Missouri Dems Introduce Alarming Gun Confiscation Bill

Democrats in Missouri introduced startling anti-gun legislation that would require gun owners to hand over their legally purchased so-called “assault weapons”  to “the appropriate law enforcement agency for destruction” within 90 days.

Under the proposed bill, “Any person who, prior to the effective date of this law, was legally in possession of an assault weapon or large capacity magazine shall have ninety days from such effective date to do any of the following without being subject to prosecution.”

Here are some additional provisions found in the gun control bill:

(1) Remove the assault weapon or large capacity magazine from the state of Missouri;

(2) Render the assault weapon permanently inoperable; or

(3) Surrender the assault weapon or large capacity magazine to the appropriate law enforcement agency for destruction, subject to specific agency regulations.

5. Unlawful manufacture, import, possession, purchase, sale, or transfer of an assault weapon or a large capacity magazine is a class C felony.

So essentially the law would turn a law-abiding gun owner today, into a felon tomorrow.

State Reps. Rory Ellinger (D-86) and Jill Schupp (D-88) reportedly introduced the anti-gun legislation, House Bill 545, this week.

Gun confiscation is being talked about more and more by lawmakers as a means to get so-called “assault weapons,” which are really semi-automatic rifles, off the streets. Democrats in California last week also proposed legislation that called for the potential confiscation of the state’s 166,000 legally purchased semi-automatic rifles.

California Senate President Pro Tem Darrell Steinberg (D-Sacramento) defended the massive gun control package, saying “we can save lives.”

    The story would have been more complete with 5 minutes of research on the current makeup of the Missouri house. Republican controlled, btw. I doubt this will even come to a vote.

      It does not matter if it comes to vote. When people pull back their mask everyone should look. Everyone across the US should look at the body of information from NY CA and MI and know that Democrats want to take away the right of US gun ownership.

      What is funny is that even if they could get it past they actually think anyone would pay attention to it. See that’s the thing with Progressive Liberal’s….they think they are always the smartest people in the room. What happens after 90 days….hmmmm.       you are right we have a super veto proof majority here in Missouri,we can pass law without the govenors signature,,the discusting thing these democrat liberals are doing is rallying there liberal base to keep them in a job when the mid terms elections begin in 2014,,all they are doing is marketing a bunch of dead kids to get more votes and that all ,,they are discusting and it will cost more of them thier jobs next year.Missouri overrode Jay Nixons veto to regain our right to carry a gun and it also eliminated hand gun permits,,its cash and carry here in Missouri now on hand guns.

      The GOP in the state should pass it. Seriously. It would cause SCOTUS to hear it immediately due to the chaos it would cause. Then we would get a definitive pro 2nd amendment ruling forever. I say call their bluff and pass it.

      In retribution the Missouri Legislature should pass a no restriction bill. Legalize machine guns (yes real ones) as long as they are made, and purchased by Missouri Citizens, and are not transported outside the State.

      This is just politics. They know crap like this will never pass and if it did, it would get kicked in the ass almost immediately in the courts for being unconstitutional. I would argue the Feinstein national bill is much the same. They can’t even get it to pass in the Senate, much less the house. The point is to get Republicans to vote against semi automatic rifles bans so that next shooting which will inevitably occur, Democrats can dance on the corpses of the victims to score cheap political points and say “see see?! Republicans want children to die! If only we had a ban on guns!”

      How many more Aurora or Sandy Hook incidents do you think it’ll take before legislation like this will not only be brought up for a vote, but passed, even if just barely, into law?

      Fact is, I think these incidents are reasons to have a better and more armed citizenry, but that isn’t going to be the discussion most people hear. When this happens again, and it will because it will always happen again regardless of ANYTHING we do, all of the politicians will be saying it is the conservative right’s fault, and many on the right will begin to concede. It’s only a matter of time.

      Actions and proposals like the one in this article is so that these dbags can hold over people’s heads later and say we told you so and blame the killings on the representatives who voted legislation like this down.

      2nd Amendment….shall not be infringed….
      4th Amendment….shall not take property…
      5th Amendment….shall not incriminate self….
      Section 9. “Powers denied to the Federal Government (and logically to the States); ….note item c. “No bill of attainder or ex post facto law shall be passed.”

      My gun is my property. It was legal when I bought it so it is still legal.

      Every State except: California, Iowa, Maryland, Minnesota, new jersey, and new York have a section under Bill of Rights in their State Constitution: Right to Bear Arms – most go further then the USC 2nd Amendment by clarifying our right to Bear Arms to Protect Ourselves.

