McDonald’s to Pay $700,000 to Muslim Groups Over Islamic Dietary Law Dispute

DEARBORN, Mich. (TheBlaze/AP) — McDonald’s and one of its franchise owners agreed to pay $700,000 to members of the Muslim community to settle allegations a Detroit-area restaurant falsely advertised its food as being prepared according to Islamic dietary law.

McDonald’s and Finley’s Management Co. agreed Friday to the tentative settlement, with that money to be shared by Dearborn Heights resident Ahmed Ahmed, a Detroit health clinic, the Arab American National Museum in Dearborn and lawyers.

Ahmed’s attorney, Kassem Dakhlallah, told The Associated Press on Monday that he’s “thrilled” with the preliminary deal that’s expected to be finalized March 1. McDonald’s and Finley’s Management deny any liability but say the settlement is in their best interests.

The lawsuit alleged that Ahmed bought a chicken sandwich in September 2011 at a Dearborn McDonald’s but found it wasn’t halal — meaning it didn’t meet Islamic requirements for preparing food. Islam forbids consumption of pork, and God’s name must be invoked before an animal providing meat for consumption is slaughtered.

Dakhlallah said there are only two McDonald’s in the United States that sell halal products and both are in Dearborn, which has one of the nation’s largest Arab and Muslim communities. Overall, the Detroit area is home to about 150,000 Muslims of many different ethnicities.

The locations advertise that they exclusively sell halal Chicken McNuggets and McChicken sandwiches and they have to get those products from an approved halal provider, Dakhlallah said. He said there was no evidence of problems on the production side, but he alleges that the Dearborn location on Ford Road sold non-halal products when it ran out of halal.

Dakhlallah said he was approached by Ahmed, and they conducted an investigation. A letter sent to McDonald’s Corp. and Finley’s Management by Dakhlallah’s firm said Ahmed had “confirmed from a source familiar with the inventory” that the restaurant had sold non-halal food “on many occasions.”

After they received no response to the letter, Dakhlallah said, they filed a lawsuit in Wayne County Circuit Court in November 2011 as part of a class action.

The AP left messages Monday afternoon for attorneys representing the corporation and the franchise.

In the settlement notice, Finley’s Management said it “has a carefully designed system for preparing and serving halal such that halal chicken products are labeled, stored, refrigerated, and cooked in halal-only areas.” The company added it trains its employees on preparing halal food and “requires strict adherence to the process.”

He said although Ahmed believes McDonald’s was negligent, there was no evidence that the chain set out to deceive customers.

“McDonald’s from the very beginning stepped up and took this case very seriously,” Dakhlallah said. “They made it clear they wanted to resolve this. They got ahead of the problem.”

The lawsuit covers anyone who bought the halal-advertised products from the Ford Road restaurant and another Dearborn McDonald’s with a different owner between September 2005 and last Friday. Since that would be impossible to determine, Dakhlallah said both sides agreed to provide money to community-based charities that benefit members of this group.

The other location on Michigan Avenue wasn’t a defendant or a focus of the investigation, Dakhlallah said.

He said the final hearing will ultimately determine who gets what and how much, but roughly $275,000 is expected to go to the Huda Clinic, about $150,000 to the museum, $230,000 to attorneys and $20,000 to Ahmed.

Dakhlallah said he believes it’s the first lawsuit of its kind related to McDonald’s and halal food — one that surely sparks both controversy and discussion.

In 2002, McDonald’s agreed to donate $10 million to Hindu and other groups in the U.S. to settle lawsuits that accused the chain of mislabeling french fries and hash browns as vegetarian. The vegetable oil used to prepare the items had contained traces of beef for flavoring purposes.

  No, you’re wrong here. If McDonalds advertised it as Halal, then they are responsible. False advertising is false advertising, plain and simple. I don’t like what some muslims are doing to our country any more than you do, but one must retain some integrity when pointing fingers at injustices.
  Halal beef is as important to some Muslim people as Kosher is to some Jewish peoples and as Animal-free is to vegetarian people. Fair is fair.

  They aren’t caving … they are making good on false advertising. This type of polarized outrage trying to paint a whole group of people with such a wide brush is the exact reason we are having the problems in this country that we are. You cannot blame a group of people for being outraged that they were, essentially, lied to … in fact, lied to in a way that may have caused them to ‘sin’ according to their religion. We may or may not agree with their religion, but we certainly have no right to tell them what they should and should not believe.

  I hate to say it, but McDonalds screwed up. If they didn’t have halal or kosher or whatever, then they should say it is. My wife has food allergies and you bet your **** I’d sue them if they gave her something that made her sick because it contained something they said it didn’t.

  The restaurant screwed up. False advertising is a crime.
  
  Imagine if they had advertised “peanut-free!” food, ran out of it, and sold food that was fried with peanut oil? All of a sudden people left and right are choking and having allergic reactions, potentially leading to death. If you’re a Muslim in this case, that’s what McDonald’s did you your soul. If the store did damage through false advertising and lying about their products, well, I guess this is their lesson.

  I would like to point out that Halal food needs to purchased from a muslim meat company. This is just a way to get the meat production out of the hands of the Infidels and put money into the muslim hands. Just wait… they will begin to demand that all stores offer this special meat.   I certainly have emotions on these items, and have been accused of being rather opinionated at times. However, there are very important discussions and we need to try and search for honesty. You want to go out of your way to divide your food up, like the government divides the people? Fine! I hope to see lawsuits brought up by Jews who were served food outside of kosher. I want to see lawsuits brought up by vegans who were served food cooked on the same grills as animal products. I want to see lawsuits brought up by Indians who were served beef.

