BURLINGTON, Vt. (TheBlaze/AP) — A Virginia pastor convicted of helping a woman and her daughter involved in a custody dispute with the woman’s former lesbian partner was taken into federal custody Thursday after refusing to answer questions about others involved in the flight posed by grand jury investigating the custody case.
Before surrendering his belt and wallet and being handcuffed by court officers, Kenneth Miller, of Stuarts Draft, Va., apologized to U.S. District Court Judge William Sessions for burdening the court, but he said his religious beliefs prevented him from complying with the court’s order that he testify about others involved in the 2009 flight of Lisa Miller and her daughter. The Millers are not related. TheBlaze first covered this complicated case back in June 2011.
“I am willing to submit myself to whatever” the court decides, the 47-year-old Miller said Thursday during a court hearing called after he refused to answer questions from the grand jury sitting at the federal courthouse in Burlington.
Sessions was reluctant to order Miller held, and he gave him several chances to change his mind.

“We can’t function as a criminal justice system without the grand jury,” Sessions said. “I appreciate your faithfulness to your religion and your moral beliefs and perhaps there is an inherent conflict here.”
One of Kenneth Miller’s lawyers said he didn’t believe incarcerating Miller would induce him to agree to testify, but Sessions said there was no way to find out unless Miller spent time in jail. Sessions scheduled another hearing in a week to see if Miller would change his mind.
After Miller was taken into custody, his wife Linda, in court along with a handful of other supporters, said she wasn’t surprised by the court’s action.
“He will always be my husband,” she said. “Until death do us part.”
Miller was convicted last summer by a jury of helping Lisa Miller and her daughter, Isabella, travel from Virginia to Nicaragua via Canada in September 2009 so Lisa Miller would not have to comply with court orders that she allow her former partner, Janet Jenkins, of Fair Haven, to visit with her the girl. Two months after they disappeared, a Vermont family court judge transferred custody of the girl to Jenkins.
Lisa Miller and Isabella are believed to be in Nicaragua.

Jenkins and Lisa Miller were joined in a Vermont civil union in 2000 and Isabella was born to Lisa in 2002. The couple split in 2003. The Vermont family court gave custody of Isabella to Lisa Miller, but gave Jenkins regular visitation.
Lisa Miller then returned to Virginia, became a conservative Christian, renounced homosexuality and sought full custody of the girl. The legal case played out for years, until they disappeared.
Kenneth Miller is facing up to three years in prison on his conviction. Sentencing is scheduled for March 4.
Miller had fought efforts to compel him to testify, but earlier this month the 2nd U.S. Circuit Court of Appeals in New York rejected arguments that he was being forced to testify against himself because he had been granted immunity from prosecution for anything he told the grand jury.
Before Sessions ordered that Miller be held, the two engaged in an unusual philosophical debate between the bench and the defense table. Miller said he couldn’t testify because it would implicate others who helped Lisa Miller and her daughter flee who were also motivated by God’s law, which they feel trumps civil law. Sessions countered that his job is to uphold the sanctity of the legal system and it is a citizen’s duty to comply with orders to testify about their knowledge of crimes.
One of Miller’s attorneys, David Bercot, an Anabaptist lawyer from Amberson, Pa., said after the hearing that Miller answered some of the questions from the grand jury, but he wouldn’t talk about others involved in getting Lisa Miller and Isabella out of the country because of their shared beliefs.
“These people they wanted him to testify against are fellow citizens of God’s kingdom,” Bercot said. “And it’s like, you wanted me to be a rat, you know, to turn on my fellow citizens. That’s basically what it came down to.”
Bercot said Miller made the decision years ago to suffer the legal consequences to keep Lisa Miller and Isabella apart from Jenkins.
“He is acting on what Lisa Miller told him are the facts of the case,” Bercot said. “It’s all based on that, it’s not just, `oh, someone’s a homosexual we are going to take their child from them.’ That is not what we would believe.”

