‘Your Right To Trial By Jury Is Precious’: Sen. Rand Paul Stages Nearly 13 Hour Old-School Filibuster Over Drone Strikes

The Senate Intelligence Committee voted 12 to 3 on Tuesday to confirm John Brennan as the next director of the Central Intelligence Agency.

However, Brennan may have at least one more hurdle to clear before final confirmation, namely, Sen. Rand Paul (R-Ky.), who has vowed to block his nomination until the White House provides more information on its secretive drone program.

The Kentucky senator doesn’t have the 41 votes necessary to prevent a cloture vote, which would block Brennan’s confirmation, so he’s doing the only thing he can do: He’s stalling all senate business with an honest-to-goodness, old-fashioned filibuster.

“I rise today to begin to filibuster John Brennan’s nomination for the CIA,” Sen. Paul at approximately 11:45 a.m ET on Wednesday.

“I will speak until I can no longer speak, I will speak as long as it takes, until the alarm is sounded from coast to coast that our constitution is important, that your right to trial by jury is precious, that no American should be killed on American soil without first being charged with a crime, without first being found to be guilty by a court,” he added.

And it looks like he’s in it for the long haul.

“They say Lewis Carroll is fiction. Alice never fell down a rabbit hole and the White Queen’s caustic judgments are not really a threat to your security or has America the Beautiful become Alice’s Wonderland?” he asked.

He continued, reading aloud from Carroll’s book:

“No, no,” said the queen. “Sentence first; Verdict afterwards.”

“Stuff and nonsense,” Alice said widely — loudly. “The idea of having the sentence first?”

“Hold your tongue,” said the queen, turning purple.

“I won’t,” said Alice.

“Release the drones,” said the queen, as she shouted at the top of her voice.

At a later point in his speech, Sen. Paul made his intentions crystal clear: “All I’m asking of the president is that he says in public that he’s not in favor of summarily executing people.”

How long do you suppose the Kentucky senator will hold out? According to senate rules, aides are allowed to bring him food and notes. So at least he has got that.

UPDATE: The senator posed an interesting question regarding U.S. civilians the fed’s definition of “enemy combatants.”

“Nobody will ever forget Jane Fonda swivelling around in North Vietnamese armored guns and it was despicable,” he said. “That’s one thing if you want to try her for treason, but are you going to just drop a drone, a hellfire missile on Jane Fonda?”

UPDATE II: So far Sens. Mike Lee (R-Utah), Ted Cruz (R-Texas), and Jerry Moran (R-Kan.) have all stepped up to give Sen. Paul a hand. Careful to not yield the floor, the Kentucky senator has engaged each one in lengthy discussions regarding civil liberties, the U.S. Constitution, and the government’s definition of an “enemy combatant.”

And it looks like Paul is just getting warmed up.

UPDATE III: Sen. Ron Wyden (D-Oregon) has just stepped stepped in to discuss “Congressional oversight of executive branch & rules for targeted killings.”

“Every American deserves to know when the government thinks it has the right to kill them” Sen. Wyden said, sharing Sen. Paul’s concerns over the government’s widespread use of drone strikes.

This should be interesting.

UPDATE IV: Here’s a collection of some of Sen. Paul’s most notable quotes (you can see more at his Facebook page):

  • “Are we so frightened that we’re going to give up on our Bill of Rights? Are we going to round up people who have a different color skin because they might have a cousin in Lebanon?”
  • “Are you in favor of martial law by the President? I don’t think many Americans would be.”

  • “I will not sit quietly and let the president shred the Constitution.”

And, yes, as of about 3:45 p.m. ET, Sen. Paul has officially crossed the four-hour mark.

UPDATE VI: Sen. Saxby Chambliss (R-Ga.) has now joined in the discussion.

UPDATE VII: Senate Majority Leader Harry Reid (D-Nev.) has just taken to the floor to invoke cloture — and Sen. Paul rejects his proposal.

It looks like we may be in for a long evening, folks. The Kentucky senator — with the aid of Sen. Pat Toomey (R-Pa.) — is moving forward with the filibuster.

LATEST UPDATES: Yes, we are now in the twelfth hour of Sen. Rand Paul’s filibuster.

