Senate Judiciary Committee OK’s Ban On So-Called ‘Assault Weapons’
The Senate Judiciary Committee on Thursday voted 10-8 to approve a ban on so-called “assault” weapons. Every Democrat supported the bill while all eight Republicans opposed it.
However, although the bill passed the Democrat-led committee, it has little chance of making it through the Senate or the Republican-controlled House.
The committee passed the bill after rejecting a series of Republican amendments aimed at exempting victims of sexual abuse, people living along the Southwest border, and others from the prohibition.
The GOP proposals were defeated along party lines.
“There are plenty of weapons out there,” Sen. Dianne Feinstein (D-Calif.) said during Thursday’s hearing. “The whole point of this bill is to reduce over time the supply, purchase, and transfer of military type weapons.”
Democrats on the committee include Patrick J. Leahy (Vt.), Dianne Feinstein (Calif.), Chuck Schumer (New York), Dick Durbin (D-Ill.), Sheldon Whitehouse (R.I), Amy Klobuchar (Minn.), Al Franken (Minn.), Christopher A. Coons (Del.), Richard Blumenthal (Conn.), and Mazie Hirono (Hawaii).
Republicans on the committee include Chuck Grassley (Iowa), Orrin G. Hatch (Utah), Jeff Sessions (Ala.), Lindsey Graham (S.C.), John Cornyn (Texas), Michael S. Lee (Utah), Ted Cruz (Texas), and Jeff Flake (Ariz.).
“Senate Majority Leader Harry Reid (D-Nev.) and other top Democrats, including Judiciary Committee Chairman Patrick Leahy (Vt.), will now try to craft one package out of the Feinstein proposal and other gun-related bills,” POLITICO reports.
“The Judiciary Committee has previously approved a gun-trafficking bill that expands federal sanctions for ‘straw purchasers’ of guns, as well as a universal background checks proposal. The panel also approved an additional $40 million for school safety programs,” the report adds.
President Barack Obama made a ban on “assault weapons” part of the gun curbs he proposed in January, a month after a shooter with an assault rifle killed 20 first-graders and six educators at a school in Newtown, Conn. Committee Chairwoman Dianne Feinstein (D-Calif.) and others have argued that such firearms are used in a disproportionate number of mass shootings and shouldn’t be available to civilians.
The prohibition is one of the most controversial of the gun restrictions being considered in Congress. Its opponents say law-abiding citizens should not lose their Second Amendment right to own the weapons, which they say are popular for self-defense, hunting, and collecting.
But most importantly self-defense.
Thursday’s debate included a fiery clash between Feinstein, the ban’s author, and freshman conservative Sen. Ted Cruz (R-Texas), TheBlaze noted earlier.
Cruz said Feinstein’s bill would create exceptions to the Second Amendment and asked her if she would favor exemptions to the First Amendment’s freedom of speech by denying that right to certain books.
“I’m not a sixth-grader,” said a visibly upset Feinstein. She described her decades in Congress involved in gun control debates and said, “I’m reasonably well-educated, and thank you for the lecture.”

Several Republicans including Sen. John Cornyn of Texas, who proposed the GOP amendments that were defeated, argued that the most effective approach to curbing gun violence would be to improve how mental health records are sent to the federal system that checks backgrounds of potential gun buyers.
Cornyn also said that as a result of Feinstein’s ban, criminals would still get the weapons.
“We’re going to give American citizens a pea shooter to defend themselves with,” Cornyn said.
Feinstein’s bill would ban large-capacity ammunition magazines carrying more than 10 rounds, which she and her allies say allow shooters to inflict more casualties before pausing to reload, which is when they might be stopped. Adam Lanza, the Newtown gunman, was said to have had 30-round magazines.
Her bill would also ban semi-automatic weapons that can take a detachable magazine and have at least one “military feature” like a pistol grip.
The bill specifically bans 157 named weapons while allowing 2,258 rifles and shotguns frequently used by hunters.
The measure’s passage by the Judiciary panel has been a foregone conclusion for some time. As mentioned in the above, it will be far more vulnerable in the full Senate, where Democrats are expected to need 60 votes for passage through the 100-member chamber.
Final Thought: Just so we’re absolutely clear, the Senate Judiciary Committee in its ongoing attempts to curb gun violence has so far voted in favor of a) universal background checks, b) an “assault weapons” ban, and c) limits on magazine size.

