Obama Admin. Set to Urge Supreme Court to Overturn Californias Gay Marriage Ban

For the second time in the space of a week, the Obama administration is expected to call on the Supreme Court to weigh in favor of same-sex marriage.

The administration will file a friend-of-the-court brief Thursday urging justices to overturn California’s Proposition 8, which banned gay marriage in the state,Β NBC News and the New York Times reported.

The Justice Department brief will argue that California voters were not entitled to vote to ban same-sex marriage, an administration official told the Times.

When Obama came out in favor of same-sex marriage last year, he said he didn’t think it was a matter for the federal government to decide.

The administration filed a brief in a same-sex marriage case last week, in which it argued that part of the federal Defense of Marriage Act of 1996 defining marriage as the union of a man and woman for the purpose of federal benefits was unconstitutional.

The court is slated to hear oral arguments on Proposition 8 in late March.

    Consider this alternative headline: β€œOBAMA ADMIN. SET TO URGE SUPREME COURT TO FORCE CALIFORNIA TO REDEFINE MARRIAGE”

    Prop 8 says, β€œOnly marriage between a man and a woman is valid or recognized in California.” Thus, Prop 8 merely recognizes the reality of marriage.

    Similar to Prop 8 is this, β€œOnly a square having four sides is valid or recognized in California.”

    Reporters, please avoid using the term β€œgay marriage.” It’s similar to using β€œround square.”

    The debate is about whether to defend or corrupt the definition of marriage. The definition of marriage in the term β€œgay marriage” is corrupted inherently.

      Marriage wasn’t always “between a man and a woman” For instance there same sex unions have been recognized in many ancient civilizations. Greece, Rome, China, Africa. Most of which continued un touched until Christianity became a major power.. and at that point the Christian leadership in Europe ruled to abolish these marriages and execute those involved.. So one can easily make the case that Christians in fact redefined marriage to fit their own standards and beliefs, and are now appalled that other people would try to do the exact same thing.

      Its actually quite interesting if you look back in history the Zhou dynasty, the Roman empire etc.. heres another cool fact! historical records show that gay marriage can be dated back to around 1,000 B.C. Long before marriage meant between a man and woman.

      They should also allow(in certain scenarios) father and daughter, son and mother, brother sister, or any combination of relatives to marry. Foe example; mother is really sick, father is dead, mother has no health insurance. Solution; son with great health insurance marries mother, she get adaquite medical attention, he get to write off medical expenses (he’s already paying for), its a win win for both.

      A marriage between 2 men or 2 women is just as valid as any heterosexual marriage. If you want to define marriage in more limited terms, that’s fine, but don’t try to force that definition onto the rest of us.

      The Constitution does not define what a marriage is either which shows the hypocrisy of the left. You can’t ask the federal government to overturn laws that they have no right to overturn (it’s up to the states) and in the same breath ask the federal government to violate the rights of others (ex. failing to protect the second amendment). Gay rights groups are digging their own graves because they are ultimately fighting against their own rights by fighting against the rights of those they don’t agree with.

      Sure it would be nice to be married to whoever and how many you want. But think outside the box. Removing the historical cultural standards of marriage (based on the majority, not the occasional culture that does things differently) throughout time leaves the doors wide open to virtually any combination. Why even be limited to marrying another person or persons at all? A lot of us are already married to our businesses or jobs. Some guys love their cars, so why not make it formal? Or what about the dog? At least you wouldn’t have a costly divorce every few years.

      This is the new era folks. Don’t be so limited in your thinking…..

      I think not. If some mad roman emperor was killed one of the usual complaints was that he engaged in homosexual relations. On top of the “I think I am a god” or “I am going to do your wife & there is nothing you can do about it,” there was usually “I done so many women why not do guys too”.

      That is what I get from reading about the history of Rome.

      It is not a cool fact. It is rather sordid.

      Marriage is culturally based, their is no US Constitutional right of marriage at all. Therefore the Federal government should not even have ‘marriage’ in any federal laws and that includes tax code. The term has been used conveniently to cover acknowledged partners and even give them some protected rights (although in the tax code, they are penalized so only us crazy traditionalists really should ‘want’ to be married).

      Now, I’m not against same sex people getting ‘married’ as it’s just a piece of paper and state of a relationship, but where I’m totally against the homosexual community in this is their selfishness. If they are going to try to break marriage away from a cultural definition (Victorian ‘man and woman’ concept) then they must also move to define it against a legal, ethical definition like “Consenting Partners”. This would mean any sex, any number of people could consent to getting married. Children are not legally able to give consent so it would still prevent child abuse. However, direct familial relations could also marry under the consent definition.

      There is no rational stopping space between the cultural definition of marriage and the logical definition of ‘consent’ where it has to be moved to. So, homosexuals, if you do not agree with moving it to consent, then your entire argument is emotionally based and hypocritical. You just want the culture to support your lifestyle, which it doesn’t at the moment.

    Being gay is not a mental illness. You’re born gay. There are gay animals in the wild. I have gay friends that I knew were gay before they did. No one tries to be gay and you can’t fix it. It would be as easy for a gay man to find a woman attractive as it would for me to find a man attractive.

      People are not born gay. Identical twins where one is gay and the other is not proves that. Also, the fact that there is no gay gene proves it.

      Being gay is a choice. But being straight is not a choice. People are born straight, as that is the normal, default condition. So for straights, that is just the way they are, there isn’t a choice that comes into play. For gays however, at some point in their lives, due to external things, they are enticed by spirits of perversion and they choose to engage in things that ought not to be done, unnatural things. But the Good News is they can be set free from these spirits of perversion by inviting Jesus into their hearts. Then the grace of Jesus will change them from the inside outβ€”spirit, soul, and body. So they can pray the gay away, for it is a spiritual problem that must be dealt with spiritually.

