Dianne Feinstein Battles Ted Cruz in Heated Senate Showdown Over Guns: ‘I’m Not a 6th Grader’

UPDATE:

Someone was caught on a hot mic criticizing Cruz during his closing remarks on the constitution. Watch those clips and see who it might have been here.

Sens. Dianne Feinstein & Ted Cruz Testy Senate Judicial Hearing Exchange

Senators Ted Cruz and Dianne Feinstein during a Senate Judiciary Hearing on Thursday got into heated exchange while discussing the California congresswoman’s proposed ban on so-called “assault” weapons.

“The question that I would pose to the senior senator from California is,” Cruz said, referring to Feinstein, “Would she deem it consistent with the Bill of Rights for Congress to engage in the same endeavor that we are contemplating doing with the Second Amendment in the context of the First or Fourth Amendment, namely, would she consider it constitutional for Congress to specify that the First Amendment shall apply only to the following books and shall not apply to the books that Congress has deemed outside the protection of the Bill of Rights?”

“Likewise, would she think that the Fourth Amendment’s protection against searches and seizures could properly apply only to the following specified individuals and not to the individuals that Congress has deemed outside the protection of the Bill of Rights?” he added.

Apparently, Sen. Feinstein was not amused with the Texas senator’s line of questioning.

“I’m not a sixth grader,” said responded. “Senator, I’ve been on this committee for 20 years. I was a mayor for nine years. I walked in, I saw people shot. I’ve looked at bodies that have been shot with these weapons. I’ve seen the bullets that implode. In Sandy Hook, youngsters were dismembered. Look, there are other weapons.”

“I’ve been up — I’m not a lawyer, but after 20 years I’ve been up close and personal to the Constitution. I have great respect for it. This doesn’t mean that weapons of war and the Heller decision clearly points out three exceptions, two of which are pertinent here.”

“And so I — you know, it’s fine you want to lecture me on the Constitution. I appreciate it. Just know I’ve been here for a long time. I’ve passed on a number of bills. I’ve studied the Constitution myself. I am reasonably well educated, and I thank you for the lecture,” she added.

The California senator eventually got around to answering Sen. Cruz’ question on how she reconciles her proposed “assault weapons” ban with the Second Amendment.

Her eventual answer? “Assault weapons” are kind of like child pornography. She argued that although we have a First Amendment right to free speech, that doesn’t mean child pornography is protected by the Constitution. Likewise, she continued, so-called “assault weapons” can be legally banned.

Sen. Feinstein later apologized to Sen. Cruz, explaining that he “got her dander up.”

    When government punishes law-abiding citizens for the crimes of criminals by usurping the people’s Constitutionally guaranteed rights and freedoms, the rule of law is lost as is the credibility of that government.

      By equating guns to child-pornography, Dianne Feinstein’s answer to all of Ted Cruz’s questions is a resounding YES. She states clearly that she “comes from a different place”. She clearly sees her role as a re-definier of what Liberty is, what Rights are, and also – I will add – she is clearly confused about what the words “military weapons” means (in spite of her claims of being reasonably well-educated).

      She represents governance from emotionalism, rather than from rational thought. When trying to discuss the Constitution, she diverts to “dead bodies” and gore – refusing to engage in logic, and rushing into panic-mode.

      She sees herself as on a holy & righteous crusade to “save the children” by destroying Liberty. She represents a danger to the Republic.

      I hate when my bullets implode. It’s even worse when they cross a trans-dimensional warp hole and vector into an alternate quantum reality.

      Feinstein’s answer? She didn’t. She snarked, she belittled, she sneered, she put on arrogance like it was a mink coat. But she didn’t answer. Saying “you can’t yell fire in a theater” is not the same as saying “the 1st Amendment only applies to these books, but not those books”. She knows that. Well, I assume she does, she may be so full of herself that reality cannot penetrate her thick head. Even if it goes through a trans-dimensional warp hole.