      Now, any legislation that infringes on your Rights Granted by your State Constitution must be put to a vote of the people to amend the article and section of the State Constitution. Any elected official who votes a “YEA” for a law that infringes on your Rights Granted to you by your State Constitution can be charged with Perjury, not Treason.

      the problem I find is that a lot of people do not know the Rights Granted to them on a State Level. Please, look up your State Constitution and contact your local representative. Remind him that he represents his constituents and not the democratic party.

      The point is not to pass this bill today. Rather this is a common long game information operations strategy to slowly shift the barriers, offer the seemingly absurd now so ‘less absurd’ restrictions seem more ‘reasonable’ and then over time the constant slow beat in the background makes the ridiculous seem an option.

      E.g. Homosexual marriage, legalized drugs, cradle to grave welfare, institutionalize racism against us evil white men,…

      Everyone reading this that was going to Branson in the next few months call and cancel your reservations like I just did. We were going mid March and then I was to reserve for mid April. Those folks asked me why and I told them that if they were going to elect idiots like this I needed to spend my money elsewhere. We decided to go to San Antonio next month and the visit all the museums in Tulsa + The Phillips museum in April.

      Your comments are very true, for the most part Missouri is very conservative (Republican), but we do have a couple of wack-a-do’s in in administration. This starts with Jay Nixon our democrat governor, who talks like he’s in the middle but pushes hard to the left, and proceeds to other state offices and a lot of democratic representation from K.C. and St. Louis. This bill won’t go anywhere but apparently the sponsors are thinking they’ll get brownie point from someone (most like Obama and his cronies).

      I think if this passed it wouldn’t get many guns even from the people who owned them legally. Even if they traced mine Fred jones in some other county bought it and here is the receipt I got signed to clear myself in case it showed up as an orphan at a crime scene.

      What it all boils down to is, Law abiding American gun owners are going to have to get used to being outlaws.
      This is something I have been struggling with, as I have spent my life being essentially a rule follower. Now that the rules are changing and are not in alignment with common sense I am having to prepare mentally to be a breaker.
      Any citizen who does not own a firearm is a slave-in-waiting. The only American Citizens are the ones that are armed and ready to defend liberty.

      You are missing the point. It doesn’t matter if it would come to a vote or not because the house is controlled by Republicans in Missouri. The point its to show that this is what progressives are all about doing and if you give them power it will happen. I might not happen today because there are enough republicans to stop it but what about next time if the power shifts in their favor? You can bet it will come up again and probably get rammed through that time. The article is meant to make people aware of what these people are all about. You and I may know that already but you can’t assume that everyone that comes to this site or reads that article are fully awake.

      Maybe this won’t pass in Missouri, but many Minnesota Democrats are pushing for the same language in our state where we have Democrats controlling both Legislative houses AND the governor’s office. So there’s a good chance this kind of law could be in affect for us and create felons out of many law-abiding, responsible people.

      Oh this will come to a vote I believe, in their next election cycle up there, when the DEMS there pay for even bringing it up. Generally speaking, I hope the Dems/Libs push really really hard on all of this between now and 14. They are on the move, and seem unstoppable. This one issue could bring their entire little party to a crashing halt. Stealing a national election for one post is a lot easier than stealing every congressional seat race in the nation.

If the weapons were already purchased legally and they were legal to own they can’t pass a law stating they are illegal now.       Ever since Obama became president we have heard more about taking our guns away than any other subject or, at least it seems that way. I don’t think anyone needs a weapon that will shoot hundreds of rounds at a time. These are meant for law and military. But we all have the right to protect ourselves and/or hunt as allowed. We all must continue to fight for our rights.

      A couple of thoughts on this bill. The first is that it should be renamed to “THE CREATE A DUAL BETWEEN LAW ABIDING CITIZENS AND LAW ENFORCEMENT ACT.” Second thought is if this passes, then legal citizens and law enforcement are bound to get killed. After all, never since the American Revolution has the words LIVE FREE OR DIE meant more. The third thought is, when someone mentioned that the Republicans have a bulletproof majority, is to pass a law making a criminal out of anyone who represents any of the people of Missouri to vote for legislation restricting the 2nd Amendment and the people’s rights to bear arms. Oh, and make it a felony to do so with the immediate loss of their status as an elected official. That should take care of the matter. It would stop the Socialists from taking over the State of Missouri.