And although he looks tired, the Kentucky senator is still going, thanks in part to contributions from Republican senators Ted Cruz (Texas), Jerry Moran (Kan.), Marco Rubio (Fla.), Pat Toomey (Pa.), Saxby Chambliss (Ga.), Sen. Dean Heller (Nev.), John Barasso (Wy.), John Thune (S.D), Mitch McConnell (Ky.), and Mike Lee (Utah).

Democrat Sen. Ron Wyden (Ore.) also pitched in earlier this afternoon.

Meanwhile, over on the other side of town, these GOP senators were absent this evening — and have yet to pitch in — because they were dining with President Barack Obama:

  • Tom Coburn (R-Okla.)
  • Kelly Ayotte (R-N.H.)
  • John Hoeven (R-N.D.)
  • John McCain (R-Ariz.)
  • Bob Corker (R-Tenn.)
  • Mike Johanns (Neb.)
  • Lindsey Graham (S.C.)
  • Richard Burr (N.C.)
  • Dan Coats (Ind.)

Republican senators Pat Toomey (Pa.), Ron Johnson (Wis.), and Saxby Chambliss (Ga.) also dined with the president. However, unlike the names mentioned in the above, they’ve participated the filibuster.

As of this writing, Republican Congressmen Louie Gohmert (Texas), Paul Gosar (Ariz.), Bill Huizenga (Mich.), Michael C. Burgess (Texas), Keith Rothfus (Pa.), & Jim Bridenstine (Okla.) have arrived in the senate chamber as a show of support for the Kentucky senator.

Democrat Sen. Dick Durbin (Ill.) took to the floor to question Sen. Paul. He asked whether former President George W. Bush had the authority during 9/11 to shoot down hijacked planes. Sen. Paul responded by saying that a military response to an actual attack on U.S. soil is different from what he has been talking about for 12 hours.

Sen. Durbin later asked whether Osama bin Laden was enough of an “imminent threat” for Seal Team Six to summarily execute. Sen. Paul responded with, “Touche.” However, the Kentucky senator should’ve probably just noted that bin Laden was neither a U.S. citizen nor was he on U.S. soil.

And in case you were wondering, Sen. Ted Cruz never gave a “maiden speech,” according to BuzzFeed’s John Stanton. So, yes, Wednesday was the Texas senator’s first time speaking on the senate floor — and it was to back Sen. Rand Paul.

FINAL UPDATE: Sen. Rand Paul yields the floor, bringing his 12 hours and 52 minute filibuster to a close.

“I would go for another 12 hours to try and break Stromm Thurman’s record,” the senator said, “but I’ve discovered that there are some limits to filibustering and I’m going to have to take care of one of those in a few minutes.”

At approximately 12:41 a.m. ET, the senate adjourns.

Final Thought: Sen. Paul just told reporters that he “did not show up today planning to filibuster.” He was under the impression that the vote would be later.

However, once he discovered that Wednesday was the day to stage a filibuster, he went for it. This means that pretty much everything you just saw was unscripted. He was neither properly rested, fed, or prepped. Heck, he wasn’t even wearing “comfy shoes.”

That was all Sen. Paul.

      I wish he said the same thing during the Hagel vote. He promised to filibuster until they got more information about Benghazi, now that effort is gone and though I am still upset with Rep. Peter “They cut my funding” King, he is at least still asking questions.       The POTUS already has the power to kill US citizens, on US soil, even if they themselves are not guilty of anything or doing anything wrong. Take into consideration Flight 93. If the passengers had not brought it down would it have been OK for the POTUS to order it shot down if it was heading directly to the WH or Congress?

      The issue is when someone, anyone, who is a bad guy, is not doing anything that needs split second decision making to stop a disaster. These progressives want that power. Perhaps we should call it “The Vince Foster Act”.

      Are you really telling me that the majority of folks here are too stupid to realize the middle east terrorist threat and are increasingly militant response to it are not manufactured and promoted by the military industrial complex. After all, without Russian the possibility of moving towards what Ron Paul clearly identified was too much of a possibility. That is reigning in the military to its constitutional objective of National Defense. Not world cop, not protector of corporate interests and not as a mechanism to transfer wealth to military contractors and their wealthy investors.