      This radical progressives argument is logically disabled. At no time is child pornography legal. In her mind, soldiers, Marines, and most police officers possess the equivalent of child porn. It is an absurd argument made by an absurd politician. She speaks of all of her time in office as if it makes her an expert in anything besides convincing stupid people to vote for her over and over again.

      My response to Senator Feinstein would be to ask where there are people using child pornography legally. What a ridiculous argument. There are millions of gun owners that lawfully possess and use firearms of all kinds, yet we want to regulate it so that we punish the people that follow the law. That makes total sense.

      The reason child porn is illegal is that it is evidence and continuation of a crime against a child, namely the sexual exploitation of a child. None of her arguments hold water. She is, first and foremost, a fascist. She will go after the 1st amendment and they already have. They consider the constitution an annoyance. They have already severely limited the first amendment already. You must have approval if you are to reach any number of given people, you must have approval if you hold a certain profession or location to speak about politics (FEC FCC IRS). The 4th amendment is already removed. They only really allow it to be referenced in cases of drugs, or local crimes. It doesn’t apply to those who might be deemed suspicious of committing political crimes.

      RabbiDRJerkins, you confabulate information and facts with antisemitism. Look, not all communists were/are Jewish, but communism did come from the Jewish culture, Moses Hess and Karl Marx. There were Latvian, Norwegian, Ukrainian… Nazis, but the Nazi movement came from Germany, Germans. Germans created, promoted, and disseminated that movement. Likewise with Jews and communism, now called progressivism.

      Many have recognized these facts and information. Sadly, these facts and information hide behind the label of antisemitism; which you have learned so well. Pavlov was able to train his dogs in a very similar manner… a reflex response.

      Perhaps her credentials are as impressive as she states. Perhaps is it, in fact, senility that is preventing her from seeing the negative impact of her stance. The fact is, the Constitution provide the “RIGHT” for the American people to bear arms. It does not include child pornography in the Free Speech clause. There is no Constitutional right for people to view pornography of any type. That implication is just as stupid as finding a right to kill your unborn child in the privacy clause.

      An “imploding bullet”. Would you consider this a misfire? Lately it seems almost everything Sen. Feinstein says is a misfire. ‘All veterans are mentally ill”, “PTSD is a new problem, a result of the Iraq War”. She is right, she isn’t a sixth grader. However some of the things she says makes one wonder about her mental capacity. To dismember means to remove or sever a part of the body from the body. Did anybody ever say that any of the people killed were dismembered?
      What is her idea of an assault weapon? I have a High Point Carbine. What makes it an assault weapon? when it has its forward grip and tactical stock on it. Remove the grip and change the stock and it isn’t on the list. The mag is 10 rounds but it is an assault weapon. I bet she supports the school district that suspended the kindergarten student for making a finger gun in the playground. Because it would be an assault weapon on the school grounds.

      Shalom,
      Interesting “facts”. A half truth, is still, however, a lie. While the people you cite did indeed have Jewish heritage, the horrors that came forth from them had no origin in that Jewish heritage. Were the Jewish faith or culture a component of Communism, surely someone in over 5000 years of Jewish history would have come up with it before these men. Surely it is the few progressives, the communists who are the abberration, and not the millions if not billions who have lived their lives according to Jewish faith and culture and never come to so deranged a paradigm.
      Progressive and Communist ideals are the antithesis to Jewish belief, and have never been promoted by any of the Jewish faith.

      Saying such is the equivalent of making a statement that pedophilia derives from the Catholic faith simply because many who claim that faith, but do in no wise practice it, have been proven to be pedophiles. Just as pedophilia did not arise from the Catholic faith and culture, but rather shows up in those who have completely rejected that faith and culture, so it is with progressivism and the Jewish faith and culture.

      It is not through the actions of the slackers and apostates that you uncover the truth of a faith or culture, but through the texts and those who abide by them.

      You are free to believe what you will, I simply suggest that believing in the truth might serve you better.

      “Government is a trust, and the officers of the government are trustees. And both the trust and the trustees are created for the benefit of the people.”