She concluded that the visits were doing serious harm to the child, causing anxiety, renewed bed-wetting, and general psychological regression.
“Isabella appears to have been traumatized by the limited visitation thus far, a serious consequence, taking Isabella in a negative direction as compared to Isabella’s condition before the recent visitations where she was a child that was well-adjusted, flourishing, above-the-curve developmentally, verbally gifted, and readily able to separate from Lisa and meet with other people,” wrote Haydash in 2007.
“At this point, after only two supervised two-hour visits, and the resulting regressive behaviors, it is my clinical opinion that leaving Isabella unsupervised with Janet for visitations would needlessly exacerbate Isabella’s trauma,” Haydash also stated. She added, “I further believe that unsupervised visits would be detrimental to Isabella at this time and could cause permanent damage to normal development.”
Gwen Corley, a social worker who also observed Isabella, noted the traumatic effects of Isabella’s relationship with Jenkins

You forgot to say that Miller had been flaking out on the visitations for YEARS before this point. For two years, Janet was not allowed to see her child, until the Vermont Supreme Court intervened. And the bath reference, might I add, is also hearsay disavowed by Janet and was complained in the same breath that the women were reading books like “Heather has two mommies.” Those two things are totally equivalent right?
No! If a naked adult is bathing with your child, you call the police! Or at least a logical person would.

As she had several times before when Janet had driven 10 hours to come see her daughter. Miller took off, let the family pets starve to death, and broke federal law. Honestly, the court seemed to gauge Miller quite right – the woman broke the law multiple times, and finally skipped the country.

Whose motive? If Miller was accusing Jenkins of sexual abuse, she should have called the police. Obviously the court didn’t think much of it, when she immediately followed up with “She’s reading pro-gay books to my child!!!”

I am. She belongs in the US, where she can legally see both of her parents. Make no mistake: both of these women seem hateful to me. But Miller is in the wrong here, legally and morally. Thinking about it, shame on you. You’ll lie and insult and turn this poor child’s future into some toy to kick around. I don’t think either of these women are good people; and I think that Isabella is the one who is suffered, hunted like the criminal that her mother is, whisked out of the United States to a third world country, forced to live in a commune away from the rest of the world because her mother is too full of hatred to allow visitation by her ex.
I honestly hope for the best for Isabella, and I think that the best would have been her living here in the US with her birth mother (before she went criminalistic, of course). Short of that, I hope she’s doing ok with the situation she’s stuck in.

There is a wheel-barrel full of public knowledge information on this case – going back to the (public) Vermont ‘divorce’ hearing, the original Vermont custody (pro gay, damn the kid) trials, the Virginia appeal, and the subsequent witch hunt conducted by the Vermont gay court. Why you would seek to assume someone’s information stems from a WND article (of which I know nothing) is puzzling …. perhaps sheer stupidity?

About 3,000 years ago Pharaoh ordered all first-born sons int he land be slain. Moses’ Mom decided she didn’t want her son slain; instead, put him in a reed basket and floated him down the Nile. The basket was found by Pharaoh’s daughter; the child was subsequently raised in Pharaoh’s house and grew up to be the second most powerful man in the land. But, the “criminal” mindset so clearly exhibited by the real mother had apparently poisoned Moses’ mind and he later killed a man who was physically beating a Jew; Moses fled to the Sinai and spent many decades as a goat herder for hire, then returned to lead the Jews out of slavery. The result: the Jewish nation; Israel; the Torah (Moses wrote it); the Bible; Christianity, modern law, etc. etc. etc.
BUT YOU THINK THIS ALL TO BE TERRIBLE AND SUPPORT PHARAOH …. THE MOTHER SHOULD HAVE KILLED THE LITTLE BRAT, HUH?

Sorry, I thought you were a Christian. The story of Pharaoh is interesting, but a poor parallel to this case. If Jenkins was going to kill her child, I’d say Miller fleeing would be the moral position to take. Considering Miller’s accusations were sexual abuse (which she refused to file a criminal report for) and reading a book that’s about dealing with two mothers (which, incidentally, is what Isabella has to deal with)… I think that falls a bit short of killing.
But hey, perhaps you think that fleeing the country is a totally justified response if your child reads a pro-gay book, or equate that book to stabbing a child to death. I’d argue that that makes you pretty crazy too, honestly.

Having some involvement with child custody if only tangentially I can make a good guess as to what happened here. After becoming a Christian, the mother with custody started filling the child’s head with talk about hell and how bad homosexuals were.
And that is why the child had psychological problems. In one house she’s being scared to death with nightmarish proclamations and in the other house she’s seeing and hearing precisely the opposite.

