Coming After the Standard Shotgun: Colo. Gun Bill the Most Extreme Proposed Firearms Law

A bill making its way through the Colorado state Capitol could outlaw the best-selling hunting shotgun in the state.

“They’re coming after the standard shotgun,” Republican state Sen. Greg Brophy told KCNC-TV.

The bill, aimed at banning high-capacity ammunition, has already passed the House and has support from Democratic Gov. John Hickenlooper. If it’s signed into law, it will also seriously limit shotguns used by most hunters in the state, according to the station.

“Hundreds of thousands of pheasant hunters are probably going to be carrying around a gun they won’t be able to replace after July 1 this year,” Brophy told KCNC.

In a state that’s seen two of the worst mass shootings in U.S. history — Aurora and Columbine — Brophy said there’s a section of the bill that defines a high-capacity magazine as one that can hold or be converted to hold more than 15 rounds or eight shotgun shells.

“This is where shotgun shells go inside this tube here,” Brophy demonstrated. “You can screw this part off the top and screw on an extender to this tube to allow it to hold more than eight rounds. It is readily convertible, which by definition in the bill, makes the whole thing a high-capacity magazine…we just might not be able to legally purchase a pump shotgun or a semi-automatic shotgun.”

Colorado has several gun bills pending in the state. According to the Denver Post, Vice President Joe Biden called some Democratic lawmakers in the midst of the debate last month and said it would “send a strong message to the rest of the country that a Western state had passed gun-control bills.”

“The law is specific as of July 1. You can keep it, but only if you maintain continuous possession of it,” Brophy told KCNC. “If it breaks, you can’t give to a gunsmith even to fix it. You can’t hand it to your son to use. It’s all now outlawed because of this 1224, the bill that Governor Hickenlooper says he’s going to sign…this is most extreme thing anybody’s ever done related to firearms.”

Democratic lawmakers told the station they are currently working on an amendment to address the issue, to be presented in a committee hearing Monday.

      All citizens who wished to purchase firearms had to register with the Nazi officials and have a background check.
      Presumed German citizens were hostile and thereby exempted Nazis from the gun control law.
      Gave Nazis unrestricted power to decide what kinds of firearms could, or could not be owned by private citizens.
      The types of ammunition that was legal was subject to control by bureaucrats.
      Juveniles under 18 years could not buy firearms and ammunition.

    Never fear, El Paso County Sheriff, Colorado Springs will not enforce this crap. These Commie politicians are on the chopping block next election. This infringement will not stand. Nobody will comply and these state reps were fools for trying to slip this crap by. Bloomberg is funding this crap in our state. Their is a concerted effort underway to flip a couple Dems in the state senate to sink this unconstitutional bill. What poetic justice if the bill dies and everyone is on record with their vote, they’ll be falling on the sword for Obama and Bloomberg.

      I live in El Paso county and have my concealed carry permit which the govt. is not entitled to. Makita has been a staunch supporter of our rights and I have to give him kudos. Sometimes I wish I knew how to start a recall petition for Hickenlooper. He says all the right things to get elected and then once in tries to ram his agenda through. Gee sounds like a president I know.

      We have the right to keep and “bear arms” … that means we have the right to own and to carry/use them.

      We also have the right to “bare arms” which is the right to wear short-sleeved shirts in the summer-time.

      Lots of folks make this mistake, and the liberal idiots use this to dismiss our arguments. For some time the opposition has controlled the language. We need to use the language as accurately as we shoot.

      I heard on the radio, 740 AM, a few days ago, there are several recall efforts going on in Colorado, hopefully we can get these twits out of office, and Hickenlooper is next if he signs those bills. Ritter did the same thing, lurched way left and went along with the enviornmentalist, then when he had a 30% approval rating, decided not to run. But that is after he had done his damage to this state. Although my state went ahead and elected another Dem, I just don’t get this state anymore.

      Governor Hickenpooper just needs to put up those “GUN FREE ” signs in all the hunting areas. Those signs worked in Aurorah didn’t it? Colorado needs to be carefull. We used to spend $15,000 to $20,000 each year to go to California for gold dredging and then they passed bills stopping it. I refuse to spend any money on Amazon, E-bay or any vednders there. I won’t travel there also. We had a company training program to go to out there but luckely there was one in Houston and guess where we went.

      Hickenlooper is Colorado’s Bloomberg. The guy is another wannabe dictator. Unfortunately, the state has made a hard turn to the left, and thanks to all the Denver/Boulder/Fort Collins 20/30-somethings that dominate the culture in those areas it won’t be turning red any time soon.

      @oneshiner- No, they’re not all coming from California. I’ve lived in several different counties in Colorado and I would bet money that El Paso county has the highest percentage of Californians. There are a lot of northeasterners/upper midwesterners that have moved to the Denver area (including Hickenlooper).

      When, Hotels are vacant, shops close up, unemployment is at its highest, produce is rotting in crates, milk goes sour, meat goes rancid then maybe there will be change in these Anti-American States.

All you folks in Colorado have to do is get your Sheriffs to tell the legislative body that they will not comply to the “law.” The libs are after your guns and if you don’t stop them they will take them away on classification of gun at a time. Put your emphasis on the pro-gun legislators and the sheriffs. You’ll win in the end.