      You may feel safe in a State with a Republican majority. But what about Amercan Citizens living in states with DEMOCRAT majorities? I think that’s the point. Democrats think the Constitution doesn’t matter… Democrats think they can get away with this ANYWHERE… even Missouri.

      play by punching a person in the face and if they don’t knockout the victim they kick and punch them

      Colorado’s state assembly (House of Representatives) looking today to:

      1. Limit magazine capacity to 15 rounds, (Magpul has indicated they may cease operations here and set up shop elsewhere).
      2. Ban concealed carry on college campus, apparently they didn’t learn from Virginia Tech. Apparently they think our Constitutional rights end when we walk onto the campus supported by tax dollars.
      3. Require universal background checks for all firearm transactions.
      4. A tax on gun sales, to pay for the huge number of transactions currently taking place.

      Call the Colorado capitol switchboard to let your opinion be known, 303-866-2904. The Democrats control the State House, Senate, and Governor’s seat. We are screwed. Hunters and anglers combined contribute approximately 1.2 Billion dollars to the state’s economy, and 21,000 jobs. Wanna guess what will happen to those numbers if these and other infringements are enacted?

      Below is a link to the Governor’s Office. It has phone, fax, and an email link directly to the Governor. I am asking each of you to POLITELY contact the Governor and point out the numbers from my comment above. ALSO, you can mention that if these actions are taken you will not feel inclined to: hunt, fish, ski, or vacation in Colorado. Nor will you feel inclined to consume products produced in Colorado, etc.

We have sheriffs and police all over the state who say they will not follow any state or federal order to confiscate guns against our Constitutional (both federal and state) rights. Further, we have a republican controlled legislature. Glenn, we were conservatives in Missouri before you ever thought of going to Texas, so don’t tell us about what is going to happen in Missouri.       I live in Missouri. I grew up here. These are idiot liberal democrats from the St. Louis area in the 82nd and 86th districts and they can keep their BS in St. Louis.

      I’m really sick and tired of people in crap hole cities trying to destroy the rest of the country because their cities are so screwed up, while at the same time declaring it’s the rest of the country. We don’t have these problems out here in the country.

      This is the same city Senator Maria Chappelle-Nadal of district 14, another idiot democrat, comes from. She is trying to pass a law (SB 124) that “…creates the offense of negligent storage of a firearm” and “…requires a parent or guardian to notify a school district, or the governing body of a private or charter school, that he or she owns a firearm within 30 days of enrolling the child in school or becoming the owner of a firearm.” In other words, if your guns are not locked in a safe and you don’t tell the school you have a gun, you are suddenly a criminal.

      Thankfully, none of these will pass.

      J-Man, the authorites can only ask for your driver’s license if you are operating a motor vehicle on public roads. If they don’t have reasonable suspicion of a crime then verbally identifying yourself is perfectly acceptable.

      Boarder Patrol agents can ask for your proof of citizenship if you are within 100 miles of the boarder. But unless they have reasonable suspicion that you are in the country illegally, the only thing they can do is ask. You are free to tell them to go piss up a rope.

      Since Democrats are so insistent on destroying the second amendment, the way best way for the Republicans to put a permanent end to this stupidity is to pass the law with one, and only one, amendment. That amendment is to give the Dems what they want, but ONLY in respect to other dems. Simply make the laws such that they ONLY apply to Dems. In other words, since the Dem voters seem to want their guns to be banned, ban their guns. Most violent crime in this country is committed by Democrats anyway, so preventing them from owning guns would save lives. See how many Dem voters switch parties when they are forced to hand over their possessions.

      Constitutionally, any confiscation measure, and the punishment for resisting it would be a violation of Ex Post Facto, in essence, you can’t punish people for breaking a law if no law was in effect when the did the act in question. It is easy to make the argument that the weapon was purchased when it was legal to do so, and therefore you cannot punish someone for it. And if you want to go the legal route of “possession” similar to laws regarding drugs, prepare for a legal shite storm.

      Of course, since when have these bozos been obstructed by the Constitution?

      Truth of the matter is, I don’t think this has a chance of moving forward. But it is a red flag that they are getting bolder, and moving deeper into territory that we never thought they would touch. It is possible that they are simply probing to get a taste of how far they can go, but I believe that we need to assume the worst here, that they are preparing for a massive ideological and legal offensive (much worse than anything we’ve seen so far, even the ongoing efforts by CNN) on the Second Amendment and Gun ownership in general.