However, to try and relate sexuality to a specific gene is to fail to understand biology and genetics. Besides, can you tell me what gene makes you get freckles? No? Then I say having freckles is a choice and an abomination!

      And for the record, no I don’t care if 3 people all want to marry, but the laws governing the added issues would need to be tidied up first. And I cannot believe that pedophiles had a choice in their attraction to children, but they cannot be allowed to molest children because that is harming another person.       We’ll.. Its against the tax code… but you do kind of have a point. Though i don’t see why you believe that legalizing gay marriage would have any effect on peoples opinion of polygamy… you know being as 54% of americans are in favor of gay marriage while 39% oppose, meanwhile 11% of people approve of polygamy. so I am not sure how the two have any effect on each other. That being said I guess we may pass the polygamy bridge when we come to it. though you and I both know that will never happen.

      2. You should never be able to vote on civil rights, or equality
      3. gay marriage and polygamy are separate issues. That would be like me saying since you want to ban gay marriage, you will want to ban interracial marriage next.

    The only reason same sex marriage is a constitutional issue is because of the tax code. A first year law student could argue this case at the SCOTUS and win. It has nothing to do with the religious concept of marriage. The constitution demands that all rights and privileges be extended to all citizens. If not for the tax code they wouldn’t have a case.

      Beyond the tax code, Sally Ride an American hero, her long time partner was denied the same benefits spouses of other veterans and astronuats would receive. Same sex spouse of military personal do not receive the same treatment on military base and access to hospitals and notifications of death and injury.       First the progressives gave us the federal reserve and outlawed the use and possession of money, GOLD. Then the progressives gave us the federal reserve’s collection agency, the IRS. Then the progressives gave us the 16th amendment classifying wages as income. Then the progressives used the 16th amendment to give us the unaffordable health care act and now they will use the 16th amendment to give us same sex marriage.
      Libertarians don’t really expect any of this to change until after the collapse and ensuing civil unrest. In so far as libertarians reconciling with conservatives, the conservatives favor the current tax code because it favors the rich and corporations. Being oppressed by fascists isn’t any better than being oppressed by communists. Until conservatives figure out that they are being played for useful idiots by the progressive fascists and stop supporting them, we will all lose.

      I believe that the biblical interpretation would tell us that the message of Ezekiel 23 is as a warning to the nations of Earth to not be godless in our actions toward other nations, or God will give permission for the other nations to kill the former.       Where I find the hipocrisy of the left, most states offered civil unions, but that wasn’t enough, the GLBT crowd wanted Marriage, in a church. When churches said NO, that is when this entire fight escalated and that is when the conservatives drew the line. I am Catholic and I for one will not stand for someone to tell me or my church, YOU WILL ACCEPT GAY MARRIAGE. That is what the fight is over right now. My personnal belief is this falls under the 1st Amendment, and if churches want to allow this in their church, so be it, but for the Feds to get involved, that is coming straight from the LGBT losses at the state level and lower courts.

      I agree one hundred and fifty percent. I love Neil Bortz’ Fair Tax plan. I remember arguing with one guy I worked with over a flat tax (back in the 90′s) He was the same rank as I was E-6, and had 4 kids, his wife didn’t work. His view point was, “I don’t pay anything right now, and I get an extra $2,000 back, why would I want a flat tax? The point I made to him was, he was taking the tax money I paid in, and my wifes, we lived and saved within our means, but were being punished, he didn’t care, just as long as “he got his”, direct quote. Hayek and Freideman both warned “When the US taxpayer approaches 50% not paying into the system, they will not care where the Govt. takes their money from, at that point, we will lose our Republic” Well, we are at 47% now.

      This is something we both agree on, I like that.

      You are close, but backwards- it is earthquakes that cause the fault line- you may say this is straining at a gnat, but the difference is major. There were earthquakes long ago where no fault line existed, too many to mention-

      CA has not been in existence for ‘millions of years,’ but thats a minor point.

      Natural disasters, yes, you are correct, I’m sorry for the farmers as well, but God does send the rain on the JUST as well as the unjust, this you may not understand. My mention of CA earthquakes is not only in regard to same sex marriage, but on a coast where most of the ‘players’ are God hating, fist shaking, God mocking, marriage hating, liberty stomping, freedom taking souls who set a downward course many years ago.

      Sodom was a real place, as were the cities of the plain. CA happens to be a trend setter in the decadent dept, and I suppose God’s patience is somewhat thin. Earthquakes are HIs strange work, and I recall the past quakes where men again shook fists at the Creator, so yes, there will be other quakes- prob. sooner than later. God by his grace uses ‘natural’ disasters’ but so few take heed.

    So is O coming after my State of Tenn next – we adopted a State Constitutional Amendment many years ago when DOMA first reared its head to define marriage as a union between one man and one woman – and our state will not recognize as marriage anything else- even from another state – anything other than one man one woman is not marriage in Tenn –

    Don’t like it but hate the punitive tax and spend policies of other states that do recognize homosexual unions like Mass – stay in Mass and reform their tax and spend policies – don’t try to pervert the other states who are both fiscally and socially conservative.

    Stop destroying your home states, moving and trying to bring about the same disasters to your adopted states. Fix you own places – leave us the h e l l ALONE

Are we going to uphold the entire constitution or just parts of it? We have created all sorts of illegal overreaches from federal government that are supported by gay rights groups yet when the gay rights groups get violated they are all the sudden for the opposite side of the law.
