Dems Reintroduce Assault Weapons Ban (And Its Not Just Rifles)

Congressional Democrats are reintroducing legislation to ban assault weapons but the measure faces long odds in the GOP-controlled House of Representatives.

The measure being unveiled Thursday is authored by Democratic Sen. Dianne Feinstein of California, who wrote the original assault weapons ban. That law expired in 2004 when Congress refused to renew it. There’s much disagreement about the effectiveness of the original assault weapons ban.

“The purpose is to dry up the supply of these weapons over time,” Feinstein said on Capitol Hill Thursday, flanked by several “assault” weapons. “Therefore there is no sunset on this bill.”

Feinstein’s sweeping legislation includes a ban on weapons with any “one military characteristic,” and bans the “import, export, manufacture, sale and transfer of hundreds of semi-automatic rifles, handguns and some shotguns,” Townhall’s Katie Pavlich reports.

In other words, the ban doesn’t just cover the “scary” AR-15 and AK-47 semi-automatic rifles. Here’s the list of more than 150 guns that would be banned under Feinstein’s plan. Freelance journalist Jonathan Krohn told TheBlaze that the list was handed out at Thursday’s announcement on Capitol Hill, which he was covering. It looks even more sweeping on paper.

The National Rifle Association promptly responded to Democrats’ proposed gun ban on Thursday and called on Congress to “reject” Sen. Feinstein’s bill. The NRA released the following statement:

Senator Feinstein has been trying to ban guns from law-abiding citizens for decades. It’s disappointing but not surprising that she is once again focused on curtailing the Constitution instead of prosecuting criminals or fixing our broken mental health system. The American people know gun bans do not work and we are confident Congress will reject Senator Feinstein’s wrong-headed approach.

Sen. Ted Cruz (R-Texas) released his own statement in response to Feinstein’s gun ban proposal on Thursday afternoon:

Washington politicians shouldn’t be taking advantage of recent tragedy to try to push an aggressive gun control agenda. Real assault weapons—machine guns—are already functionally illegal, and they have been since 1934. This proposal would have done nothing to prevent the terrible murders in Newtown, but it would limit the constitutional liberties of law-abiding citizens. And gun control doesn’t work – the empirical data overwhelmingly demonstrate that strict gun-control laws consistently produce more crime and more murders.

The Second Amendment exists to ensure that law-abiding Americans can protect their homes and families, and I look forward to helping lead the fight to defeat this bill and to protect our constitutional right to keep and bear arms.

An assault weapons ban is among the measures supported by President Barack Obama, who unveiled a package of gun safety proposals last week. But because of concerns among moderate Democrats it’s seen as a heavy lift in Congress, with measures such as beefed-up background checks more likely to pass.

At the heart of the debate, President Barack Obama and Democrats are claiming that banning so-called “assault weapons” will make Americans more safe.

The truth is much more complicated. The use of handguns in gun-related homicides is roughly 70 to 80 percent in most states, 24/7 Wall St. notes. Meanwhile, the use of rifles is under 5 percent, and use of shotguns about 5 percent. Knives are nearly always used in more murders than rifles or shotguns, according to FBI data.

24/7 Wall St.’s Douglas A. McIntyre suggests the federal government should make more of an effort to gather data on gun violence from local authorities in order to take meaningful action.

“The problem that the lack of data causes is about how to determine which guns might or might not be regulated more carefully,” he writes.

    If a person wants to purchase a certain item that the government bans or restricts, will the person find a way to get the item through any means possible? Will there be a “supplier” willing to break the law to provide the item?

      Laws do not matter. Rights do matter. When the government passes a law that makes a commodity “illegal”; it cannot be anything but moral for a man to supply that commodity to willing patrons. Just like laws in 1940′s Germany that made it illegal to be a Jew did not matter and those who protected them from the law were moral.

      First and foremost, it is about individual rights. These various laws and regulations are nothing more than an infringement on those rights, limiting one’s ability to exercise those rights. We have a duty, as citizens, to fight for our rights and not let the Government take them away. The Second Amendment is the keystone in this struggle since it gives the citizens the means to resist a tyrannical and oppressive government, should it come to that…the ultimate check and balance. If it falls, the rest will not survive.

