Last week, Missouri Democrats introduced a bill that would ban semi-automatic rifles and give law-abiding gun owners 90 days to turn in their firearms to law enforcement or become felons. This week, a GOP state representative has turned the tables to make a point.
Rep. Mike Leara (R-St. Louis) introduced legislation Monday that would make “any member of the general assembly who proposes legislation that further restricts an individual’s right to bear arms” guilty of a class D felony.
The entire bill, HB 633, can be read on the Missouri House of Representatives website.
While his opponents will surely argue that his position is extreme, Rep. Leara told TheBlaze on Tuesday that he is under no illusion that the bill will pass. He says he introduced the legislation to make a point after Democrats proposed an alarming gun confiscation bill last week.
“It’s outrageous,” Leara said. “I have received an overwhelming response of about 100 to 1 to stop this legislation.”
Under the gun control bill, owners of semi-automatic rifles would have 90 days to give up their guns. Those who refuse to comply would be prosecuted by police and charged with a class C felony.
Here are some of the provisions found in the Missouri Democrats’ bill:
(1) Remove the assault weapon or large capacity magazine from the state of Missouri;
(2) Render the assault weapon permanently inoperable; or
(3) Surrender the assault weapon or large capacity magazine to the appropriate law enforcement agency for destruction, subject to specific agency regulations.
[..]
5. Unlawful manufacture, import, possession, purchase, sale, or transfer of an assault weapon or a large capacity magazine is a class C felony.
Leara called the gun control bill wholly “unconstitutional,” adding that there is no legitimate rationale for proposing such a law. He also said the primary sponsor of the bill, Rep. Rory Ellinger (D), calls himself a constitutional lawyer, believe it or not.
“I filed HB 633 as a matter of principle and as a statement in defense of the Second Amendment rights of all Missourians. I have no illusions about the bill making it through the legislative process, but I want it to be clear that the Missouri House will stand in defense of the people’s constitutional right to keep and bear arms,” Leara told TheBlaze, reading from a prepared statement.
Leara said Democrats’ gun confiscation bill is currently in the Missouri House speaker’s office and awaiting assignment to a committee. Similar bills have been proposed in California and Minnesota. Further, lawmakers in Washington state have proposed a gun control bill that would allow police to inspect the homes of owners of semi-automatic rifles once a year.

Feb. 19, 2013 at 4:56pmThe obnly crime they THINK they can prosecute you for is not turning in your firearm BUT such a law is entirely unconstitutional because gun control is not one of the enumerated powers of congress so that the state law would be outside the scope of the powers so delegated to congress and in violation of the 2nd amendment……So how in Gods good earth can they propose such legislation?

Well yeah, because you probably know (1) it’d be declared unconstitutional before the ink dried, and (2) it’s bat **** insane. But it’s GOOD to know you aren’t wasting the taxpayer’s money for your salary by focusing on unproductive and nugatory legislation…

Feb. 19, 2013 at 4:53pmI want to see both bills put to a vote. This will show us who the politicians are who do not believe in our Constitution and who the politicians are who don’t see it as a felony to submit unconstitutional laws. We need to have on record who these politicians are so we know who to vote for when it comes time for their re-election.

Feb. 19, 2013 at 4:52pm“MISSOURI GOP REP. TURNS THE TABLES ON DEMS: INTRODUCES BILL THAT MAKES PROPOSING GUN CONTROL LAWS A FELONY”
Yeah because that sounds constitutional, LOL.
“The United States shall guarantee to every State in this Union a Republican Form of Government.”
U.S. Constitution Article IV
PRETTY sure you can’t just pass a law saying “no future laws shall be made on subject ‘X’!” Besides, how would that work? Presumably, the act would be repeal-able by future legislation. Also, it’s probably ADDITIONALLY unconstitutional on separation of powers grounds, in that it assumes a judicial responsibility for the legislature–i.e. determining what is, and is not, constitutional legislature. The legislature can’t bind itself to a priori determinations of what can and cannot be legislated, save by amending its constitution (and/or by amendment of the federal constitution).

Feb. 19, 2013 at 4:23pmWhy not a bill that makes “alinsky” a felony? Kill all the birds with one stone. Treason is already illegal. ‘alinsky’ is just a process of steps to skirt the definition.

Feb. 19, 2013 at 3:55pmThousands of marxist communists were killed in the Korean and Viet Nam wars. Thousands of facists/Nazis were killed WWII. These people were enemies of the people of the United States of America and American soldiers killed them dead.
These people are still enemies of this country and of the U.S. Constitution. Nothing has changed. They are just as dangerous and deadly today as they were back then. We didn’t vote these people out of office, impeach them or support them in any kind of way. We went in with our military and killed them. They got no court trial. Justice was served on the battlefield with guns and other weapons of war. So why are we putting up with all the crazy insane freaks today? I say we need to clean this country up and rid this country of all this crazy insane human filth.
This filthy marxist/communist/progressive/facist human trash i n this country tries to call responsible, accountable, law-abiding patriotic U.S. citizens loyal to the U.S. Constitution terrorists and racists….they try to make us look like the criminal they really are……..theyt try to use their Alinsky tactics to overthrow our republic government……..they try to take away our freedoms/liberties…….pride, greed and lust for power/control has turned these people into the unaccountable, irresponsible, mentally unstable freaks that they are. The sleeping giant has awakened and is watching who does what…identifying who’s who……and waiting…..it hasn’t forgotten.

Feb. 19, 2013 at 3:40pmThese slimy, lying, corrupt anti-American progressives have been hitting hard-working, normal Americans in the shins with lead pipes for years. It’s about time someone in the GOP acquired the courage to rear back and kick these idiots square in the jimmy. I hope this is contagious and more Republicans start putting the country ahead of their own careers and finances.
I’ll hold my breath.

Feb. 19, 2013 at 3:20pmWhere do these “constitutional lawyers” keep getting their degrees from? I know the universities are loaded with socialists anyways, but it seems like every major liberal that’s making headlines recently has some kind of degree with the word “constitution” in it..

Feb. 19, 2013 at 3:04pmAbsolutely Awesome! Why should we stand here while all the ant American fascists shred our constitution in front of our eyes? These Democrats should be incarcerated for treason. Why do they always attack the law abiding citizen who have nothing to do with the anti depressant users shooting up some place or some street punks having a shootout? You creeps on the Democrat side are trying to gut our 2nd amendment by first introducing a few restrictions and then enforcing a total ban on firearms for the American people. Our country is insolvent. We have an anti energy president who continues to forge our American dollar. The chance of crippling inflation is high, and we need our firearms more than ever especially since Obama and the Democrats have put our country into a hostile land of racism, divided rich vs poor, and demonized successful value producing Americans in the private sector. Mike Leara gives us hope that our rights and freedoms will not be destroyed by these basxxxxxxrd Democrats. God Bless you Mike Leara. We gun owners just want to live in peace. I can’t understand why the Democrats don’t want that to happen?

Feb. 19, 2013 at 3:00pmI’d like to see the state nullify federal regulations and limit state mandated gun controls to restricting only buyers that have been convicted of a felony involving weapons, those being treated for mental illness and persons under the age of 18. Both open and concealed carry should be allowed. Suppressors should be allowed. Provisions should be made for legal private ownership of select fire or automatic small arms.
