Many housing developments have homeowners associations (HOA) that impose strict rules and regulations. While some of the stipulations seem silly, abiding by them is a necessity for those who wish to live within these groups’ bounds. A Fairfax, Va., family learned this lesson after they posted a yard sign in support of Barack Obama’s 2008 presidential run and the board ruled that it violated HOA standards. What resulted was an epic legal battle between the Farran family and the housing authority — one that inevitably led the board to bankruptcy, splintering the community and creating ongoing division among its residents.
While there is certainly no ban on the placement of political signs at Olde Belhaven, the development at the center of the debate, the placard that was posted by Sam and Maria Farran was four inches taller than allowed by the rules and regulations. When the board approached the family in the heat of the highly-contentious election season and told them to remove the Obama sign, the Farrans decided to simply cut the placard in half, with one side reading “OBA” and the other reading “MA.”
The couple knew that their signs were too large, but they felt that the attack was, more than anything else, an assault on free speech. As they doubled-down with their sign-cutting prank, the board, too, geared up for a fight. After passing a rule that residents in violation of HOA policies could be fined up to $900.00, the situation intensified.

The Farrans believed that the fining action was illegal, however HOA leaders held that they were entirely within their bounds to take such action against the family. After the fine was levied and the board subsequently rejected the family’s proposed deck and roof projects, Sam and Marcia decided to take action. They sued, arguing that the fines were not legal and that the projects they proposed were rejected out of retaliation over the Obama sign debacle.
“It’s like we weren’t living in America,” Maria told the Washington Post. “You are always one board election away from a tyranny. They wield enormous power.”

The Farrans said HOA backers told them to move. They found bullets in their yard. Someone implored a priest at their church to prevail on the Farrans to stop the lawsuit. A local real estate agent said the infighting was scaring off some home buyers.
“It was a crusade,” a supporter of the Farrans said.
On the other side, board members said that the Farrans were unreasonable and that they declined numerous offers to begin settlement discussions. And as the case ground on, the HOA increased dues from $650 a year to about $3,500, mostly to cover legal fees.
The board’s former president, Jim LeBlanc, said the situation put a strain on some elderly residents living on fixed incomes. “Some had their health impacted,” LeBlanc said. “There’s a sense of, what is it going to take to resolve this? This was a tragic nightmare.”
Of course, there are two sides to every story. Just as the HOA claims to made attempts to settle, so do the Farrans. Both sides clearly believed that they were in the right, though, leaving little room for negotiation and agreement. The stalemate brought the entire community into the ugly battle — one that has financially-ruined the HOA.
In 2010, the Farrans won their case surrounding the fines and in 2011, a judge ruled that the decision to reject the deck and roof was improper, because the determination was made at a closed meeting that didn’t follow protocol. In the end, the HOA was forced to pay the Farrans’ legal fees as well as hundreds of thousands of their own court costs. To settle these debts and stay afloat, the HOA has been forced to put the community square, land where residents would gather to celebrate holidays and have picnics, up for sale.
Currently, the sale of this land is up in the air and the board is in bankruptcy. Residents hope that a sense of community will return, but, for now, the debate that was sparked over an Obama yard sign has left Olde Belhaven fractured.

No tears for the HOA that has to pay their own legal fees or auction the land–too freakin bad! You shouldn’t have turned it into a retaliation by denying their roof project out of spite.
People will stand up for freedom of speech more and more in the years to come. The battle that we thought we’d never have to fight again since the fathers founded this country is fresh again, and I dare say will probably be bathed in blood again too as it was then. Some things are worth dying for though.

Feb. 11, 2013 at 1:26pmI live in a subdivision where there is an HOA. I chose to live here an knew there was an HOA upfront. Part of our rules state no signs of any nature unless its a “For Sale” sign. If you want to show support for a candidate, buy a bumper sticker!

Feb. 11, 2013 at 1:09pmMy neighborhood has an HOA. It cost $15/year if you decide you want to pay. That money goes for a newsletter that’s put out about 6 times a year. The rest goes to a college fund for one lucky kid in the development. The rest of the time the HOA gets together and has dinner parties and “meetings” that are nothing more than an excuse to get together and have a few drinks. Occasionally the will have a topic of discussion that is a concern and invite a local politician or police representative.
Other than that, ain’t a whole lot to it. Paint your house whatever color you like, take care of your house or don’t, that’s on you. The freaking taxes are so high in NJ it keeps a lot of people away that tend to allow their homes to fall into disrepair. The overbearing township ordinances are enough for any person to bear.

A developer and/or real Estate Agent is supposed to give you a copy of the rules and regulation before you buy the house(maybe after) but it is up to the home buyer to investigate before making a contract. New rules need to be discussed and voted on by the residents. Whether the HOA was right or not they are now bankrupt! Take your pick.

