Megyn Kelly Panel Debates Firearm Ban on Vietnam Vet: ‘So Unfair To This Guy’

U.S. Navy veteran Jefferson Wayne Schrader of Cleveland, Ga., has been permanently banned from buying or selling guns because of an altercation he got into 45 years ago, TheBlaze reported Tuesday.

“It’s a depressing thing. A depressing thing,” the 64-year-old Vietnam veteran told TheBlaze in a phone interview, “to have the government treat you like that. It’s not, well, it’s not a good thing.”

Since our initial report on Schrader’s five-year battle to have his name removed from the fed’s firearm ban list, his story has been making the rounds and even ended up on Fox News’ “America Live with Megyn Kelly.”

“This man is facing an uphill battle now that the D.C. circuit has ruled against him,” said Kelly on Wednesday, referring to a recent fed appeals court ruling that upholds the lifetime ban. “It’s just so unfair to this guy.”

“He has never been in any serious trouble with the law except for a traffic violation. Other than that, this has been a law-abiding citizen,” she added. “We’ll see if this craziness somehow gets remedied.”

    This is one of the MOST dangerous power grabs against our rights PERIOD……
    What’s to keep the states from saying you are barred from owning firearms if convicted of a traffic ticket or just by being arrested or detained by police even when no charges are filed?
    If you say this is conjecture, the ENTIRE Constitution is based on conjecture of what COULD be done to you without protection of your rights if a government so saw fit.

    Is this what “background checks’ are going to look like? ‘Sorry, you were in a fight when you were a young man…seems your violent nature indicates you will be irresponsible with a gun.’ Was the Sandyhook kid ever in a fight? How about the looney tune who shot Ms. Gifford? When I was a young man, a guy slapped me up sid ethe head in a bar and tol dme that we were going outside. After I had turned away, nicely, to avoid just this. I obliged. I bloodied him up pretty badly, split his nose on both sides from the impact. I had to stop. He was dazed and unstable. I walked him around, took him in a bought him a beer…it was never reported. Despite the fact that many could make a tenuous connection…..there is no one who could prove that I am now MORE likely to use my gun any differently than a person who had never been in an altercation where violence ensued. It is a non sequitur. But proof is unimportant to opponents. They only need their cause…and nothing else matters.

    Support the Troops! Great bumper sticker but not so much applied.

    Reminds of this – several states are exempting police AND former police from their gun restrictions, but can you name me ONE state with restrictive gun control that will so much as waive the mandatory safety training for veterans, some of which have been handling guns professionally for 20 to 30 years. I don’t know of any.

    In the case of Jeff Schrader, the veteran prohibited from buying a firearm; Three attorneys on Fox, 5 judges and Schrader’s attorney cannot understand that this is ex post facto law, prohibited to both state’s and federal government, then EVERYONE should be disbarred.

    THREE attorneys, several judges and NONE know that this is ex post facto? What does the Constitution say about ex post facto law in the U.S.???????? UNBELIEVABLE!!!!!

    Listening to this clip Ms. Kelly listed several misdemeanor’s. One was wife beating. So let me get this straight. If I punch a douc bag liberal out or beat the hell out of my wife it is the same charge? This is just not fair or right. Seems to be a lot of misdemeanor’s should be felonies then. Wife beating YES.
    Douc Bag liberal punching reduced to the equivalent of oh shall we say littering with a flat $50.00 fine.
    I’m good now; pass this law quick and make it retroactive back about 50 years to cover all the liberals I have punched in the mouth.

    This is a test case. The slippery slope is near vertical now; next week driving infractions will count as reason to bounce a background check. Then the Feds will prosecute you for attempting to make an “illegal” buy.

      Thank you for your unwavering support for the Constitutional rights of this unsung Veteran of the Viet Nam war. My American Legion chapter has mobilized our support and requested the VFW and VVOA join in a friends of the plaintiff brief, if some basics facts bear out.

    so many of you are falling into the emotional trap set by the progressives… megan kelly is a fraud of the highest order….the progressives laugh at you and your post’s. This guy has to work out this using the rule of law…just because he is a vet gives him not special leeway…if it did a wounded vet would get more and someone with a silver star would get even more and someone with 8 purple hearts would get ,more….listen to yourselves…there are people out there that shouldn’t be allowed to have sharp pencils let alone a gun….

      Jungle – why the bitterness? You insult Megyn and this Vet. I do think Megyn blew her analysis of this case (ie., in commong English not recognizing that laws can NOT be made retro-active) but show some respect to this veteran Jungle – he made one mistake 50 years ago. He’s not asking for honors or medals – just his Constitutional right to own a gun.

