TheBlaze Fact-Checks Sen. Dianne Feinstein’s Anti-Gun Claims Made During Senate Committee Hearing

Sen. Dianne Feinstein (D-Calif.) made her case in favor of gun control during a packed hearing before the Senate Judiciary Committee on Wednesday. The hearing was called to debate Feinstein’s proposed a ban on so-called “assault weapons.”
“Let me now describe the key features of our new legislation, the ‘Assault Weapons Ban of 2013,’” Feinstein said Wednesday. “The bill bans the sale, transfer, importation, and manufacturing of 157 specifically named semi-automatic assault weapons.”
She continued: “It also bans any other assault weapon, which is defined as a semi-automatic weapon that can accept a detachable magazine and has one military characteristic, such as a pistol grip, barrel shroud, or folding stock…These features were developed for military weapons to make them more effective and efficient at killing people in close-combat situations.”
Feinstein, with photos of Sandy Hook victims behind her, argued that the U.S. has “witnessed an increased number of these mass killings” and called semi-automatic “assault weapons” the one “common thread running through these mass shootings.” She says the gun ban is needed in order to prevent future tragedies.
“Sadly, [Newtown] is not an anomaly,” Feinstein said. “We have witnessed an increased number of these mass killings. The one common thread running through these mass shootings — from Aurora, Colorado, to Tucson, Arizona, to Blacksburg, Virginia — is that the gunman used a military-style semi-automatic assault weapon or a large capacity magazine to inflict unspeakable terror.”
But do the facts support Feinstein’s argument?
Let’s start with the claim that mass killings are on the rise in the United States. According to the Associated Press, those who study mass shootings say they are not becoming more common.
“There is no pattern, there is no increase,” says criminologist James Allen Fox of Boston’s Northeastern University, who has been studying the subject since the 1980s, spurred by a rash of mass shootings in post offices.
Grant Duwe, a criminologist with the Minnesota Department of Corrections who has written a history of mass murders in America, said that while mass shootings rose between the 1960s and the 1990s, they actually dropped in the 2000s. And mass killings actually reached their peak in 1929, according to his data. He estimates that there were 32 in the 1980s, 42 in the 1990s and 26 in the first decade of the century.
Chances of being killed in a mass shooting, he says, are probably no greater than being struck by lightning.
“Without minimizing the pain and suffering of the hundreds…who have been victimized in senseless attacks, the facts say clearly that [there] has been no increase in mass killings,” Fox wrote. When clusters of incidents occur close together, he added, that likely reflects a mixture of copycatting and coincidence.

Many anti-gun advocates have noted that six of the 12 deadliest shootings in U.S. history have occurred since 2007, with the Newtown massacre ranking second on that list. However, mass killings, in fact, peaked in 1929.
Feinstein also argued that banning so-called “assault weapons” would help decrease mass shootings.
A study by the University of Pennsylvania concluded that the old assault weapons ban was undermined because it is difficult to define what an “assault weapon” actually is and there were already so many in circulation. The study also concluded that the law appeared to have little effect on gun violence overall, most likely because rifles are used in a small percentage of gun crimes.
Consider this, hands and feet, knifes, shotguns, and handguns all killed more people than rifles in 2010. According to FBI data, 358 people were killed by rifles that year, half that of people who were killed by “hands and feet.”

Finally, Feinstein argued that semi-automatic “assault weapons” were the “common thread” in mass shootings. While Newtown shooter Adam Lanza reportedly used a semi-automatic rifle during his rampage, Aurora shooter James Holmes’ AR-15 reportedly jammed. Holmes also had two Glock pistols and a shotgun, according to reports.
Tucson shooter Jared Loughner reportedly used a Glock 19 pistol with an extended 30-round magazine. All magazines with more than 10 rounds would be banned under Feinstein’s bill.
These are just a few examples, however, to insist that only so-called “assault weapons” are used in mass shootings would not be accurate.
In a previous Blaze report, Jordan Hunter, director of marketing for Daniel Defense, said a semi-automatic rifle is not the weapon most commonly used in mass shootings.
“We tracked 62 mass shootings wherein 5 or more people were either shot or killed from the early 1980’s to now; 41 times pistols were used, 12 times shotguns or some type of hunting-style rifle was used, and 9 times semi-automatic rifles were used (14 percent),” Hunter told TheBlaze.
Overall, Feinstein’s claims — the basis of her gun ban — don’t appear to hold up under scrutiny.
However, it may be important to note that Sen. Feinstein’s bill refers to certain types of handguns and shotguns as “assault weapons.”

Posted on February 27, 2013 at 8:35pmThis isn’t a fact check! they didn’t disprove anything she said.. and as for assault weapons stopping mass shootings, look no further than Australia or the U.K. both have passed assault weapons bans, as well as other practical gun restrictions, some 20 or so years ago and since then Australia has had NO mass shootings.. the U.K. has had one.. and both have seen strong declines in gun violence.

they had the Waco compound surrounded. Koresh and his followers had a finite amount of food and water. It wasa for lack of a better term, a Medieval castle under seige.
Instead of having 1000 or 1200 LEOs from 9 or more different agencies in there[depending on who's numbers you use], they could have done it with 100 and a couple of Hummers and a helicopter, a coffee maker and someone to go into town for burgers!
But instead of letting them stew in their own juices and starve them out over a month or so, they attacked a compound on the premise that they had TONS, of GUNS. Isn’t that like swimming into the middle of the Amazon river to see IF the piranha are in a feeding frenzy?
BULLIT, plenty was done wrong by both sides. But trying to attack that place was one of the biggest bungles in American Law Enforcement history.

