Late Monday, the Colorado Senate pushed ahead some of the controversial gun control measures currently before that state’s legislature. After impassioned debate from both sides, the state Senate advanced:
- A bill limiting the capacity of gun magazines to a maximum of 15 rounds
- A total ban on gun and ammunition ownership for people accused of domestic violence
- Expanded background checks on private gun transfers
- Reinstatement of a fee for background checks, to be paid by the would-be gun purchasers
Still, only one of the above measures — the reinstated fee for background checks — is for sure on its way to the Governor’s desk to be signed into law. At least for now. The Associated Press explains in its full report below.

DENVER (AP) — A gun control package pushed by Colorado Democrats cleared the state Senate on Monday, as sponsors described it as a needed response to Colorado’s blood-soaked history of mass shootings.
One Democrat after another rose Monday to talk about restricting gun rights after last July’s shooting at a suburban Denver movie theater. The vote came on the eve of an expected plea by the alleged gunman, James Holmes, who is accused of killing 12 people and injuring dozens more.
The measures approved by the Senate included a limit on the kinds of high-capacity ammunition magazines Holmes is accused of using in the theater shooting. Other measures included expanded background checks on private gun sales and a new ban on gun ownership for people facing domestic violence charges.
Republicans argued in vain that the gun controls would not have prevented the theater shooting, nor the school massacre last December in Newtown, Conn. Some cited the 1999 Columbine High School shootings outside Denver.
Democrats stood firm.
“We can’t get back the kids we lost, but can refuse to send them more,” argued Sen. Mike Johnston, D-Denver.
The Democratic gun control package in Colorado is being watched nationally to see how a politically moderate state with a gun-loving past responds to the recent shootings in suburban Denver and in Connecticut.
Only one of the five bills heads to Democratic Gov. John Hickenlooper to be signed into law. The remaining four must return to the House for more debate, including the ammunition magazine limit and the domestic violence bill. The House is under Democratic control and will likely approve the measures.
Hickenlooper has said he supports the one bill awaiting his signature, a revived fee for people seeking background checks by gun purchasers. Hickenlooper has also called for expanded background checks and has said he’d sign the magazine limit if lawmakers get it to him.

Republicans tried in vain to stop parts of the gun control package. They argued longest against the magazine ammunition limit.
“It’s not going to work, and I hate to say that,” concluded Sen. Mark Scheffel, R-Parker. “What it will do is infringe on the rights of law-abiding citizens.”
However, Republicans only succeeded in picking off two of the three Democratic defectors they needed to defeat the ammunition limit. They warned that the gun controls are feel-good measures that won’t make Colorado safer.
“Which of these bills we’ve voted on today would have prevented these tragedies?” asked Sen. Owen Hill, R-Parker.
Democrats insisted that lawmakers have no excuse after those mass shootings not to tighten gun restrictions.
“If we fail to do a common-sense measure … then shame on us,” said Senate Democratic Leader Morgan Carroll, whose district includes the Aurora movie theater.
Democratic Senate President John Morse said Monday he was proud that his caucus was promoting measures to reduce gun violence.
“We will make a difference and increase gun safety in Colorado and decrease gun violence,” Morse said.
The remaining gun bill headed to the House requires increased training for a concealed-weapons permit. That measure has had support from both parties and is thought likely to clear the House.

Mar. 13, 2013 at 9:12amWe are alike– Only thing I can add is I survived the time when the Reprobates called Colorado the Hate State. and I suggest we call Colorado what it now is the Slave State. Twice the Democratic Party and a “progressive” Legislature has decided they know what is best for the people of Colorado. The domestic violence criteria for infringing on the right to keep and bear arms makes criminals of citizens who have not been convicted of any crime using a firearm. and denies them the fundamental right recognized in the Second Amendment. The other legislative act was when the Despots decided to disenfranchise every citizen who voted NO! to the Fraud of Civil -Unions in 2006 And the bill passed allows no exemption allowing for the free exercise of religion -a first Amendment Right that these despots take a solemn Oath or affirm their intent to support.Colorado is now the Slave State. governed by Despots

Oh, I forgot. Latinos traditionally vote Democrat, too…

Mar. 12, 2013 at 10:55amCan’t push through restrictive gun measures at the Federal level? Turn to Democrat controlled states to do your bidding. Send in Mark (I just bought an AR-15 and three 30-round magazines) Kelly [why a AZ resident should have any say in CO is beyond me]; have shotgun Joe Biden call…
So here we are in Colorado, actually a fairly conservative state other than Boulder (4 square miles of liberalism surrounded by reality) and Denver with a progressive elite controlled House, Senate and Governor’s office
What four bills move forward – (1) Universal Background Checks (aka Gun Registration); (2) Magazine limits (back at the house after the 5 round shotgun limit was changed to 28 inches); (3) automatic surrender of firearms based on TRO (where the accused may not even get a chance to defend himself; and (4) gun poll tax (pay for the redundant CBI check).