Feb. 11, 2013 at 12:42pmThis is what always happens in disputes with HOAs. They have no legal authority to enforce any of their rules. Unless people follow them voluntarily they really can’t do anything. Besides most HOA aren’t even legitimate anyway. Most of them were formed through manufactured consent which makes them illegitimate. A real HOA contract has to be voluntarily signed and only governs the homeowners that signed it. Mandatory contracts required to be signed by a developer in order to purchase a house are not legitimate.

Feb. 11, 2013 at 12:26pmIt’s regretful to come to side with people who voted for obama. But many HOAs out there (too many) are run by people with a host of authority complexes and live for those moments where they can force others to comply with some kind of rule.
It’s ridiculous that this HOA wanted these people to take down their obama sign in what was the most important presidential election of our time. That this HOA could not appreciate that fact and put their own rules above it shows that they are small and petty.
The left is always trying to silence those who oppose them. If we do the same, then we become like them. In any case, I could never lose any sleep over the bankruptcy of an HOA – they are a haughty industry and could use some humbling.

Feb. 11, 2013 at 12:22pmLook people, I live in a neighborhood that has an HOA and to be honest, some of their rules piss me off to no end, however, when you decided to move into the neighborhood, you accepted all of their rules. Problem is , you get a bunch of retired liberals that want to make rules that nitpick every little thing, at least down south we do. The only option is for me to join the board and try and change those rules, or move out of the neighborhood. You are responsible for your own actions people.

Feb. 11, 2013 at 12:21pmFor me I would not live in a HOA but if I made the choice to live in one. I would be expected to abide by the rules. It makes me scratch my head, you drive down the road and speed you take your chances and if you get caught and get a ticket you pay the price. You dont think the law is correct you lobby to get it changed. Some folks in our culture believe they are above or beyond the law. I dont like that rule, I will ignore it. In this story the folks who broke the rule freely admit they were wrong. Why would you break a rule knowingly and willingly and then get bent out of shape when you get called on it? Would you let your children do it, your spouse, a person who steals your property? Seems pretty simple to me, break the rules you pay the price. The fact these folks got off scott free shows just how messed up our legal system is.
I see a lot about how bad HOA are, but in the anger towards HOAs. It appears that the basic reality of follow the rules regardless if you like them or not. Seems lost here…..

The hate in this country is becoming so common place and out of control it is hard to believe.
At least in this case, the HOA took it on the chin.
I always wondered why anyone needed to have someone tell them how to live, but it seems the wave of the future for all the younger generations. They have to have someone take care of them.
So what is different between the HOA in this case and our Federal Government, except the HOA is down to having to sell the home owner’s property, where if it had been the Feds, they would just borrow more money or use the tax payers taxes and keep on suing.

Feb. 11, 2013 at 11:43amYes, I have had my battle with our HOA. Just be sure you are within the State law (Our state) and you can be sure that the HOA officers are not acting within that law. Then stand your ground and let the HOA sue you (if they are so stupid!). It is so nice to be left alone. My only action is to write a letter each year to send along with my dues, stating that the officers are personally liable for their actions which are not within the State law. I no longer have to justify the way I live! I may be poison to my neighbors but I am surely left alone and I can relax and let those HOA officers sweat! NICE!!

Feb. 11, 2013 at 11:42amFor all you people who have trouble with reading and have commented “they knew and agreed to the rules when they signed up to live there” you are missing the entire story. The HOA CHANGED and went beyond the scope of its covenants when tried to fine them and put a lien on their property. That is the issue. I would argue this is the correct response when someone or organization tries to put an illegal lien on your PROPERTY. As a conservative site – everyone here should support the homeowners.
The reason everyone here doesn’t is the exact same reason the country and the gop is in trouble. Babyboomers – who make up vast majority or HOA board members – are clueless and think they can tell everyone what to do. The covenants are like the constitution – that is what owners agree to – they don’t agree to be held hostage to the whim of boards that are elected every year or so.
This is a great victory for PROPERTY RIGHTS. And I would never support Obama or anyone like him but that isn’t the point of this.

All that had o be done was replace the sign with one of proper size and some how its tyranny becase the people of both parties couldnt handle this like responsible reasonable adults. For the love of all that is holy people get your priorites straight. There is alot more to worry about than things like this.

These people knew the rules before they moved in. Why do this?

While I don’t like the sign (and I doubt I would like the brainless fools who posted it), I respect the rights of the people to place that sign in their lawn…
Cause hey, If my neighbors want to advertise that their brains are nearly non-functional, power to them…
