      I believe the prohibition of guns will come through hard economic times with a “food for guns” buyback program and through the “mental illness” status and/or approach.

      Take notice that every MSM outlet had a big story last night about a shooting and hostage situation in Colorado.

      This morning, every one (including Fox) had dropped it. Why did they drop it?

      When they discovered the shooter was a Hispanic gang member with a back ground of drug dealing, the dropped it like a hot rock./

      It does not fit their agenda.

      the media no longer does journalism. It looks for stories that fit their agenda, and only show those stories,

      the Sandy Hook shooting happened weeks ago. What new info did journalists dig up since the shooting,.

      What video games did he play?

      What medications was he on?

      It was reported that he was found with two pistols, and had an AR in his back seat. Coroner claimed all vittimes were shot with a rifle. Which is it

      What relationship did he have with his dad?

      Media in the first two days declared he was “Goth” no more on that one?

      Journalism is dead, and Fox news is a facade to make you think there is a conservative news source. they are a joke also.

      Not one media source (blaze included) has mentioned Kevin Jennings so much as once. Jennings was Obama’s pick for SAFE SCHOOL CZAR!!!! Did he do anything to keep our schools safe? his only claim to fame was teaching homosexuality to school age children.

      Libertarian…I understand what you are saying and I agree with it up to a point. Where the law needs to change is not in relationship to guns but in relationship to what happens to someone who is truely off of their rocker. The last three multiple murderers were clearly mentally deranged with provable track records. These people should have been locked up and they would have been locked 40 years ago before the bleeding heart liberals insisted that they should all be turned loose. The other thing that needs to change is Hollywood. Beck nailed it the other day when he was talking about the fact that these mass murders didn’t really start at the level they are now until the late 70′s and the only difference is violent movies and other media. Screw Hollywood. I am not willing to sacrafice my rights because some idiots want to make money off of a movie.

      It is very clear that the founders envisioned armed insurrection of an oppressive government as the reason for the second amendment. “Every generation needs a new revolution.” Thomas Jefferson. During the revolution many civilians owned superior firearms to the issued musket. General Daniel Morgan led such a group. The founders could not conceive hunting to be the reason for owning arms, there were no hunting laws until late in the 19th century. Clearly the 2nd was intended as a foil to an oppressive government. Any cursory study would clearly demonstrate that. We need to clearly make THAT argument. Do we need better background checks? Yes, but privacy clauses protect the whack jobs who will kill us. Tim McVeigh did not use a firearm. Mohammed Atta did not use a firearm. 500 people were murdered in Chicago in 2012, how many of the murderers used legal registered firearms.
      Report: 1.8M dead registered to vote. This from Politico. If we have about 2 million dead people still registered to vote how can we know that the form for purchasing a firearm is filled out accurately? If we know our government helped buy guns for known felons in the Mexican drug cartels, why shouldn’t we be at least as well armed? I am sick of the BS from the liberals.

      Yes, every time a mass murderer with a semi-automatic with a 100 round magazine kills lots of people, or students or children, some people suddenly jump up and try to politicize those brutal, bloody, brain spattered deaths and say something should be done to prevent those acts in the future. And if there were a week to go by when a mass murder didn’t take place, those freaks would STILL try to politicize mass murder in order to promote their view of absolute despotism in the US for “Utopian” purposes.

      Ever notice how when hundreds or thousands of people get sick or die from e.coli in beef or vegetables that the weirdos come out and try to “politicize” that? E. coli doesn’t kill people, people who eat contaminated vegetables or meat are killing people. Are you telling me that more regulation is going to prevent people from being killed from a naturally occurring pathogen? And that business owners who sell those pathogenic products are somehow responsible for a bacteria that God created?

      Look. You’re more likely to get killed by a car than by a gun. So what are we supposed to do, make every owner of a car register that car with the Federal Government? Is that what the libs want? Clearly that’s a violation of my rights under the Constitution. If the government wants to take my car, they’ll have to pry my cold, dead hands off of the steering wheel.       Notice that you like to harp and harp on “mass murders”. Also notice that there are less mass murders now than ten years ago. Notice that they make up a minute fraction of the nation’s murders.

      Notice also that blacks make up 12% of the population, but do half of the nation’s murders, and not so much as a peep from you or libs on the matter.

      If we drop black murder rates to the same as whites, then the national murder per capita rate will drop by almost 40%, and save a whole lot of black lives.

      Notice also that for every murder with a rifle (every type, .22 single shot squirrel rifles included), there are 18 murders with a handgun, but it is the rifle that liberal politicians are clamoring about.

      Notice also that more people in America were killed wtih knives last year than with a gun

      Jared Loughner had a skull altar in his backyard & it was taken down pretty fast, because the left does not want to rightly get blamed for creating him.

      These Rights shall NOT be Infringed! It doesn’t lay out who or what kind of Arms!