      Laws that restrict goods that the people want serve only to develop a thriving criminal network: Prohibition brought about significant growth in organized crime, the war on drugs allowed for the expansion of violent inner city gangs, etc. When the Government reduces the supply but the demand remains, prices go up to the point where it is worth the risk to break the law to provide the goods.
      In the case of guns, laws and regulations only affect the legal gun owners and will serve to slowly disarm the populace over time. Criminals will still be able to get illegal guns, but at a higher cost which will, by necessity, be funded by increased criminal activity.

      Keep your liberty; keep your guns.

      I used to be a supervisor in the trucking industry and from time to time I had to transfer trucks myself for the truck rental companies. I got stopped in a DOT inspection station and upon presenting my driver’s license, I also present my concealed carry license as is required in my state when you are carrying. The Texas Department of Public Safety officer examining my truck expressed great satisfaction in seeing that I had a CHL. He said that the crime rate in Texas had gone down 35% since the CHL was implemented and that we CHL holders were making it safer for law officers.
      Every CHL citizen was another possible backup to him, should he get into a problem with the bad guys. In CHL class we are warned that our gun should be used only for our own and family protection because you never know exactly what is happening in any given situation. But if someone is on top of a cop wrestling for his gun or repeatedly stabbing someone on the ground, then one knows without a doubt what is going on.

      Just wondering, but did these same dems happen to mention anything about 74% of all murders in the US being tied to gangs? The logical person would think they may have mentioned something about going after gangs. If they did mention, I must have missed it.

      Did the dems happen to bring up the fact that in America, black Americans make up 12.5% of the population, and that they are currently doing 1/2 of all murders?

      Did the also talk about the fact that half of all murder victims in the US were also black?

      I would say that there might just be a statistical significance to those numbers, especially when you consider that if we lower black murder rates to the same as whites, we will drop the national murder per capita rate by almost 40%, and save a whole lot of black lives. I want to save black lives; do you think the dems do too?

      Crime is not genetic, and skin color is benign and non-behavioral. Race does not cause crime, but we do know that the democrat’s welfare programs are intrinsically tied to our violent crime. I wonder if dems are staying hush hush about black crime, because they do not want to lose votes, and want to continue the facade that they are a friend to black, when in reality, the dem has a 150+ year history of racism toward blacks?

      Did dems happen to mention that our cities with the highest amount of gun control (like Chicago) also have the most murders?

But the guns were taken from one segment of the population and then that segment was rounded up and exterminated. Now lets see what is happening today by the Progressives. If you want to stop the crime then take the guns away from all the blacks.       I was mistaken. bad link i guess. Hitler did get rid of most rights for jews, including guns, It wasn’t a nation wide thing. it was more incentive for jews to move and leave germany. But Look you guys saying that disarming jews lead to the holocaust is ridiculous! Also, won’t the manufaturers just need to come up with new names for their products to get around the intended ban – If I manufacture an AR 15 and the AR 15 is now banned can’t I just make the same gun and call it a STFU 15 – no longer on the banned list is it? ;)

      I read your post but it’s fear based, and I am not fond of fear based responses or ones that generate it. It doesn’t matter how ‘true’ it is, but it is fear based. Fear is a divider, a ‘fight or flight’ generator. We must be better than this or what are we actually fighting for in the end, old words that only a few people actually care about any more, or our pride? I think this is the wrong path.

      We must find common ground with these people, govern to the common ground. Feinstein ‘means well’ in the echo chamber that is her office, but it’s wrong and at some level she has to know it (like you said in your comments). That means we have room to change their minds.

      We cannot say “No!” to this without having a realistic plan to point to in ‘common ground’ opposition. Otherwise we just look obstructionist and not trying to resolve anything.

      So, let’s come together on common ground. We can all say “There is too much violence in society” and we can all say “Let’s lower violence”. Nobody will disagree with that. Let’s propose laws or executive orders that discover where we are melting down into violent idiots that are so lost in ourselves that we cannot even see others as people. THAT is where to start, not trying to solve symptoms… Gun laws are laws in search of symptoms to solve.

