Armed with a realistic plastic replica handgun, a 34-year-old man on Friday attempted to rob a bank in Trimble, Mo., according to police. Unfortunately for the robber, one of the bank’s employees was able to retrieve a very real Smith and Wesson .357 revolver and shoot the suspect in the face, effectively ending the robbery attempt.
The U.S. Attorney for the Western District of Missouri said Monday that Michael Oliva has been charged in federal court in connection with the attempted bank robbery and leading police on a high-speed chase. Oliva remains hospitalized and is in federal custody pending a detention hearing, WDAF-TV reports.
WDAF-TV has more details about the robbery based on court documents:
According to an affidavit filed in support of Monday’s criminal complaint, Oliva entered First Security Bank, 202 U.S. Hwy. 169, Trimble, at about 1:25 p.m. Friday, March 1.
Oliva allegedly pulled on a black mask, pointed what appeared to be a handgun, but was later found to be a realistic plastic replica, at a bank employee and ordered her to give him the money in her teller drawer.
The employee instead dropped to the floor behind the teller stations and began crawling toward another bank employee, shouting for help. As she was crawling, the affidavit says, she saw Oliva lean over the teller station and point his handgun at her. She grabbed a plastic trash can and tossed it over the teller counter toward Oliva; however, Oliva had moved around the end of the teller stations and was directly behind her.
The second bank employee, who was in an office, heard the shouts for help. He saw Oliva pointing a handgun at the first bank employee, the affidavit says, and retrieved a Smith & Wesson .357 revolver. He fired two rounds at Oliva. The first shot struck Oliva in the jaw, according to the affidavit, and he turned and started toward the bank’s front doors.
No money was taken during the attempted robbery.
The worker who fired the shots is not expected to face charges. He is reportedly a legal concealed carry permit holder.
“Anybody that does any kind of crime, breaks into houses or goes and robs anybody they basically they’re taking their own life on the line,” said Chief Larry Fish, Trimble Police Chief.
A bank employee told police she saw the robber staggering behind a building after the robbery attempt. Police said the man left a significant blood trail for about 150-200 feet leading to a handicapped parking space.
Trimble police officers located Oliva’s Dodge Stratus and pursued him at speeds approaching 100 miles per hour, according to the affidavit. Police used spike strips to stop the vehicle.
After police officers approached the vehicle, Oliva emerged from the car and reportedly asked, “You guys going to let me die?”
Police said Oliva seemed to have suffered a gun shot to the jaw or chin and there was a lot of blood on him and his vehicle.

The bank employee hit the robber in the head (yes, the jaw is on the head), under duress, from a distance which was not detailed in the article. I seriously doubt that the target was the robber’s jaw. I’m pretty confident that the bank employee was shooting to kill. I would have been.

The bank employee deserves a medal for “saving” the teller’s life. The gun could have just as easily been real.

Had he had a 4 in barrel or above that’s a good 700 ft lbs with a .357, that may have prevented the mope from walking out the bank. This is why we should all just open carry. Lady’s could mix and match grips and finish whith their clothes, everyone could just pack hand cannons without worrying about printing, it would be great…. whose with me?

Unfortunately, Mr. Oliva has learned that in some banks in the home state of the James Gang, bank employees shoot back with real guns and bullets.
I am now awaiting the story on Oliva’s litigation against the bank and the employee for shooting him for merely attempting to redistribute the wealth. You know it’s coming.

First thing is, the liberals need to stop trying to demonize the good guy as if he/she possibly did something wrong, “not expected to face charges” should read, ” yet another hero citizen stopped a heinous crime.”
Secondly, if he had permission to have the gun on the property (assuming it’s not his property) then he does NOT need a CCP.
Good for this guy in reacting to what was a potential real threat to others, by having the kohonas to respond with needed force.

PERIOD. Biggest problem, people don’t seem to be ale to identify a right or wrong action anymore, just whether the law allows you to do right or wrong.

Mar. 5, 2013 at 4:53pmBIGHONKEY80…I TOTALLY agree. The only kicker to open carry is…if a felon has obtained a gun illegally (Libs believe, to their very core, that never happens) then what’s to stop the felon from open carrying it? I am all for open AND concealed (with a license) carry and stiffer penalties for felons found in possession of firearms. Prison isn’t enough, though. We need to start thinking about capital punishment for people caught on video, seen by two or more legitimate eye-witnesses (preferably video), or caught by forensics committing violent/armed crimes. That would save the taxpayers hundreds of millions of dollars each year in reduced prison costs.
Here’s a tip for those that are having trouble training b/c of ammo shortages…train without shooting. Practice your proficiency at handling your weapon…unholstering, loading and discharging w/out firing a shot. Your being able to put rounds on target is secondary to your being able to get the gun out and up quickly enough to use it. Yes, shooting is half the battle, but when you can’t do something (because of lack of funding or availability…thanks to our current “leadership”), find something else CONSTRUCTIVE and INSTRUCTIVE (i.e.-teach a handgun safety course) to do with your time. Just food-for-thought. God Bless America and those that fight for her continued true liberty!

Mar. 5, 2013 at 9:09pm@Freeamerica78– Agree, I also highly suggest the dummy round for practicing good trigger pull which, in my opinion, is as important as proper site alignment. I like to load my service pistol with dummy rounds and do triggers pulls when I’m working out….Three minutes of jumping jacks, grab your gun, pick a target, acquire the front sight, and puuuuullllll. Doing the drills when working out helps you learn to maintain control under physical duress.
As for the bad guy situation, this is how I see it; punishment should be like a business transaction, and not a punishment/ revenge transaction. Example; Bad guy kills, rapes, or molest an innocent person. Bad guy has just proven to every single human on the whole of earth that he is not capable of living among the law abiding folk. The bad guy has identified himself/ herself as a cancer on society; a destructive force who if left on earth will continue to destroy in one way or another. Even if he is locked up in prison he/she continues to destroy by making you, and I pay his way via our tax dollars, and by committing more crime in prison, i.e., assaulting prison guards. When viewed from this angle, the angle of bad guy is a cancer, the next question is, what do you do with cancer? You destroy it, or it destroys you.
So, yes, Capitol Punishment needs to be revisited big time. The liberal, and religious who advocate for forgiveness, and mercy at the expense of logic, rationale, and justice really just need to shut