      – Henry Clay

      ~~~~~~~~~~~~~~
      Henry Clay, Sr. (April 12, 1777 – June 29, 1852) was a lawyer, politician and skilled orator who represented Kentucky in both the Senate and in the House of Representatives. He served three different terms as Speaker of the United States House of Representatives and was also Secretary of State from 1825 to 1829. He lost his campaigns for president in 1824, 1832 and 1844.
      Clay was a dominant figure in both the First and Second Party systems. As a leading war hawk in 1812, he favored war with Britain and played a significant role in leading the nation to war in the War of 1812.
      Abraham Lincoln, the Whig leader in Illinois, was a great admirer of Clay, saying he was “my ideal of a great man.”
      Dear Ghost of Jefferson:
      Read your letter to Mrs. Feinstein(she should be defrocked from her title as Senator) and agree 100% with your stance against the b!tch. She is an old bag and certainly not fit to serve as a US Senator. Like most liberal senators, she has no common sense nor horse sense either. She has a disease – liberalism. The disease of liberalism has been researched and defined by Lyle H. Rossiter, Jr. M.D., a forensic psychiatrist with over 35 years of clinical experience.
      His book is titled “The Liberal Mind: The Psychological Causes of Political Madness” and can be purchased on Amazon or the doctor’s website, http://www.libertymind.com
      You will find Mrs. Feinstein and Mrs. Asterbuilt’s pet horse(Barbara Boxer) along with Nancy Pelosi, and don’t forget the Schumer’s and Durbin’s of life, explained in explicit detail. There are all kinds of names and tabs you can place on them, but the most accurate one would be mental. That should disqualify them as not fit to serve, but we are still behind the times. Therefore we might have to arrange to drag them kicking and screaming out of Congress and place them in the looney farm that was used for “One Flew Over the Cuckoo’s Nest”. They could then pal around with Jack Nicholson. Lovely group of people. They might want to add a couple wings for a number of the others who would fit well there. We probably could take up a collection to fund their permanent stay. We would save on taxes as well.
      The 2nd Amendment is the ONLY legal law concerning our RIGHTS as individuals to keep (own) and bear (carry) arms in these United States. NO government federal, state, country, city, and NO treaty with any other government, etc. has any right to make any law concerning arms – the US Constitution trumps a federal treaty. (This means getting rid of the Firearms in The Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE). All citizens have the NATURAL right to protect themselves, family and property from all transgressors. The Bill of Rights covers every citizen in the United States of America, no matter what US State or US Territory he or she may reside. In other words they are INDIVIDUAL Rights.
      The 2ND Amendment reads: A well regulated militia, being necessary to the security of a free State, the right of the people to keep and bear arms, shall not be infringed.
      Really, how hard is it to understand: Shall Not Be Infringed?
      Shalom,
      None of their actions can cause law abiding citizens to become criminals. They may indeed call them criminals, but name calling does not make something so.
      No law that they have passed in this country that is contrary to the constitution is valid. They have the power to arrest, but that should never be confused with the right to arrest.
      In passing these laws, it is the senators and representatives who make themselves criminals by violating the Constitution, the real law of the land.
      The only citizens who make themselves criminals are those who comply with the unconstitutional laws, and who, when they have the opportunity, do not act to remove the real criminals from their invalid positions of power through any means that are at hand.
      The opinion of another does not determine my nature or alter my being.
      Remember, any who act to restore the Constitution, any who act in accordance with the Constitution, are defined as criminals and terrorists by this government. Those who now stand against treason are now called traitors. I am in good company when standing with any who are so branded by the government, for I would rather be called a criminal and a traitor, than be a criminal and traitor.
      I must say, this woman deserves all the animosity directed at her.
      ‘ John Locke reasoned that God gave the earth and everything in it to the whole human family as a gift. Therefore the land, the sea, the acorns in the forest, the deer feeding in the meadow belong to everyone “in common.” However, the moment someone takes the trouble to change something from its original state of nature, that person has added his ingenuity or labor to make that change. Herein lies the secret to the origin of “property rights.” ‘ -The 5000 Year Leap
