Many Americans were shocked to learn about Georgetown University Professor Louis Michael Seidman’s advocation for the U.S. to abandon the Constitution — the central document that has helped spawn America’s growth and progression for hundreds of years. As previously reported, the constitutional expert recently noted his belief (via an op-ed) that a blind allegiance to the outdated document is perilous. On Friday, he defended his controversial views about some purportedly “evil” provisions in the Constitution in an interview with Fox News’ Megyn Kelly.

Similar to his statements in his New York Times piece, Seidman argued that it is misguided to follow the advice of men who lived centuries ago.
“This is our country. We live in it. We have the right to have the kind of country that we want,” he told Kelly. “I’m not very happy with having a bunch of folks who have been dead for over 200 years…telling us what kind of country we have.”
While he admitted that the Founding Fathers were right about many sentiments, he also doubled-down on the fact that the Constitution includes some elements that he has described as “evil.” Kelly countered his argument, challenging that the amendment process was foreseen by the Founders and that changes to the document are more-than possible. Thus, she asked why abandoning it is a necessity.
Seidman responded by explaining how difficult making amendments can be, calling out the process as one of the biggest problems with the U.S. Constitution.
“Of all the constitutions in the world, the American Constitution is the most difficult to amend,” he proclaimed. “It’s only been amended 27 times — only 17 times if you don’t count the Bill of Rights.”
Kelly had a difficult time imagining an America without a Constitution and repeatedly asked the professor to explain what would replace the core document as “the rule of law.” Rather than getting into specifics, Seidman noted that many elements should be kept in place. The protection of civil liberties and the Second Amendment were two sentiments that he mentioned.
While he called the Constitution “beautiful” and the preamble “poetic,” he was unbending on his belief that allegiance to it is no longer warranted and that it has created an ineffective system.
Watch these comments here:
Also on Friday, Fox News Senior Judicial Analyst Andrew Napolitano appeared on “Fox & Friends,” where he took aim at Seidman’s constitutional assessment, dismissing the professor’s take on the historical document. Of particular note, without it, Napolitano warned that the U.S. government would have too much power.
“Think of it this way – the purpose of the Constitution is to govern the government, to restrain it, to make sure Congress writes the laws, the president enforces the laws, the courts interpret the laws,” he said, claiming that the “brilliant” document ensures that power isn’t concentrated too heavily in any one place.
“The Constitution is the supreme law of the land. If you want to amend it, amend it, but you can’t overlook it,” he added.

Jan. 7, 2013 at 11:03amThey want to be rid of it because it constrains the government from taking away our liberties “for the common good”. Our government is dysfunctional because of closed door meetings between the Pres., the Speaker, and the Senate leader. That isn’t how its supposed to work. All should be debated on the floor. I the president doesn’t like a bill, he can reject it. Period. That would tend to end the practice of moving the goal posts and claiming the other side is obstructing. I’m really tired of that. Do it the way it was meant to be done.

Jan. 7, 2013 at 11:10amThe fact that men like this have been “educating” law students about the Constitution explains a lot. Our government doesn’t run smoothly because that is precisely the way our founding fathers set it up. The reason there are so many checks and balances in our Republic is to make the government as inefficient as possible when it comes to dismantling rights.

Jan. 7, 2013 at 12:41pmI agree. I am particularly perturbed about the quote, “it is misguided to follow the advice that men gave centuries ago.” Advice? This is not advice you moron. It is law. Law of the land. I cannot tell you how often I think, “American Academia is just getting stupider.” I think of the “men” who wrote things long ago and they were hands down smarter and more thoughtful and more intelligent. Is it just me or is America just getting full of more stupid academics or what? Ackk!

