Over two months since the horrific mass shooting at an elementary school in Newtown, Connecticut, and national gun cuntrol measures are still moving slowly but surely in Washington.
Vice President Joe Biden has headed the Obama administration’s efforts on the issue and met with retired military leaders today, before a vote on the assault weapons ban with the Senate Judiciary committee possibly this week. On background checks, a bipartisan group of Senators including Tom Coburn, Joe Manchin, Chuck Schumer and Mark Kirk are reportedly close to a deal, but according to the Washington Post’s Greg Sargent, are caught up on a provision concerning guns sold in rural or remote areas.
The Senators have agreed on a key provision: How background checks would be expanded to most private sales. The way it would work is that in most cases, if you want to sell me a gun, you and I would go to a federally licensed dealer, who would run the check for a fee and okay the sale. In that case, a record of the sale would be kept by the gun store — which is already how it works for existing background checks. Coburn, according to the sources, does not have a problem with this.
However, Coburn wants private buyers and sellers in remote areas (how this would be defined is not yet clear) to be able to remotely get federal dealers to run the background check, via an internet portal.
Coburn’s concerns relate to fears conservatives have had for some time relating to broadening background check procedures opening the door for a federal gun registry. Not only do I need to bury my guns, but my reloading supplies and ammo. It is now looking like I need to put the research to work. They want me to register all my guns – what guns, I sold them years ago at a garage sale. Background checks next week, registry next month and confiscation next year. Wait and see.

Feb. 27, 2013 at 11:15amThere are only 2 ways to legally sell a gun in the US. One is a private sale between individuals (ex. friends or family) or by a gun dealer with a Federal Firearms License (FFL) from the BATF. Only individuals with an FFL can run a background check through the government NICS database of prohibited persons. Private citizens cannot. So to fix this, you need to do 2 things:
1) Allow any small gun dealer to get an FFL without having a storefront. Currently, thanks to the Clinton administration, you can’t get an FFL if you want to sell guns only at gun shows (See question 18a of ATF form 5310 FFL application). As a result someone that wants to sell guns but can’t afford the inventory costs and overhead of a storefront has to sell discretely as a “private citizen” and can’t run a background check. Rather than throwing these people out of the system they should allow them back in to get an FFL and subject them to BATF rules and oversight like they were before.
2) Give anyone free, public, anonymous online access to the NICS database. Once this is done, you then tell private sellers if you sell a firearm to someone and don’t retain a piece of paper that says you did a favorable NICS check on the buyer, you could be held liable if they commit a gun-related crime. This would also provide an easy, fast, non-bureaucratic method for anyone to determine if a suspicious neighbor, student, etc is a potential threat to society whereby the authorities could be notified to i

Feb. 27, 2013 at 10:37amI still fail to understand why one has to go through an FFL dealer to make a simple phone call. If a private person wanted to sell a gun to an unknown person and try to do the right thing so to say, they can’t… why? Why can’t a person make a blind call with no forms etc., when no information as to why one is not approved is told to the seller, and up to the buyer to go work the issue. What privacy violations if the issue are any different from a dealer making the call? Bad guys won’t care anyway or use any system, and if the goal is more background checks, why the jumping through hoops with a dealer? The only reason I can see for the current proposals with requirements of filling out the 4473 forms, fees, etc. is to set up for the next step, a national gun registry via the back door, and likely followed with confiscation later at the whim of politicians. The NICS background check system and the requirements for dealers to transfer guns via forms 4473 and all are two separate processes, and need not be tied together. It’s a political scam I can’t support in any manner, a lie, and will only make criminals of law abiding millions over-night, and lead to disaster later in losing our 2nd amendment rights.

If you want to sell or give a firearm to a friend or a relative, you are suppose to go to an FFL. How are they going to know what you sell or give away? The answer is they can’t without Gun Registration which is the only way they could possibilty track a firearm. I shall not comply!

You snakes . One of the problems with background checks with private collection sales , Is the fact they will have to have some kind of “evidence of a pre-existing ownership” of said firearm . To prove you didn’t already OWN it. That’s how a auto-sales works, its already titled BEFORE you SELL it.
Another words they would have to have all guns ‘previously registered’ for this to work. Meaning a ‘mandatory registry’ . Meaning failure to comply turns law biding citizens into criminals. Game over if this happens.

In fact the whole purpose of the Second Amendment is to prevent the federal government from gaining any such information, precisely becuse they can use such information to confiscate those weapons. I have no problems with state-run background checks that draw on criminal records made available in a federal data base, but ONLY if the federal government is guaranteed to be completely blind to all inquiries to the federal data base.