      Common ground people- FIND IT!

At what point does the futile efforts against the Constitution actually cross over into subversion and treason by an elected official? It goes beyond grandstanding, wasting money and time- this crap is treasonous on it’s face. They have won half the battle already- go try and find an AR or magazine or ammo. If you can find it, the prices are outrageous. That is what they want and have gotten in less that 6 weeks from SH.       We DO need a shot heard around the world, and it will happen. There will be an event, more than likely involving the inner-city blacks that will start the conflagration. And then it will spread all across the country. The Zimmerman acquittal comes to mind here. Then, it is game on. All of the traitors and trouble makers will be rooted out.       Silver…both you and MilDot have a point. My guess is there is going to be a “staged” sports complex shooting or a “staged” assination attempt on Obama. He needs a 9/11 type event. If an assination attempt is made, the Black Panthers (et.al) will go ballistic, causing an upheaval in the inner cities that will compel Obama to declare Marshal Law. He’s not going to get what he wants after the Newtown fiasco. Expect more to come. What really bothered me the other day was the distain in his face when he left the Capital complex. We are dealing with one angry and determined individual who is going to get what he wants come hell or high water.

    The paramount question is, . . . . “why?” I want to know the REAL “why”. A FEW incidents where a sicko used a certain type of rifle . . . should never speak to “the danger of something” when MOST are never used [nor will ever be] to “kill people in a mass shooting”. What is their TRUE agenda?

There are millions upon millions of productive patriots that will be disarmed if you insist on pushing that reasoning. We need all freedom lovers on deck here. Don’t look for excuses to take their rights from them. That is a ruse. A red herring. That goon that shot up the Aurora, CO theater was just standing outside of the theater waiting for the cops. Multiple witnesses said there were more than one gunman. That guy was a patsy, just like Oswald. The cop that arrested him said he looked hypnotized. More is going on here. But, you are free, you are still entitled to your opinions. Carry on brother.

      The true agenda, as far as I can tell, is to disarm the public for nefarious purposes having to do with relinquishing American Sovereignty. As stated in the bill, guns subject to the ban that are grandfathered, not really, “must be forfieted to the government upon the owners death”, thus registration. You will no longer be able to leave your ruger 10/22 (a virtual pellet gun on steroids) to your son or daughter. That is the goal, to disarm the public over time, to eliminate “a rifle behind every blade of grass”.

      One of the founding fathers, “tyranny is only ever one generation away”. Truly manifested in this proposed legislation, which probably will not pass in this form.

DHS labels vets as “terrorist threats” and VA is instructed to push PTSD diagnosis’ on as many as possible, you can see it in the PTSD martketing campaign. They will use this as the basis to deny veterans 2nd ammendment rights, two birds with one stone.

      Hate to say it, but keep your problems to yourself, carry your own water. They will use it against you.

      The right to own and use a weapon is protected by the second amendment. You have no right to healthcare, housing, food or water, so who really owns those?

      This attempted legislation, like the patriot act, the virtual strip search of your person, the rifling of your luggage, the screening of your e-mail and the ability to listen to your phone conversations is all an assault against the right to pursue private property.

      What is “private” anymore? Can you talk to your spouse on the phone with 100% certainty that the conversation was neither monitored nor stored in some data base?

      What do you actually own and can be considered your “property” whereby it belongs to you to use as you see fit and if it were removed from your possession by any entity without either a search warrant, your permission or agreed upon compensation, it would be considered a theft? That list has dwindled considerably over the last two decades at least where the government is concerned.

      The number one aim of communism was the abolition of private property. The second amendment is part of that right.

      I hear ya but unfortunately gun manufacturers will have to adhere to this stupid ban. If you already have all the guns and greater than 10 round magazines you want then more power to you. For a guy like me who’s still drooling over this or that firearm that he really wants, this law is pretty disastrous. It means having to pay absurd amounts for the few remaining magazines and rifles still floating around that people are willing to sell.
