UPDATED: Military Vet Ordered to Remove Tiny American Flag From Patio: ‘I Saw the Flag Flying in Afghanistan, It’d Be Nice to See It Flying Here, Too’

UPDATE: Tyler Barge told TheBlaze on Friday that Riverwalk Apartments will allow him to leave his small American flag out on his patio.

“The apartment has agreed to allow the flag to remain on the patio! Riverwalk is owned by a Local Virgina based company. They were very apologetic about the whole issue and want it to be known they too support the US flag and what it stands for,” Barge wrote in an email to TheBlaze.

“I greatly appreciate all of the support that has been shown to myself and those we have lost fighting for freedom,” he added.

Tyler Barge describes himself as a proud military veteran. He was deployed to Afghanistan for nine months in 2011 where he served in the U.S. Army National Guard. He just returned home in March of 2012.

So, you can imagine his disgust when management at his apartment complex ordered him to remove the small American flag he had stuck into a pot of dirt on his patio.

“I like to keep a flag on display in honor of those who have died fighting for our freedom,” Barge, 22, told TheBlaze in an exclusive interview on Thursday. “I had the privilege of coming home and they didn’t. I try to do what I can to keep their memory alive.”

“I saw the flag flying in Afghanistan, it’d be nice to see it flying here too,” he added.

Barge said he received a notice from Riverwalk Apartments in Salem, Va. on Wednesday ordering him to remove the American flag, trash items, a broom and even a glass table from the patio.

“We need your help to keep our community one of the best in Salem! We need for you to remove the following items from your patio,” the notice read. It then listed the previously mentioned items. The notice went on:

Per our lease agreement we only allow the following times on your patio/balcony:

1. Patio furniture

2. Up to (3) working bicycles

3. Plants

The complex is giving Barge until Monday to remove the flag and other items.

As a veteran, Barge said he wanted to honor the flag, even if in a small way. He says he was well aware his lease prohibited him from hanging an American flag, so he opted to put out a small version of the flag in a pot of dirt instead. But the apartment complex is saying even that is unacceptable.

“Being a veteran and growing up with good patriotic parents, I’ve always had a flag out,” Barge told TheBlaze. “I didn’t think anything of it.”

Barge says he has served in the National Guard for nearly five years as an infantryman and is currently an E4 Specialist. He and 41 other soldiers from Virginia were deployed in June of 2011 to Uruzgan province in southern Afghanistan to provide security for a multinational provincial reconstruction team.

Given the fact that the complex has only given him until Monday to comply, Barge said his wife has been trying to get in touch with the property manager to work something out so they can leave the flag on the patio. However, the property manager, identified as Tristan Byrely by the apartment complex, was “unavailable” on Wednesday and again on Thursday.

Byrely was also unavailable when TheBlaze called the Riverwalk Apartments on Thursday.

    um, let me shed a bit of common sense here. First, they said patio furniture is acceptable. What he has out there is a glass kitchen table. What’s the difference? The glass table is breakable while patio furniture is more sturdy. Secondly, @JCLDWL….freedom of speech protects you from prosecution by the government. It does not protect you from a lease agreement with an apartment complex which you voluntarily signed. Third, simply let your lease terminate and move to a house in an area without associations and you can put whatever you damned well please on the porch. Personally, regarding only the flag, I would change the table to an actual “patio” table, put the flag on that and tell them to kiss my big white A$$ and that if that isn’t enough to terminate my lease and let me freaking leave.

      No, what he needs to do is everyday move the flag to a different place. Different windows, planters, front entrance etc. It would make them have to write letter after letter to him and would drive them crazy. I personally would love if this happened to me as I love to play games and this is one I would win.

      If thats not patio furniture I don’t know what is. I’ve seen plenty of glass patio furniture and my wife and I have been using that table for several years as such.

      One of the problems that people should take into account is that many of these managers and property landlords must enforce these agreements to the letter ( I don’t know if this is the case here), or they then become null and void when someone puts up something truly annoying. Once you allow John Doe to put up a something that violates the rules but not sensibilities, Bobby Joe can put up something that violates both rules and sensibilities. The best solution for a manger in this case is to work with the tenant to find a way for him to show reverence without encountering the problem of causing the community problems down the road with someone else.

