Constitution-Bashing Georgetown Law Prof. Continues Battle to Make Americans ‘Give Up’ on Founding Document

It’s not often that a professor of constitutional law at Georgetown University launches a nationwide push to retire the U.S. Constitution to the dustbins of history, but that’s exactly what Louis Michael Seidman has been doing for roughly the past month (though he may have begun earlier in the classroom).

TheBlaze has featured his efforts several times in the past, but it appears Seidman is only doubling down on his efforts.

Appearing on CBS News ​Sunday Morning​ this weekend, the professor was introduced by the question: “”Is the U.S. Constitution truly worthy of the reverence in which most Americans hold it?”

I’ve got a simple idea: Let’s give up on the Constitution.

I know, it sounds radical, but it’s really not. Constitutional disobedience is as American as apple pie.

For example, most of our greatest Presidents — Jefferson, Lincoln, Wilson, and both Roosevelts — had doubts about the Constitution, and many of them disobeyed it when it got in their way.

To be clear, I don’t think we should give up on everything in the Constitution. The Constitution has many important and inspiring provisions, but we should obey these because they are important and inspiring, not because a bunch of people who are now long-dead favored them two centuries ago.

Unfortunately, the Constitution also contains some provisions that are not so inspiring. For example, one allows a presidential candidate who is rejected by a majority of the American people to assume office. Suppose that Barack Obama really wasn’t a natural-born citizen. So what?

Constitutional obedience has a pernicious impact on our political culture. Take the recent debate about gun control. None of my friends can believe it, but I happen to be skeptical of most forms of gun control.

I understand, though, that’s not everyone’s view, and I’m eager to talk with people who disagree.

But what happens when the issue gets Constitutional-ized? Then we turn the question over to lawyers, and lawyers do with it what lawyers do. So instead of talking about whether gun control makes sense in our country, we talk about what people thought of it two centuries ago.

Worse yet, talking about gun control in terms of constitutional obligation needlessly raises the temperature of political discussion. Instead of a question on policy, about which reasonable people can disagree, it becomes a test of one’s commitment to our foundational document and, so, to America itself.

This is our country. We live in it, and we have a right to the kind of country we want. We would not allow the French or the United Nations to rule us, and neither should we allow people who died over two centuries ago and knew nothing of our country as it exists today.

If we are to take back our own country, we have to start making decisions for ourselves, and stop deferring to an ancient and outdated document.  ​[Emphasis added]

Much of what the professor said is recycled from previous interviews, but what’s noteworthy is that he continues to find new, large audiences.

    He makes a great point. It isn’t about hatred of the Constitution, it’s about how we govern ourselves today as opposed to how they had to govern 200 years ago. I think that’s the point he’s getting at and it’s a good one. It is outdated, but the fundamental values of freedom will never be outdated. I think that is where this country should head.

    So the American Bolshiviks now feel secure enough to trot out a shill who maintains the Constitution, the fundemental basis of American society and social order, is obsolete. If you have a beard, and a law degree from Georgetown or one of those pathetic universities of the left, you can still have FIRST AMENDMENT protection. But a guy like Phil Michelson is afraid to speak his mind because he knows the IRS will audit his 1040′s going back 10 years and forward to infinity. NEWS FLASH: the Constitution has already been set aside, and the genocide of the white male has begun in earnest.

    There is nothing more that Gaybama and his acolytes would want, than to convene a Constitutional Convention, to shape and mold it to fit THEIR idea of a Country they lost – or better yet to scuttle it and make a new one up as they go along.

    He says “IF WE ARE TO TAKE BACK OUR COUNTRY”…

    Who is ‘WE’?
    What did you lose that existed prior to the creation of what our Founders wrought? It’s not possible.
    How can you take back what you haven’t lost?
    Ergo, he, like all Marxists, like Obammy, like Alinsky and Pelosi and Clinton, the 75 or so registered members of the Congrssional Progressive Caucus and the rest of the Cancerous Cabal, want REVOLUTION, in a Communist ‘sort of’ way, and they found THEIR ‘Brendon Ayanbadejo’ to carry some weight.

      Correction – On second thought, I don’t think this Marxist professor wants a Constitutional Convention – he just wants the Constitution dropped, because THEY’VE LAREADY WRITTEN A REPLACEMENT.

      Just like with Obammy care, and if they have their way, they’ll vote on such a measure quickly, “um, to see what’s in it.”

    I agree with the professor. I would like to make changes to the Constitution also. The way to get it done is by using the constitution itself by way of amending it through the constitutional process.

    The problem with politicians, they are unwilling to initiate constitutional amendments out of fear of failure. The Dem’s know they only maintain a majority in the metropolitan areas of the country and not at the State Governors mansions where any radical amendment would die.

    I would like to change the constitution by limiting voters to Natural Born Citizens. By doing so would take the politics out of immigration policy, thereby removing the biggest hurdle in solving the problem.

    I would also like to amend the constitution by adding verbiage that would reinstate the Governors authority to remove and replace US Senators. This would stop the 100 senator bubba club from its arrogance that keeps Senators seated that no longer process the mental facilities to properly execute their duties.