Jan. 7, 2013 at 12:44pmThis exactly why we are in the mess we are in. People like this who profess to know more that anybody else. Right along with the haaaavaaad law people who profess the same thing. All this claptrap marxist PC crap that is mashed into the heads of Students give us the Occupyer’s and this President who believes that we need to defy and is defying the Constitution. Actually spreading it in the name of FAIRNESS. Nobody said that life was easy and most of all that you deserved the fruits of other peoples labor.
Fairness is another popular word dreamed up by the PC left. Political correctness is Cultural Marxism another way to control free speech. While a Black man can call me a MF or whit tie I on the other hand if I even intimate the N work I am a raceist, Honky, MF or a lot more. Some how the country needs to figure out that the Emperor is wearing no clothes. You are quite right. THIS is the sort of crap that is taught in colleges all over the country–NOT just law schools, either The colleges have become little more than left-wing re-education/brainwashing centers. It is no wonder the colleges are turning out legions of compliant SHEEP who will blindly follow our Dear Leader right to the slaughterhouse, if necessary. And it’s looking as though it may come to that.
With the open hostility toward, and attacks upon Conservatives, it appears we are now the group to be “ghetto-ized” by our New Nazi regime. That lying dirtbag in the White House has taken so MANY pages out of Hitler’s playbook that it’s scary. The clouds are gathering, and the Storm Troopers are massing for the assault, and the sheep in this country don’t even see it. They cheer him on, parrot his catch phrases, slurs, and attacks on loyal Americans, and if tomorrow he tells them to break windows and vandalize the homes and businesses of those who don’t support him, I expect they will blindly march to do his bidding, the same way the Brown Shirts did for Hitler

Jan. 7, 2013 at 1:17pmHow about this. How about we “require” that ALL GOVERNMENT fallow the Constitution. To fix the “problem” and quit treating the symptom all we need to do is LOOK to the US Constitution itself. We will never put this ship unless we take control and we will never gain control until we move to “repeal” the 16th & 17th amendments. This out of control Tax & Spend has NO barrier by the P&D or D&P party.
Most all “Representatives” breath life into “out of control Tax & Spend” as a solution. If you have a disease, treating the symptoms will “never” lead to a cure; the cause of the “disease” must be located and then removed.
The cause of the disease “out of control Tax & Spend” is in the ability we gave Congress to lay there “out of control Tax & Spend” on “We the People” with out a check to the balance. What was the balance that keep Congress in check ? The other CONSTITUENCY, our own State Legislators.
You see I can walk over to my State Legislator’s office or HOME and let my views be know with some results. However, I can’t even find either of our Congressional Senators let alone voice my views because I can’t write a $100,000.oo check. Make sense?
And of course super ” intelligence” such as ” Georgetown University Professor Louis Michael Seidman’s” is far to complicated to just read and understand the simple language of the US Constitution. Just my 2 “sense” worth ! ! !

I was artillery, and with an MLRS launcher having a target area the size of 6 football fields PER ROCKET, we gave new meaning to the phrase “Close enough”. Then again with a 16 inch naval gun having a blast radius of about 1000 meters, the Naval battleships were turning mountains into molehills for decades, at least as long as the twits in DC didn’t tie their hands with idiotic rules of engagement. Nothing says “You’re toast” like a forward observer saying ” Missouri in effect.” That means you’re about to be on the receiving end of an incoming round that weighs as much as a Volkswagon Beetle and is going to truly ruin your day for those who haven’t served around the big guns. The old 8 inch howitzers had a 200 meter blast radius and could hit a dumpster at 8 miles. By the time the first round has landed, the second is in route. Long distance is so much better than being there.

Jan. 7, 2013 at 12:48pmWas it your hero, Soetoro, who commented that his bowling prowess was “like Special Olympics, or something” and that the ‘shovel-ready jobs’ he was touting were “not as shovel-ready as we thought”?

Jan. 7, 2013 at 1:07pmWho? Soetoro? Is that another zany character that only Beck and the Beckbots care about? You clowns know more about those characters (including alinsky, ayers, farrakhan) than any of the “libs” you assume worship them. Get a grip, you’re living in an alternate reality. Like shooting fish in a barrel.

he keeps using that ” propaganda” phrase ” dead people” That’s like ” old white people”
Truth is eternal..
” The government can do what it wants as long as it’s noble” hah yeah who gets to decide that, the government? good ole Wilson…

Jan. 7, 2013 at 12:04pmWell said.
The fact that the framers of the Constitution are dead is MEANINGLESS. The fact that this guy would suggest it had profound meaning calls his judgement in to question.
Thank God we have the Constitution to limit the government. Without it, we wouldn’t have an Internet. By the way, liberals are also saying they must destroy the Internet. It’s too dangerous to allow people to speak freely.
They also hate anonymity because they silence dissenters by intimidation and assault, and they can’t harm anonymous persons. Don’t be surprised to hear of legislation to destoy the Internet and to make anonymity a crime.