      The Way I see it, Yes we really do need to do some thing about our Mentally Ill people out there! But that’s a separate subject.

      The constitution is not the “supreme” law of the land, it is a short list of laws governing what is the responsibility of the general government, and a a list of things that this general government cannot do. Then along comes the 10 amendment and defines who or what really has the power in this country.

      Gun control, free speech, free press, free religon, etc, etc, are not in the general governments authority to regulate at all. Now any state is free to regulate whatever it wishes unless it violates that states constitution.

    The visible acts surrounding the obvious attempts to strengthen the gun control laws beyond constitutional limits are bad enough, but what is truly alarming is what is happening on the periphery.

    The ATF has recently purchased another 200,000 rounds of ammunition. This brings their total holding to about 1.6 Billion rounds. Billion.

    How long would a machine gun with a cyclic rate of 5 rounds per second take to use all that ammunition up if it began firing now and continued until this supply was exhausted?

    Well, if my mathematics is correct, a little over six hundred years. It would stop in the year 2622.

    Maths is not my strength, so can Monk or someone check that. I have re-calculated several times but I might be wrong.

    Why am I bringing this up?

    Well, it seems that at the same time as these gun restrictions are being promulgated, plans are being laid to use the DHS, ATF, and other agencies to confiscate the weapons of law-abiding Americans, and that way lies tyranny. “Preppers” are the first in line and then everybody else, and the policy is “shoot to kill”.

      5 rps = 300 rpm = 18,000 rph = 432,000 rpd = 157,788,000 rpy / 1.6 E9 r = 10.14 years.
      r = rounds, p = per, s = seconds, m = minutes, h = hours, d = days, y = years, given a year = 365.25 days. Oh yeah, / = divided by.

      The DHS is only one agencies that is buying large amounts of ammunition. Huge amounts.

      Why are “preppers”, who also stockpile food and ammunition, being specifically targetted? Well. it is felt, apparently, that they will be “the worst part” on any potential unrest.

      What “potential unrest” is the administration expecting? And why?

      While some of his statements match those that I have read on other sites, it’s a little difficult to decide how much credibility to attach to this. I can’t find a reference to Lt McCoy in North Carolina anywhere, and while the USA has been divided up into ten regions with a governor heading each one (Council of Governors), I can’t connect that to any of this.

      Possibly someone else can. Anyway there it is…

      How does Obama control guns? By controlling the ammo manufacturers. The ammo manufacturers are busy fulfilling the government contracts. They aren’t producing much if any ammo for civilian use. notice there isn’t much ammo on the shelves now and how the price of ammo has jumped up? Obama is buying up all the ammo so civilians won’t have any. That’s the bottom line and that’s also what most people aren’t seeing or paying any attention to. Guns don’t work too good w/o any ammo.

      For the sake of argument, go with a cyclic rate of 600rds per minute. Gives you 10 rounds per second.

      Most weapons smaller than M2 .50cal will easily be able to hit that rate of fire. I am, of course, assuming these weapons are capable of automatic fire (which most aren’t). i.e. pistols, M4′s, etc.

      No, actually they are really lax with it. The AT-F Troop can be and have proven themselves to be a bunch of lazy goof offs in the past when it comes to maintaining records. You should put your eyes on the mess they actually are. I’ve dealt with them a couple of times on a professional basis, and they scare me sh/tless sometimes.

      SOY, On that I agree. What concerns me is that they are lax when it comes to keeping up with records on the Class III license they issue, and have actually charged citizens with illegal gun ownership when it was they who lost their own records of issued license. And yes, the citizens presented their paperwork and were still arrested. Happened quite a bit under the Clinton Admin. Not saying Clinton had anything to do with it. They also let slip the names and full identities of those who are found guilty of crimes and are supposed to lose their 2nd Amendment rights, as well as lax on the listings of the mentally unstable who are actually reported. Think about it, some crazies have shot up their chosen venues over recent years.

    Good for him. I am glad someone in Washington has a backbone; but time will tell. Others we thought we could trust, folded like lawn chairs or buckled like a belt.

    We also need to have some kind of policy regarding these pychotropic drugs that doctors are feeding these kids.

    We still have not found out what, if any drugs these people who supposedly did these crimes were taking, even though they are dead. I would bet dollars to donuts, if they were high on coke, meth, or alcohol, it would have come out within 24 hours of the incident.

    And for that matter, I am still not convinced that this Sandy Hook incident that we have heard is the whole truth. Not sure what is and is not true, but if this is a false flag or Reichstag(sic) fire moment, we need to know and act accordingly.

    I have high hopes for Ted Cruz. I would like to comment that it is not enough to just say a law is unconstitutional. I think conservative/libertarian lawmakers should understand and clearly articulate the negative effect of these gun control proposals on the liberties of the people, which is what the Founders did in order to put the 2nd Amendment in the Constitution in the first place.
