There’s a Slight Problem With NY’s Hastily-Made New Gun Laws: They Forgot to Exempt Cops!

New York Passes Gun Laws That Fail to Exclude Law Enforcement Officials

In their rush to push through tough new gun control laws, the New York State Legislature made a huge mistake: They failed to exempt police officers from the regulations regarding “high-capacity magazines.”

This means that when the new laws take effect in March, it will be illegal for any law enforcement official to carry a magazine that holds more than seven rounds. For point of reference, almost every law enforcement agency in the state uses handguns that carry 15 rounds.

“We are still working out some details of the law and the exemption will be included, currently no police officer is in violation,” a spokesman for New York Gov. Andrew Cuomo’s office told ABC 7 Eyewitness News:

“The PBA [Patrolman's Benevolent Association] is actively working to enact changes to this law that will provide the appropriate exemptions from the law for active and retired law enforcement officers,” the group’s president said in a statement.

Sen. Eric Adams told ABC 7 Eyewitness News he’s going to introduce an amendment to exempt law enforcement from the new regulations.

“You can’t give more ammo to the criminals,” he said.

Final Thought: So basically New York lawmakers are telling us they had to pass it to see what was in it?

    This is just more stupid laws. They take away our right to be able to protect yourself but give more ammo or support to law enforcement who aren’t obligated to protect or help anyone. I am so happy I moved back to Texas. We need to take our weapons and force these government officials out and replace them. I for one is ready when anyone else is for this. Either they leave peacefully or we can make them. There choice.

      They didn’t just forget law enforcement. They also forgot the SECOND AMENDMENT!

      Ok, How about law abiding citizens? You know the criminals don’t care about obeying the new laws let alone the old laws you already had in place. What’s to keep the law abiding citizens from getting hurt or killed while waiting on the cop who has a couple more bullets and are only 10 minutes away?

      Did they include the National Guard. Their Guard is considered State, unless federalized, right? That means unless the New York National Guard is federalized, they would have to abide by State laws. They’ll have to develop 7 round mags for their M-16s, and SAWs. If this is so, consider me hilariously amused.

      Remington Firearms needs to close up shop in New York. They need to take their business to a friendly state. They HATE you. Why do business in a state that hates your presence and hates your product? Think of the tax expense they would save by moving out of New York. In the long run they would likely save a lot of expense. I am quite sure there are states that would even throw incentives to relocate your direction. For other liberty lovers… MOVE OUT OF NY, IT’S A FASCIST CESSPOOL!

      They’re looking at it as a way to created another whole society of criminals, and thus creating a means to totally take that part of societies rights to bare arms. If they make having magazines larger than 7 bullet a felony then a lawful gun owner whose never ever broken the law,pays his taxes and does the right theng can be made a felon by simply having one more bullet than allowed.
      Laws like these are why Jury nulifacation is a taboo word in COURTS. The founders knew a that from time to time unconstitution and unreasonable laws would be created Thats why juries are supposed to made up of our peers though it rarely happens usually the prosecution will stack the deck . In case like this would be they would never ever request or allow a gun owner on the jury. stack the deck and they get the first and last word,,,and they call that justice

      I work for a state government and this is par for the course. Second amendment issues aside, most politicians live in a dream world where ideas look great and they can never be bothered by something as inconvenient as reality.

      1. laws only control the behavior of people who obey them.
      criminals do not obey the laws.
      gun laws restrict law abiding citizens ONLY.

      2. To pass laws that apply only to certain people is tyranny.
      The law must be equally binding on everyone.
      That means the law restricting how pain meds can be dispensed by ER Dr.’s must apply to
      ALL Dr.’s in the state, not just the ones who service the poor.
      No free pass for congressmen on the insider trading they would hammer anyone else for.
      All rules and regulations they wish to impose on other employers must apply to how they
      treat their own staffers.
      Also, enforcement must be equal…. No one gets a free pass on gun law violations because the press likes him, or he is friends with the prosecutor, or votes for the approved ticket, or whatever.

      Another though t: The constitution was amended 2x in 4 years when the public wanted the changes. To say that it is too hard to amend it, is to admit that most people don’t want the changes you want to make, but you think we should do it anyway, & d___ what the public wants.

      They are working to exempt police officers and RETIRED officers. That is total BS. There is a name for a retired cop……..CIVILIAN. I guarantee if they don’t exempt retired cops the police organizations will be against the bill. They get on board with this crap because they believe the hype that they are more special than you, and they want to be the guy riding in to save you. You should not be armed….only them. What is the reason for the 7 round mags that would mean that a retired police officer should get an exemption?

    So law-abiding citizens who generally carry only a single firearm without spare magazines, Tasers, pepper spray, AR-15s in their trunk, or a radio to call for backup are expected to protect themselves with 7 rounds while the police face the same criminals with all that additional equipment and support. Sounds reasonable.

      But, this is totally rational, because all law abiding citizens are potential homocidal criminals.

      You do understand that is where all of this is coming from, right? It’s all about fear, all about “I don’t like guns therefore I don’t want anyone to have them but cops.” It’s complete paranoia and irrationality given the guise of reason and sanity. It doesn’t make it right, it just makes it all a Toy Matinee.

    Ever try doing a google search for “Chris Christy slams attacks on Bush’s daughters”?

