New York Army Vet Facing 7 Years in Prison Over Empty Ammo Magazines

An Army veteran in New York is facing up to seven years in prison for possessing five empty 30-round ammunition magazines.
Nate Haddad told WGRZ-TV he was parked on a road last month waiting to meet someone interested in buying them off him when police approached. According to the station, the magazines were for an AR-15 rifle, the same type of weapon Haddad once carried in combat. Magazines over 10 rounds have been illegal in New York since 1994, unless they were manufactured before the law went into effect. Haddad says he thought his were legal, until he found out otherwise.
“I certainly did not think I was committing a felony crime by having these,” Haddad told WGRZ. “My understanding of what I had in my possession was that it was manufactured before 1994, but the arresting officers told me otherwise after I showed them the magazines that I had in my possession.”
Haddad — who retired from 12 years of active duty in 2010 after sustaining a shoulder injury — now faces five counts of criminal weapons possession, punishable by up to seven years in prison. An online fund for his defense started by his brother has raised more than $40,000.
He was offered a deal this week to plead guilty to five misdemeanor counts and avoid jail time, but declined — citing, for one, how it would impact his job at Fort Drum, where he still works as a civilian employee.
There’s another reason too: “Even if I took that deal I would still be branded as a criminal, and I don’t think I should be,” Haddad said.

Still a New York Yankee fan but they spring train in Tampa and play the Tampabay Rays during the regular season. I belong to a shooting club, hunt , boat, fish, golf and enjoy living as a free man. My children and grand kids were born in Florida and know what it is like to grow up in a free state. I will give my life and fortune to keep it that way.

I have 2 small kids and a small “gentleman’s farm” with horses and chickens. My wife and I have a pretty good income from the private sector considering how this sh@t hole state is run. My company has expanded into Texas and my wife has a very lucrative job lined up out there. So to Texas we go! Leaving behind the growing unemployment, growing retirment/ entitlement pensions created by the blood sucking CSEA. Thank you Cuomo for coming out and offending my love of the constitution! I have seen the light and will be packing up my tax footprint to Texas. The magazines I have are larger and carry more rounds but unlike your newest victim of communism…are loaded. I didn’t risk my life defending my country just to lower my head to and show my belly to the same type of tyrant’s that I fought! FU Cuomo!

How many active Military Personnel will be arrest in the Anti-American State of New York? 71, 197 military personnel including Reserves and National Guard who are now in Jeopardy of violating NY STATE Gun and Magazine Ban. Last I checked: the Military uses “Assault Style Weapons” and have High capacity Magazines.
I think it is time for the US Military to close all bases in NY and move to a Pro-American State that does not willfully Infringe on the Constitutional Rights of Americans.

I love the beauty of upstate NY but the taxes are criminal and our representatives are selling out the state for their own gain. It is hard to breath the government is into every part of our lives. I plan to leave the state as soon as my family obligations have been resolved. My question is what state to go to? I want to spend the remaining part of my life where I have maximum freedom from government interference.

Thank God the board of supervisors in the county I work for told the union to go pound sand. They flatly refused to recognize unionization and refused to bargain with them which pretty much put it to rest. Of course, I live in a right to work state in the south rather than a douchebag union state in the north where they are oh so popular.
I won’t give agency names or ranks but suffice it to say, after 22 years, I’m a high ranking officer. I would hang up the badge before following any unconstitutional order. ANY UNCONSTITUTIONAL ORDER. I swore to protect and defend the constituion when I joined the Corps and I still consider that my most sacred oath. I will definitely be on the side of the individual citizen when the time comes.

Posted on February 24, 2013 at 5:27amThis is where coming after law abiding citizens comes so easy. We realize what we thought was right, may be now wrong, due to our misunderstanding of the law. He willing gives up what is in his possession and goes with the officers. It sounds like he then will be or was charged, and will spend time in jail.
Those officers get to chock up a “win” and a law-abiding citizen and veteran, goes to jail. At worst, they should have just confiscated. He probably would have admitted to having other magazines as well.
What this article doesn’t spell out for me, was it a sting operation? He was waiting for someone to buy the magazines, and the police just happened to be interested in what he was doing?
With so many illegals, drugs, drunken escapades, and other lowlifes to go after, officers going after those who willingly comply is just so much easier.

After performing constitutional talks in 341 high schools across America, I have seen firsthand the indoctrination being imposed on the future generations of this great country – which, for the most part, they are rejecting.
I recently returned from a Tea-Party speaking tour in Florida, and the No. 1 concern these patriots brought up to me was how to reach the next generation.
Finally, they were asking the right questions to bring our country back in the right direction.
The answer is all too simple: Show them the price of freedom.
When performing my high school assemblies, I will ask the students in the assembly how many know their Constitution.
Many begin to laugh in sheer ignorance.
I tell them that if they do not know their rights, they don’t have any rights.

Meaning, more out of ignorance or lack of political correctness than what I would define as real racism. Mainly in the older population who are just “set in their ways”. Now there are definitely parts of the South that have some racism, but trust me you would not even but looking to move into those areas. In NY (Syracuse) I found more racism than in the South. Best move I ever made moving out of NY. I love Tennessee.

Which I define as just people 65 and up who just don’t care about political correctness or taking time in their speech to keep from offending people. Lived most my life in Southern CA and found that to be one of the least racist places.

