United Nations Report Says Israels Settlements Violate Palestinians Human Rights

GENEVA (AP) — The United Nations’ first report on Israel’s overall settlement policy describes it as a “creeping annexation” of territory that clearly violates the human rights of Palestinians, and calls for Israel to immediately stop further such construction.

The report’s conclusions, revealed Thursday, are not legally binding, but they further inflame tensions between the U.N. Human Rights Council and Israel, and between Israel and the Palestinians. Israeli officials immediately denounced the report, while Palestinians pointed to it as “proof of Israel’s policy of ethnic cleansing” and its desire to undermine the possibility of a Palestinian state.

The Palestinians also hinted that they could use the report as a basis for legal action toward a war crimes prosecution.

In its report to the 47-nation council, a panel of investigators said Israel is violating international humanitarian law under the Fourth Geneva Convention, one of the treaties that establish the ground rules for what is considered humane during wartime.

This was the first thematic report on Israel’s settlements with an historical look at the government’s policy since 1967, U.N. officials said. Previous U.N. reports have taken a look at Israeli settlement policy only through the lens of a specific event, such as the 2009 war in the Gaza Strip, when Israel launched an offensive in response to months of rocket fire by the ruling Hamas militant group.

The Israeli government persists in building settlements in occupied territories claimed by Palestinians for a future state, including east Jerusalem and the West Bank, “despite all the pertinent United Nations resolutions declaring that the existence of the settlements is illegal and calling for their cessation,” the report said.

The settlements are “a mesh of construction and infrastructure leading to a creeping annexation that prevents the establishment of a contiguous and viable Palestinian State and undermines the right of the Palestinian people to self-determination,” the report concludes.

More than 500,000 Israelis already live in settlements that dot the West Bank and ring east Jerusalem, the Palestinians’ hoped-for capital. Israel annexed east Jerusalem, with its Palestinian population, immediately after capturing the territory from Jordan in 1967 and has built housing developments for Jews there, but the annexation has not been recognized internationally.

At U.N. headquarters in New York, Secretary-General Ban Ki-moon’s office released a statement saying that he “has repeatedly made his views on Israeli settlements clear. All settlement activity in the occupied Palestinian territory, including east Jerusalem, is illegal under international law. It also runs contrary to Israel’s obligations under the Road Map” for a Middle East peace settlement.

The Israeli Foreign Ministry accused the council of taking a systematically one-sided and biased approach towards Israel, with the report being merely “another unfortunate reminder” of that bias.

“The only way to resolve all pending issues between Israel and the Palestinians, including the settlements issue, is through direct negotiations without pre-conditions,” the ministry said. “Counterproductive measures – such as the report before us – will only hamper efforts to find a sustainable solution to the Israel-Palestinian conflict.”

French judge Christine Chanet, who led the panel, said Israel never cooperated with the probe, which the council ordered last March.

Because it was not authorized to investigate within Israel, Chanet said, the panel had to travel to Jordan to interview more than 50 people who spoke of the impact of the settlements, such as violence by Jewish settlers, confiscation of land and damage to olive trees that help support Palestinian families. The report also references legal opinions, other reports and a number of articles in the Israeli press.

Another panel member, Pakistani lawyer Asma Jahangir, said the settlements “seriously impinge on the self-determination of the Palestinian people,” an offense under international humanitarian law.

At a news conference, Chanet called the report “a kind of weapon for the Palestinians” if they want to take their grievances before The Hague-based International Criminal Court.

The Palestine Liberation Organization appeared to suggest it might seek such action, in a statement that called the report’s legal framework a clear indictment of Israeli policy and practice.

“All the Israeli settlement activities are illegal and considered to be war crimes according to the International Criminal Court’s Rome Statute as well as the Fourth Geneva Convention. This means that Israel is liable to prosecution,” said PLO executive committee member Hanan Ashrawi. The settlements, she added, are “clearly a form of forced transfer and a proof of Israel’s policy of ethnic cleansing.”

In November, the U.N. General Assembly recognized a state of Palestine in the West Bank, Gaza and east Jerusalem in a vote that was largely symbolic but infuriated Israel. In December, the Palestinians accused Israel of planning more “war crimes” by expanding settlements.

The Geneva-based U.N. Human Rights Council was set up in 2006 to replace a 60-year-old commission that was widely discredited as a forum dominated by nations with poor rights records. The United States finally joined the council in 2009, and U.S. State Department spokeswoman Victoria Nuland said earlier this month that while all countries should appear for their review “we also consistently registered our opposition to the council’s consistent anti-Israel bias.”

Earlier this week, Israel became the first nation to skip a review of its human rights record by the council without giving a reason. Diplomats agreed to postpone their review until later this year based on Israel’s request for a deferral.

The council, which could have proceeded with the review or canceled it, said its agreement to defer would set precedent for how to deal with any future cases of “non-cooperation.”

All 193 U.N.-member nations are required to submit to such a review every four years, and council diplomats said they worried that if a nation were let off the hook that could undermine the process.

      But, don’t expect the UN to stand up for women or LBGT. At least, not in the middle east. Only when it serves to aid in demonizing Israel and the US.

      I guess the UN doesn’t believe in human rights for women or LBGT.