I would love to see a story tomorrow about how they have been overwhelmed with calls and are issuing an apology! The liberals whine and cry to get their way, lets show them we can do it in a constructive way. No getting nasty with the operators or leaving vulgar comments. Let’s do it with class and respect.       I just don’t understand why these management people always go after the flag. They stick their feet in their mouth, get a ton of bad publicity, and usually cave and let the flag stay. Guess like so many other sheeple in this country, they fail to learn from history and keep making the same stupid mistakes. Hopefully the bad press does a number on the idiots running the apartment complex.

      umm, no. I have an official patio set with a glass table top. Before that, I had a camp table (the kind that rolls up and fits in a bag) with a tempered glass top on it. I have small children and it never got broke. Glass table tops are TEMPERED glass. And if you can have potted plants, why can’t you have a potted American flag? These land lords are getting to be fascists just like our government.

      If I were him, I’d just get a big ol flag and hang it inside, off the curtain rod. That way it’ll be about as prominent as can be, still be visible from outside and the apartment management can suck on it!

      To those who say the flag – the very symbol of our nation – is somehow “offensive”, are off their collective rocker! The flag represents everything GOOD about this country: freedom and liberty and opportunity. I find their attitudes “offensive”, yet I would still fight to the death protecting their right to voice them.

      It’s very sad they’re too dense, too filled with anger and hatred to understand the folly of their ways.

      Did not read all comments so not sure if already posted, from the Federal Flag Act of 2005 “SEC. 3. RIGHT TO DISPLAY THE FLAG OF THE UNITED STATES.

      A condominium association, cooperative association, or residential real estate management association may not adopt or enforce any policy, or enter into any agreement, that would restrict or prevent a member of the association from displaying the flag of the United States on residential property within the association with respect to which such member has a separate ownership interest or a right to exclusive possession or use.” It goes on to say they may impose reasonable limitations, hardly think this qualifies.

      Umm. My patio table outside has a glass top. So no he does not necessarily have a kitchen table outside. Go patio furniture shopping dude.

      Second of all management he could not hang a flag outside. They never said he could not display one. Also, they won’t win this argument, because I guarantee all the military has to do is report this apartment complex as combative towards military and they will be taken off the suggested living quarters. Don’t piss off the military.

      Sorry I don’t see any trash, but it may not be in the picture, unless they are talking about the cup planters.

      A) Any table “Patio” or “kitchen” is made of Tempered Glass, there is no difference.
      B) instead of removing his flag, Every neighbor out to stick out a tea cup with a little flag in SOLIDARITY. call it a tea cup revolt.
      It is not like he hung a banner, it is a simple little decoration. Yard Art. It is not permanently affixed.

      I would submit that if the American flag is offensive to a Muslim or to Muslims now it was offensive to them 50 years ago, 100 years ago & 200 years ago. In that case is the flag the problem or is it Islam?

      I saw the article and followed it out to the apartment complex and sent the following email: We still have free speech so I thought I and possibly others might want to give them something to read!
      I saw the article where your management was demanding a veteran remove a small AMERICAN FLAG. You do not deserve the privileges that my father, father-in-law, uncle (who died in the Philippines), husband, and son have fought for you to have. Anyone that reads or hears about this should not want to live in your “complex”. This is still the United States of America, and you should be proud of this young man and be flying the FLAG yourself. I will be honor to “share” this article through the wonderful social media and emails that we have.

      The rules state you can have up to three working bike. Buy a cheap used one & put the flag on the bike. I have seen many bikes with flags.

      The American Flag is not a religious statement. Its a representation of what it has taken so these clowns can have their apartment complex here in America. The American flag is suppose to be exempt from discrimination. This Veteran has a right to proudly display this representation of this (troubled today)wonderful country we have bled for and died for, in the name of freedom. This young man displayed a very reasonable size American Flag, not to obstruct anything, plus its not attached to the building. So, the guy planted a flag to grow, so what. I wonder if the restrictions actually include the American Flag? If I lived in Virginia or TDY at the CIA blg, I would give this place a personal visit!!

      LOL – patio furniture is not restricted to the low-end plastic crap…I myself have a large wrought-iron, glass top patio table. I am more surprised they didn’t go after the child’s beach chair in the photo.

      I hate Home Owner’s Associations and apartment leases that are too restrictive; all done ith good intentions, but seems to make enforcement nazis out of (some) people. However, if you sign the agreement you willingly give up your rights.

      Needs to work within the lease. I would get a red/white/blue pot with a plant, add the flag in it and say it is a decorative portion of the pot/display. My wife has numerous potted plants with ceramic frogs, etc., and I am sure some of his neighbors do, too, so unless all remove such decorations, the flag would stay.