I ‘know’ that just as well as you ‘know’ some of the things you claim you do with the added benefit of having seen this very same drama play out once before for precisely the reasons described. The fact that they ran off to another country with the help of a pastor sort of ‘clinches’ this.

Yanked around by the adults, separated from one of her parents, dragged out of the country… I don’t know if she will adapt to her new environment or rebel against it, but it has to be frightening and hurtful.
I see a bit of bashing on the grown-ups. The kid being given a chance to speak for herself, is she? What about her hopes and fears, her love for her parents being dragged through this hostility and confusion? I hear some people seem to think that it’s important to teach Christian values to the girl… It’s hard to teach love for god while showing hostility and distrust for your
fellow (wo)man. I don’t think the Christians are doing a good job on this one.

He has more respect for the bible and his God than he does the law of man. Jesus himself was called names, mocked, and murdered yet in the end over 500 hundred people saw him after he was resurrected. Death could not defeat this man because he was God. One day he will come to judge this world based on the word of God not some law created by some judge. The United States is a country that no longer honors God and those that speak out against Ken clearly walk in spiritual darkness. So you can mock me too because as Jesus said the servant is not greater than his master if they do it to me they will do it to you. But he also said in the world you will have tribulation but be of good cheer for I have overcome the world.

And it may sound trite to Bible haters, but God does not recognze gay relationships and says that lifestyle is wrong, so I would bet all I have that God would be on the biological mother’s side on this one, and the Bibl even gives allowance for breaking the law when it goes against what we believe

You don’t think the better option would have been, you know, sticking to the custody settlement that had originally been legislated, and then just telling her daughter “your mommy and I aren’t seeing each other any more.”
Christ speaks directly on the immortality of divorce, but I don’t see that as any reason that a heterosexual mother alone should have custody.

Frankly, I hope it happens soon. The entire situation is disturbing, including the views of Miller’s supporters who think it’s completely fine to kidnap a child and smuggle her to a religious commune in South America rather than allow the child to see her step-parent every other weekend.

Then you haven’t followed the story. IIRC, it goes like this: The two women were married legally in Vermont; one (Miller; there are three Millers in this story, by the way) went through in vitro, conceived, and had a child. After a few years the married couple fought, and divorced. Miller, as the birth mother, had primary custody; her ex-wife had weekend visitation rights.
Miller joined a strict Mennonite sect soon after, and her ex-wife soon started hearing what she considered to be “disturbing” religious teachings when her daughter visited on the weekend. Soon after, Miller stopped allowing her ex-wife to see their daughter. The ex-wife went to court, and the court agreed that Miller needed to allow visitation. She didn’t. The court then charged Miller with breaking the custody agreement, and awarded custody to her ex-wife instead while Miller came to court. Instead, Miller was helped by her fellow religious community, who smuggled her and her child out of the country – while she was due to come to court (and thus violating federal law). She is currently believed to be living in a Mennonite commune in South America.
Two pastors, Timothy Miller and Kenneth Miller (all with no relation) were charged in the kidnapping. Kenneth Miller was found guilty last August and can face up to three years. Miller herself is still at large.

I think we need a federal commission to study this and determine if the failure rate is proportional to that of the heterosexuals. Then we can get some new regulations, a new form to fill out and hire more people to help these people out.
You know they will do it someday. The slippery slope is always watched by the farm hands and they do try to interject themselves as they have in the past. They allowed this stuff and now they have to do some post mortem review, analysis and submit a corrective action plan…
I say we go for a class action lawsuit against the feds for fraud, waste and abuse. They allowed it, sponsored it and now we have to pay for messed up outcome…
It’s like a snow ball rolling down a step hill of snow…I can’t wait till it hits a wall, falls over a cliff or something.
Meanwhile it’s creating jobs…

Apparently she didn’t think of results by actually contacting authorities with issues. Courts don’t tend to trust people who openly break the law and then complain that they’re the ones being victimized. Go figure ;-)

I saw a freeway sign the other day announcing a kidnapped child. I wondered, to my wife, if that child might belong to a good Christian woman who lost custody to her child to her _______ husband… (you fill in the blank). I would never call the 911 to report anything until I knew for sure the child truly was in danger… and the government is doing everything they can to confuse the issue so that we don’t report these things.
