Lesbian Couple, Gay Man Listed as Three Parents on Baby’s Birth Certificate

A Florida judge is allowing the names of three people — a gay man and two lesbians — to be included as the parents on a 23-month-old girl’s birth certificate.

According to Reuters, the decision by Miami-Dade Circuit Court Judge Antonio Marin is the end of a two year battle between the lesbian couple who used the man’s sperm to conceive the girl, but the man later wanted more of a part in the child’s life.

Here are more details surrounding the situation from Reuters:

The women, Maria Italiano, 43, and Cher Filippazzo, 38, had made several unsuccessful attempts to become parents using fertility clinics.

They then turned to Italiano’s hair dresser, Massimiliano Gerina, and asked if he would provide his sperm for artificial insemination.

“When push came to shove, they figured he would understand the situation,” said Kenneth Kaplan, an attorney for the women.

“The mistake they made, however, was there should have been a written document spelling out what his rights and responsibilities were going to be.”

The Miami-Herald reported Gerina’s lawyer Karyn Begin saying “we’re creating entirely new concepts of families.” Initially, Gerina was seeking parental rights and had Begin draw up these rights and a visitation schedule in a contract, which “they hated,” Gerina said. It was at this point, shortly after the girl was born in 2011 that they all officially went to court.

Although under Florida law sperm donors technically have not legal rights to the children they help father, the judge ultimately decided the two women will have sole parenting rights, but Gerina will be allowed some visitation twice a week for the next two years.

“The mothers are in charge. I’m just going to spend time with her. They are the parents,” Gerina said, according to the Miami Herald.

The mothers seem to agree that the arrangement could benefit the toddler.

“We’re trying to do the right thing for Emma,” Filippazzo said according to Reuters. “We want Emma to have it all, and we believe by doing it this way, including him in a birthday or Thanksgiving, it’ll be a nice addition for her.”

Lawyers involved said many of these legal issues could have been avoided if all parties involved had discussed the implications and drew up a legal contract before the child was conceived.

Scientific research has also shown a baby could be made with the DNA of three parents, which could call into question the three parent birth certificate issue again someday as well.

Sorry folks, but the baby has 1 father and 1 mother. Unless they did some very complicated genetic manipulation, the baby only has DNA from one male and one female. You can marry a whole tribe of other people, but the fact remains. 1 Daddy. 1 Mommy.

Since when do judges pose for pictures with litigants in a case?? A judge is supposed to be an impartial arbiter of the law. The picture indicates this so-called judge was more focused on publicity or making a “social statement” instead of making a ruling based on law.

Surprised he had to fight such a lengthy court battle at all considering there have been cases of sperm donors being held responsible for child support payments when they wanted nothing to do with the child in the first place.

It’s one thing to be gay, but to be allowed to bring up chlidren by this method is evil, and God is watching…..You play with science and unGodly practicies, and you will feel the consequences. An identical ” couple ” in, I think, Missouri produced an infant girl using a male donar. Four years into the child’s short life, the ” Moms ” fell on hard financial times and sued the male donor for Financial Support of the child. The case is in the courts. Having children is a life committment of love, hard work and sacrifice. Guys – have your own children with a life partner according to God’s perfect plan and refuse to be a donar.

Jon Stewart (Stuart? who cares) was just ‘lampooning’ the idea argued by Republicans that gay marriage be equated to polygamy or bestiality or incest, and here, the radicals on the FRINGE of LGBT community insist on proving the Right correct.

‘redefining the idea of family?’ no, just corrupting it, and providing the lawyers with ample new clients when the ‘family’ dissolves… more places poor kids will have to be shuttled about, more uncertainty they will absorb.

It’s sick, that instead of being content to push for ‘equal’ treatment, even with a different name, there are those out there who insist that their far fringe interpretation of social interaction and what is appropriate be made mainstream.

the country has no shame, no grace, and no common sense, any longer.

and when the backlash PREVENTS acceptance of same sex unions and perpetuates bias it will NOT be the fault of Republican politicians or ‘closed minded’ American men and women, but the fools in their own sub culture who want to rub the country’s nose in a patently ridiculous notion of what is moral/ right/ normal.

I’m a senior software architect in Human Resource at one of the largest corporations in the world. Do you have any clue how much money and how long it will take to upgrade computer systems to allow for three parents in dependent management applications, healthcare applications, geneology databases and so on?

How do we rewrite these applications? How many parents do we allow for? Do we need to create an entirely new classification of birth parent?