      My take on RAND’S take on HAGEL and BRENNAN: Obama as president has the right to get his
      selections for various posts approved barring no information other than ideological differences. As it turns out RAND’S HONESTY and INTEGRITY in allow the Pres. this courtesy is standing RAND in great stead because THEY (the slime-ball REID types) can’t say “OH HE’S JUST SAYING NO because he’s a REPUBLICAN”… get it??? I am a total RAND FAN now!!! PRAYING FOR HIS STAMINA!

Graham, because they are having dinner with Obama tonight instead WITHOUT their supposed ‘LEADER” M. McConnell. And THAT, boys and girls, is the problem within the Republican Party. Congress and the American people, and certainly the victims families are entitled to an answer. Drones became an issue when Rand Paul got hold of a leaked memo from Eric The Red on the use of drones on the American people on American soil.

      I remember someone on the article about Rand voting for Hagel, that he only had so many silver bullets, and needed to save those for when it really counts.

      I think this is one of them. And just when you thought it couldn’t get any better, my man, Ted Cruz joins in. This just gets better and better. We are witnessing history, my fellow American brothers and sisters. This is the spark we’ve been waiting for. Let’s hope it spreads a fire of freedom and liberty across the nation.

      The issue is not to stop the nomination but to bring the issue of drones against U.S. citizens to the front burner. It is to wake people up to what this anti-Constitution administration is progressing to. This is a real Constitutionalist in action. I hope others start to see that this guy is for real.       So if someone breaks into your house, you have to capture the guy and wait until he is “found guilty”? That a cop can’t “kill an American” if that American is in the process of murdering people in a bank robbery?

      Come on folks, this is so stupid I can’t believe it. “no American should be killed on American soil without first being charged with a crime, without first being found to be guilty by a court”? Seriously? Why not take guns away from everyone, including police? So an American in the act of shooting people in a mall can’t be killed by killed by a cop or you because he hasn’t been tried and convicted?

      You guys need to stop divorcing your rationality and common sense from your inclination to believe and support anything someone anti-Obama says. No American can be killed by a cop? Please, you’re not that stupid.

      Finally, a few GOOD men. I’m so proud of these guys. God Bless Rand Paul, Mike Lee, Ted Cruz, and the sweet Dem Wyden……..now 3-4 more are joining in: Rubio, Chambliss, Toomy & ? Only that 2 faced trouble maker tried to get a cloture, but Paul dismissed that little wimp.

      Love these men who have something between their ears and other places and show they have what it takes to be REAL men standing up for our Country and Constitution against Tyranny.

      We need to get RID of all those go along to get along who want to be popular with their liberal base, and send the likes of Mr. Paul goes to Washington with all the brave men working with him. YEA!

      #STANDWITHRAND I heard a couple phrases referring to “We are a nation of laws, not of men,” ie we are not simply subjects to the whims of some dictator or king no matter our status.       @Sendinthemeteros- if you look into the leaked justice dept papers on this subject, imminent threat is extremely vague to the point it is a bit concerning. The ambiguous definition followed by Holder’s response letter seems to be what people are upset about.

      Meteors, while you’re technically correct, it is very obvious that Rand means you cannot kill US citizens on American soil without imminent threat. I really can’t think of many examples of when a freaking drone strike would fall into that category. Police don’t call in an air strike from a jet, no matter how dangerous the perpetrators are, for a reason. Drone strikes are just somewhat more economical versions of air strikes but the principles are the same. But you know this. If you had any intellectual honesty you would be with us on this. I see this as one of the few issues where the left and right can stand together on.

      The POTUS already has the power to kill US citizens, on US soil, even if they themselves are not guilty of anything or doing anything wrong. Take into consideration Flight 93. If the passengers had not brought it down would it have been OK for the POTUS to order it shot down if it was heading directly to the WH or Congress?

      The issue is when someone, anyone, who is a bad guy, is not doing anything that needs split second decision making to stop a disaster. These progressives want that power. Perhaps we should call it “The Vince Foster Act”

      I’m not sure what Rand “meant” only what he said. But yes, you are correct. You can’t kill people without “imminent threat.” And that applies to drones as well as every single other lethal weapon at the disposal of the police, state police or any arm of the government.

