Missouri GOP Rep. Turns the Tables on Dems: Introduces Bill That Makes Proposing Gun Control Laws a Felony

Last week, Missouri Democrats introduced a bill that would ban semi-automatic rifles and give law-abiding gun owners 90 days to turn in their firearms to law enforcement or become felons. This week, a GOP state representative has turned the tables to make a point.
Rep. Mike Leara (R-St. Louis) introduced legislation Monday that would make “any member of the general assembly who proposes legislation that further restricts an individual’s right to bear arms” guilty of a class D felony.
The entire bill, HB 633, can be read on the Missouri House of Representatives website.
While his opponents will surely argue that his position is extreme, Rep. Leara told TheBlaze on Tuesday that he is under no illusion that the bill will pass. He says he introduced the legislation to make a point after Democrats proposed an alarming gun confiscation bill last week.
“It’s outrageous,” Leara said. “I have received an overwhelming response of about 100 to 1 to stop this legislation.”
Under the gun control bill, owners of semi-automatic rifles would have 90 days to give up their guns. Those who refuse to comply would be prosecuted by police and charged with a class C felony.
Here are some of the provisions found in the Missouri Democrats’ bill:
(1) Remove the assault weapon or large capacity magazine from the state of Missouri;
(2) Render the assault weapon permanently inoperable; or
(3) Surrender the assault weapon or large capacity magazine to the appropriate law enforcement agency for destruction, subject to specific agency regulations.

5. Unlawful manufacture, import, possession, purchase, sale, or transfer of an assault weapon or a large capacity magazine is a class C felony.
Leara called the gun control bill wholly “unconstitutional,” adding that there is no legitimate rationale for proposing such a law. He also said the primary sponsor of the bill, Rep. Rory Ellinger (D), calls himself a constitutional lawyer, believe it or not.
“I filed HB 633 as a matter of principle and as a statement in defense of the Second Amendment rights of all Missourians. I have no illusions about the bill making it through the legislative process, but I want it to be clear that the Missouri House will stand in defense of the people’s constitutional right to keep and bear arms,” Leara told TheBlaze, reading from a prepared statement.
Leara said Democrats’ gun confiscation bill is currently in the Missouri House speaker’s office and awaiting assignment to a committee. Similar bills have been proposed in California and Minnesota. Further, lawmakers in Washington state have proposed a gun control bill that would allow police to inspect the homes of owners of semi-automatic rifles once a year.

Write, email or call your legislators regarding the MO Democrats’ anti-gun legislation. Let your legislators know how you feel about this gun confiscation legislation before it is too late. For the MO senate, go to http://senate.mo.gov/ and type in your zip code to pull your state senators’ contact info.

These laws only disarm responsible gun owners. Criminals will not obey new laws, any more than they obeyed the old laws. It is foolish to think things will be safer if people are disarmed. England, with a ban on all guns. has a lower gun crime rate, but their violent crime rate is 4 times that of the U.S. So called “Assault weapons” were involved in less than 1/2 of 1% of all gun crimes in the U.S. last year. The highest mass murder rate in U.S. history was in 1928. “Assault weapons” were not yet invented. Do not be fooled by the propaganda. Try to use what little intellect God gave you, and reason intelligently the facts, and we might come up with a viable solution to our problem. A much more effective solution would be to actually provide inpatient care for mentally ill people. Jail, and keep in jail, violent criminals. Increase sentences for crimes committed with guns. Fire liberal Judges that keep letting repeat offenders out with minimal sentences.

Any elected official from Missouri who goes against The Missouri Constitution can be convicted of Perjury,
Missouri Revised Statutes Chapter 575: Offenses Against the Administration of Justice: Section 575.040
575.040. 1. A person commits the crime of perjury if, with the purpose to deceive, he knowingly testifies falsely to any material fact upon oath or affirmation legally administered, in any official proceeding before any court, public body, notary public or other officer authorized to administer oaths.
6. Perjury committed in any proceeding not involving a felony charge is a class D felony.
7. Perjury committed in any proceeding involving a felony charge is a class C felony unless:
House Speaker Pro Tem Jason Smith, a Republican from Salem, says it is important for legislators to publicly vow to support the U.S. and Missouri constitutions. Infringing on Article 1:section 23 of the Missouri State Constitution is a violation of the Oath sworn to and signed by Missouri Legislators.