The Colorado gun bills that get signed into law will be challenged in court as unconstitutional on virtually the same day they become law. Much like the NY soda ban. The law won’t go into effect for long as it’s blatantly unconstituional in at least 3 different ways.
The Senate bill will be tossed around from comittee to comittee seemingly building up steam for the big vote. AND….it won’t pass the Senate. To many of the Democrats come from gun loving states. Everyone knows this, so this is nothing more that some show and tell to keep the issue alive and to keep the left leaning media happy.
If it were to pass the Senate, (which it won’t) it would then go to the house and die a very ugly death. I doubt it would even get a hearing.
Don’t buy into this sense of urgency and importance that the Media wants to portray this issue. It’s meaningless like most of the media.

You are probably right. But all they really want right now is a national registration of firearms and I am sure the failure to do so will be a felony. Thereby giving them the legal standing to classify all unregistered gun owners as domestic terrorist fugitives. Hello drones. We are already registered through the background checks done when we purchase them. If anyone believes the feds don’t log and keep all firearm purchase background checks then you really need to wake up. They don’t need to know what we purchased they just need to know we purchased and did not register.

However, these bills are very unlikely to get passed in the Senate (there are some Dem Senators that would have to sacrifice their careers to vote for this) and any Republican that voted for it would certainly be out of office come the next election. In the House there is pretty much a zero chance this would pass … or anything remotely like it.

Posted on March 14, 2013 at 2:25pmSNOWLEOPARD, regarding your 2:11pm reply to PROGRESSIVESLAYER’s 2:07pm post, the fact that all those executive orders relating to gun control that Obama issued on January 23 were pretty flaccid tells ME that Obama ISN’T so confident that he could issue draconian anti-2nd Amendment orders and then expect those who would be charged to enforce them to actually DO so.
If Obama thought the vast majority, or at least enough, of those in our military/National Guard/civilian law-enforcement would back him up in any blatantly unconstitutional gun grab, then I argue that he WOULD have gone a LOT farther with those executive orders on January 23rd than he did.
Of course, there’s no way to know right now how true this is, but I read on some Internet site at the time that Obama DID indeed want to go a LOT farther on those executive orders than he did, but that those around him, including purportedly Harry Reid, told him to back off.
If this account is true, then if Feinstein’s bill is shot down in the Senate or by the House (ESPECIALLY if it is shot down by the Senate, which his own party after all controls), what makes Obama think that the climate will be any MORE favorable for him to try some overreach by executive order on the 2nd Amendment than he apparently thought it was on January 23rd?
And in any case, as other posters here have avowed, Americans are NOT going to obligingly surrender their guns just because Obama says to – at least, not ENOUGH of them.

And we show up, if anything passes that smells of anything other than “symbolic”, at our Capitols, armed, and demand our states pass legislation to prevent these “laws” from applying. Wyoming is doing it, and so is Ohio, but I don’t know about the rest of the Union.
I might also float the notion that, you know, we could all appear in D.C. during normal business hours, armed, locked and loaded for a demonstration. If we can pull a cool million in for that we can neuter them into submission quite easily, and demand an immediate, at that very moment, repeal of all restrictions on the 2nd Amendment. Fact is that they would not be able to prevent an armed march of that size, and it would shock them beyond measure.

As far as assault weapons having anything to do with “self-defense, hunting, and collecting. But most importantly self-defense.” is at best laughable. Other than the 2nd. amendment remedies by some of the more militant members of the IRA mentioned by the idiotic Sharon Angle I see no other situation even remotely threatening enough to require a assault weapon with a high capacity magazine.

There’s just too much money in this sector of the economy for any other sector of the economy looking to make money to simply ignore.
If AMERICAN banks are enjoined from doing so, then FOREIGN banks will happily take up that slack.
And SOMEONE will set up financing companies, if need be, to provide funding for firearms manufacturers.

The picture of Leahy reminded me that he appears in two of Chris Nolan’s Batman films as a board member of Wayne Enterprises.
For a bit of perspective….when the GOP put forward legislation to bring Fannie into scrutiny in 2005 (and by so doing helped to reduce some of the impact of the mortgage crisis)…Democrats like Chris Dodd and Barney Frank killed it in committee, thus never allow it to go to the floor for a vote.
We can see where the democrat priorities lie…”affordable housing” for people who would never qualify for a loan in a sane world, over protecting yourself and your family in your own already afforded “housing”.

I look at all the damage done since Obama took office and how he just skates by with an adoring and complicit media. I think about how morally low America has sunk, the DNC booing God, the hatred of Israel, the rise of Islam, a President who openly supports things God hates like abortion and homosexuality.
I think we are past a time when voting counts. I think that with Obama in office, with the people he appoints to high ranking posts and his absolute hatred of the American way a gun ban is inevitable.
I also think that it does not matter to him how he gets this ban or how many have to die in the process.
I think all of the gun control rhetoric and bills are just theater for the masses as the real plan is put into motion behind closed doors. It is when those doors finally open that we will see that America has been conquered.
