No Shots Fired: Home Intruders Decide Not to Stick Around After Seeing Their ‘Victim’ Holding an AR-15

Two home intruders, one holding a handgun, broke into a New York apartment on Tuesday and waited at the bottom of the stairs for a potential “victim” to come down. While their intentions are unknown, it is clear they were criminals up to no good.

After hearing some noise coming from the basement, Christopher Boise, a student at Rochester Institute of Technology, went to check it out.

“They were waiting for me at the bottom of the stairs,” Boise told WHAM-TV. When they saw him, the man with the gun pointed the barrel towards him.

Relying on pure instinct, Boise let out a blood-curdling scream in order to alert his roommate, Raymond, who is also a RIT student.

“It wasn’t like a, ‘I stepped by stepped on a piece of glass’ kind of scream,” Raymond said.  “So, I instinctively went to my gun bag.”

In that bag was a AR-15 semi-automatic rifle, one of the very guns at the center of the current gun control debate.

About five seconds after he retrieved his gun, one of the intruders began opening the door to the room where he was waiting. But he was ready.

“By the time I had it out and ready, one of the men came at my door, slowly opened it, saw that there was a barrel on the other side and from there backed out,” Raymond recalled.

After seeing the barrel of an AR-15 staring them in the face, the two men fled from the apartment. No shots were fired and no one was injured. In fact, the rifle wasn’t even loaded at the time of the incident, Raymond said.

It’s not the kind of story that always makes national headlines as bullets never went flying, but it certainly shows why so many Americans are adamant about protecting the Second Amendment as it is written in the U.S. Constitution. It also shows that, in some cases, a gun doesn’t even have to be used in order for it to protect its owner and others.

“I’m happy he saved my life. I was very thankful he had his (gun),” Boise said of his roommate.

Rochester Police Chief James Sheppard said Raymond’s gun was legal and effectively protected his property.

“We’re thankful that no one was injured,” he said.

Police reportedly found BB rounds near a broken glass window. It’s unclear if the handgun used in the home invasion was a BB gun.

      (B) Former Florida Attorney General Jim Smith told Florida legislators that police responded to only 200,000 of 700,000 calls for help to Dade County authorities.

      (C) The United States Department of Justice found that, in 1989, there were 168,881 crimes of violence for which police had not responded within 1 hour.

      (A) Every year, more than 2,400,000 people in the United States use a gun to DEFEND themselves against criminals–or more than 6,500 people a day. This means that, each year, firearms are used 60 times more often to protect the lives of honest citizens than to take lives.

      (B) Of the 2,400,000 self-defense cases, more than 192,000 are by WOMEN defending themselves against sexual abuse.

      (C) Of the 2,400,000 times citizens use their guns to defend themselves every year, 92 percent MERELY BRANDISH their gun OR FIRE A WARNING SHOT to scare off their attackers. Less than 8 percent of the time, does a citizen kill or wound his or her attacker.

Wilson, a respected expert on crime, police practices and guns, says, “We know from Census Bureau surveys that something beyond a hundred thousand uses of guns for self-defense occur every year. We know from smaller surveys of a commercial nature that the number may be as high as 2-and-a-half or 3 million. We don’t know what the right number is, but whatever the right number is, it’s not a trivial number.”

      The Department of Justice’s own National Institute of Justice study titled “Guns in America: National Survey on Private Ownership and Use of Firearms,” estimated that 1.5 million Americans use guns for defensive purposes every year.

      Former assistant district attorney and firearms expert David Kopel writes, “… [W]hen a robbery victim does not defend himself, the robber succeeds 88 percent of the time, and the victim is injured 25 percent of the time. When a victim resists with a gun, the robbery success rate falls to 30 percent, and the victim injury rate falls to 17 percent.

      You don’t need to apologize, I wouldn’t believe its sincerity anyway. You’re just trying to score points, not have a meaningful discussion. But for what it’s worth think on this. The people you need to use a gun on, don’t respond to reason, or words. Ever. They’re broken inside, and only respect force. It’s sad, but it’s true….and when seconds count, the police are minutes away.

      Wait….did I miss something…the gun wasn’t loaded? So now these two criminals are free to try this again….possibly a woman with children while the father is out of town, an elderly couple or a young girl home alone…..the only good news from this story is the two guy’s are all right…unfortunately where these guy’s live they would have probably been charged with murder had the AR been loaded and used to rid the world of the vermin that entered theirs.

