‘You’ve Got to Be Kidding Me’: Woman Reportedly Ticketed for Driving 2 Mph UNDER the Speed Limit

(Photo: NBC Washington/News4)
A Maryland woman is outraged after receiving a ticket for driving just two miles per hour under the speed limit on Interstate 95, NBC Washington/News4 reports.
The woman, who prefers to remain anonymous, was driving to work Friday morning amid inclement weather when she decided to take her speed down to 63 mph from the limit of 65 mph. StormTeam 4 Meteorologist Doug Kammerer confirmed that winds were gusting up to 40 mph.
“Sometimes when it’s dangerous, you have to do what you can to stay safe,” she explained.
But police apparently objected to the fact that she didn’t move into the right lane, slapping her with a ticket and a $90 fine.
“[I was] really shocked,” the Maryland woman remarked. “I thought, ‘Oh my God, you’ve got to be kidding me.’”
She plans to fight the ticket in court, and John Townsend of AAA Mid-Atlantic says the violation “[sends] the wrong message.”
“We will tolerate you driving at more than the speed limit,” he said, putting himself in the position of police, “but it you drive below the speed limit then you’re penalized for that.’”
News4 has more on the story:
But many are actually standing up for Maryland police, glad that they’re tackling one of the biggest driver grievances out there: slow drivers in the fast lane.
Jalopnik’s Travis Okulski writes:
There are a lot of little things that annoy me on the roads. One is a slow driver in the left lane on the highway. Seems like that annoys Maryland cops too, because they just ticketed a woman for doing 63 in the fast lane in a 65 zone. Good for them.
[...]
Of course, the AAA thinks the ticket is “silly” and “sends the wrong message.” It’s actually the opposite. The message it sends is 100 percent accurate. If you feel you need to slow down due to road conditions, feel free to do so. Just don’t do it in the left lane.
The driver is going to fight the ticket in court. I really hope it doesn’t get overturned. This sets a great precedent.
Kudos to you, Maryland State Police, for standing up for what we’ve all been saying for years.
What do you think? Is the traffic violation absurd, or are you on the side of the Maryland police in this case?

Posted on March 12, 2013 at 11:56amShe should have moved to the right, Good for the COP I am sick and tired of people in the left lane not moving over for people that want to pass. Many times I am doing the speed limit and in the left lane and still passing people but there is always one jerk off that wont move over. I should be able to move them like I did on the roads in towns in Iraq by pushing them with my truck.

I just had this happen to me yesterday . Some old bitty driving in the RAIN in the PASSING LANE , just staying slightly ahead of a semi next to her on the freeway. She didn’t want to have to drive behind anyone throwing mist .This went on for about five minutes .(felt like forever)The semi literally slowed down to to let traffic PASS HER ON THE RIGHT. I was hoping for a patrolman ,like in this story , to ticket her as well.

Posted on March 12, 2013 at 12:20pmYour right, it’s called failure to yield the right of way. This is a law in all 50 states and it also (I understand) in Mexico and Canada. Look it up if you want. Also there is supposed to be consideration for even a 2 lane road where you should yield but w/out a shoulder that would be a problem. So the ticket and the cops explanation was probably off. It should have been a failure to yield the right of way, the speed is irrelevant. Even if your exceeding the limit you still must yield. Most of the tickets are written to those who lag or drive slowly in the passing lane. The safety issue is that passing on the right puts you in a blind spot and the person on the left might not see you…This is epidemic in Illinois and Wisconsin. Funny thing is here (Arizona) that we see the slugs going slow in the fast land and sure enough many have the Illinois or Wisconsin tag. I have seen it when I lived there, even on a 6-8 lane wide freeway, they get on and slam over to the left to get in the lane, even though it might be going slower, it doesn’t matter. Side bar to this is however that she was driving in a storm and probably felt uncomfortable, all the more reason however to pull to the right and get out of the way…

There’s also a law in California that says you have to go with the flow of traffic, and this lady obviously wan’t and should have been in the slow lane.

