Guns of Law-Abiding Husband Confiscated After Wife’s Single Voluntary Mental Health Visit

Just last week, the California Senate approved a $24 million funding bill to expedite the process of collecting guns from owners in the state who legally acquired them but have since become disqualified due to felony convictions or mental illness.
Such was recently the case for one woman, who had been in the hospital voluntarily for mental illness last year that she says was due to medication she was taking. Lynette Phillips of Upland, Calif., told TheBlaze in a phone interview Monday she had purchased a gun years ago for her husband, David, as a present. That gun, as well as two others registered to her law-abiding husband (who does not have a history of felonies or mental illness), were seized last Tuesday.
“My husband is upset that they took the right from us that should never have been taken, Phillips told TheBlaze.
But according to the state of California, that doesn’t matter.
“The prohibited person can’t have access to a firearm” regardless of who the registered owner is, Michelle Gregory, a spokeswoman for the attorney general’s office, told to Bloomberg News.
According to the Los Angeles Times last week, budget cuts created a backlog of 19,000 people in the state with more than 40,000 guns that they are no longer legally allowed to own.
Such a Prohibited Armed Persons File is created through the Office of the Attorney General. When a person is entered into the Automated Criminal History System, the Consolidated Firearms Information System is also checked to see if they might have possession of a gun. The same check is conducted for those involuntarily admitted into the hospital for mental illness as well.
Bloomberg reported that nine police with the state’s Department of Justice wearing bulletproof vests and carrying Glocks went to homes on March 5 to retrieve the guns from people who, under this law, were no longer allowed to own. The Phillips family was one of them.
Phillips told TheBlaze the authorities arrived in unmarked cars Tuesday night around 8 p.m. Seeing as how she had never been in trouble with the law before, when they asked to enter, she said “sure,” not thinking to ask for a warrant. This gun confiscation law doesn’t go so far as to give officers warrants to enter property without permission.
Phillips explained that she and her husband were seated at their dining room table and questioned about the firearms. Phillips showed authorities where the weapons were located — a handgun in the top dresser drawer and two rifles in a safe in the garage. After Phillips unlocked the case in the garage, she said officers pulled her away from the guns and back into the house.
“They weren’t mean,” Phillips said. “I know they were just doing their job.”
But it’s a job Phillips said that never should have had to be done in the first place.
Phillips told TheBlaze she had an adjustment to her medication in December and could not stop crying. Her personal psychiatrist suggested she go to Aurora Charter Oak Hospital in Covina, Calif., where she said she was admitted voluntarily, not a threat to herself or others. Then, when she reviewed her file, Phillips said the nurse had recorded that she was involuntarily admitted and indicated she might be a suicide risk. Phillips claims the nurse had put words into her mouth.
“I kept telling her I had a grand-baby at home and had to be better for Christmas,” she said. “Does that sound like the words of someone who is a risk to themselves and others?”
Phillips believes — and noted online reviews of the center should substantiate her claims — that the process at the psychiatric hospital was a joke. Bloomberg contacted the hospital for a response regarding Phillips’ admittance but had not received a reply.
Still, the issue of patients potentially being misdiagnosed speaks of the larger implications of the laws that might apply following such a hospital admittance.
“Let’s see if we can’t prevent this from happening to someone else,” Phillips said, calling what has happened since she was in the hospital a “snowballing” effect.
“I do feel I have every right to purchase a gun,” she told Bloomberg. “I’m not a threat. We’re law-abiding citizens.”
She also pointed out the length of time it took before authorities had come to collect the firearms.
“This happened in December,” Phillips said. “I asked them at what point where they notified. They said between 24 to 48 hours after I was in the hospital.”
As Phillips pointed out, if she were truly a risk to herself or others, the authorities didn’t claim the guns in timely fashion. Timeliness could be what the state senate’s new funds for the collection of such firearms could be for. Some disagree, though, with where the new money is coming from. According to the LA Times, the $24 million would be made over three years from a fee paid for by those registering their guns in the state.
Bloomberg reported, according to state records, around 2,000 firearms, 117,000 rounds of ammunition and 11,000 magazines were collected under the law last year.
As for the Phillips family being reinstated with their firearms, she said they have to wait 30 days while an investigation is underway before she can appear in front of a judge who will determine her competency.
“What they are investigating, I have no idea.”

The food you eat, the hobbies you have, gun confiscation is a big piece, bank account confiscation, the car you drive, the house you live in and more are all under the new. State regulatory committees forming the rules. Anything deemed by these groups as unhealthy of dangerous to your health will now be regulated under. Regulations without statute and there is not a damn thing a legislator can do.

