Proposed Gun Law in Washington State Calls on Police to Inspect the Homes of So Called Assault Weapon Owners

With each proposed anti-gun bill put forth by Democrats across the U.S., the demands appear to be getting more and more restrictive on gun owners. While the Obama administration pushes for a ban on so-called “assault weapons” and universal background checks, Democrats in both California and Missouri have proposed legislation that would result in possible confiscation of semi-automatic rifles.

Now, Democratic lawmakers in Olympia, Wash. last week introduced legislation that would allow county sheriffs to inspect the homes of semi-automatic rifle owners once a year. Seattle Times columnist Danny Westneat describes the move as “Orwellian.”

The proposed bill, Senate Bill 5737, would ban the sale of semi-automatic weapons that use detachable magazines and magazines that contain more than 10 rounds. It would also subject law-abiding gun owners to random searches by a county sheriff.

“In order to continue to possess an assault weapon that was legally possessed on the effective date of this section, the person possessing shall … safely and securely store the assault weapon. The sheriff of the county may, no more than once per year, conduct an inspection to ensure compliance with this subsection,” the bill states.

“They always say, we’ll never go house to house to take your guns away. But then you see this, and you have to wonder,” Seattle trial lawyer Lance Palmer told the Seattle Times.

“I’m a liberal Democrat — I’ve voted for only one Republican in my life,” Palmer added. “But now I understand why my right-wing opponents worry about having to fight a government takeover.”

He also said it’s this type of radical bill that “drives people into the arms of the NRA.”

One of the bill’s sponsors, State Sen. Adam Kline (D-Seattle), told the Seattle Times that he didn’t properly vet the bill prior to jumping on board. He claims he didn’t realize the bill authorized police searches.

“I made a mistake,” he said. “I frankly should have vetted this more closely.”

The legislation’s main sponsor, Sen. Ed Murray (D-Seattle) also blasted the search provision written in his bill, saying it is likely unconstitutional.

“I have to admit that shouldn’t be in there,” he said.

Murray also explained that an assault weapons ban isn’t likely to pass anyhow and the bill was intended to be a blueprint for gun legislation in the future. With the search provision included, the bill has very little chance of passing.

It wasn’t immediately clear which lawmaker wrote the search provision into the bill.

UPDATE: Following up on a tip from a reader, TheBlaze has discovered that Democrats in Minnesota are also pushing for a gun confiscation bill using almost identical language as the bill proposed in Missouri.

10.20 Sec. 7. PERSONS POSSESSING ASSAULT WEAPONS ON EFFECTIVE DATE ACT; REQUIRED ACTIONS.

Any person who, on February 1, 2013, legally owns or is in possession of an assault weapon has until September 1, 2013, to do any of the following without being subject to
prosecution under Minnesota Statutes, section 624.7133:

(1) remove the weapon from the state;

(2) surrender the weapon to a law enforcement agency for destruction;

(3) render the weapon permanently inoperable; or

(4) if eligible, register the weapon as provided in Minnesota Statutes, section 624.7133, subdivision 5.

EFFECTIVE DATE.This section is effective the day following final enactment.

    But what if a “Christopher Dorner” shows up to “inspect” my home?
    (Not implying all law enforcement is corrupt..in fact, I work along side daily & talk with many patriots within WA Law enforcement)

    No, I would rather have the privacy that our 4th Amendment “Right” guarantees… which insures that my 2nd amendment “Right” is not infringed upon…
    Oh, but many do not like me (not implying any of my FB friends) expressing my 1st amendment “Right” to explain why.

    Thomas Jefferson, Abe Lincoln & MLK would be turning over in their graves if they saw what some control freaks are trying to do. There is a reason we (western world) have peace.

    I would be amazed if this makes it out to a vote …
    but I have been shocked before… here in Washington.

    Today on Glenn’s radio show, he implied – no, he stated – that California is responsible for liberalism in Washington State and Colorado. Sorry, Glenn. You are wrong. Washington and Colorado became liberal all on their own. I am really tired of Glenn (and many Blaze readers) bashing California. I’ve lived in California all my life. It is not as liberal as the conservative media has made it out to be. Yes, most here are liberal, but not everyone is. I personally know far more conservatives than liberals – and I used to be a liberal. Sorry Glenn for the rant, but you may have visited California once or twice in the last couple of years. You don’t really know what you are talking about on this issue. California is far more than Hollywood and San Francisco.