      But if, let’s hypothetically say, an American hijacks an airplane and it’s headed toward the Sears Tower or the Superbowl, then US has an obligation to prevent that terrorist act with whatever means at it’s disposal, including drones if appropriate.

There are literally folks that are hired to do nothing but surf sites and post just to divert the conversation and pull you out and solicit a response. When they get responses, they stay employed. This information is collected and they have to report to their employers. Some websites/blogs/etc even hire people to keep the traffic up on their own sites. So if you ignore and starve them, they will eventually become emaciated and go away. . .

      SendtheMeteors is precious. An example of intellect gone awry. One false assumption or false logical argument in the chain & the rest is for naught. Meteors is the poster child for this.

      Meteors gives us yet another strawman argument. First, planes taken over by terrorists are not the only thing we are talking about here. Second, we (normal people) already have a solution that does not entail shooting down an airplane full of people. It does not involve the liberal cooperate with the hijackers because this is better. It does not involve urinating on oneself or telling your attacker that you have an STD.

      Meteors is in the liberal predicament of having advocated jury trials for thousands of jihadis captured on fields of battle but denying jury trials for Americans in the U.S. who can be captured/arrested more easily.

      Of course Meteors voted for Clinton. Clinton appointed General Janet Reno (who held imperium). These 2 rats deiced that arresting Koresh by himself did not have the photo op or the overall optics as a military maneuvers of arresting at his house. You must realize that Meteors started down this path many decades ago.

      Gee, Meteors who would have thought that the WSJ would have a 1000 batting average? Or that Rand Paul would? I don’t. But they have a much better batting average than you when it come to policy questions.

      Maybe it is not that Attorney General holder cannot explain things well. Maybe the Obama administration was floating a trial balloon & wanted to see how much resistance they would get. They have tried trial balloon before. If there is no resistance then they say it is precedent and we know how lawyers love precedent. Precedents don’t have to be consistent with previous law, or logical or moral. They just have to stand for a period of time and judges, officials & other lawyers will build on them. It is like a person that crosses you property to get their property or for any reason. You do not explicitly have to give them permission. If you let them do it because you are unaware or any other reason, it becomes their right to under law.

      That is exactly how the Washington lawyer elitists work.

      You seem approve of it. You have extolled the virtues of precedence in the past.

    THIS is what a filibuster is supposed to be. Not like the idiotic nonsense they do these days where somebody simply declares a filibuster.

    A real filibuster cannot be stopped with a cloture vote. There is a very good reason nothing is allowed to be voted on if there is still actual debate taking place.

    Having said that though, this won’t last long with just one guy doing it. The first time he has to take a bathroom break…debate over, vote taken.

      Hi Resme,

      I saw him with Glenn and he told GB that that’s the way it is in the Senate. If the Repub’s vote no then the Demo’s will vote no when a Repub POTUS appoints someone. What I don’t understand is why Rand Paul doesn’t realize that those days are over. The Demo’s are going to do whatever they want to now.

      No more “you scratch my back and I’ll scratch yours” from the progressives.

      I don’t think Rand did it to get his back scratched. A republican (usually) never votes against a republicans president cabinet choice. ( Same with democrats )

      I just don’t see Rand as playing party politics. Was it wrong to vote for Hagel and Kerry? Sure, I don’t agree with it. Hagel is CFR and Kerry is a globalist.

      I agree here Resme- Paul was sticking by his beliefs that the president can pick his own cabinet. People need to stop getting their panties in a knot over Paul doing this. I understand they want a perfect candidate but no one is Jesus and it just isn’t realistic thinking. To be honest, Hagel is probably the best we would get from Socialist Obama.

      While I don’t agree that Reps opposing everything this administration tries to do will destroy the country, I do agree that this strategy of theirs is simply that… opposition at all costs. What I do believe could destroy the country is the fringe that has been emboldened and aroused into a frenzy with talks of violence and such in response to roughly 5 years of continual, conjured up, long-shot, wildly dramatic fabrications drawn up on a chalkboard… the only saving grace I believe is that it doesn’t occur nightly on a network that anyone really watches anymore.