My vote hasn’t counted for years but I like the 4 season weather and the upstate countryside is some of the nicest in america, and the falls are spectacular. I have to tell you though, Its getting harder and harder to deal with all the taxes and cost of living and the stupid idiots in Albany and the deprogramming I have to do with my kids when they get home from school. You should see what they pass off as history and english in the schools here. Whats worse is what they leave out. I have to teach my kids about the constitution and federalist papers and founding fathers and such. If it wasn’t for that they would have no idea what our God given rights were as enumerated in the constitution. You can see why these clowns keep getting voted into office. The next generations are clueless. There’s even talk out there about getting rid of the constitution compleetly. What happens if the state you love becomes the government you hate. Well just know that not all of us here are liberals. I’m just worried that when God has had enough New York is going to have the first and largest bulleye on it. Can you say nuclear upstate New York winter boys and girls?

More money in my pocket now and less school indoctrination. But there is still some crazy issues with schools you will have to deal with. Our Supreme Court has ruled repeatedly that no state or local “law” can curtail any rights enumerated in our US Constitution, and that anything even though in the form of “law” that contradicts or over reaches the Constitution is null and void from inception, as though it had never existed, and creates no “duty to obey”. Period. Jury members may acquit on these grounds, and neither the prosecutor nor the judge can do anything about it, other than retire with egg on their faces.

Yes, I can because I’m not a robot, so I understand that laws have purposes. Arresting Mr. Gregory for displaying a borrowed magazine before returning it to its owner would have nothing to do with fulfilling the purpose of the law. Arresting Mr. Haddad for attempting to make a unregulated sale to some guy he doesn’t even know does. And I’m not even for the law. I think anybody in the country should be able to own any kind of a firearm they want. But it is the law. I have to follow it, and so does Mr. Haddad.

Our legal system has judges instead of law adminitrators because the spirit of the law matters and human judgment is part of the system. Cops get to decide whether to arrest you or let you off with a warning because the spirit of the law matters and human judgment is part of the system. District Attorneys get to decide not only if there is enough evidence to prosecute you, but also whether prosecuting you would serve the interests of justice because the spirit of the law matters and human judgment is part of the system. Like I said, I’m not crazy about this law, and it wouldn’t have bothered me any if the police had given this Haddad guy a break, but hauling him in and prosecuting him is a justifiable decision in light of the spirit and the purpose of the law. Prosecuting Gregory would not have been. If you really can’t comprehend that, then you have no business calling anyone else obtuse.

Just because a certain prosecutor or jurisdiction may “choose” to arbitrarily enforce or not enforce a law does not negate the written implications of said law. You are arguing “letter” versus “spirit”; the former is objective and the latter is subjective. I’ll go with the ideas of the founders of our country. We are all equal under the law. When you equivocate or bend the essence of any rule of law, you create an imbalance that has precedence. That is not a good thing. Break the law, prosecute. Sentencing is how you deal with an inequity in the “spirit” of the law.

You are living in a childish fantasy world. It is not, never has been, and never will be either possible or desirable to prosecute every violation of the letter of the law. Decisions have to be made. The criteria on which those decisions are based include the possibility of successful prosecution resulting in conviction, the seriousness of the offense in terms of the harmfulness or potential harmfulness of the act, the intent of the perpetrator and the intent of the law. By all of those criteria, choosing to attempt to prosecute David Gregory would be the decision of an imbecile. Attempting to prosecute Nate Haddad is a judgment call. If it was up to me, I might have let him off, but it is not entirely unjustifiable given that no reports on this story indicate that he knew or cared who he was selling to or what the purchaser intended to do with the magazines.

What WE can do, rather than pick at each others words, is any one or any number of suggestions already made here:
Contribute to his defense fund
Convince him to move to sane state of his choice
Boycott NY and all they have to offer
Raise our voices, make sure they hear us LOUD AND CLEAR
Presently – our silence is deafening. In the military, I was allowed my political beliefs as long as I kept them to myself. As a DOD member, I can speak as long as non one knows that I’m DOD. As an AMERICAN – I know longer care what happens to my job if I will lose my country by staying silent.

I’m sure Obummer will stop these charges because that would only be “fair”, right? Unless this guy is military, “Bad”, and the other guy was liberal press, “Good”

Posted on February 23, 2013 at 5:28pmfleeing NY is the only option at this point. There are other places to battle and win. NY is lost. The police depts are as bad as the schools. Most officers have grown up in the NY schools and lived in those communities all their lives. In addition I found a huge percentage of them do have a power complex. I could go on.

Regarding the law no matter how stupid or unconstitutional the law is ya have to know your situation and if you are in compliance. That is your responsibility. As foolish as this law is it is never wise break a law unless it is your intent to challenge it. Doesn’t seem that was your intent. You might on that path now however. I wish you all the best and I hope you are successful getting this dismissed. What a terrible waste of private money, time, tax money, and resources for a useless pos bit of feel good legislation that accomplishes nothing positive. Especially one like this were the punishment is so disproportionate to the actual risk.
We will have some of the same crap on the books in my state VERY soon. As soon as the disarmament weasels can sneak around and get them passed. The laws being passed here are for the sole purpose of setting up disarmament. They have no interest in safety or justice or anything but leveraging other people’s tragedies to promote their control agenda power trips. Get out of NY. It is lost ground. Same advice I would give to anyone unfortunate enough to be living there.

Posted on February 24, 2013 at 11:13amThat’s one side of the story. There are still a few questions unanswered here. Where exactly was the vet parked? It may have been at a spot of concern to traffic. What happened when the cops approached his car? Did he voluntarily show the cops what he had for sale? Did the cops forcefully search or ask him for evidence? Nate should have kept silent to any interrogation by the cops and moved his car away a few feet. It should be a rather easy case to defend if the cops were in any way forceful when they approached Nate.

So, the ploy here is to simply make everyone who has a gun or magazine a criminal, that will force people to just get rid of them out of fear. This Govt. now has no fear of the people, we are now just sheep to them to be used for their own ends.
