Gun Control Laws Advance in Colo. — Here’s Everything You Need to Know About Proposed Bans and Background Checks

DENVER (TheBlaze/AP) — A series of sweeping gun-control measures in Colorado are on track to hit the governor’s desk by the end of the month, with Democratic committees in the Legislature advancing all the bills despite a Capitol packed with hundreds of opponents and surrounded by cars circling the Capitol blaring their horns.

Gun limits including expanded background checks and ammunition magazine limits were helped Monday by testimony from the husband of former U.S. Rep. Gabrielle Giffords and victims of mass shootings in Connecticut and a suburban Denver movie theater.

As TheBlaze has previously noted, Colorado has become a focus point in the national debate over what new laws, if any, are needed to prevent gun violence in the wake of recent mass shootings, including an attack at a suburban Denver movie theater last summer — a massacre that brought to mind the Columbine High School shooting of 1999 for many in the state and across the nation.

The seven gun-control measures cleared their committees on 3-2 party-line votes and are planned for debate by the full Senate by Friday. Four of the seven have already cleared the House, making it possible some of them will land on the desk of Democratic Gov. John Hickenlooper within weeks.

KUSA-TV provides more about what these seven proposals would do:

BACKGROUND CHECKS: House Bill 1229 would add a background-check requirement for many guns sold in private transactions. It passed a Senate committee in a 3-2 party-line vote. The Democratic-sponsored bill has already cleared the House.

MAGAZINE LIMITS: House Bill 1224 limits gun ammunition magazines to 15 rounds. The Democratic-sponsored bill has cleared the House, and passed Senate Judiciary on a 3-2 party line vote.

FIREARM BAN FOR DOMESTIC VIOLENCE OFFENDERS: Senate Bill 197 would expand a ban on gun ownership for people convicted of certain domestic-violence offenses. The bill passed the Senate Judiciary Committee on a party-line 3-2 vote Monday. One more committee vote awaits before the full Senate considers it.

GUN LIABILITY: Senate Bill 196 adds legal liability for gun sellers and owners. The bill faced its first test Monday.

GUNS ON CAMPUS: House Bill 1226 would end Colorado’s unusual law barring public college campuses from banning concealed weapons. The Democratic-sponsored bill has already cleared the House.

ONLINE GUN TRAINING: Senate Bill 195 would require people seeking concealed carry permits to take gun training courses in person. The bill faced its first legislative review Monday.

BACKGROUND CHECK FEES: House Bill 1228 would revive fees for gun purchasers who need background checks. It passed a Senate committee in a 3-2 party-line vote. The Democratic-sponsored bill has already cleared the House.

“I think they’ll all pass. I really do,” said Democratic Senate President John Morse. “And I think they all should pass. I think any of them failing doesn’t make Colorado as safe as we could make Colorado.”

A biplane flying above the Capitol Monday warned the governor, “HICK: DO NOT TAKE OUR GUNS!” Hickenlooper backs expanded background checks and has said he’s considering a bill to limit ammunition magazines to 15 rounds. He hasn’t indicated where he stands on other measures, including whether he supports a proposal that would hold sellers and owners of assault weapons liable for shootings by such firearms.

Gun rights supporters walked the Capitol halls wearing stickers that read, “I Vote Pro-Gun.” Several dozen people outside the Capitol waved American flags as light snow fell.

Inside, retired astronaut and Navy captain Mark Kelly told lawmakers that he and his wife support the Second Amendment, but he said the right to bear arms shouldn’t extend to criminals and the mentally ill.

Kelly compared the different background check requirements for private and retail sales to having two different lines at the airport, one with security and one without.

“Which one do you think the terrorist is going to choose?” he asked.

Giffords, a former Democratic congresswoman from Tucson, Ariz., was severely wounded in a mass shooting in January 2011 while meeting with constituents.

Gun control opponents say the proposals will not reduce violence. They say lawmakers should focus on strengthening access to mental health services for people who could be dangerous to communities.

