Arkansas Adopts Most Restrictive Abortion Law in the United States

LITTLE ROCK, Ark. (AP) — Arkansas lawmakers overrode a veto Wednesday and gave the state the most restrictive abortion law in the country — a near-ban on the procedure from the 12th week of pregnancy onward that is certain to end up in court.

A day after the Republican-led state Senate voted to override Beebe’s veto, the GOP-controlled House voted 56-33 to do the same. Only a simple majority was needed in each chamber.

The vote comes less than a week after the Legislature overrode a veto of a separate bill banning most abortions starting in the 20th week of pregnancy. That bill took effect immediately after the final override vote, whereas the 12-week ban wouldn’t take effect until this summer.

Abortion rights proponents have already said they’ll sue to block the 12-week ban from taking effect. Beebe warned lawmakers that both measures are likely to fail in court and that the state would end up wasting money defending them if they became law.

The measures’ supporters, who expected court challenges, were undaunted.

“Not the governor, nor anyone else other than the courts, can determine if something is constitutional or unconstitutional,” Rep. Bruce Westerman, a Republican from Hot Springs, said in urging his colleagues to override Beebe.

Bill sponsor Sen. Jason Rapert, a Republican from Conway, watched the vote from the House gallery and said a number of law firms have offered to help the state defend the laws in court, if it comes to that.

“I’m just grateful that this body has continued to stand up for the bills that have passed. The eyes of the entire nation were on the Arkansas House of Representatives today,” he said.

Beebe rejected both measures for the same reasons, saying they were unconstitutional and contradicted the 1973 Roe v. Wade ruling that legalized abortion until a fetus could viably survive outside the womb. A fetus is generally considered viable at 22 to 24 weeks.

“The Arkansas Legislature has once again disregarded women’s health care and passed the most extreme anti-women’s health bill in the country,” said Jill June, the CEO of Planned Parenthood of the Heartland. “With this bill, the Arkansas Legislature will force many women to seek unsafe care.”

The 12-week ban would prohibit abortions from the point when a fetus’ heartbeat can typically be detected using an abdominal ultrasound. It includes exemptions for rape, incest, the life of the mother and highly lethal fetal disorders. The 20-week prohibition, which is based on the disputed claim that a fetus can feel pain by the 20th week and therefore deserves protection from abortion, includes all of the same exemptions except for fetal disorders.

The measure is among several abortion restrictions lawmakers have backed since Republicans won control of the House and Senate in the November election. Republicans hold 21 of the 35 Senate seats, and 51 of the 100 seats in the House. It takes a simple majority in both chambers to override.

Beebe has signed into law one of those measures, a prohibition on most abortion coverage by insurers participating in the exchange created under the health care law.

Rep. Ann Clemmer, a Republican of Benton serving her third term in the House, asked her colleagues to support the override attempt, saying her votes on anti-abortion bills this year were the first time she could fully express a pro-life stand at the Capitol. When Democrats held control, such bills never made it this far.

“If I say that I’m pro-life, at some point I have to do something about what I say I believe,” said Clemmer, the bill’s sponsor in the House.

Unlike the 20-week ban, which took effect immediately, the 12-week restriction won’t take effect until 90 days after the House and Senate adjourn. Lawmakers aren’t expected to wrap up this year’s session until later this month or April.

In vetoing both measures, Beebe has cited the costs to the state if it has to defend either ban in court. The American Civil Liberties Union of Arkansas has vowed to sue if the state enacts the 12-week ban and the group said it was considering legal action over the 20-week restriction as well.

Beebe noted that the state paid nearly $148,000 to attorneys for plaintiffs who successfully challenged a 1997 late-term abortion ban.

The original version of Rapert’s bill would have banned abortions as early as six weeks into a pregnancy, but he changed the measure after facing resistance from some lawmakers worried that it would require the use of a vaginal probe.

Women who have abortions would not face prosecution under Rapert’s bill, but doctors who perform abortions in violation of the 12-week ban could have their medical licenses revoked.

    As a Christian, I realized that the next step for Christians is that we MUST step up and make sure unwanted babies have homes. Adoption rates have to increase if you are going to support more strict abortion laws.

    It’s also amusing to see right wingers who don’t believe birth control is health care…or try to restrict access to birth control, talk about saving babies. When easier/more affordable access to birth control would save far more babies, prevention is better than cure

ANYONE can go to Walmart and buy many forms of birth control without a prescription…ANYONE can go to their local health department and receive FREE birth control pills if they can’t afford the $9 a month…It’s a FARCE made up by the Left to say that people don’t have easy access or affordable birth control…If you can’t figure out how to get it easily and cheaply, you are stupid.

      Your last argument goes both ways.

      If we can’t “tell” them to not have an abortion, then your side can’t “tell” them to have one.

      The same argument is used against Pro-life men. “Well you’re a man, and will never be in that situation, so you can’t “tell” a woman not to have an abortion.”

      Following that line of logic, since a man will never know the mental anguish women experience after having an abortion, men had better never “tell/advise” women to have an abortion.