      Property rights are sacred, because infused inside every man’s property is his essence, the sweat and trial he had to endure to obtain something the honest way.
      I’d like to think this applies to money as well, which is why even taxes are seen as an affront to natural law. Not my idea, the idea of the enlightenment thinkers who helped forge America.
      Great post.
      They created the Indefinite detention bill for people that know their rights, the CONSTITUTION and the LAW.
      They have given themselves the authority to execute any American, without due process or evidence.
      They have done this, because they know that the educated people could easily win their case with 12 of their peers, and expose the system’s fraud.
      Instead, they classify the informed Patriots as “Right-wing, Anti-American, Anti-Government, Domestic Terrorists” that can be assassinated without a trial.
      These “representatives” are clearly the true Criminals and Terrorists.
      Any lawyer knows the difference between ‘MAY’ and ‘SHALL’.
      75% of these POS politicians are lawyers. They know that it did not say’ MAY not be infringed’.
      ‘MAY’ would give them the ambiguity to achieve this act of regulation, because ‘MAY’ allows for OPTIONS.
      ‘SHALL’ means that There are NO OPTIONS !!!!
      She is the face of the enemy. You cannot debate the Constitution with you because she feels that you are stupid, she knows better than you (because you are stupid), and you should shut up & let her decide what is right & what is wrong. Your job in this country is to go and work so you can pay the taxes to provide her with a good living. Your freedom & liberty is not an issue. If she were to ban all guns in the country, murders would still happen because the guns are tools, not the source of the evil. Her logic is invalid, but she doesn’t care because in her mind, we are all stupid & nothing we can say will change her mind. It will eventually come down to whether those in this country that still value freedom & liberty are willing to fight to keep it. That is what DHS is preparing for (1.6 Billion rounds of ammo, 7000 fully automatic “Personal Defense Weapons”, 2717 Light Armored Tanks, Range targets with pictures of pregnant women/children/elderly laides in their kitchen, and Obama surveying which military leaders will follow his orders to shoot US civilians that refuse to give up their firearms).
      I think I finally found something said by this senator that I can actually agree with. Her comparison of “assault weapons” to child pornography, I think, is somewhat profound.
      You see, people have been taking pictures of their kids since the invention of the camera. I believe my mother has a picture of me running around my grandparents house in nothing but a bright blue motorcycle helmet. Is that child pornography?! It actually depends on how the picture is used. If the picture is distributed to perverts or displayed for sexual pleasure, then yes, I would say that it is child pornography. If it is kept by my mother to be used for my own embarrassment and her reminiscing of days long gone, then it is not, and it should be protected by the first amendment.
      Similarly we can look at “assault weapons.” If it is kept by a law abiding citizen for protection or enjoyment, there is nothing wrong with it and it should fall under the protection of the second amendment. If it is used by a criminal to hurt people, then it should be taken away from THAT PERSON, just like pictures of naked children are taken away from the people who abuse them. A gun isn’t an assault weapon until it is used to kill people, no matter what the mechanics, and even then, there are times when that is rightfully justifiable under the law.
      “communism did come from the Jewish culture, Moses Hess and Karl Marx”
      So Karl Marx, who was born into a family that practiced Christianity, is the paradigm of what Jewish culture is? Moreover, why do you never bring up Frederich Engels, Marx’s partner in just about everything? Is it because he’s not Jewish? But wait, how could a non-Jew from a non-Jewish cultural upbringing have helped to author the Communist Manifesto?
      Here’s what I notice Jerk. Every major communist in history has either been an atheist or has rejected any traditional religion for a secularized one that better fits them. Every Jew you mention has either been secular, atheist, or, as in your star case of Marx himself, wasn’t even raised Jewish.
      Besides, you claim German culture gave birth to Nazism but German culture also has influenced US culture. Through Engels I can argue that German culture created Communism (did I mention that Marx too is a product of German culture). But even though the English language you speak is more closely related to German than to any other language, you never attack American culture for its connection to Germany. You don’t even attack Germany itself. Why is it that Germany can produce something clearly evil (unless your Techengineer) and be forgiven while the Jews are all guilty for all eternity for the actions of a few HUNDRED of their members that you have specifically named?