McDonalds wants to be politically correct? Pay the Piper you bass terds, or get off the PC 3-wheeled wagon and get back into the business of providing A PRODUCT that people can choose to have, or NOT to have…

  Regardless, the food did not poison anybody and they have the freedom to eat elsewhere. If their God is as good or powerful as they say he is, he can certainly deliver them from food that is not poisonous or not kill his own for not obeying his food laws. Right?

  What @searcher619 stated was spot on. Whether or not they misunderstood, it is their obligation as the entity making the claim to ensure it is valid.

  Wrong. Whether or not it poisoned anyone matters not. To some people, eating food against their religion is tantamount to being poisoned. It is not for you nor I to decide what is/is not OK for someone else’s religion. It is for us, however, to responsibly advertise our products. I’m surprised PETA is not out there protesting shops these McDonalds. Getting Halal meat involves some gruesome rituals. I comprehend that you have to kill the animal either way to get the food but making a spectacle of the whole affair seems a bit barbaric.

  You know, people like you are the problem, not the solution. Many muslims have savage beliefs; I am not arguing that point. But, there are SOME that do not, and they are good people. We make a huge mistake when we try to paint all muslims with the same wide brush. You are trying to rationalize your anti-muslim hatred by pointing out the very bad of many of them. This is really no different than when American imprisoned Japanese during WWII due to the fact that SOME Japanese attacked us. Do you find it OK that we imprisoned those that were NOT a threat to us due to the actions of those that were? Is this sort of knee-jerk reactionism OK in your belief system?

  According to your logic, then they should not “punish” the rest of America by taking away or banning gun ownership because of one or two nut jobs? You can’t not pick and choose the standards you hold people to benefit your agenda. You are part of the problem, do as I say not as I do.

  You are correct; my logic states that they (meaning the government) should not ‘punish’ the rest of America by taking away or banning gun ownership of one or two nut jobs. I do not pick and choose based on my agenda … I use logic and from your statement it does appear that your logic is, well, not logical. How you stretched thinking it OK to lie to someone based upon their ethnicity with legal gun ownership is about as big of stretch as I have thus far seen here.

McDonalds and the franchise owner involved deserve the outcome of this just for trying to appease these people with their halal BS. This si the same BS as companies putting bi-lingual labeling on their products. Imigrants into this country need to assimilate to our culture, not the other way around. Oh well, I digress, America’s culture is being systematically destroyed from within anyway so carry on, appease all you want.

  Jewish people were a part of this country almost from the very beginning — surely as far back as the late 18th century. So, we shouldn’t offer Kosher food at place upon request? Catholics should be denied their fish Fridays?

  With ya. That may be a significant market in Dearborn- but they would do just fine without trying to appease devout Muslims. There are plenty of other restaurants in Dearborn that meet the hallalala requirements. I work with some very devout Jews. They travel frequently and are often in areas where truly “Kosher” foods are hard to find. They manage and never complain. I respect them greatly- I don’t have much respect for McDonalds for trying to cater to this group- they need to stick to what they know.

  Any company has the freedom to cater to specific groups or not. It is the insanity of the lawsuits when really no real harm was done. Looks more like greed on the part of those suing.
  If this lawsuit was justified, what about suing the press for lying and elected officials for breach of contract when swearing to uphold and defend the constitution, a much weightier matter

  RANEPOWEL, I am not aware of any Jews or Catholics that are complaining that McDonalds, of all places, is not Kosher or does not only offer fish on Fridays. If this is such a big f’n deal for Muslims then maybe they should open up their own damned fast food chain and call it Halal. You, and others of the diversity at any cost ilk need to learn the outcome, in the end, will not be beneficial to anybody. Europe is going to fall to a soft takeover by the influx of Muslims and, should we decide to continue down this merry path we are on, will follow shortkly afterwards. McDonald’s deserves it. Why do they try to placate these people? They would have been better off just selling their normal food and whoever doesn’t want to eat it, doesn’t.

I like how poor Ahmed get’s $20k when the lawyer gets $230k, the clinic (i.e. money funnel for al qaeda) gets $275k and the museum (aka jihadi front) gets $150k.

This is the price you pay for capitulation. You play with fire, you will get burned. These people have the morals of satan. They value death more than anything else. They will sue the white devil every chance they get. The owner deserves to be sued and to lose his or her business. I am sure the owner was desperate because this area of the country has been overrun with this disease called Islam. Ann Coulter was right, we need to kill their leaders and convert them to Christianity. Otherwise our grand children will be living under Sharia Law.

If you have never seen the way animals are killed for halal consumption you should research it. It is horrible and cruel. The followers of Islam treat animals just like they treat people praising their god all the while.

Simple answer to the mussie problem, stop selling ANY HALAL FOOD ITMES at any eatery, stop selling them at grocery stores, make the mussies cook in their own homes and open their own specific mussie eateries and grocery stores. Problem solved. Stop making things easy for these terrorist turds.

  Yes .. I am gluten free …and not because I want to be … McDonalds offers almost nothing I can eat … Chick fil A has many items and are happy to prepare a grilled chicken sandwich without the bun or anything else I ask. McDonalds makes little to no attempt to help me as a customer.

  True. That factory-raised fecal chicken is disgusting. It’s injected with water that is allowed to contain up to 10% fecal matter. If you buy chicken from factory farms that is processed at the big processing plants, you’re eating garbage. Buy local and pay the price. It’s worth it.

  I suspect we are on opposite sides, but your post is exactly the issue … most who complain against progressive democrats are doing more harm to their own desires than they apparently are capable of understanding. I hate progressiveism, and I dislike obama very much, but these stupid ideas so many have are harming that cause in so many ways.