Posted on March 12, 2013 at 12:36pmI agree with yall 100%. my only problem is she didnt break a law. A speed limit is not a speed minimum. And the law is not specific in these areas. so no matter how i get mad at them It doesnt make sense to me. Most minimum speeds i have seen are 45mph on the interstate They should however create a law that says you must maintain a minimum speed limit in what is known as the passing lane then you have one problem. People have had the license for 40 years and are not up on the new laws in the first place. I would be the first person to get a ticket for road rage because of idiots on the road. this could be beat in court anyway.. the tachs are within 2 mph variant. it will probably be discharged but it is a waist of time. he could of given her a warning about the way she should of been driving. then a ticket next time.. still 2 miles per hour.. i do 5+ every day

Posted on March 12, 2013 at 12:39pmHow is it that the “fast” lane is the one where only lawbreakers can drive? When I drive in the righthand lane and come up on someone I want to pass, I am faced with the decision to increase my speed beyond the legal limit (disobeying my Lord and Savior to submit to governing authorities) and squeeze in between two vehicles that are traveling no less than 0.25 second from one another or remain stuck behind a vehicle who is perfectly within his rights to drive lower than legal limit.
It is not “slow” drivers who drive the speed limit who are the problem. It is people who are sick and tired of people who respect the law and their Savior and are unwilling to give anyone a break because they have more of a right to that public space than anyone else.
As a result, I have slowed my normal speed to 5 below the legal limit so that if I need to pass someone I will not be forced to break the law of the land and my Savior. Even still, when one of those others who have more of a right to the road than I do get the chance, they will cut me off big time as s oon as they get the chance.
So get off of your high horse and abide by the law of the land and our Savior. I drive in DC and its a nightmare everyday. The only satisifaction I have is that I have plenty of people to pray for during my trips to and from work. I will pray for you as well.

On I-95 during rush hour a full 90% of drivers in the left lane are going AT LEAST 10 miles over the speed limit. If you find yourself in that situation, and remain in the left lane going exactly the speed limit, refusing to merge right, then IMO you are putting those around you in danger (by refusing to merge right). There IS something to be said for placing yourself in the lane where the prevailing speed of traffic is closest to your own preferred speed. Maybe you DO have the right to drive exactly the speed limit in the “fast” lane. So what? You have the right to be a jerk too.
The same folks who are afraid to exceed the speed limit by even 1 MPH are usually the same folks who are afraid of merging traffic (and who act like a lane change is inherently dangerous even when there’s no traffic in the other lane). And that’s how you end up with a 3 lane highway like I-95 having the left lane packed and the right lane mostly vacant (which is almost standard for rush hour).
TEDDYC73, if you are in the left lane and notice lots of open spaces in front of you… and in the rear-view mirror, traffic is lined up behind you… then look to your right. If you see no vehicle, MERGE RIGHT!! and if you see a vehicle going the same speed you are… SPEED UP to pass (like you are supposed to be doing when in the left lane) and THEN merge

Posted on March 12, 2013 at 1:20pmGonzo,
Does the speed limit somehow go against God? If you can justify it that way, then live with your conscience. Otherwise read Romans 13:1-5
Let everyone be subject to the governing authorities, for there is no authority except that which God has established. The authorities that exist have been established by God. 2 Consequently, whoever rebels against the authority is rebelling against what God has instituted, and those who do so will bring judgment on themselves. 3 For rulers hold no terror for those who do right, but for those who do wrong. Do you want to be free from fear of the one in authority? Then do what is right and you will be commended. 4 For the one in authority is God’s servant for your good. But if you do wrong, be afraid, for rulers do not bear the sword for no reason. They are God’s servants, agents of wrath to bring punishment on the wrongdoer. 5 Therefore, it is necessary to submit to the authorities, not only because of possible punishment but also as a matter of conscience.
or do you just pick and choose when to obey God?

Obstructing the uniform flow of traffic and creating differentials in velocity caused by lack of good driving habits and simple common sense is dangerous. It is lacking in consideration of the people around you. You cannot share a roadway when ‘you’ is the only thing on your mind. It is dangerous, unthinking, just plain wrong. So other than the many times you are doing the speed limit. What are you doing the other times? Speeding or driving too slowly? Which is it? Yes it is frustrating if people are driving slowly in the left lane commonly and inappropriately called the fast lane. If you are in the left lane and exceed the speed limit to pass someone, you are in violation of the law. Never forget that the left lane does not have any different speed limit than the other lanes. Plus her ticket will never stand. A 2 mile an hour deficit is within a margin of error that cannot be proven. Why do you think most tickets are written for 10 mph or more over the posted speed limit? It eliminates any margin of error caused by the angle of the radar that is being used. Which usually falls in the 2 to 3 mph area.