      If laws can be allowed to be made retro then imagine the power the Govt could have over a 12 mph speeding ticket..

    It’s obvious, homeland security is getting set to confiscate your weapons when the constitution is fully trashed … it’s obvious to me anyway. There is one way to fight this, without shedding blood, and that is to use one option Obama and his thugs can’t take away, .. yes Prayer, mighty prayer, asking our Heavenly Father to remove Obama and his family from power, as he is a traitor to a free land. Your all thinking of defend you property and families with guns … since that “never” goes right, it should be the last option used. Eventually the Lord will cleanse the land by blood, so I understand, but faithful prayers can do much right now .. come-on let’s do it .. join with me!

      If Obama as President was God’s Hand, it is supposed to be seen as our punishment for having let the country’s lawyers and socialist scrub a lot of Christianity out of our society. A lot was scrubbed and legislated out, yes, but I think we will see a steady resurgence of spiritual values. We have need to go to the forth sub-level of Hell’s Basement (several times) before understanding what we have lost as a people., and what we still do have to protect. We will survive this dark stain on our history, I am convinced!

    Here’s an idea let’s petition Barry to pardon Schrader,hmmm let’s see he’s white and a veteran,sorry Jeff.
    I don’t care how many laws or regulations politicians put on the books infringing on our second amendment right, they’re all unconstitutional. This man punches a punk in the face 45 years ago and is barred from ever owning a firearm. Ted Kennedy kills one woman that we know of and nothing happens to him. The difference between the two is one fought in a war the other was part of the ruling class.

      @Rino – My brother made the bad choice to opt out of the US Army after my parents agreed to sign for him to enlist at the age of 17 in the late 1950′s. This led to a Dishonorable Discharge after running away from base several times, which has followed him all of his life. Even after he became a responsible productive adult.

      Vietnam draft dodgers and deserters were eventually given “conditional amnesty” in 1974 by President Ford. All was forgiven an forgotten with these men.

      So, I guess we must always abide by the letter of the law with no exceptions and never by the spirit of the law or a road to redemption?

      No doubt we’re ALL going to be deemed to have made “bad choices” when we were younger and we’ll all have to expect similar “consequences”. We just should have been a lot more careful. Sarcasm intended.

    Well… the Constitution does say you can’t own a gun if you beat up someone.

    I really don’t think the whole can’t own a gun if you’re a felon is constitutional either. That means a white color crime like stealing a lot of money means you can’t protect yourself.
    That goes against the whole idea of self preservation being inalienable.

    To me, inalienable means if you’re not in jail and out FREE, you should have a right to bare arms and protect yourself. IMO

    I love to see this overturned but because his record involves violence I doubt if anything
    will come of it.

    The only reason they would even consider this is his service record .

    Our laws don’t distinguish any time factor when STRIPPED rights is in question.

    That’s why it’s called a ‘permanent record’

    But I have had a problem with this huge FLAW, before this veteran ever made the news.

    How can we have GOD given rights in this country and turn around and strip them ‘permanently‘…

    That tells me it’s a fallacy belief ..!

    And our government is HIGHER AUTHORITY…THAN GODS AUTHORITY..!

    I can understand being punished for a time ..

    But when time is served, all rights should be restored period.

    Or your not fit to be in public . So there’s the rub with me.

    We have let the politicians turn our country into one big penitentiary ..!

    What most don’t understand is, that there are a lot of folk just like him that are carrying firearms and hunting, etc. They are vulnerable to become felons without knowingly doing anything wrong. Ex-Post Facto is guaranteed against in the Constitution for a reason….This needs to go to the Supreme Court of the US…. If they can’t rule correctly, then we have to do something about it NOW!!!!!!

    Totally ridiculous, and the fact that this has been a knock-down drag-out case, as opposed to being the slam-dunk win it should be for Schrader, is an ominous warning of where we’re headed. Have you written your congressman of issues affecting you that you’ve read about here? I have – you should too.

    What is the story behind the unusually huge demand for ammunition, arms, and armored vehicles from the Dept of Homeland Security? I’m reading reports of DHS ordering BILLIONS of rounds of ammo; tiny towns in NH and Arizona getting $250k ea armored Bearcat vehicles; body armor, etc…I’m reading these stories on Glenn Beck’s The Blaze, and online news site.

    I checked the local sporting goods store to see if this was true, and they asked me if I’d been under a rock since Christmas!! They said commercial ammunition was VERY difficult to get, and showed me their empty shelves. I asked about prices and they said that prices have gone up dramatically. Mr. Issa, what is going on?
