It’s not often that a professor of constitutional law at Georgetown University launches a nationwide push to retire the U.S. Constitution to the dustbins of history, but that’s exactly what Louis Michael Seidman has been doing for roughly the past month (though he may have begun earlier in the classroom).
TheBlaze has featured his efforts several times in the past, but it appears Seidman is only doubling down on his efforts.
Appearing on CBS News Sunday Morning this weekend, the professor was introduced by the question: “”Is the U.S. Constitution truly worthy of the reverence in which most Americans hold it?”

I’ve got a simple idea: Let’s give up on the Constitution.
I know, it sounds radical, but it’s really not. Constitutional disobedience is as American as apple pie.
For example, most of our greatest Presidents — Jefferson, Lincoln, Wilson, and both Roosevelts — had doubts about the Constitution, and many of them disobeyed it when it got in their way.
To be clear, I don’t think we should give up on everything in the Constitution. The Constitution has many important and inspiring provisions, but we should obey these because they are important and inspiring, not because a bunch of people who are now long-dead favored them two centuries ago.
Unfortunately, the Constitution also contains some provisions that are not so inspiring. For example, one allows a presidential candidate who is rejected by a majority of the American people to assume office. Suppose that Barack Obama really wasn’t a natural-born citizen. So what?
Constitutional obedience has a pernicious impact on our political culture. Take the recent debate about gun control. None of my friends can believe it, but I happen to be skeptical of most forms of gun control.
I understand, though, that’s not everyone’s view, and I’m eager to talk with people who disagree.
But what happens when the issue gets Constitutional-ized? Then we turn the question over to lawyers, and lawyers do with it what lawyers do. So instead of talking about whether gun control makes sense in our country, we talk about what people thought of it two centuries ago.
Worse yet, talking about gun control in terms of constitutional obligation needlessly raises the temperature of political discussion. Instead of a question on policy, about which reasonable people can disagree, it becomes a test of one’s commitment to our foundational document and, so, to America itself.
This is our country. We live in it, and we have a right to the kind of country we want. We would not allow the French or the United Nations to rule us, and neither should we allow people who died over two centuries ago and knew nothing of our country as it exists today.
If we are to take back our own country, we have to start making decisions for ourselves, and stop deferring to an ancient and outdated document. [Emphasis added]
Much of what the professor said is recycled from previous interviews, but what’s noteworthy is that he continues to find new, large audiences.

Changed careers immediately and the only thing I am saving for for my kids is a vehicle to get them to work and a trade school at most unless they become an athlete cop or military. Factually, the constituition is nothing but four pieces of parchment. It means nothing. It is certainly not a contract. No one signed it, and no one possibly could. You could call it a charter, it would fit, forming corporations and franchises. That is obviously something that holds no authority over anyone unless they personly and knowingly consent to it.
You have to give up this system of violence. This stupid lottery you participate in. Where you vote for your canidate, with hopes that the majority does so also. Only so that canditate can take what you think is right and shove it down the throats of evryone else. Then complain when the other side wins and now they are shoving their views down your throat. this is why we do not want any new amendments to defend marriage, the flag, or any other small items. Do not open the door to set a precedence for changing the Constitution. In the long run it is not worth it.

He has a 1st amendment right to speak his piece. I totally disagree with what he’s saying, but certainly would not condemn him to death for it. I agree with you, but if we want to be honest about it, _WE_ allowed this to happen. We should have recognized what was being done and taught in our schools years ago as these people were taking foothold, but we were all too busy with other things to keep an eye out for enemies.
I agree with this professor’s right to state his beliefs, but I very much disagree with those beliefs. I don’t know if we can turn the tide anymore … will the pendulum being swinging back the other way, or is it too far on the progressive side now?

What we need to do is have him be sued for failing to provide law students with a proper education….by a state university law school.
This would imply that Georgetown is living of past success and is no not worth the price of a public state university. So georgetown is actually a second or third tier law school.

The Constitution itself defines treason in very narrow terms so that charges of treason could never be used to stifle dissent or preempt efforts to effect non-violent change. To suggest that mere disregard for the Constitution is treasonous is itself disregard for the Constitution.

girl i know you not the sharpest tool in the shed but even you have got to be seeing the pattern after the LITERAL dozens of examples I’ve provided in just the past few months..
if you want to love and worship these people because you believe the Bible commands you to do so then that’s ok, but when you see their obvious play on power then why not call them out in love?
Do you realize that it was a Christian missionary that traveled to Russia in the late 20s who came back and wrote a book about what she witnessed over there that first opened my eyest to the problem?
I too use to love and worship these people because my pastors said so and they quoted from the OT and so forth but then when one understands the truth you have to sober up and protect your people from the coming slaughter.

Any that bother to read the writings of our early leaders will realize that they looked to the future with a clear vision of the hardships and possible pitfalls that could come to pass. There are those who would break free of the limiting boundaries of our Constitution so that they can enslave us all. In many ways they have already been successful. We are nearing their endgame push. Powers of government were limited for good reason. Justice was intended to be applied evenly and fairly with due process. How many freedoms have been subverted already? Most.

I’m not talking exclusively of your Constitution, which I know was written that way, but talking about the general guide lines our societies and way of life have…that simple! The world, the technology and everything must to adapt to morals, not the way around….

But besides that, Irving Berlin wrote “God Bless America” so that lets the whole race off of the ‘hook’ (uh, no pun intended).