      A state’s constitution does not trump the federal Constitution. Missouri could amend their constitution to reinstate slavery and it would still be illegal. All that means is that no one has challenged Missouri’s law in SCOTUS yet.

      Actually the Constitutions states that whatever powers are not specifically given to the fed govt, over the state govt, (which are plainly outlined also as taxes, creating money and a few other powers that do not effect our gun ownership rights) are specifically left to the discretion of the states. The Constitution writers knew too much power in the hands of the fed govt was dangerous, so specifically designed our system so that the states actually have all of the power. They give power to the fed govt only when they voluntarily cede their rights to the feds to decide, otherwise the power to make laws concerning the states remains in the hands of the states. So until the states agree to let the fed govt take away their power of deciding whether they can own guns, the fed govt cannot create any gun ownership law or ban that will trump the authority of the states laws regarding it. Basically if the feds say all guns in US are banned, but all states say no they’re not, the feds cannot enforce the unconstitutional law in the states.

    The story would have been more complete with a little research on the current makeup of the Missouri house of representatives… Just saying. It’s republican controlled so there is little chance of the bill actually passing. probably won’t even be voted on. But the Blaze can’t raise enough panic if they include all these details…

    Some would say that the ideology of the 2 Amendment no longer applies today. An example in California, just earlier this week a rouge ex-police-officer was sought for multiple murders. On three different occasions the police opened fired on civilians, no verbal commands, just ambush and open fired. Two women delivering newspapers early in the morning, Truck? the wrong make and model. Plates? did not match. Occupants? the police did not identify. The police just open fired and pummeled them with fifty rounds of ammunition. Is not the citizen permitted to maintain sufficient armament to protect his or her own life? Whether it be to protect against an officer’s inept actions, or it be of the evil intent of a perpetrator, or it be to stave off a tyrannical government. THE CITIZEN HAS THE RIGHT to maintain sufficient armament to guarantee the advantage. The citizen is to be afforded this advantage not the government.

    Look at history, study the political climates they faced then and how it mirrors what we face today. We find that the level of wanted counteraction and necessity of resistance seems to coincide to the severity of oppression. The African had no firearms, they became slaves. The Jew had firearms confiscated and the perceived threat to the ruling government mandated the Jews extermination.

      Or from the side. Don’t think that once this gets out that they are confiscating that people will sit idly by as their neighbors are murdered by the State. They would also have to probably use LEOs from out of state, because most of these LEOs have family that live in the community.

    This will never pass. These two idiots are in a very small minority in the Missouri legislature. Local LEO and PDs as well as the majority of the legislature will not support this.       Folk really don’t know about the history of Missouri, when it comes to riots. In fact just about 100 years ago, Missourians rioted in the streets over jobs and such, killings and beatings were very common around St. Louis and nearby areas during the time. If there was ever a state that lived by it’s motto, it’s Missouri. I can’t imagine Missouri becoming a Zombie state for Democrats all of a sudden, especially since there are a lot of hunters running about on a yearly basis. If that bill does somehow magically pass, head for Arkansas or Kansas. It’s that or go down shooting.

      I’ll trust people who know more about the Missouri legislature to answer your question but the very fact that this bill has been introduced is alarming.
      To me it means the left is testing the waters. What kind of response will be raised and by whom.

      If even one state, even a predominately Democratic state, ever passes such a bill Obama and gang will run with it. They probably have the confiscation EO already written, signed and loaded in the teleprompter.

      DARMOK, I hope that you are right and this happens again nationwide like it did in ’94. Brady I and II played a major role in the Dems losing the House and Senate that year for the first time in over forty years. Hopefully, the attacks in these states will result in the same thing. As the Dem-wits were taken over by the radical left in our state we started to oust them and send them packing. Their actions have come close to exterminating their party here, and this was all Dems from Post Reconstruction to the late ’80s. The people here were just stuck on what the Republicans supposedly did to them after the Civil War. They finally learned that it was what the Dems had been doing for over a hundred years. After living in Upstate, NY and going shooting with many of the residents in the area, and knowing how they feel on this subject. I can see even some minor changes in their state’s political face.

      DARMOK, Good luck on that. If things keep going the way they are here, although the Dems are kicking and screaming all the way. We’ll have only certain pockets with a minor Dem stranglehold in places like Birmingham, Montgomery, and few other more minor cities, and communities.
      You guys need to run many of the Californians back to California. I’m so glad that my parents got us out of there back in the mid to late ’50s. We still have relatives out there and they really worry me at times.