    I would also like to see no less than 25 new states formed from the biggest states in the country. Why should the little state such as Rhode Island, have more representation than Texas per capita? By splitting the Bigger states up, Chicago would no longer control Illinois, New York City, New York, Philadelphia, Pennsylvania , etc etc etc.

    So I agree with the Professor, lets change the constitution using the method provided in the Constitution!!!!!

    Maybe a six pack of shut the hell up is required here. Non experienced academics telling us their opinions with no experience or knowledge to back it up. They’ve never been in the regular work force, they’ve been teaching so long they’ve lost touch with the real working party. But our money is sure good enough isn’t it. There are women who stand on the corner who get money for their services, without all the lectures, and opinions on how we should give up our rights to the more educated elitist people. Maybe these whores of academia should just teach and not voice their in experienced opinions to any one. Or maybe quit teaching and get real jobs. Where knowledge has to be tempered with common sense, and strength and the ability to get the job finished. No time for opinions, no time for anything else other than work your **** off, and move on to the next job. It’s a shame that the smartest people or so they say they are, don’t have any god given common sense.

    IIf this uneducated liberal loser doesnt like the rules, he is welcome to leave.

    The constitution allows Americans freedom and common sense. Our Gov. is the only thing that needs to change. They cant follow the rules if they want power so they try to find ways to whine cry and complain their way around it.

    Fact is their biggest issue is that the constitution puts we the people in charge of ourselves and liberals cant control those that believe in freedom

    You know that everyone has a different way of viewing things. This person is certainly entitled to his. The part I don’t like is that he is teaching “law” and putting his spin on facts. This is exactly how you get a bunch more of already left leaning college students even further left and we wind up with the current “gimme society.”

    Seidman is an leftist plant that thinks in his position as a Professor someone might take him serious. I went to college got an excellent education, but the difference is I was taught to think for myself, notlisten and follow idiots like him. The founding fathers knew what could become of their fledgling nation and put in Law those things they could foresee becoming a problem. Lucky for us they had foresight andguts, something these leaders of today lack on both counts.

    Any parent that would send there child to today’s colleges Is about as stupid as you can get. Why not just sacrifice them on the altar of Baal such as abortion.They are nothing but communist indoctrination centers with the intent of stealing the soul of your child. That goes for public school also. If you truly love your child, Home school them or scrutinize the private institution you put them with a fine tooth comb. If we don’t break the back of liberal influence we are dead. Today we have a social war that will soon escalate to a real live civil war if we are not vigilant. America has denounced it’s God and his protection over us has been lifted and we are about to experience the darkest times in human history. Repent America and cry out to your God while there is still time. It is your only course of action!

      The Federal Government has no place in the education of the people, that should be handled at the community and local levels!

    This just goes to show that critical thinking is missing from classrooms in even the most revered universities.

    I like the statement: “Constitutional obedience has a pernicious impact on our political culture.”
    This is his opinion, and while examples could be made that demonstrate this, it would also be possible to show examples that demonstrate this statement: “Constitutional disobedience has a pernicious impact on our political culture.”

    Just because you can prove that some americans are bald, does not mean that all Americans are bald, or that all baldies are American, or that one causes the other, etc. I get SO tired of people saying things that may be true, and then trying to use that to somehow prove something that is unrelated to the larger question at hand.

    Most of all, I love these liberals standing up and saying we can just ignore the parts we don’t like. Who then gets to decide which parts we don’t like? Shall we have a vote? OK, let’s vote. Let’s say that we need at least 66% of each house of congress, and 75% of the states’ legislatures to approve ignoring a part of the constituion. Would that make everyone happy? We can then ignore whatever part we all agree on. Oh, wait, we ALREADY HAVE this process in place.

    I would EXPECT a constitutional law porfessor to KNOW that we already have a provision in place to “ignore” or change parts of the constitution.

    I guess I’m expecting too much, huh?

    Prof. Seidman unlike some of the countries you feel are superior to the U.S. Cuba, China among others we don’t have a wall around our country keeping its’ people in. You may leave at any time, we’ll stay here, in our country with our Constitution.

    It is a simple idea but to be more accurate it’s a simple minded idea. These over educated morons are the useful idiots that are indoctrinating the youth of America. They always think they have a better way to reach their utopia but it always seems the Constitution gets in their way. That’s exactly what the Constitution was designed to do. What this dopey “professor” refuses to accept is that there were visionaries 200 years ago far more intelligent than himself that realized that someday in the future nitwits would try to screw up peoples lives once again as has been done in the past.

    This guy says to get rid of the Constitution, on the other hand he says we should keep the parts he agrees with. So we should let him decide what the good parts are? What needs to be stopped is allowing the Supreme Court to rule by precedent law and to rule strictly BY the constitution. In all the amendments I have read I didn’t see anything about if we have a law that makes it constitutional so we don’t have to use the constitution to rule.

    Their is a reason why the constitution has been amended several times. Things change society is different now then it was when the constitution was written. The original constitution did not get everything right, like slavery or women’s rights. What’s wrong with modernization. Maybe we shouldn’t live our lives the way a previous society wanted us to. I certainly wouldn’t want to live in the world the original version of the constitution created.