    You MIGHT be surprised to learn that what pops up are all the attacks Christy has made on the GOP and other conservatives; there’s VERY little on his living up to his Republican stripes, and NEVER to the defense of Bush’s daughters. This guy is another Olympia Snowe. Or worse. Rush says he’s making a push to knock Hillary out in 2016…in what Party?!?

    NY Law Enforcement unfortunate hypocrisy, what about all of the properly trained civilians and veteran’s rights to self defense? LOE decrying the law “about criminals not obeying the law” is exactly why the law never should have been passed. As a veteran I have not seen exemptions to the Military in NY either? What about Active Duty/Guard/Reserve military bases in N.Y. state and their duty armed members Governor? What about all their evil guns, ammo, grenades in the armories and even worse F-16′s, assault vehicles, missiles, C-4 and so forth? Semi-auto’s sold to civilians are not the same no matter how scary they look to the Left. By the way, I am a retired Air Nat’l Guard member who served on Active Duty for the Air Force in the Finger Lakes area. Citizens must bring forth lawsuits and clamor their representatives to repeal, overturn the laws or throw them out of office. What happened to the Pro-Choice Left? Who is he to decide what you “need” in NYS. The need for higher capacity is for self defense and one may “need” more then 7 if more than one perpetrator is a threat. I am so glad I live in Wisconsin and I will never visit NY again nor spend my money there. Hopefully these laws will cause an exodus of free minded citizens to the Red/Purple States! Good luck subjects and Boycott NY State if you agree! Sincerely, a Saddened and Shocked Cheesehead.

    New York state will soon look like Rochester, empty and broke. The uber liberal state is taxing it’s citizens back to the stone ages. With leaders like Cuomo and the really weird Bloomberg, pushing some of the most constrictive and stupid laws in the universe, down the throats of those who pay taxes and work for a living will find they can put a lot more money in their pockets and have a much less stressful life by moving to places like Texas. I would suggest that Texas start it’s own stock exchange, governed by the Texas Rail Road commission, because of a new honesty, people would find the Texas exchange to be far superior, and leave the crooked New York Stock exchange in droves. My God that would be funny….Bye, bye New York……

      New York will be the east coast machigan within the decade couple decades.
      As far as this law goes I don’t see how they can change something they already voted on without rewriting it and revoting on it. A law isn’t a blank check it’s written and passed place the same requires on the police as they do the citizens. I mean after all the citizens face the same exact threat as the police. the same criminals the police are after are the same ones victimizing the private citizens.

    Peace officers are civilians. Carving out exceptions for them in the law further divides the peace officer from the citizenry, and fosters an “only ones” attitude – the same problem we see in Washington, albeit on a smaller scale.

    Further… the police have backup at the call of a radio, will be wearing armor, and will be *responding* to a known threat, rather than being surprised by an attacker.

    If 14 rounds in their pistol instead of 7 is necessary for them, it sure as hell is for the good citizens who’ll meet the dark alone.

    conflicting reports claim the prior exemption was not removed and so applies…
    BUT why should LEO’s have an exemption? they work in groups and away from work are no different than you or i (but for at rank and file level a greater understanding of the need to be armed)…

    if you and i cannot have more than 7 rounds legally, they should not.
    Cuomo’s entire security detail should be allowed 7 total rounds… Bloomberg’s, too… UN security details, the Secret Service if the President visits…

    Politicians are supposed to put the people ahead of themselves… if we do not need high capacity magazines and weapons with collapsing stocks, certainly they and their security details cannot need them.

    THAT is where the attack on the law should be directed… the security details exist because Cuomo and Bloomie and their ilk know that the bad guys won’t pay attention to this law… it impinges the rights of the law abiding citizen, who will become felons merely by doing the same thing they did yesterday and the day before… and before that… all without once harming another human being.

    while i have heard many claim the law is not unconstitutional it is irrational.

    And not just Cuomo should be held accountable… all the politicians who voted for it need to be put out on the street, where they can proect themselves the same as the sheeple.

    and the thinking people need to consider leaving New York… the wonder of this world is you can work anywhere….

      let me explain military is exempt while they are on federal land. but once of the land they must obey all state laws I.E transport to and from base on state land.the national guard depends if the state identities the guard as federal troops or state troops.

      Sadly, pulling the trigger on your attacker has adverse consequences… those who kill, even to defend their life or the lives of loved ones, have real issues in the aftermath.

      But I completely agree with you, better to learn to deal with that new ‘through the looking glass’ reality than that of the victim… potentially of a lethal attack.

    So… While active duty membership is less than 1% of the population, active duty members have committed almost half of the mass murders since Columbine.       The police should not be armed better than law abiding citizens. They are civil law enforcement, not military. If seven is good enough for a civilian, than it is good enough for lawmen to do his job.

    But …but… but….. it felt good to make that law. The best way to make sure the police aren’t outgunned by the crooks is to allow law abiding citizens to provide backup. Disarm the good citizens and it’s the cops against the crooks, with the crooks outnumbering the cops.

      Oh I hear that they are going to try and pass an amendment soon before the law takes effect. I hear they want to exempt LEO and RETIRED LEO from the law. As long as you are a servant of the State you get special rights that other subjects are not allowed.