      The question everyone forgets to ask: Police use to use the 6 – shot revolver (Duty Weapon.) why did they switch over to semi-automatics?

      Anyone give thought to why these intruders where waiting? Think they might have known a firearm was on the premises? Do you think that was a legal handgun they had to?

      The Police chief in Rochester, who has publicly come out in support of an ‘assault rifle’ ban, did not release this story to the press for several days, until local talk show host, Bob Lonsberry broke it. Instead, the chief released a story from the same night where another apartment was successfully burglarized and no AR 15 came to the rescue.

      So, what this article and peoples comments are equating that many lives are saved because of “assault style” semi-automatic guns?? Then would not that be “mission accomplished” by Pres. O statement that he will do what needs to be done for control to save just one life??? Did not the the current laws just saved 2 lives???       I’m going to hold off on using this story as an example of why AR15′s are needed.

      No shots fired no one arrested. This story could easily be a hoax, done by 2 students to get media attention. We have had more than enough instances of that in the last 5 years. I’m not saying that it is a hoax, just that i for one don’t want to look like a fool in 2 months, if it turns out it was. I can defend the reasons for the second ammendment without using stories like this one.

They rarely arrive at the scene of a crime as it is being committed. More often than not they arrive on the scene late and deal with the aftermath.They gather evidence for use in court if the perpetrators are ever apprehended.       Essentially all studies of the subject, a dozen or so, come up with numbers like that. The best one I know is by Dr. Gary Kleck, and my guess is that those are what Michael was quoting.       Legality of open carry depends upon the State and sometimes City you live in. In Georgia, open carry is perfectly legal. I have a permit to carry concealed.       Have you lost your freaking mind, just use the laser.If you have a robber opening your bedroom door yes you can put the laser on them,squeeze the trigger,these two criminals are loose on the streets and now the cops are on their ****,so they are laying low or they are robbing someone else to get out of town.There is two criminals running around with illegal guns,that aren’t afraid to put them in your face and probably use them if you are defenseless.The young man needs to have a loaded mag.close to his rifle if he his going to use it for home defense.Where he can lock & load fast and be ready.

      Better yet, just leave the gun in condition 3 all the time like I do and you don’t even have to worry about a magazine getting lost. The only time my guns are unloaded is when I am cleaning them. They are in my home for one reason only. To protect myself and my family. If I cannot use them in under a second, they are worthless. Therefore, the only time my guns are out of reach is when my 3 year old nephew is running around, and even then, they are just one bedroom door lock away.

      My gracious, but you do seem to know a lot about guns. Thanks to you, I now know that the .45 ACP is the most lethal round ever manufactured. Thanks for that bit of insight. And, I know that 9mm is incapable of inflicting death. Thanks again. I’m grateful that the gun experts here on The Blaze are just that, experts, and that you guys would never leave a loaded pistol behind in a school bathroom. Or shoot off you own weenus. Or kill your own son outside of a gun store. But what I’m really interested in is your experience in deadly encounters. How many times have you experienced hostile fire? How many times have you defended yourself or others against hostile fire? How many aggressors have you engaged? Killed? (Here’s a hint: It starts with a Z and ends with an O.) But hey, someone has to stay behind and watch the car.

      As the owner of a .45 ACP, I can assure you that it is far from the most powerful cartridge available. Just about anything in the range of a .50 caliber puts more kinetic force per square inch than a .45 could possibly hope to. And before you say anything a Civilian can get ahold of, may I remind you of the .50 caliber Desert Eagle? Readily available throughout most of the non-retarded United States.

      Hell, I’m sure that .44 Magnums put out more kinetic energy than a .45 ACP.

      Try knowing what the hell you’re blabbering about before commenting again.

      You asked have we ever been involved in armed conflict. I lost count half way through my first tour. And yes All of my guns are loaded at all times, of course except when I am cleaning them. When we had a window peeper at my front window spying on my beautiful wife and new son I was out the door in less than 10 seconds with my Glock. When he saw the Crimson Trace laser light up he turned fast and he and his buddies know that our house is not a soft target. To chime in on the caliber issue. All calibers can kill if used properly. I wouldn’t want my 100 # wife to wield my .40. So she gets the .410 and I sport the 12 gauge. Have a plan set yourself up in the most advantageous position. Put the bad guy in the fatal funnel and don’t ever shoot to wound. You never know how much bath salts that guy has been snorting.