I also support the bill this gallant legislature has introduced.

It will have no affect… I believe that noxious gun legislation is being proposed only to pound the buttons of gun owners and rights supporters. These proposed anti gun laws have no chance of passing and their authors know it. Their purpose is to (1.) piss people off, just because they like to do that, and (2.) they are hoping for a violent reaction from some gun owner that is not stable. When that guy pops up and opens fire on a anti gun proponent, that whole *#*hole crowd will jump up an yell ” See they are all crazy” and if the gunman has a subscription to the blaze or is an NRA member or has a conservative book in his home even better. They will yell ” Aaaa Ha!!!! and they will blame and blame and point and shout all kinds of stupid crap about the Tea Party and Glenn Beck and anything else they can connect him to. They are going to push and taunt until that day. That is their goal to provoke a violent reaction from anyone they can to prove their point. We are first time gun owners, and the gun that we bought came with an NRA membership application. By the way, My husband took me to the indoor shooting range yesterday, just to get me familiar with guns. I used a Springfield 9mm, I was only able to shoot 5 rounds then I got very nervous so I had stop, is that normal? Is the shooting range outdoors are better than indoors. I’m just asking because the guns going off with 10 other people near me, made me felt very uncomfortable.

Everyone is different. If you are not used to firearms, it can take some time. Don’t pressure yourself. A very helpful course is the NRA F.I.R.S.T Steps. You do not have to be a member of the NRA to take the course. It introduces you to handguns, ammo, how to hold a gun, how to aim, gun cleaning, safety, etc., and you get some experience at a range with your instructor and fellow students. Sometimes it’s easier to learn with people other than a family member.

There are lots of guns going off at outdoor ranges, too, but you might not feel so closed in. I highly recommend a class like the one I mentioned above, or see if there’s a chapter of A Girl and a Gun or a similar group in your area. At any rate, the more you know about guns, the more confident and less nervous you will be. Target shooting can be fun.

We’ve got to hammer home the point about “Don’t Mess with My Gun Rights” as well as all the libs (Marxists’) attempts aimed toward the 1st, 4th, 5th & 6th. The NDAA is as bad…no probably worse that the Affordable Care Act. BOTH need to be run through a paper shredder and then burnt!

What would happen if 50, 000 gun owners converged on the state capital all carry weapons? Sometimes legislators need a “reality check”. They confuse position with invincibility. Both are revocable.

Cavallo is right, but i am glad to see legislators fighting back to protect our freedoms here in the fly over states. The Missourians I know would not support the legislation for ‘control’ that had been proposed, but I cannot speak for the sheeple 43% who will probably be convinced that background checks and registries will get rid of the handguns the gangbangers use to terrorize them, and that high cap and assault weapons bans are necessary, even though neither is in significant quantity in downtown St. Louis.
Columbia has shops that are dedicated to ‘the black rifle’ so any politician seriously willing to attack the second amendment does so at their own peril…. as it should be.

Although I think execution is juuuuust a bit over the top, there is another way to make them just as ineffective, DON’T VOTE FOR THEIR REELECTION!
Between now and the 2014 election I intend to blog as often as I can against and Repub that clearly votes for a non-conservative position on issues. I am not suggesting being against someone who negotiates or compromises with the Dems, as that is demanded if we are to accomplish anything. Just those that through compromise our morals and core conservative principles are vanquished. I intend to speak out about and Repub that: voted for the Hurricane Sandy pork laden bill; anyone that votes ‘yea’ to Hagel’s confirmation for Sec. Def.; anyone that votes for illegal immigration reform that is not phases in AFTER border security and e-verify has been guaranteed; that votes for additional taxes to avert the sequestration cuts; etc.. If those moderate Repubs are re-elected nothing will change!