Only when rulers are doing what is right. Do you always fail to rightly divide the Word? If Christ being born was God’s will was eliminating all the firstborn to stop it God’s will? Or was it evil murder to block God’s plan? Was it God’s will when women, children, and men innocent of any crime worthy of death, merely due to heritage, went into the showers in Hitlers Europe and then on to the furnaces? When the people in N Korea eat insects, their children, each other, or starve, is it God’s will? How about the fields in Cambodia? You see when those in charge do what is right by God, then and only then do you have a valid point. There is no blanket authority for evil just because they are running things. Evil happens in this world and submitting to it is evil. America has done more good on earth than all other nations in a thousand years. Was disobeying the King wrong? Or were our Founding Fathers doing God’s will? Misunderstanding the Word has both caused and continued great evil on earth. When you saw ‘GP’ in the vision it meant ‘go plow’ not ‘go preach’. You surely underestimate God’s sovereignty if you think His will can be thwarted. I agree that it is not His will to cause pain and suffering in the world, but it most certainly is His will to allow it. Otherwise, He is nothing if He can and won’t stop it. No, my ways are not His ways and I will not presume to tell him what His will should be. I will do my best to submit to Him in everything I do and say.
I gave Gonzo the out that if he wanted to justify his lawbreaking by it somehow be that he is obeying God rather than men, then let us depart in peace. However, I do not see the speed law (especially in DC) as being against God’s laws.
As far as your attacking my misuse of God’s Word, please be specific or retract your accusation if you consider yourself to be honorable. I can swallow humble pie.
Respectfully yours,

Posted on March 12, 2013 at 2:41pmTho Those Who Think Speed Limits Are Hard Limits:
They are not. Well, it depends on where you are. Essentially it is LEGAL for you to drive over the speed limit in most states as long as the road conditions and traffic permit it to be done safely. If you wish to fight a speeding ticket read up on your state speed law. While living in California I successfully beat every single speeding ticket I ever got. How? I came to court and argued I was driving for the conditions of the road and traffic. I had a weather report for the day in question, traffic reports for the day, time, and stretch of highway I was ticketed on. Each time the judge ruled in my favor. The officer could not testify that I was driving erratically nor that I was driving in a manner that endangered others on the road.
Also, you can just as easily get a ticket for driving too slow as you can get one for driving too fast. It all comes down to the conditions of the road, traffic, and signs.

Posted on March 12, 2013 at 5:50pm@rowgue International conventions were signed in early 1970′s by most civilized countries, including USA to unify tragic regulations worldwide regarding by than globally present and dominating multilane highways. The very concept of “passing lane” was explicitly removed/banned by that treaty. One of crucial points all countries agreed to was THE RIGHT TO PASS ON RIGHT OR LEFT ON MULTILANE HIGHWAY as well as EQUIVALENCE OF ALL TRAFFIC LANES . Existence of archaic traffic regulations in some states is sad and driving education that perpetuates a concept erased from existence four decades ago is a nonsense. What’s next, requiring a flag waiver to run in front of every car as that was a rule at one time? Without an explicit minimal speed regulation, driving at or below maximum speed in any traffic lane on a multilane highway is legal. Traffic regulation to mandate move to the right is illegal for decades now and with a good reason.

As for people who argue no one should be driving faster, maybe the officer's radar was 7 MPH off and she was doing 55 in a 65. Additionally, I HAVE THE RIGHT TO CHOOSE to drive faster and pay any penalty that is applied via the law enforcement officers as directed by the laws written and approved by a legislature that have become law.

Posted on March 13, 2013 at 9:29am@ Teddy: You have apparently never even seen I-95 in that area. 65 MPH is about 20 MPH slower than most people travel on that road. She wasn’t ticketed for speed. As others have said, she was ticketed for not yielding the right of way. That road is at least 3 lanes wide, If she was going 65 MPH and in the left lane, she was creating a huge road hazard and traffic jam. Trucks aren’t allowed in the left lane, which means people were probably trying to pass TWO now-slow lanes in the far right – the entry & exit lane.
I already know she is one of these busy-bodies who like to make a stink out of something to prove a point – namely that traffic moves too fast for her and she wants it changed or she wants to make herself a pain in the 4ss. She thinks she is doing some kind of great community service when all she is doing is picking fights with bad drivers who do even more dangerous maneuvers to get around her.
The cop was right, the headline on the Blaze, as usual, is wrong.