    Antitheism, I read the scripture you referenced and you greatly embellished the verses from Numbers. Shame on you. If you are making some kind of point don’t lie to make it. The Hosea verses you have taken out of context, no surprise. You have to read the preceding verses to see what was actually said in Hosea 13:16. It was a warning to the Samarian people because of their sin. The wages of sin have always been death and that is the gist of what the prophet is telling them. It is impossible for a heart of one that is lost to read the Word of God and understand because it must be read with the help of the Holy Spirit. The unbeliever does not have the Holy Spirit. It would do you good to have a believer in Christ sit down and explain scripture to you. God does not support or condone abortion. He makes it very clear in the Bible how He feels about children and how He feels about those that harm them.

    Wow! You’re a tool. In the old testament God had to be portrayed as a vengeful God so that the people would obey Him. After Christ came God became a benevolent God because of Jesus’ death and his covenant with His people. And even though you blaspheme Him and His word for your own ends, when you die He will forgive all your sins even though you don’t deserve it and welcome you into Heaven. We do not deserve His love but He gives it to us anyway.

      Hebashen, although I agree with you about God making a covenant with us after Jesus death on the cross, you are very much in ERROR about an unbeliever getting a second chance at salvation after they die. It is appointed unto men once to die, but after this the judgement Hebrews 9:27. You must make your choice to accept Jesus before you die or you will find yourself in hell when you die. Its very straight forward.

    We’ve had many more advances in detecting the beginning of life within a woman’s womb since Roe v. Wade in 1973. It only makes sense that we evolve and change our own opinions about when life really begins within the womb. It has been proven over and over that life begins at conception. I think it only prudent that laws should be enacted to protect that life. Saying that a life is a parasite is disgusting. Valuing life is a strength not a weakness and should be commended. Putting a tiny life ahead of your own selfish wants is truly a big sacrifice and should be admired. Hearing about how many babies were aborted last year when there are so many people waiting to adopt or even have their own child is deplorable. If those women who want to have an abortion would be shown a video of what actually happens to the baby during an abortion they would not be able to go through with the procedure. Their ignorance, lack of good morals, and selfishness is what the liberals are counting on. Our country makes me sad.

    It should be 12 weeks nationwide. If that is a problem for you then keep your damn legs crossed.
    I can’t believe other states allow abortions after 20 weeks – that’s a 5 month old baby. Even at 6 weeks you can see a little baby inside you on the ultrasound. People want to save turtles crossing the road, why not these little innocent pure babies? Oh yeah, it’s Agenda 21 – people are nasty and all other animals are lovely. Yes, I can agree with you on that except a little baby is innocent and does not deserve death, however, they don’t deserve to be brought into this world as ‘given up for adoption’ when really they are probably sold into the sex slave market without the mother even knowing about it. It’s really sad that the majority of human animals are so gross and creepy, including the so-called “elite.” The problem with abortion, whether surgical or by the pill – there are too many of them. What is the percentage of DAILY abortions because of rape, incest? These men never have consequences and if they did then they wouldn’t rape in the first place and we wouldn’t have a problem with millions and gazillions of bloody abortions every day! Therefore this conversation would not have to exist. However, there are too many lazy trashy women who spread their legs and use abortion pills several times per month and the pill should not be available to the public because it’s given secretly to underage girls by men who should have their dirty pecker cut off.

    God is listening and answering prayers. Amazing because this has happened during the 40 days for life campaign. At 12 weeks the dramatic development :reflexes. The baby’s fingers will soon begin to open and close, his toes will curl, his eye muscles will clench, and his mouth will make sucking movements. In fact, if the abdomen is prodded the baby will squirm in response, although the mother cannot feel it.The intestines, which have grown so fast that they protrude into the umbilical cord, will start to move into his abdominal cavity about now, and his kidneys will begin excreting urine into his bladder. This does not sound like a parasite.

      How is this an unconstitutional law? After all, how is it that an unborn baby, conceived in the United States, not entitled to Life, Liberty, and the Pursuit of Happiness? And if the fetus happens to be a girl, how is it that by killing her is not telling her what to do with her body? Do you enjoy killing defenseless, innocent human beings?

    We must be careful of the slippery slope regarding legislation such as this. If this passes people may be forced to consider who they have sex with. Such as limiting the number of partners to only one, most likely their spouse. Pregnant women may be forced to become good mothers, men will have to get out and get a job to support his family. Tragic!

    It’s not Roe vs Wade that should concern the courts. It’s Doe vs Bolton, passed the same day, which says that a baby can be aborted at ANY time if the health of the mother, or others involved (family members to pets) are affected. And it’s carried out with a wink and a nod over anyone’s MENTAL health. So all this talk of 2 weeks or 24 weeks is a load. It’s legally up to the first pang of labor. Viability is not the end date. Just invoke “health” and it’s a done deal. Good for Arkansas!

      @Evolved: It’s certainly not the unborn child’s fault that obama loves to give welfare, food stamps, free housing, free schooling (that they never use anyway) free phones, etc. to every lazy or illegal person in this Country. If he would deny those people government assistance then we may be able to help the innocent American children in this Country. Oh but then again he would lose a lot of his followers if he did that.