      The UN sounds and acts more and more like the KKK every day. I wonder how long before we see photos of UN blue-helmets burning crosses on the front lawns of LBGTs and Jews?

      I DO have one positive thing to say about the UN, however.

      NUMERO UNO the West Bank is CONTESTED TERRITORY pending diplomatic negotiations (of which the Palestinians have been surprisingly absent)

      Second, Palestinians have just as much right to build schools, hospitals, daycares farms, greenhouses and grocery stores as the Israelis have done. But do they? Again, crickets.

      Tertiary, Palestinians have received tens of millions of dollars a year by the U.N. to rebuild their “war torn homeland”…..

      ….but do they spend it on schools, hospitals, daycares farms greenhouses and grocery stores like the Israelis do, who are not supported by the U.N.?

      No they spend the money they recieve on bombs and rockets to chuck at the Israeli daycares and hospitals, etc.

All that history that the Islamists don’t want you to know about Islam’s “Golden Age” where in 1200 years they waged over 500 battles of aggression and swept through the Middle East and obliterated everything in their path and cut out the heart of Christianity! In one such battle Khalid, a contemporary of Mohammed, cut off the head of the Zoroastrian captain and raped his wife in his blood right there on the battlefield. He had the best of teachers, Mohammed, at the Battle of Khaibar.

      Israel needs to define the borders, throw up a 12′ high wall and call it done. Treat any rocket attack or cross border incursion as an act of war and respond with 20x the force. If necessary, set up a 1km DMZ on the far side of the wall. Keep the cavemen barbarians at bay.

      On the contrary Vox, we won our wars and earned our lands through strength and determination. The Palestineans have failed in that regard, and now beg others to fight their battle for them because they lack the strength.

      A pity, if they had focused on building themselves up instead of focusing everything on destroying the Israeli’s and relying on their neighbors to do everything for them, they could have a nation that was at parity with Israel. Instead they have wasted all their effort in this foolish war which they have no hope of winning, and in desperation grovel for aid. It’s much like the child that tries to bully someone stronger than him only to get laid out, and then goes crying to teacher.

      Your sympathies are better utilized elsewhere than wasted on this cause. It will only give you heartache.

      The West Bank was but a small part of the area designated by the League of Nations for a Jewish homeland under British Mandate. After British occupation ended in 1948, it was OCCUPIED by Jordan until the 1967 Six Day War, and since then by Israel as a result of its victory in that defensive war. Israel has every right to build on their land. It’s about time.

      And by the way, I should mention that mocking God never turns out well for the mocker. You might want to open that 5,000 year old book to find out why.

      For one you are still using Wiki as a valid source but more to the point your own source admits that Arabs have equal rights under the law. All your “source” did was point out that there is discrimination within Israeli society. A second class citizen would have restricted rights under the law of the country in question, which is not the case in Israel.

      Conclusion: Your use of the term “second class citizen” is nothing more than a propaganda ploy to exaggerate the facts and is therefore highly misleading. Goebbels would be proud of his student.

      Clearly you know nothing about the issue and should shut up. Palestinians who are citizens ARE granted voting rights and even have their own political party. A Palestinian is currently serving on Israel’s supreme court and was one of three justices who upheld the conviction of a former President.

      Of course it is quite possible you simply didn’t bother to read my comment in its entirety as I clearly specified “citizens”. Palestinians who are not citizens don’t vote for the same reason illegal immigrants aren’t allowed to vote. That IS fair. Unless you think we should let Germany choose our next President.

      Most of our allies look at Israel and sees a chronic human rights abuser who is occupying a population they do not give equal rights to and is not working proactively toward peace (which the more powerful party in a conflict should do).

      But they’re brown and Muslim, so let’s not worry at all about them

      Name one country Israel attacked that hadn’t previously attacked Israel, sent troops to assist in attacking Israel, or supplied weapons to be used to attack Israel. Surely one isn’t too much to ask, right? Besides, attacking sovereign nations isn’t illegal, it’s just an internationally recognized act of war.

      When did I mention WMDs? It is a fact that Iraqi troops attacked Israel in 1948 and upon losing expelled their entire Jewish population, including communities that predate Christianity. They never signed a peace treaty, never recognized Israel, and in fact had even used WMDs against Israel (unsuccessfully). If you learned that your enemy was using a ceasefire agreement to develop nukes what would you do?

    1. The state of Israel was a wasteland with little to no inhabitation before it was settled, and the countries that it was parceled out of really didn’t want it to begin with.

    2. I dunno, maybe 6 million recent casualties to a population that has been off and on decimated by arsehole governments for going on 3000 years, maybe that doesn’t count for anything anymore?

    3. When the ‘Palestinians’ were displaced, NOBODY ELSE WANTED THEM TO BEGIN WITH. Tells you right there the color of their character, when the Quaran has a requirement for hospitality and nobody wants to show it to them.

    4. PALESTINE NEVER EXISTED. In sync with point #1, There never was a Palestine state. These people, whose lands were legally expropriated, belonged to four countries that really wanted nothing to do with them to begin with. The name Palestine is an old Roman insult, not a country.

    Every time I hear a story like this, I have to LOL. History is always such a b1tch to political agendas.

Then and only then is it a fxcking hot potato, worthy of fighting over, etcetera.