      I had to move from Colorado 5-years ago due to work. I grew up in Colorado, went to school there, & no place in the world felt more like home than Colorado. However, if the people of my home state have become leftist,, progressive, anti-gun nuts, then my heart dies a bit more today and my hopes of ever returning there will be cast away. If this insanity passes into Colorado law, then Colorful Colorado turns into another California, Illinois, & New York. Three states i never want to return to.

      With all due respect SKIPPY6, the US Constitution does not give you a right to one a gun but does prevent the US Government from “infringing” on you right to own one. However your State may be able to pass a law preventing you from owning a gun. I strongly urge everyone to make sure your state government respects the majority of their citizens. So many people don’t understand the US Constitution and have allowed it’s abuse.

      BTW – I am a gun supporter and live in a state that respects my right to protect myself.

      2nd Amendment:
      “A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.” It was adopted on December 15, 1791, along with the rest of the Bill of Rights.

      That’s not true. By your logic, States can make it illegal for women to vote or excuse their constituents from paying Federal income tax.
      The States can only legislate powers not enumerated by the Constitution. Clearly, gun ownership is enumerated by the Constitution.

      Only this far, I agree with DFW1 “that the US Constitution does not give you a right …”.

      The 2nd Amendment protects an unalienable right, given to us by our creator. Our Constitution does not “give” rights; it recognizes and protects them.

      In this same spirit, I don’t think any of the founding fathers though this right could be infringed by the States. If they meant this to be a question of another authority (like the States) they would not have been so explicit to sat that it “shall not be infringed”. That sentence is UNCONDITIONAL.

      Read the US Constitution, Bill of Rights, and study the Founding Fathers. The 2nd Amendment gives the States the right to make law regarding guns not the federal government. It has nothing to do with your God given rights or your rights to owning a gun, PERIOD. The only way to change it would be an Amendment. The first 10 Amendments limit the US Government not empower it! Did you ever hear the term “limited government”? But what does it matter BO and his predecessors have been violating the Constitution for decades. God help us for they know not what they do.

      DFW1 is correct.

      I have little pity on you fools who think the Constitution protects your right to bear arms. It actually impedes the central government form passing ANY laws that “infringe” upon that right – meaning that you should be petitioning the central government for the right to have a damnned cannon or .50 cal BMG if you wanted.

      However, the States DO retain the right to “inffringe” upon your right to bear arms. Its nothing short of rediculous laziness, apathy, and stupidity that you’ve let your home states do so. Have you not considered how easy it would be to get active closer to home? Well, your adversaries sure have – that much is for certian.

      Quit pointing to the Constitution to guard your right to bear arms – it was only meant to keep the Federals from passing anything that would disarm you. Your “rights” closer to home are just that – within your sphere of influence to protect for yourself.

      How in the hell do you actually expect to have your rights protected by a bunch of disconnected, disassociated miscreants in Washington DC? Get off your asses and see to your “inalienable rights” protection where you live. Evidently Colorado residents have much to do, so – GET TO IT COLORADOANS!

      I wasn’t QUOTING the Constitution… I was EXPLAINING it. “Enumerated” simply means “mentioned”.
      The truth is that YOU don’t know what the Constitution means on this issue.. because NOBODY does.
      United States v. Emerson, Silveira v. Lockyer, United States v. Miller, D.C. v. Heller, McDonald v. Chicago…. the Supreme Court has been bouncing around on this issue forever.

      In McDonald v. Chicago The Court held that the right of an individual to “keep and bear arms” protected by the Second Amendment is incorporated by the Due Process Clause of the Fourteenth Amendment and applies to the states. On June 28, 2010, the Supreme Court, in a 5–4 decision, held that the Second Amendment was incorporated under the Fourteenth Amendment thus protecting those rights from infringement by local governments.
      Since then, many States have enacted bans that have yet to be challenged… simply by “declaring” their bans Constitutional… despite the previous Court rulings.
      Essentially, and unfortunately, more lawsuits are needed in order to determine whether any other existing gun regulations might also be unconstitutional and, incidentally, whose interpretation (Yours or Mine)- passes muster.
      Even then- it won’t be absolute. It will be LAW… but it won’t change the words of the Constitution… or how individuals such as you or me INTERPRET those words.

      Tomato, tomato. If we were founders we’d know for sure- but we’re not.

      DWF1 is correct. The 2nd amendment doesn’t grant us any rights. The purpose of the Bill of Rights is to protect our natural rights from those who would use the government to take them away from us. He is wrong about the states having authority to take these rights away. The 14th amendment ensures that the protections in the Bill of Rights are enforced on the states.

      “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”

      I think DWF1 is sorely mistaken on what rights the states have and don’t have. You shouldn’t have stopped reading at the second amendment. If a state is allowed to ban the ownership of guns, then why did the Supreme Court rule that no government has the authority to ban guns altogether. My two pretty recent examples are Washington DC and Chicago. If it was legal for the state and even the federal government to ban guns, then neither of their handgun bans would have been struck down. There’s also more to the Constitution than the Bill of Rights. You should try reading that too.