Posted on March 13, 2013 at 9:37am@ all you people who think it is fine to do just the speed limit on a four lane + expressway. Really? What planet are you on. durring the high traffic periods on the highway, if you do not keep up with the tragic flow you are a danger to yourself and others. In most areas weather it is legal or not folks are doing 5-10 mph over the limit. If you are not doing the same and are in the left lane people are coming up on you and having to hit their brakes. In heavy traffic if one person hits their breaks it causes a chain reaction which can very likely end in someone down the line being in an accident. That is reality. The ticket should have read “this is for being an obstinate idiot and endangering others”. You know that others had attempted to get her to get out of the left lane. Blinking lights, passing on the left and waving, etc. The Cop just had enough stupidity. Good for him.

Posted on March 13, 2013 at 12:44pmnicky -reread the law please. One is allowed to temporarily exceed the posted speed limit in order to complete a safe pass. Consider a two lane highway.
For all who think this ticket is moronic re the 63 v. 65 mph, please the ticket was for blocking traffic or failure to yield or whatever, not “going too slow”. It is entirely proper for a cop to give a ticket her for going 55 in a whiteout, because that would be excessive for conditions, even though it is below the posted “normal” limit. Likewise, it could entirely be proper for giving a ticket to someone going 65 in the left lane if everyone else is going 75. Split speed limits endanger traffic, whether by bad driving habits (apparently as in here) or by regulations (as any trucker if he loves the speed differential required in CA or TX)
The police officer was required, I suppose, to make a note of her speed on the citation, but it does not matter if was 53, 63, or 73mph as long as she intentionally or not, created a hazard by blocking traffic or failing to yield to an emergency vehicle, etc

Posted on March 17, 2013 at 12:17amRedfor, you took the time to quote the MD law, now read it. MD law allows her to go as much as 10 MPH below the posted speed limit in that lane. The cop is clearly one of those “new age” cops and the judge will quite rightly set him straight.
Mr_Anderson, stay in PA. You also do not know MD law and are hence a hazard to MD highways. MD has no “keep right” regulation. We might wish all day that they did, but they don’t.
I liked the law in NJ where it said “Keep right except to pass.” If you were in the left lane, regardless of your speed, if you weren’t passing someone you got a ticket (ask me how i know). Good law.
In CT, you couldn’t pass on the right. Stupid law. One night I came upon a drunk doing 45 in the left lane of I-95. He refused to move over. Stupid law (oh I’m repeating myself).
What I see are short, ugly facists who think the left lane is theirs. They cruise there as fast as they wish, for miles on end, and then get all pissy when they come up on someone doing exactly the same thing, but at a slightly slower speed (maybe only doing 70 in a 55 MPH zone – boo hoo). We will have safe highways only when these people slow down, realize that we share the roads and start obeying the laws. Give as much consideration as you are “demanding” of others. Some of them fought in wars to give your sorry azz a free country. They probably have paid way more than you for the “priveledge” to drive on “our” roads. Cut them some slack while y

Posted on March 17, 2013 at 12:47amDr Vel Nickylouise was correct in pointing out scripture that relates to following just authority. She did not “misinterpret” it, she simply quoted it. If that one raises hackles on your neck, then please don’t read Hebrews 13:17 and for heavens sake don’t go near 2 Timothy 4:2. (Actually, please read them.)
In my mind anyone who thinks it is fine to determine what just laws they won’t keep, is no better than a President who does the same thing after taking an oath to uphold our laws (i.e., Oblamer). Speeding is against the law. If you disregard that law, what example are you setting for that new 16 year old driver or for those children in your vehicle (not counting you)? Besides, most speeders are also tailgaters who are further unaware of what a turn signal is for (kinda like a 3-fur).