The bill hearings were at times testy, and included some outbursts from the audience. After one bill passed, someone leaving the committee yelled “That sucks!” to lawmakers.

“I’ve never seen such unprofessional behavior,” Democratic Sen. Irene Aguilar told the audience at one point.

The commotion at the Capitol underscored the attention the debate has generated nationally from gun rights groups, such as the National Rifle Association, to victims’ families and White House officials.

One of the nation’s largest producers of ammunition magazines, Colorado-based Magpul, has threatened to leave the state if lawmakers restrict the size of its products. Its founder said smaller magazines can be easily connected to each other and the company fears it would be legally liable if people were to do that.

Victims who have lost relatives to gun violence say it’s time for legislators to take action.

Tom Sullivan, whose son Alex was among the 12 killed in the Aurora, Colo., theater shooting, was among the people urging lawmakers to pass magazine restrictions.

“He was enjoying the movie one second, and then the next second he was dead,” Tom Sullivan said.

Jane Dougherty, whose sister, Mary Sherlach, was a psychologist killed in the shooting rampage at Sandy Hook Elementary School in Newtown, Conn., has been lobbying Colorado lawmakers to pass new gun laws. She said she doesn’t understand gun owners who worry the bills are putting a burden on their rights.

She said the Connecticut shooter used “the same type of weapon that we use in war” to “slaughter these babies” and asked lawmakers for stricter gun laws.

“We cannot wait for yet another massacre to transpire,” Dougherty said.

If all the legal gun owners in the state refuse to obey the law Colorado will be forced to abolish these ant-Constitutional laws not enough room in the jails.

      I admire your spirit. Imagine when the cops come to your door. They are there to search your house to determine if your guns are stored safely. Or perhaps they are there to confiscate that newly designated illegal semi auto rifle or that super dangerous Beretta 682 over under. Your precious kids are in bed, Monday Night Football is playing on the big screen and you and your wife are relaxing watching the game. What choice will “most” of us have? We will comply. And they are counting on it. I have a family to raise and protect. I have a job and a mortgage. I’m just not sure what will happen. I intend no offense in my response to you.

      skeeterhawk some things are more important than life. men have died by the thousands to protect a right their are actively seeking to take away in colorado. i would in that case tell the officer that he is executing an unlawful order in violtion of his oath of office and the state as well as federal consititution as such i am under no obligation to obey or cooperate. ANY attempt to enter my residence will be met with force up to and including leathal force as is my right under law….i would also organize with my neighbors so that if they came to my home they would be facing the entire neighborhood in arms.

The reason we are losing & may well lose ultimately, is because these state politicians are more afraid of obama than us. I guarantee you, they have been told “you will pass strict gun control or we will cut off all federal money, strip your representatives of their committee positions, all the unions in your state will go on strike, DHS & IRS will investigate you, we’ll simply shut down your state.” All we are doing is holding rallies & honking horns. Oooh, that will scare them. We MUST make the pols afraid of US. The idiots that voted in Colorado for gun control should be made to pay a price for their treason.     This is by far, certainly not all we need to know. These laws have such far reaching legal technicalities and unintended consequences that they are going to ensnare hundreds, maybe thousands of Coloradans that are law abiding citizens today and will be criminals when the clock strikes midnight in July ’13. I can think of dozens of scenarios in just a few minutes of thought with HB-1224,possession of high capacity magazines. The 7 laws are a disaster. I think the most sickening thing I witnessed over the last couple weeks was high-fiving and dancing in the aisles by some of these elected zealots, ALL DEMOCRATS, at the LOSS of liberty and freedom for the citizens of Colorado. They reveled in the increase of government over reach and control.
    They should be ashamed but instead they are drunk with the power they wield over me and the notion that they know what’s best for me and my family. They sicken me with their arrogance.