      @DFW and others. It seems clear to me that if the intent of 2A were to simply constrain federal law, it would have used the well-known phrase “congress shall pass no law”. The Heller ruling supports my opinion.

      All of this discussion is moot, since our “elected” government doesn’t care.

      Its interesting to see so many falling for the “Incorporation” doctrine of the 14th Amendment. The raving progressive Liberals are sooooo proud of you.

      I’ve long said that the Heller and McDonald cases were the actual first step to disarmament. Those cases are the first precedent of 14th Amendment “incorporation” of gun rights. If those of us claiming “states rights” on the issue are wrong about the longest and most established precedents regarding the 2nd Amendment, then why the myriad of gun-related laws all over the country? Is it just co-incidence that the 2nd Amendment has just recently been “incorporated” into the supremecy of the Federal Government? Wake up folks.

      The unspoken truth about “Incorporation”, as has been the example of every other BoR amendment usurped by Washington, is that Washington does whatever they want once “supremecy” is achieved. The 4th Amendment’s complete destruction has been achieved in just the last week. Once the 2nd Amendment is firmly established as a Federal Supremecy: 1.) first in the minds of the electorate – which has been achieved. 2.) second by re-interpreting the language/laws to exert their supremecy, then they’ll simply do away with it.

      They will do whatever they want, no matter the language of the Amendment – because you’re local powers will be gone. You Federalist “Incorporators” are just as big a problem to Constitutionality as the Progressives.

    Legalize marijuana and take away their guns what the hell is going on. This states government along with many others is out of control. Stop standing around and take action. The government works for us they are our servants they are hired by us and we control them not the other way around. Most politicians have forgotten this. They abuse our money that we fund our government with, to go on lavish vacations, to support stupid projects, and give to their friends. It is time to stop this runaway government. It is time for us to step up and be the boss we are supposed to be. It is time we band together to protect our way of life. They are our employees they are not our leaders, rulers, king, or anything else that would put them above us. It is time we as a group write letters to our elected officials and remind them of this. we need to make phone calls to them to remind them of this. We need to visit their offices and remind them of this. We need to go to their public events and remind them of this. The government can only be as powerful as we let them be. Now is the time for action. We run them, they represent us and our wishes. We have rights and they are powerless to take them away from us. If we do not stop this and stop it soon we are finished as a free nation. Take a look around, they are telling us what we can eat how much of a soft drink we can drink, what we can and cannot have in our houses. Now is the time for action, if not we only have ourselves to blame.

      Although I agree with most of your argument, I have to say that voting, phone calls and writing letters just don’t work. I don’t think they ever did. It is evidenced by their total disregard and lack of respect of our constitution and our rights. The ONLY thing that is left is a civil war, for some insane reason they seem to support.     If they get their way enough, before you know they’ll have us down to just revolvers, lever and bolt action rifles and break action shot guns like the old west days (not sure if they had bolt action rifles then). And after that it will be ball and powder firearms, then maybe nothing.

    ‘for the good of the people’ What tyrant or dictator HASN’T said that before banning the civilian ownership of firearms.

Some are malicious (they want guns gone because they want a compliant citizenry); some are just ignorant (they have no data or frame of reference on the issue); some are overly emotional (they lack perspective); some can’t afford guns so they think nobody else should have them either; and some just go along with the “leaders” they follow. Some are a combination of any and all.

    Regardless of why these nuts want to take away our rights, it is your duty–your responsibility–to get off your **** and write, call, fax and smoke signal your elected officials (state, local and federal). Write op-eds. Put together a local rally. Educate people you know. Donate money. Join the NRA. Join GOA. Get a CHL. Join SAF. Slap a bumper sticker on your car. Put flyers up informational flyers at the supermarket. Offer to take that wishy washy liberal in your life to the range. Take a kid to the range. Don’t patronize gun-free zones (and let them know you didn’t!). Make your own PowerPoint and post it on YouTube. Do anything you can to fight this nonsense. If the good people of this country don’t get motivated to do something, these America-hating “progressives” are just going to continue to steam-roll our lives and rights. Do *whatever* you can to make your voice heard and increase the footprint of law-abiding gun owners.

      One of my “Low Information” acquaintances recently told me the Founding Fathers only intended for us to have “muskets”.
      When i tried to explain it to her.. i mentioned the word “tyranny”, and she asked me, with a straight face, what “tyranny” meant.
      This is a college graduate, mother of two, and a regular voter.

    Colorado is a living example of what liberals do when they flee their own soild nests, and start over in a more comfortable location, free of all the rules and regulations, they voted for in the old home.

    Texas better take a long look at how the progressives have infested CO and are no in the process of turning it into another California.

    This is what progressives / liberals do, and the sad part is then don’t even know it until they are forced once again to flee their own mess.

    With all of the fear buying going on, shotguns have been overlooked by most, and there is no tool quite as versatile. There are still decent used shotguns at most good sized stores that are very serviceable and they always work in a pinch. If you can, add another shotgun to the mix. Or buy a beater, remove the pin, and give it to a lib.