      Guess he should have read his lease a little closer before signing. Sounds like management is not going after the flag so much as anything that doesn’t comply with the lease (which the tenant signed).

      Would be nice if they could work something out with the flag though.

      I think if every US Citizen living in that apartment complex put out a small flag in a flower pot to show support, then confirm their intentions to leave once they are threatened with eviction, they might actually accomplish something, The right for every Citizen to display the US Flag when they desire to. I think that in this day and age where the US Constitution has been under constant fire by some factions in the US, a 3 July flag day for all supporters of the US Constitution to bolster support to all the Citizens that are being bombarded by numerous media sources attacking on the Constitution and the Bill of Rights.

      The right to fly the flag would be covered under the Frist Amendemnt with respect to freedom of expression. Even if it weren’t in the Constitution, the right could still exist. United States Constitution, Amendment IX: The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

      I really think it is a disgrace this young Vet comes home after serving our country and is confronted by this mess. The flag is a Memorial to his fallen comrades. They paid a helluva price for that small piece of cloth and dirt. You know what? The values in this country do not exist any longer. It’s fine to to display a flag for “GAYS”. But, display the “American Flag”, how dare you. What is wrong with that picture? These Property Associations think they are God Almighty. I don’t think they should be allowed to wield this sort of power. If it ever got to court perhaps a Judge would overrule it.

      I don’t agree with the apartment complex decision, but I would not want a renter telling me what he/she can do on my property.

      Property rights first – the apartment owner has the right to prohibit how an individual uses his/her property.

      Just like an individual does not have the right to to carry a weapon onto my property, say whatever they want on my property or do whatever they want on my property. Unfortunately, the Landlord Tenant Act has given renters way too much authority over the property rights of the owners.

      People don’t use their head when emotional stories like this arise – instead of using philosophy to measure these types of incidents they use emotion. Using emotion to dictate how we should govern makes us no different than the liberal ilk.

      You are absolutely wrong. Can I bring a gun on your property? Can I come into your house and scream profanities? Can I peacefully assemble in your yard with a group of people? Can I hang a flag on your property without your consent? No!

      This was meant for “public” property, not private. If you came onto my property with a gun, you would be staring down the barrel of one. If you came on my property to use whatever speech you wanted without my consent then you would be escorted off of my property with a black eye.

      You’re wrong about the glass table. There are plenty of glass top patio tables around….. we have one that also supports an umbrella in the center of the glass top. Go to some of the box stores and you’ll see them.

      I read this in one of the earlier posts;
      from the Federal Flag Act of 2005 “SEC. 3. RIGHT TO DISPLAY THE FLAG OF THE UNITED STATES.

      A condominium association, cooperative association, or residential real estate management association may not adopt or enforce any policy, or enter into any agreement, that would restrict or prevent a member of the association from displaying the flag of the United States on residential property within the association with respect to which such member has a separate ownership interest or a right to exclusive possession or use.” It goes on to say they may impose reasonable limitations, hardly think this qualifies.

      No, they wouldn’t. The reason they can’t let an American flag go is because as soon as you bend the rules, it opens the flood gates for others to bend the rules, and even push the envelope even further. Well, if you let him fly an American flag then the Satanist across the way should be able to put up some satanic looking flag too. If the signed lease agreement isn’t stopping american flag, why should it stop satanic flag?

      I hate HOAs and the likes as much as any guy on this forums, which is why I won’t ever live anywhere that has one. He knew the rules, he saw the words on the lease agreement and signed anyways. Hang a flag inside your house that can be viewable from the outside, problem solved and you didn’t break the lease agreement.

    Check your lease and see if you can paint (with glass paint) a HUGE flag on your sliding glass door

    Better yet, get everyone in the building to fly a flag and tell management where to shove their restriction

    The complex can’t follow it’s own guidance.
    They said:
    Per our lease agreement we only allow the following times on your patio/balcony:
    1. Patio furniture
    2. Up to (3) working bicycles
    3. Plants
    The letter shown in the article wants him to remove the glass table. The glass table is patio furniture so why do they want him to remove that too?

    If the can’t follow their own rules, then they’re just making it up as they go.

    Sad that he likely can’t afford legal assistance to fight the order to remove the flag.

    So if he put a couple plants in a pot around the flag (low ones that it doesn’t touch I might add) he should be in the clear. Or he just needs to fool them into thinking it’s the rare and elusive Potted Patriot Flower. They clearly can’t tell a glass table qualifies as patio furniture so he should be able to pull it off flawlessly.