Posted on February 19, 2013 at 2:28pmWhile I like the purpose of the law, I doubt that it is constitutional to make it a crime to introduce legislation. That’s like saying, there will be no further debate on this issue. I am pro gun and therefore pro 2nd amendment, I am also pro 1st amendment. On the other hand I am tempted to wish that someone would pass a law that would make it illegal for Congress to pass ANY laws.

Take the fight to them and keep taking it to them, who cares if it’s Constitutional or not, put them on defense and keep them on defense and in retreat.

Any person/persons who try’s to introduce a gun law is a Treasonous act in the first place. They all take the oath to uphold the Constitution. So i see this law already on the book’s and the punishment as well…

The dems bill violates the Constitution by taking away people rights that are protected. All Rep. Mike Leara’s bill does is protect his constituents from a tyrannical government shi_tting on the Constitution.

Well. . . when it gets right down to it I agree with the above statement, and therefore, what the rest of you said as well. I have to say that it is beginning to look like the real spirit behind the 2nd Amendment is going to have to be put to use. If so, it’s going to be terrible. I just hope there are enough people left on the other side of it all who will be wise enough to ressurect the Constitution as it should be. I appreciate the comments.

One or two people revolting and fighting back won’t do it, they will be charged with domestic terrorism and that’ll be it. Organization is the key, WE THE PEOPLE, not ME THE PERSON.. Posted on February 19, 2013 at 10:49pmThe line in the sand has already been crossed my fellow patriots…fact is the 1st and 2nd amendments are already under siege (on multiple levels and fronts), the only rational solution (I feel we have left) is to send THE strongest of messages (agaisnt such unconstitutional activities), for the red states to become dead serious about seceding from this rotten Union. I see no other viable recourse that will be taken seriously by the left or the Dems/Independants that are willing to let the status quo continue and to progress further ( much further ).
What say you, fellow patriots ? Have the left already crossed the line (that should trigger serious consideration for disolving the union amongst those who hold the founding principles and laws/rights dearer than there own lives,families, fortunes and honor ) ? Do those words even mean anything anymore to some (if not a large section of) Americans ?

To subvert the 2nd Amendment is a violation of the sworn oath of the elected official, treason against the basic foundation of this country and the irreproachable boundary of liberty of the individual citizen. Any elected official found in violation shall resign from office and make reparation. Any elected official found in violation who refuses resignation shall be subject to impeachment proceedings.

Stop reacting and playing by their game, turn the tables on them and force them into constant defense. Outstanding. Looks like somebody has been studying Sun Tzu. You take the battle to the enemy on your terms, and by doing you, you assure yourself the best chance of victory. Playing defense as a primary strategy has to stop.

That “Maybe if we just educate them, they’ll see the folly of their ways and stop infringing on our rights.”. That doesn’t work. They know what they’re doing, they’re doing it on purpose. They have an endgame they’re fighting for. We need to get out of the habit of “defending our rights” and go on the offensive. Attack anyone who goes after our rights instead of trying to block everything.
Afterall, after the attack on Pearl Harbor we didn’t just build a big wall around Hawaii to keep the Empire of Japan from doing it again. We nuked em. Twice.
It’s time to “drop some nukes”, so to speak.

Most conservatives are far too nice and orderly and really dislike confrontation and always look for a way to make the squeaking wheel stop squeaking. The days of that being of value, if ever there were any, have passed. Time to take it directly to these dirtbag statists, not just once, but over and over and over again. Force them to focus their resources on defending their position instead of allowing them to use their resources to engage us on their terms.
It has to be steady and consistent though, not just an occasional shot over the bow.

the problem is that there are too FEW actual Conservatives getting elected. Don’t get me wrong, there are plenty of Republicans, but damned few of them are honest to Pete CONSERVATIVES. Then, the worst part of all our miseries is their ongoing and near constant refrain of ‘reaching across the aisle’ or some other trash!
They allow themselves, and thereby us, tp be moved further and further to the left as a nation. They never call the (D)s out on ANY issue. Or if they start to do so, they only go half way through the fight, THEN start doing their aisle crossing double talk. Sadly too few people who identify themselves with the Right or Conservative beliefs stand up and raise the roof when their elected worms sell them short.