Imagine they write you up as “incapable of caring for self/possible danger to self” – remember, you walked in and begged for help. Imagine they stick you in an ambulance and ship you off to your local county mental health facility – against your will. Imagine 72 disgusting hours later, and one nights sleep, you demand to go home. Imagine they point to the door and say your husband is waiting for you on the other side – BUT, you need to sign this piece of paper first. The paper states you cannot own a firearm for the next 5 years. Imagine looking at that door – yeah, I signed the frickin paper. Now I cannot protect myself. My husband cannot protect me. We cannot protect our children in our own home. It’s not imaginary. We are living it.

The whole experience was a nightmare all around and feeling terrible because I could not protect my daughter from this! Years later, while I was going through menopause, I started having panic attacks caused by the hormone imbalance and the doctor again prescribed Xanax for me for the once monthly panic attacks. Shortly after the sexual assault, my daughter has been suffering with a very painful and incurable bladder condition. The doctors put her on birth control and anti-depressants to help her live with her daily pain, these are suppose to suppress the pain transmitters in your brain. Neither one of us has MENTAL issues that should prevent us from owing a gun!

I understand where you are coming from…my wife, shortly after we got together, fell apart. Her hormones raged due to the pregnancy, her pending divorce, and just everything else going on in our lives. She tried to commit suicide. She lost the baby with a miscarriage. She was diagnosed as having Severe re-occurring depression. We went through hell with them playing with medication and dosages.
After our marriage and getting pregnant again, she had to change some and stop other meds. She had Post Pardum on top of everything else once our boy was born. She did a voluntary committment for 3 days. It took them years to figure out which meds worked best and her diagnosis was changed to maniac-depression and then Bi-Polar.
Now 11 years later and two babies…we left CA and moved to TX…we just bought 2 rifles, a shotgun, and a .40 S&W over this Xmas…. When everything hit the fan I knew it was now or never. We have a gun safe and our kids know gun safety, our boy is a Cub Scout.
I have been thinking “thank God I am in TX” because in CA I knew they would be coming for my guns already.
I respect and love cops…and military…but now my response at the door will always be “do you have a warrant? I respect you and support you but get the hell off my property without a warrant.”
I would probably have signed the paper as well…my kids are too important…

I go to a devastating house fire where an entire family, including several children, dies in the fire. I have to help the state medical examiner’s office recover the bodies. I spend the next few days feeling really bad about the whole event, requiring me to get critical incident stress debriefing. Uh oh…..mental health counseling…..get ready for the visit by the jack-booted thugs to confiscate my firearms.
Or do I just not say anything and blow my brains out about a month later because I am haunted by those terrible memories.
Yeah, government knows what’s best.
Sometimes I am personally ashamed of serving on the fire department, because it is a government entity.

I can’t imagine living in a state like that. I was worried that my husband VA record would have them at our home, but, since the VA said SCREW YOU, We aren’t playing the game – I’m not concerned anymore. He isn’t a threat to anyone. If he were, he’d have already done something. It’s been yrs. As for the chick in the story who worked at the hosp and filled out the paperwk wrong – she should be fired, deemed untrustworthy and banned from owning a firemarm. :) After teh lady in the story gets a chance to slap the crap out of her.

The right of free assembly includes the right to associate with people that nobody in their right mind would be caught dead with. If there was a sanity test on freedom of religion, we would only have about half as many sects in this country as we do now. The right to keep and bear arms is not a right if it does not include the right of crazy people to own guns for crazy reasons.

In the end such laws only restrain people who would not be willing to kill in any case.
There is no dilemma, the right of self protection is universal.
YOU have the right to self defense no matter what your state of mind or history, and the “state” has no right to take it from you.
As a matter of fact, the state has no “rights” whatsoever. They only have powers.

Posted on March 12, 2013 at 6:10pmI know people that are on medication for high blood pressure or migraine headaches that is typically used for depression. Because the medication is listed as being used for depression the medical insurance is higher or their level of risk is associated with the mental care issues. I worry that this type of information, which the government will have and require to be reported, will trigger similar responses with the Government coming for their guns.

Can you imagine your doctor prescribing Wellbutrin and then the feds get wind of that? Next thing you know, they will be knocking down your door to take your firearms because you are taking Wellbutrin….never mind its because you want to quit smoking!

What kind of logic are these people using anyway? If people who need help refuse to seek it out because they’ll lose their rights for doing so; will the crime rate go up or down? Just imagine that what you tell your physician will be looked at by anyone that wants to, that being in the Federal Gov’t and all those that hack into their computer system (with the potential to post that info online for all your friends and family to view as well). Less is more.
