City Promises New Truck to Women Shot At During Cop-Killer Manhunt…But It Comes With a Tax Surprise

L.A. Not Complications Arise After LAPD Promises Emma Hernandez, 71, & Her Daughter, Margie Carranza a New Truck

Two women who were shot at during the Los Angeles Police Department’s frantic search for alleged cop-killer Christopher Dorner last month say city officials have failed to adequately atone for their mistake, according to their attorney Glen Jonas.

“It has been more than a month since LAPD Chief Charlie Beck promised the truck to Emma Hernandez, 71, and her daughter, Margie Carranza, who had been working in Torrance, Calif. before dawn on Feb. 7,” NBC4 News reports.

In what city officials call a “case of mistaken identity,” police officers on Feb. 7 opened fire on Hernandez’ truck, riddling it with more than 100 bullets. After the terrifying incident, Beck told Hernandez the city would replace her truck with one from Galpin Ford, a local car dealership.

But this is where things start to fall apart.

“LAPD and Galpin Ford wanted [the women] to pose for a photo opportunity and pay income tax on the truck,” the NBC report reads, citing Jonas. “The women no longer want the truck after they were told they needed to fill out a 1099 form for the donation.”

For those of you who don’t know that a 1099 form is, it’s for tax form for “miscellaneous income.”

“You tried to murder the woman, now you’re telling her she can’t have a four-wheel drive, you’re telling her she can’t sell it and you’ve got to be taxed on it?” Jonas said. “How would anyone react to that?”

“Jonas plans on filing a government claim, which is a precursor to any lawsuit filed against a government agency. He said he felt the truck was being touted as a ‘reward or prize’ instead of a sincere gesture by the LAPD,” NBC 4 News notes:

According to Galpin Ford, the new 2013 Ford 150 SuperCrew is worth about $32,500. Also, according to a dealership spokesperson, Galpin Ford planned on covering the cost of sales tax, vehicle registration, and title.

“It’s really sad for us because we want to help these women move on with their lives, and help them move forward with that, we just can’t get past the 1099 issue,” LAPD Cmdr. Andrew Smith said. “The government has to take their bite out of it, I guess.”

Emma Hernandez is currently recovering from two bullet wounds taken to the neck, which, according to Jonas, are giving her “life-threatening complications.”

“The grandmother, Emma, starts saying, ‘God have mercy on us,’ because she thinks for sure they’re going to die,” Jonas said, recounting the Feb. 7 shooting. “She then clutches around the back seat of her daughter to protect her from the gun shots because her daughter has children.”

Eight officers involved in the shooting have been placed on “non-field assignments” until “the (police) chief decides otherwise.”

      And they didn’t hit the occupants in the truck? Those guys need some training.

      Why aren’t the officers in jail for attempted murder? And where’s the inquiry into this “mistaken identity” I thought all officer involved shootings had an inquiry. When the DC sniper was on the loose the word on the streets was that it was a white box truck. The DC police shot at exactly ZERO white box trucks.

      The LAPD was completely willing to kill as many innocent citizens as possible to get to that guy. Why? Scared what stories he might be able to tell?

      Both these women where shot and their vehicle riddled by Police. There is no defense for this blatant disregard for American Citizens. So, 8 Police Officers fired 108 rounds before realizing these 2 women did not look like Dormer. This was not a case of mistaken Identity, this was a blatant Gestapo Tactic. I guess the 4 other Incidents where police open fire on Innocent Americans, during the manhunt, are just amore cases of mistaken Identity. Lets call it fair – 108 bullets that hit the truck – how many missed? I think California should pay 1 million per round that hit the Truck. 108 million seems like a fair number and the LAPD can keep the truck as a reminder.

      When is the criminal trial for attempted murder by these officers? There is no “mistaken” identity, they made no attempt to identify their target. They opened fire because it was a truck. Not even close to the perp’s. They are criminally liable for negligent discharge of a firearm and attempted murder.

      I wonder what would have happened if they had killed these to innocent women? Would they have just gotten off because of mistaken identity? If so….that would open up a lot of new avenue’s for law enforcement abuse..I pulled him over for a broken tail light….I shot him because I was pretty sure he had a gun on him because of his NRA sticker on his bumper…or…she reached into her purse to get the license I asked for so I shot her because I was pretty sure she had a weapon in there…I mean she had a Romney/ Ryan bumper sticker…I had no choice….right?

      This is so sick, I taught marksmanship in the military and always stressed only shoot at targets and of course identify your target first.

      Notice that both sides of the truck were shot up. They were “hunting” one large man. They chose to fire on a vehicle occupied by nothing they new for sure. Every target practice and every hunt I have ever gone on involved me knowing full well what I was shooting at and what was behind it. The LAPD has big problems with this one. And they thought Rodney King soaked them.

    Obviously these women posed no immediate threat. They were delivering news papers. There is no difference between the actions of these officers and Obama ordering a drone strike on a citizen driving to work. Both are non-combatants not posing an IMMEDIATE threat. The law requires us to arrest, try, and convict criminals before we execute them.

    A jury should decide if these officers broke the law.

      The more diverse police departments become, the more they shoot first and ask questions later. Half of today’s police force are short, chubby, lesbians who are obviously unqualified and scared. Lets see, now. Out of shape, scared, and heavily armed government employees are what will likely respond in an adverse situation. Patriot dad- you are so right. Why would anyone want to call 911?

    why dont they force the pig union to pay out of pocket, or deduct the cost from the salary from those pigs involved. “pigs” really doesnt do them justice- go to CA and deal with their cops, they are terrible. 20 yr old punks who never handled a gun before training, who go on ego trips since they have a badge. Min age for a cop should be 25 so they can be a tad bit more mature when starting out

    Mistaken identity! That’s Bullsh!t with a capital “B”. That is gross neglect of duty at a minimum. There is no frigging way that they unload on a vehicle in the dark before determining what they are about to shoot at. Before this is over, they are going to owe these ladies a lot more than a $32,000.00 SUV. The police need to be taken to the cleaners on this one. Maybe they will revamp their procedures or look at the lulu belles that they hired on the police force who obviously fired with complete disregard of the consequences.
    Just because they were looking for someone who took down “one of their own” does not give them the right to shoot anything that moves, which is pretty much what they did.

    What happened to identifying yourself as a police officer and issuing instructions before you shoot two innocent people?

    What these officers did is a crime. They should be awaiting a trial by public jury. I understand being a police officer is intense, if they couldn’t handle that stress they should have removed themselves from law enforcement. It is entirely arguable they committed attempted murder, they should be charged and tried with a jury deciding the verdict.

    But that won’t happen. Not because it’s LA. It won’t happen because that doesn’t happen in a police state, and make no mistake, America is indeed a police state. Stories like this simply prove it.

    If Dorner had been out to kill only civilians, the LAPD would never had put in place the huge manhunt they did. It was only because THEY and their families felt threatened that the LAPD did this. Then they proceeded to shoot up several civilian cars without positive ID of their target. Now, they want the state to benefit from this travesty. Remember, these women already had a vehicle but now they have to pay income tax on the replacement for that destroyed vehicle.

    Big governments mean big tyranny.