    Good thing he didn’t shoot the intruders, in NY the law abiding citizen has a duty to leave their home if at all possible, you can not injure, harm or kill an intruder unless you have no other way out. The two roomies would be looking at charges if they harmed the thieves. What a bunch of b.s, but welcome to we treat taxpayers like crap NY.

      Not true, you do not have to retreat from your home in NY. There is no “stand your ground” law but inside the home, NY is essentially a “Castle Doctrine” state. No prosecutor would bring a case against a homeowner who shot an intruder who forced their way in, especially one who displays a firearm.

How does one waive rights? By implied or explicit CONSENT — part of the contract :-) How does it or does it not ‘apply,’ and when? First we have to identify what it is from its SOURCE. Only then can we have full knowledge and understanding. {NOT a lawyer (noun) nor an attorney – just someone who understands the term due diligence}

    Gun should have been loaded & they should have fired.

    They don’t know who the intruders were. But now the intruders know the layout of the place & some of the weaponry. They can bide their time & come back in a week or 6 months. They can attempt to steal the gun, when the people are not there or they can waylay the people away from their domicile just for the principle of it (principles according to a criminal mindset).

      Tyranny is not limited to Gov’t Dictators. Tyranny can also come from criminals in the neighborhood.

      I remember an incident in a Town in WA state that involved some Army Rangers that lived “off” base. The neighborhood was close to “Gangland” neighborhoods in the town and the Rangers were at a birthday party of a friend. At the time the military allowed these Rangers to keep their weapons in their homes. And since they had done so when gang members decided to deliver some gangland justice to the neighbor they did not realize that they had engaged a hornets nest of retaliation. The Rangers treated the incident like they would any operation and took to the high ground – upstairs rooms facing the street and returned fire. It was big news at the time. And the Rangers were thanked and reprimanded, the Unit Commander then instituted a policy of no more “Military Arms” going home with Unit Members.

    Don’t bring a BB gun to a gun fight. I hope all the no-goodnicks understand that a lot of people have obtained guns that did not have them before. It has just gotten a lot more dangerous to be a criminal. I suggest they go to the board of elections and find the democrats who are probably in favor of excessive gun regulations.

    Too bad this will never be spread nationwide. In places I have been forced to live due to economic hard times or duty restriction due to response times I have had to deter several break-ins with my 12ga pump. The best deterrent were the little Obamanites that were trying to incite fear in my family till I opened the curtains and showed them my shotty being loaded and racked. they even asked me what’s that for, I politely answered your butts if you cross my onto my lawn. Peace was brought to my house due to the show of force. Funny how urbanite thugs melt when faced with gunmetal and B-A-L-L-S.

      Unfortunately, they are not the only ethnic group working to destroy America from within.
      The Bush’s, Clinton, Obama, and more have had their hand in allowing the UN’s NWO integrate into America.
      Throw in a few hundred NGO’s and Foundation’s, and you have the perfect mix to pull off the defeat of America.

      To call Frankenfeinstein an idiot is an insult to idiots everywhere. Even someone with major brain damage is capable of understanding the lunacy of removing guns and ammo from law abiding citizens. There is absolutely no way anyone with an IQ higher than that of a common barn yard swine can argue safety as a reason for a ban on any gun. The sole reason for banning a gun or any weapon for that matter is power, pure and simple.

      Come on, size doesn’t matter, my PS90 is small, but it can spit out 50 5.7 X .28 mm in less than a minute, and with a laser sight, very accurate. If they get through the alarm and the dog, they will face a very upset assault weapon, because you know, they kill all by themselves. I usually just sleep through it.

      DARMOK, That is a very nice little weapon and quite effective. Back in the mid ’90s I was escorting a newly promoted general at a Warfighter Convention and as we visited an SMG range with reps from FN/USA I got the chance to fire the P90. The general had me fire magazine after magazine as he observed. That was a blast. I probably fired close to a thousand rounds on full auto, and the weapon itself makes anybody who fires it an instant expert. Part of the targets the FN reps set out where French made versions of the Kevlar helmets. It tore them apart.

      I love that rifle, and my tommy gun, AR, M1, Mosin Nagant, and a few others. The PS 90 is my favorite though, and it makes a really good varmit gun, those poor rabbits don’t stand a chance, they just wonder why their buddies are blowing up. (I have a friend that needs his pastuers cleared from time to time.)