No one at any age was getting out of Waco alive. Snipers on the perimeter shot anything that moved. During the fire, a kill team was inserted, our special ops. guys here used the SAME firesuit. Caught his exit on CNN. The agencies were off the leash under Janet ‘barbeque’ Reno. They are really off the leash under Napolitano, expect terror from the DHS. They are not friendly towards the citizens. They see us as the “enemy”.

Check the numbers. Less than 4% of all murders last year were done with a rifle (of all types), Check and see how many murders are welfare related though.
In America, blacks make up 12.5% of the population, and do 1/2 of the nations murders. One half of all murder victims in the US last year were black. If you do not find those numbers to be statistically significant, then you are a moron. If we can lower black murder rates to the same as white murder rates, then we will lower the national murder per capita rate by almost 40%, making us one of the safest countries in the world. It will also result in saving a whole lot of black lives. I want to save black lives, do you?
Political correctness has turned this nation into blind idiots who refuse to look at truth.
America owns 88 guns per 100 people (highest in the world), but there are 27 nations with higher murder rates. Honduras owns 6.6 guns per 100 people, and leads the world in murder rates.
In our large cities, over 70% of murders are gang related, but no one is talking about gangs. Those doing the killings are also intrinsically tied to welfare.
Why will someone not stand up, and call out Sen Feinstein on these stats? Why will the blaze not do a story on these numbers?

But they will make up stats or scoff at “Government” statistics as not being totally correct. They do this because that know that if they get what they want and we end up like Australia…its game over anyway. Then they can do what the Australian Government is now doing…back peddling and lying because they know their ban failed miserably and now only the innocent “un-armed and un-protected” are left to suffer. Which by the way as no passage in it that says that congress or the president can curtail your right to bare arms of any kind. It just does not specify that Americans cannot have assault weapons.
Although according to the definition of an assault weapon just because it happens to be semi automatic doesn’t make it an assault weapon.
Just because it looks like a military weapon doesn’t make it an assault weapon, but to these guys an assault weapon is whatever thay define is as.

In addition, it makes no difference if one was used or not. The second amendment was designed to keep the militia, defined as the whole people by George mason who authored it, armed as well as any government force. Sure back then they had muskets and cannons, so did the people. I will not put myself in a position where I or my family is at a disadvantage.
Who gave a government the right to tell me how many rounds I need to protect myself? That power does not exist. Does anyone have a stat that shows in gun crimes, how often the gun was obtained thru legal means? I’m real sure that any group of thugs breaking into my house will only have the legal number of rounds in their weapons. Horse shirt.

I’ve heard interviews as well as to McVeigh’s reasons behind the Oklahoma City bombing, and it goes directly to what he observed during the WACO standoff. Yes, McVeigh was there, observing, and being former military, knew what the gov’t forces were doing with those tanks and sprays…his reasoning for the bombing came out simply as getting even for a gov’t sanctioned mass murder at Waco, followed by a cover up, followed by McVeigh’s throwing what he felt the gov’t had done right back at them. Some will just say “another conspiracy”, but in dealing with gov’t, only a fool will not believe that half of what the gov’t says leaves another half they are hiding.

Honduras 91.6, El Salvador 69.2, Jamaica 52.2, Venezuela 45.1, US Virgin Islands 39.2, Columbia 33.4, Bahamas 27.4, Puerto Rico 26.2, Panama 21.6, Mexico 16.9, Bermuda 12.3, Costa Rica 10.0, Pakistan 7.8, Martinique 4.2 and the US 4.2.
There are many other countries listed with murder percentages, but what makes the US different from the others is all the other have a 100% ban on guns and the US does not and is why we only have a 4.2% murder ratio per 100,000 citizens..

I’m reading reports of DHS ordering BILLIONS of rounds of ammo; tiny towns in NH and Arizona getting $250k ea armored Bearcat vehicles; body armor, etc…I’m reading these stories on Glenn Beck’s The Blaze, and online news site.
I checked the local sporting goods store to see if this was true, and they asked me if I’d been under a rock since Christmas!! They said commercial ammunition was VERY difficult to get, and showed me their empty shelves. I asked about prices and they said that prices have gone up dramatically. Mr. Issa, what is going on?

Can you debate with MBE? Or other trolls for that matter? Mostly they seem to come here to mock & to try to infuriate. It is hard to even get agreement on even the most basic facts.
I have only seen 1 good post by MBE that was not weird, bizarre or mocking. It was on the story on the remains of the American Fuhrer Bunker. MBE said they thought another website had done a better job in describing it with photographs & prose. And MBE linked it. Outside of that solitary post everything MBE has done has been surreal from her SN, to icon, or to her posts.
Another troll Encinom has 4 or 5 aliases & counting. Wango has at least 4. Meteors responds back after a fashion but never responds back point by point. Very selective.
What debate? At times the most one can do is look stuff up yourself, talk to people on the street or in other countries or what you have learned on your various jobs and make your own mind up.
You’re not going to get a not of wisdom from incestuous bigots who on have journalism/Communication degree, Poly Sci degrees or JDs. You’ll have as much cross pollination of different ideals as there are different genes exchange in a vast planting of mono-cultured crops.

We should immediately round up, and place into safe storage all Democrats in order to save the children. If only one child’s life is saved by banning and locking up all of the Democrats it would be worth it. Being a Democrat is a private pleasure and therefore is not a right. Since it isn’t a right, it can and should be regulated to include registration, incapacitation and confiscation of all Democrats.
If it sounds stupid when being applied to Democrats, why doesn’t it seem stupid when applied to an inanimate object?
