Citing a new letter from Attorney General Eric Holder, White House Press Secretary Jay Carney on Thursday responded to Kentucky Senator Rand Paul’s question regarding the White House and its stance on the use of drones on U.S. citizens.
“Does the president have the authority to use a weaponized drone to kill an American not engaged in combat on an American soil,” said Carney, reading Holder’s letter. “The answer is no.’”
Here’s Holder’s letter:
However, Carney added that “if the United States were under attack, there were an imminent threat [emphasis added],” then the president would have the authority to order military action to repel said threat.
So, although Holder’s response to Sen. Paul’s is a flat “No,” it sounds like we still haven’t escaped “imminent threat vs. immediate threat” purgatory.
Still, regardless of the letter’s brevity and the fact that Sens. Lindsay Graham and John McCain characterized Sen. Paul’s question as “ridiculous,” the fact that his filibuster pushed the White House into issuing an official response means one thing: The freshman senator gets results.

UPDATE: Following the release of Holder’s letter, Sen. Paul said that he is satisfied with the White House’s response and that he will end his objection to the nomination of John Brennan as director of the Central Intelligence Agency.
“We’ll hold a vote as soon as people want to,” he said, adding that he was “quite happy with the answer.”
“I’m disappointed it took a month and a half and a root canal to get it,” he added, “but we did get the answer.”
Later, on the Senate floor, Sen. Paul addressed Holder’s letter: “So it has taken a while, but we got an explicit answer. I am pleased that we did and I think the entire battle was worth while.”

Like WAKE F UP chowder heads…the old guard is going down. Good on the 13 reps and 1 dem from OR for chipping in…that was good to hear…but Graham and McCain…need to dry up and go away…making statements about a fellow member like that…well that was simply stupid on McCain and Grahams part…Rand Paul asked a simple question and look what it took to get a simple answer.
Really a waste of time and effort that Holder put the nation thru for simple no, eh??????????????????????? Forced to say no…ouch must have hurt his legal mind no doubt.

Mar. 7, 2013 at 5:41pmThis letter should not be acceptable to Rand Paul, if he’s sincere. Holder didn’t say the US will never use a drone to kill an American who does not pose an imminent threat. He said, the US will not use a drone on a “non-combative” citizen. Does this mean if he resists police arrest, he is then “combative” and can be killed by an overhead drone? And why should anyone believe a single word that comes out of the chronic liar, Eric Holder’s mouth? Rand Paul wasted 13 hours of his time yesterday. Nothing has changed because of it.

Mar. 7, 2013 at 5:20pmAs much as Eric Holder is being truthful in his answer, he, along with Obama are being deceptive as they both know full well they will continue with this agenda. When drone strikes on Americans begin, the American people will want to legally pursue the matter. when they do, the case will simply get stuck in endless deliberations and hearings until it is forgotten or dropped without one single consequence just like they did with Fast and Furious and Benghazi. America as a country is lenient on the president and can talk themselves out of any legal action against any illegal action perpetrated by the administration. Because of this, Obama and Holder have already won their jihad against America. It’s simply a waiting game and a matter of going through the motions now.

Shame on McCain and Graham for actually believing Pres Obozo and “Fast and Furious” Holder, without really pushing the point..

Mar. 7, 2013 at 5:00pmNo. See the War Powers Act, as well as the general concept that the president can take whatever action is necessary to protect the U.S.A. from danger, with or without a declaration of war. (think 9/11 or Pearl Harbor, to use Holder’s examples.) He used them in a stupid, not-well-thought-out way…but they really do make the point here. If an American Citizen was pointing a Stinger Missile at an airliner, and a drone saw it, the president could order that drone to drop a hellfire missile on that person, citizen or not. Imminent and Immediate Threat. Not sitting in a cafe, to use Senator Paul’s example.