Back when my Pappy was in law enforcement you walked up,carefully,to the door and rung the doorbell while your partner watched the back door to serve a warrant. Now they send a SWAT team equipped for the Normandy invasion to kick down your door and shoot your dog.Maybe even handcuff your grandma and children while screaming “STOP RESISTING M..F…!” as they kick the crud out of you. Posted on March 12, 2013 at 1:15pmShe was driving the fastest speed allowable by law, hence the ‘speed limit’. So, why does it matter which lane she was in? Because the cop views the speed limit as a recommended speed rather than a limit as it was originally intended. This is a bad ticket because it is punishing and shaming those that impede actual law breaking. Even while passing, it is against the law to exceed the speed limit, so there should be no cars traveling faster than her for any reason. She was in the fast lane where she should be when traveling the speed limit.

You fail to understand that in most places with 2 lane highway traffic you will see signs instructing SLOWER traffic to keep to the right. Why? Because you can legally drive above the speed limit as long as you are doing it safely. Most police will not stop you for doing 5 over the limit as long as weather and traffic permit. Most will ticket you if you do 10 or more over the posted limit o matter what. Speed limits are just guidelines people driving need to be aware of. I have a 30 minute highway commute. Most of that is 2 lane highway with posted speed limit of 65. Most people in the left lane drive between 70 and 75 while traffic in the right lane is going slower. highway patrol park at different intervals looking for people doing more than 75 and i have seen them pop a few doing that. Speed limits are grey areas not black and white.

“Causing unsafe driving conditions for others by driving under the speed limit in the fast lane”
Because it seems that is why she got ticketed. Not because she was driving to slow, but because she was driving slow in the fast lane without pulling to the right lane.
I believe this summarizes this story up
“If you feel you need to slow down due to road conditions, feel free to do so. Just don’t do it in the left lane.”
My last statement, is that maybe she shouldnt be fined so much, but she shouldnt get away scotch free.

You can LEGALLY drive other the speed limit. it’s up to the patrolman’s discretion on giving you a speeding ticket. As long as you aren’t doing 10 or more over the speed limit you will not get ticketed as long as the rod conditions permit it. You fight a speeding ticket in court by arguing you were driving for the conditions of the road. People on I-95 in this area are on their way to work, many with no alternate route available. I am tired of people using God to justify selfish behavior. Sitting in the left lane causes major traffic jams in this area, which is why it is against the law. People do it because they don’t like to be in the right lane and have to adjust for merging traffic, or in the middle lane with vehicles on either side. People ignore the passing lane law so frequently here, and get away with it, that it is likely she was stopped for her violation because of the traffic mess she was causing behind her.

Posted on March 17, 2013 at 2:05amNicky, that cannot happen. If he’s doing 80, sooner or later he will come upon someone only doing 79 and his rightous anger will well up an overflow yet again. He is quite selfish and immature, and he has a lot of company out on our roads today. Public education I suppose.

Posted on March 12, 2013 at 11:56amDing DING … yes .. I have a friend who got a ticket for 4 over .. she thought ridiculous .. then her sister got one for 2 over !!! .. as for the lane .. isn’t most of 95 at LEAST 3 lanes .. was she in the FAR left lane? For the flow of traffic in 3 lanes (I drive 3 lane I-75 often) it actually works best if you leave the right lane empty .. and let people getting on and off the highway use it … then the center lane is for the thru traffic … and the far left lane is for passing. Fight the ticket .. the only way to stop them is to tie up the courts.

Posted on March 12, 2013 at 2:07pmin texas we actually have signs that say “left lane for passing only”. (not sure how it is in maryland). It’s considered the fast lane. All slower traffic is to stay to the right two lanes (or however many lanes apart from the left lane). extremely slow traffic (more than 5 miles below the speed limit) is to stay to the far right lane. This is common knowledge.

Posted on March 12, 2013 at 11:37amIf you want to drive under the speed limit there is a lane for that. It is not called the “slow” lane for nothing.

Posted on March 12, 2013 at 11:52amWhen you are in the fast lane and there is no one in front of you for a quarter mile, but behind you are cars stacked up as if trying to get thru a toll booth and one is a trooper? Yea it is easy to detect that.
Wanna meet alot of Asians? Drive from Vegas to LA and everytime you have to pass someone on the right side just wave to them as you go by.