If the governor signs any of these unconstitutional bills I will fly my United States flag upside down until the recalls remove these socialist democrats from office and the bills are repealed.       I was in every meeting on the house side and the senate side for these so called hearings. The answer to your question is yes. They have forgotten and they don’t care about reality or the second amendment. I’m sure you know that these plans, these bills, have been languishing in the dark recesses of the libs bucket list since the Brady Bill sunsetted. Make no mistake that these hopelessly ignorant legislators will never stop until its just the police and the military bearing arms. This is in motion and the only way to stop this is in November here in Colorado. We have to reign in these useful idiots and at least get some resemblance of sanity and constitutional reverence back in the state house.

      Every freedom loving resident of Colorado should participate in the upcoming recall movements. I was at a town hall Sunday and our State Senator (Jeanne Nicholson) refused to tell the overwhelming pro 2nd amendment crowed how she would vote. Her staff made sure the 4 anti 2nd amendment folks who wanted to speak spoke first. On her way out she was heard to make a comment about the “stupid hillbillies up here in the mountains”. She won her seat by 650 vote because the gerrymandered district includes small sections of liberal Boulder and Denver with the vast majority (75%) residing in Jefferson County which is us mountain hillbillies. A group has already formed to start to recall this socialist democrat.

      Holmes was not registered to vote and a retraction of claims that he was have caused a retraction after the false reports had been promulgated.

      Nidal Hasan was either a resident of VA or TX, neither of which require you to declare a party when you register, so he wasn’t a “registered” democrat, although he may have voted for any manner of parties and up to six times it seems.

      Cho, Virginia Tech, was not a citizen and could not vote.

      Lanza, I can’t really find any good information on this family because some sources claim R and other sources claim D. So many people are scrambling to use this for their own gain facts have been pretty muddy. However, Newtown CT voted for Romney by a 51.7 to 47 percent margin so it’s not a solidly blue part of the country voting over 99.998 percent Democrat.

      I’ll keep reading up on this because the post above sure seemed pretty shocking and it would make a great chain e-mail and has been stated by certain websites and talk hosts, but if I can do half an hour of research and shoot a few holes in it like that then it’s safe to say claims like that should be taken with a very large grain of salt.

      Honestly, the only one that is unpalatable is the magazine limit. My statement does not mean I support ANY of these measures, but they are par for the course. I can live with any of them. This is a far cry from “taking my guns.”

      Blackcrow is the only one who’s correct because the government doesn’t even have the authority to make ANY laws regarding the sale or ownership of firearms. We need to take the offensive with these candy@ss progs in government who’s made it their life’s mission to end not only our 2nd amendment but all our rights. Join the NRA and demand that ALL gun laws be abolished because every one of them is unconstitutional. It won’t happen overnight and might take a century to get done but look at the other side,they haven’t stopped their efforts to infringe on our rights and we shouldn’t stop our efforts to ensure our rights,all of them.

      Maybe nowhere in the Constitution, but the government we have set up based on that Constitution, (rightly or wrongly) certainly does regulate trade. The Constitution sets up the legislative branch to make laws. You can argue that the second amendment overrides any laws the Federal or State government may create regarding firearms, but the reality is we already have laws regarding them and will more than likely create many more laws. Is it unconstitutional? Sure, you can argue that. Till you are blue in the face. Think it matters to them?

      My point is with the exception of the magazine limit these proposed laws are not terrible. New York State created far worse. Should you fight this? Sure! We all need to fight. That is not my point here.

      Really. Exercise critical thinking a bit. Do you really think that any elected representative is telling the truth, when they openly are willing to violate any part of the Constitution? Do you rationalize that a lie for good purposes (as you determine) is honorable and righteous?

The mess made by our irresponsible and uncaring legislators that defend the FEAR of those kept ignorant by our Democratic Party despots–but will NOT defend ones fundamental right to self defense. The very EVIL that is reflected in the 911 call where a nurse was NOT allowed by her employer to administer lifesaving assistance— but was instructed to call someone else to do what needed to be done-what should have been done. The “progressives” are an EVIL from the pits of Hades.