    BTW, Texas isn’t as great as Glenn makes it out to be – that comes from personal experience and family that lives in Texas. Sorry, Texans, but it is the truth. Neither California nor Texas is as bad or good as Glenn wants them to be.

    Having lived in the Seattle area for over 30 years before escaping I can say that in that time it went from being a liberal place to about as far left as it could be. A Seattle Demorat is just as far left as the ones in NY, IL, or Kalifornia. They knew there were search provisions in this bill and figured that they could slide it through without anyone noticing.

    I believe that any Demorat who owns a computer, smart phone, or any other device that allows connection to the internet needs to have them registered and their homes searched twice a year.

    Not to mention the fact that all of these bills violate the 4th Amendment. Not that these guys even KNOW what that is, but it is a direct assault, pun intended, of that part of the Bill of Rights. Not the one proposed by another loon, FDR, but the one written by the Founders.

    When the time comes to take up arms to finally put a stop to the tyranny, corruption, socialism and degradation of this nation…please do not stop until all this liberal mess has been wiped clean and the slate completely cleared…at that time elect legislatures and adjust laws so that this NEVER happens again in the lifetime of our great, great, great, great, great grandchildren. Legislation that requires strict adherence to the U.S. Constitution is the only way to go. 240 years isn’t old. Long live the Republic for another 240!

    We need to pressure the big gun manufactures into NOT selling to those states and even our military. Liberals crush their enemies so it’s time to learn to play their game and use it on them. I NEVER thought I would own guns and in the past two months have purchased the limit allowed in my state. I’m already listed as a terrorist for being at a Tea Party Event… But when I stocked my cellar with emergency food my next door neighbor (Local democrat commissioner) made it very clear that if needed he would help himself. I can’t wait for the weather to get nice so I can show him pictures of my gun collection. Or will democrats outlaw pictures of guns too????

    It is not unreasonable for the elite to search our homes. What is needed, however, is an amendment that allows any taxpayer, at any time or day, to search the homes of our elected representatives. We need to know if they are harboring armaments. We also need to know what medications they are on. If they can invade our privacy, we can invade theirs.

    Im ready for this political age to done and over with. I mean he didnt even read the bill properly! Or he says he didnt – either way he still looks bad. He should be fired for admitting his laziness with legislation. But ya “we” wont do anything. Most people dont care now a days…but they will start to care when they realize half their paycheck is now in Obamas pocket on a golf course.

    Warrant and probable Cause My AZZ.

    Have you ever been stopped by armed men asked for you papers while they took their flashlight and searched your car, checked your inspection and county stickers, checked your seat belt was buckeled, and checked that your kids if under XYZ weight were in a carseat? We in the USA have not been “SECURE IN OUR PERSONS” for quite sometime.

    DON’T ANYBODY RESPOND THAT A CAR IS NOT YOUR HOME. Just rest in the fact you are a moron.

    We will do whatever they ask. So much so that only a few will need be detained or disappeared for offering resistance.

The Fourth Amendment is pretty clear, “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

    You need a warrant and probable cause to enter someone’s house.

    These are not “blueprints” for future gun legisltation, these are pre-planned attacks on your civil rights that will only succeed if you fail to fight them in court, or demand to require those who are in positions of power now, to tell these people, don’t even think about it?

    Guns are not the only issue, we have medical “miracles” coming where they plan to develop “brain to brain” interfaces, endangering the free will of people and enabling states to mentally manipulate them? They plan to release “break throughs” before laws are in place protecting citizens from abuses from such technology?

    This is not going to be just a battle about gun control, this is going to be a battle for the human race?
    Oh sure, you will have “volunteers” that will tell you this technology is safe, then you will be in the same position as you are now for gun control? We have a right to search your mind proposals will be written for legislators?

    At some point in the near future, we are going to have to tell legislators, you can’t write any new laws, you can only enforce existing ones? The average citizen can not keep up with 20,000 college interns writing laws for Congress and we need that kind of legislation to stop the attack on civil rights and those reserved to the People and the States by the US Constition?