Posted on March 12, 2013 at 11:58amYep – they’re called speedometers and laser/radar.
In all seriousness, she was probably driving much slower – they probably upped her actual speed to give her the benefit of the doubt, much like most drivers rarely get hit for going five miles OVER the limit, but that’s just speculation on my part.

Posted on March 12, 2013 at 11:54amZIPIT, After talking with a good number of truck drivers I used to hate driving through Maryland when I was stationed in Upstate, NY. I usually made those long drives starting late in the day and it was well into the night when I got to Maryland. I used to work my way into a convoy of trucks and they slowed down to exactly 55 mph when crossing the state line. Still, I saw a lot of trucks pulled over along the route. The funny thing, is that stories, jokes, and movies illustrate southern PDs and sheriff departments as money gouging speed traps backed up by their local kangaroo courts.

Posted on March 12, 2013 at 11:36amThe ticket leads me to believe she was driving slow in the fast lane “Failure of driver driving below speed limit to keep right”.
Ergo, she was impeding the normal flow of traffic…bee itch got off easy if you ask me, and you did.

On the mark, it’s drivers like this that cause accidents, more tickets need to be given to those incapable of driving with the flow of traffic.
I’ve driven in countries all over the world, and I can say without question drivers in Washington State are the worst at blocking the fast/pass lane, if state troopers (who I consider State arm of the IRS) went after these people the roads would be safer and they’d collect more money.

Posted on March 17, 2013 at 2:12amRLTW, by far, year in and year out, it is speeders that cause the majority of the accidents. NHTS.

Posted on March 12, 2013 at 11:35amGo as slowly as you want – in the RIGHT lane! If driving at a speed that matches other traffic in the left lane scares you, perhaps you should explore alternate means of transportation.

Posted on March 12, 2013 at 11:41amAgreed. What a stupid and misleading headline. She was ticketed for not driving in the right lane as she should. The people that insist in driving the center and left lane aggravate the traffic pattern and create undue congestion at high speeds, which can lead to accidents.

Posted on March 12, 2013 at 11:41amThey are called Speed Limits for a reason – Because it is the Limit of how fast you can go. Switching lanes can be dangerous – especially in a high volume situation like that of the Beltway. If someone rear ends you because you are going 2 miles per hour under the Limit – Then they have a serious problem and they are breaking the Law by failing to maintain a safe distance from the vehicle in front of you !

It is a huge problem that feel they have the right to cruse in the left or center lane if they are doing the speed limit. They aggravate the traffic pattern and cause allot of accidents. Many times they have a hard time to move over to the right because they have created a bottle neck by not driving in the right lane in the first place. This has been an issue on US highways for many years. Whereas in Europe, everybody stays to the right unless they are passing, and will move over to the right as they see cars approach them in the mirror. This is how the autobahn in Germany, functions as well as it does with as few accidents as it has even though there are no speed limits!
Granted if someone was given a ticket in the middle or rush hour, when they could not merge over I would say that you have a point. Nevertheless; More people should be ticketed for not staying to the right, in order to train the drivers of our road of proper driving etiquette.

This ain’t Germany, or even Montana. It’s an incredibly overcrowded road in MD. If that lane had no speed limit, it’d be different.

Posted on March 12, 2013 at 11:35amI’m not terribly fond of any kind of speed-related ticket (if it involves recklessness then there are laws for that that can be used instead).
That said, driving slow in the left lane is dangerous, especially in bad weather / lower visibility. People coming up from behind may not see you in time.
If the weather is bad, should they slow down? Yes, are you willing to get rear-ended to prove that point?

Posted on March 12, 2013 at 12:57pmReally, Termyt? If you are doing 65 and you come up on someone doing 63, you’re not going to see them? Or is it that you want to do 75?
Someone passed me on a 4-foot wide shoulder with snow on the graded shoulder because he felt he had more right to the road than me, but I was driving the speed limit and passing someone to boot.
Wake up and smell the repentance. It’s not slow drivers who are the problem… it is impatient ones. aybe I too am impatient when I see more than half the drivers out there driving inconsideratly and dangerous, speeding, tailgating and cutting people off. I will do my best to try to understand that people live in fear and believe that if they are not where they need to be going 3 minutes sooner than safer. I will try to understand that not all have the Holy Spirit guiding them to live a life of faith and peace knowing that their rushing around will not mean a hill of beans in eternity.