Mar. 12, 2013 at 10:22ami need clarification though…
‘accused of domestic violence’… what happened to ‘innocent until proven guilty?’
and knowing that often lawyers suggest or imply to avaricious women leaving an otherwise benign marriage to file such, for its impact in the later ‘negotiations’, this seems especially contrary to the spirit of America and the Constitution.
moreover, a ‘ban on ownership’ suggests not just no future purchases allowed, but implies there might be confiscation of existing firearms… ignoring how impossible a task either confiscating or tracking ACCUSATIONS would be, this is a tacit proof that the loons in government are NOT defending the Constitution and should be kicked to the curb forthwith.

Mar. 12, 2013 at 12:08pmBeing “accused” and “convicted of” are two different things aren’t they? If someone “accuses” you of domestic abuse, but it turns out that it was just an attempt to get more money in a divorce settlement, or perhaps a girlfriend upset that her former boyfriend dumped her for someone else, are they banned for life under this law? It does happen and not all that rarely. Shouldn’t law makers make sure that someone actually committed a crime before they take away an individual’s rights? Could it be that whether or not a person is actually guilty not the important thing, but was is important is finding a way to confiscate firearms or preventing someone from owning one? I am not down playing the dangers of domestic violence to the victim of that act, I am just saying that I find it difficult to approve of punishing someone for a crime that he has not been convicted of.

Mar. 12, 2013 at 10:19ami’ve heard reports that california emigrees are responsible for the changes, and other reports that Bloomberg and a couple other wealthy Left leaning (worded strongly pro gay marriage) activists were funneling MILLIONS of dollars into campaigns in the last 2 elections, changing the make up of the legislature.
i suspect the latter more… fleeing California one would hope the escapees would recognize that creating a new california in colorado will repeat what they just left.
and i hope that the people of colorado will stand up and decisively emphatically demonstrate to those attacking the second amendment in one of the states where it is possible to be all alone and in NEED of a firearm much of the time how they feel about such anti-constitutional measures.
in the meantime, every bordering state would happily accept MagPul and the other firearms related industries in that state. And the majority of the neighboring states have hunting, fishing, and in some cases skiing and climbing opportunities sufficient to make Colorado a ‘no go’ state on my vacation list.

We have solved gun violence once and for all in Colorado. Oh yes, and if this doesn’t work, next year we will impose more bans and restrictions.
The level of arrogance and factual ignorance of these morons is staggering. Nothing on mental health, nothing on longer, tougher sentencing guidelines for the use of a firearm in the commission of a crime. Only restricting the freedom and liberty of law abiding Coloradans.

The state has the burden of proof. If you posses a date stamped or serialized magazine that can be proven to be manufactured after 7/15/13 then you are a criminal. Before that, who cares, go ahead and buy a thousand of them. So “The Man” pulls you over after a long hot day of shooting prairie dogs. He asks you if you have any hi cap mags. And why wouldn’t he? You say, “Sure, right here officer.” Officer notices that of the fifteen 30 round mags you posses, one has a date code of 7/14/13. You are under arrest.

Mar. 12, 2013 at 8:30amIn all the sates and federal government trying to oppress the citizens, none of them have looked at enforcing the laws on the books to the maximum extent or strengthening the current laws to punish the criminal. That is due to the fact that stricter gun laws are a revenue stream, whereas enforcing the laws on the books cost the government(s), already cash strapped, to spend more money. It is also the beginning of complete confiscation and control of the people. The only way to fix this is remember these events during the next election and throw the progressives and rinos out of office.

Mar. 12, 2013 at 7:56amThe only true purpose of an expanded “Universal Background Checks” is to provide a direct conduit to future over-all gun confiscation from private, law abiding citizens. There are over 186 million guns in circulation nationwide and any private sale would only necessitate a need for the Seller/Buyer to backdate the transaction before the draconian law was enacted. In that way they would easily skirt the gun tracking and dodge the usurious fees on both ends of the sale. Then the new law will become a toothless, dead-end hag. Only greedy gun dealers and sycophant gun grabbers support the “Universal Background Check”. Each has their own reason. Both are bad!

Mar. 12, 2013 at 8:04amThat’s a very good spot on the “accused” aspect of the law. That also highlights how poorly thought out the Lib gun control freaks codify any draconian law.