Jan. 7, 2013 at 10:45amThe time that has passed since the Constitution was constructed is very small when compared to recorded human history. Our founders were more aware of that history than we are today and they knew what was going to happen based on history repeating itself. It’s obvious by so many wanting to skirt or abandon the Constitution that this is true. Our founders were brilliant and much wiser than we, to abandon the Constitution is a definite death sentence for our country.

Jan. 7, 2013 at 11:50am…and yet, people like this guy are rooting for it…
There was a day when the Progs would simply read things into the Constitution that weren’t in there. Now that this tactic is long-since outed as a Constitutional end around, they’re saying we should pay any attention it it anymore.
My answer: “Oh- you mean like what Dems did when they took every big Government step taken since FDR?”
This Republic is dead when Congress takes a whole three minutes to read a bill hundreds of pages long that’s intended to avert financial calamity, that the President cares just enough about to have a robot sign for him.

Jan. 7, 2013 at 11:04amWe have an aristocracy now. Princess Pelosi is an aristocrat. Her daddy was mayor of Baltimore. She married a rich man. Between his business & her political connections they do very well. Some Democrats with 2 or 3 decades in politics pack it in when the Republicans win. Not Pelosi. She still has enough power to keep the dough rolling into her family coffers. Without being a ranking member of Congress he family fortune would falter & further shenanigans done without the auspices of power would get her imprisoned..
Japan still has an aristocracy. It is hidden in the background, but they still have it. You got to wonder why they have 2 lost decades & counting. Is it more than incompetent politicians? Without retrograde immigration of overseas Japanese they would have a population implosion well underway. What a way to run a country into the ground.
Aristocratic Families
Bush’s, Obamas, Clintons, Pelosi, Feinstein, Kennedys, Daleys,

Jan. 7, 2013 at 11:06amThe correct term might be “oligarchy” — rule by a few. Like most Statist governments with a strong central government ruling by fiat — like 1939 Germany, 1920 Russia, 1948 China, or even 1776 England — there would be a core of elites which seek to run everything. Wait, sort of like the Democrats now!

Jan. 7, 2013 at 10:36amHow about we split the country? The states that wish to continue to embrace the constitution can continue as the United States of America. Those states that wish to go their own “enlightened” way can call themselves the Peoples Liberated Democracy or somthing.
In 10 years, if not sooner, the United States of America will be back on even footing, with a currency based on reality (Heavy Metals, and other enduring commodities). We will once again be the wonder of the world, and will likely be planning grand adventures like permanent colonization of the moon, perhaps Mars. Mining Asteroids, and setting up a true space based infrastructure.
In 10 years the People’s Liberated Democracy will be a failed nation, 3rd world at best, and likely managed by some international entity like the UN.

Jan. 8, 2013 at 12:23amJust imagine how badly we’d have to guard the borders then. Of course we could easily stem the tide of border jumping liberals by eliminating welfare and/or denying welfare recipients the ability to vote. That should keep the Dems on the other side of the border. Of course we’d have the best healthcare in the world for the lowest cost too. All of the doctors would come here, and severely restricting malpractice suits would cause the lawyers to go to libby land. A win on both accounts.

Jan. 7, 2013 at 10:47amChange that part about how a president can only serve two terms. That’s outrageous! See where this will go? Guys like this want it their way and conservatives are just too bound up in the constitution to see clearly. He may say initially the 2nd amendment can stay, but once you change it just a little, the flood gates open up. Give em’ an inch… Oh wait a minute we’ve already given them an inch. Is it too late? He fears the ratification process because the “flyover states” won’t sign on. The heart of america knows better.

McCarthy Vindicated At Last 12/18/2007
“…These intercepted cables proved that there were over 350 Americans spying for the Soviets, and enabled investigators to identify about half of them. Joe McCarthy had access to the information contained in the top secret Venona intercepts, access given him by J. Edgar Hoover and others concerned with the extent of Soviet espionage and penetration, but he could not defend himself against charges of recklessly accusing people of being Soviet agents by revealing the source of his information without alerting the Soviets that some of their most important secrets were known to U.S. Intelligence…”