We need public oversight as to WHO is being identified as Extremist, Terrorist (potential), or otherwise a “security threat”. This is the language by which the Administration is labeling their enemies ie: Anyone with a different view or who disagrees with the boy King. Anyone see the SPLC “declaration”? This is dangerous! This is the means by which they can violate your rights and hold you without trail just like any foreign terrorist met on he battlefield. It was important that Paul brought to attention & questioned the boundaries of the ” Theatre of War” and if the US Homeland is in fact part of that. There is so much work left to be done just to ensure our basic rights!!? PLEASE anyone reading this post, call or write your Representatives and DEMAND that they nullify the Patriot Act and the Homeland Security Act. These are the vehicles they employ to strip us all and are absolutely UNCONSTITUTIONAL and extreme!! We will be fine without them reading all our messages!

Mar. 7, 2013 at 4:47pmEric Holder is a Boneheaded Idiot. A TERRIBLE lawyer, let alone an awful person. But in this case, it’s the TERRIBLE lawyer part. This is simply a SLOPPY letter. Here’s why:
If an american were an innocent passenger on a bus or plane (bus, so that nobody says “airspace” is different than “on American Soil,” and that bus was being driven by Keannu Reeves, and if it slowed down, it would trigger a nuclear explosion, and the bus was headed toward a populated area (or, OK, for most people, if someone were a passenger on a jetliner headed for Washington DC a-la-9/11) the president would clearly have the authority to take that bus or plane out, including all the passengers. But the innocent person would NOT be “engaged” in combat. They would be an innocent passenger. This letter would apparently say the president could NOT take their life with a weaponized drone. B.S. I TOTALLY get, agree with, and understand Rand Paul’s position and his worries about the president’s position…and I agree. HOWEVER….this letter is SO sloppily written that Eric Holder would get a FAILING grade and probably FIRED if he were a FIRST YEAR law school student law clerk.

See the 1973 War Powers Act, passed as a joint resolution of congress.
The president CAN commit the military to action, but must “notify” congress within 2 days, and must not keep them engaged for more than 60 days.

Mar. 7, 2013 at 4:39pmRead the letter CLOSELY. We need to UNDERSTAND ‘legalese,’ and be ACUTELY aware of LANGUAGE and meaning AT LAW. It says, “…..AMERICAN….” — That is an ambiguous term, and Holder knows it — remember — “Penalty means TAX” — are American Citizens separate and distinct from United States small (c) citizens? — The term at law ‘appears,’ based on how the courts have interpreted LANGUAGE of the law, to NOT be synonymous with United States citizen – Maybe Rand needs a follow-up question ” does the term American mean United States citizen, AND American Citizen?” – the courts have held that the 14th article of amendment CREATED a new CLASS of citizenship. Assume nothing — ask a native American :-)

Mar. 7, 2013 at 4:22pmI generally agree with Senator Paul, but in this case I am not satisfied with Eric Holder’s answer. Specifically, the phrase “engaged in combat on American soil” is too vague. Is a bank robber whose shooting it out with the police engaged in combat. Is someone accused of smuggling weapons across the border engaged in combat? Is the Tea Party winning political debates engaged in combat?
Who gets to decide if one is “engaged in combat” and based on what criteria? I think Holder found himself a convenient political (if not legal) loophole. Further Holder never addressed the issue of the proximity of innocent people. What if there is a terrorist on American soil and he/she happens to be driving down a street near other cars or pedestrians? Does the president still have the authority to order a drone strike? There are too many unanswered questions in Holder response.

That way he gets to appear as if he’s providing a direct and specific answer to Paul, but he’s really just shielding his own very deliberate deceit.

Mar. 7, 2013 at 4:16pmI don’t really like Holder’s response either. It still isn’t that explicit. It just says “combat”; mind you, one man’s defense is the other sides “combat”. So if I’m actively defending my life/family/property from an intruder or hostile forces, you could make the intellectual argument that I’m “engaged in combat against” the other party. I would like Holder’s letter to be worded that “a person not engaged in active, offensive military operations against the government of the US, in which law enforcement and/or military personnel are in IMMEDIATE danger, CANNOT be killed by a weaponized drone.” THAT’S the only verbage I would accept.
