‘Wilkow!’: Small Business Owner Takes on the Department of the Interior
Department of Interior Secretary Ken Salazar is in a legal battle with small business owner Kevin Lunny. Lunny’s family has run Drake’s Bay Oyster Company for 40 years, and is now suing Salazar and his agency after it ended the oyster farm’s lease from Pont Reyes National Seashore, determining that the farm land will become a federally designated wilderness area.
Lunny says his farm employs 31 people and harvests a third of the oysters imported from the state of California. With oysters no longer imported from this area, Lunny predicts customers will look to China. With many businesses near the farm being allowed to keep their leases, conservatives are crying foul about a situation where government seems to be picking winners and losers.
Lunny joined ‘Wilkow!’ Wednesday to discuss his small business’s fight against big government, and what the closing of his farm will mean to the economy of the entire Bay Area.

Posted on January 10, 2013 at 10:58amEminent domain states that property seized must be for “public use” such as highways, water purification plants, jails… Re-labeling the land wilderness and leaving him official title (though not use) seems to cross a line. The fact that the land was leased, not owned, will count against him in court. I wish him well, but legally I’m not sure he has much ground to stand on. The fact that his business seems to be singled out for destruction is troubling. I do not think that the article provides enough information to make an informed judgement.
Yes, I thought of agenda 21 as well. Pick your battles, because you will be picking your precedents. A weak case that fails will strengthen their position.
That said, FIGHT well.