      Ted Cruz, as a graduate of Harvard Law School and former Law Clerk for CJ Rehnquist, should have known better than to ask a silly question like this. Of course, the government can ban certain books (child pornography), or allow searches of certain areas (cars), or ban certain guns. Society would not function if all the rights in the Constitution were absolute. It was a specious argument made to win political points. Fortunately it blew up in his face. Unfortunately, Ted Cruz isn’t the only politician, Republican or Democrat, who twists the law to fit his or her agenda.
      I’ll also have to call you out on your correlation comment. There simply is nothing to suggest that 90% of Jews are communists like you suggested. In fact, the majority of Jews I’ve met and spoken to associate Communism with Stalin, who persecuted Jews by the thousands. Russian Jews in particular, many having experienced Communism first hand, are often some of the strongest critics of Communism there are.
      Personally, I find it contradictory that you can justify 51% of Americans voting Democrat as being a symptom of widespread ignorance but simultaneously refusing to admit that any non-white ethnic group could be voting Democrat due to ignorance.
I’m with you, I want no restrictions on my God and Constitutional right to keep and bear arms, including chemicals and biological arms, like anthrax and Sarim (sp on purpose) gas. Where your anarchist ideas go astray is that the Supreme Court interprets the Constitution, not you. You claim to love the Constitution, just not the functional part about the judicial branch. You know, those legislators who can under the Constitution limit gun sales. Here’s Scalia’s comments on Heller:
      “Like most rights, the Second Amendment right is not unlimited. It is not a right to keep and carry any weapon whatsoever in any manner whatsoever and for whatever purpose: For example, concealed weapons prohibitions have been upheld under the Amendment or state analogues. The Court’s opinion should not be taken to cast doubt on longstanding prohibitions on the possession of firearms by felons and the mentally ill, or laws forbidding the carrying of firearms in sensitive places such as schools and government buildings, or laws imposing conditions and qualifications on the commercial sale of arms. [United States v.] Miller’s holding that the sorts of weapons protected are those “in common use at the time” finds support in the historical tradition of prohibiting the carrying of dangerous and unusual weapons.”
      Hey, why can’t I own a sawed off shotgun or ricin? I will not comply!
      @Send in the mediocre.
      Why would I care if you had serin gas, ricin or a sawed off shot gun ?
      I don’t give a crap what you own. I only care if you violate my rights with them,
      If you are a suicidal psychotic (Thats debatable), you could find a hundred ways to kill off a large number of people or an individual.
      1) Poison in a cafeteria
      2) a Bomb
      3) A 80 mph vehicle on a sidewalk during a large event
      4) A private plane full of gas into a sporting event.
      5) Sinking a ship with a lot of people on board.
      6) illegally (or legally) obtained guns.
      7) A machete in crowded place.
      8) Poison into a water supply
      I could go on….
      My point is, if you have a proclivity to murder, you will find a way.
      What is the differece between getting shot with a shot gun as opposed to a sawed-off shotgun ?
      Both are lethal.
      This one statement from Thomas Jefferson says it all.
      ‘”The strongest reason for the people to retain the right to keep and bear arms is— as a last resort, to protect themselves against tyranny in government”
      Thomas Jefferson also wrote “The tree of Liberty must be refreshed from time to time with the blood of patriots and tyrants—Resistants to tyrants is obedience to God.”
      techengineer11, excuse me for supporting the Constitution of the United States of America and our form of government. Why do you hate the Constitution? Why do you believe the Supreme Court has no right to interpret the Constitution, despite their Constitutional obligation to do so? Why do you think you are a law unto yourself, and have no obligation to live by the principals of our Founding Fathers?
      techengineer11, evidently you don’t believe in our form of government, nor the rule of law. And you mock me for believing in our Constitutional government? Try living in another country for awhile. You may gain some appreciation of the United States. Where in your education did you miss the concept that a group of people must abide by principals for the common good as set forth in our country by the framers of the Constitution or our country, or devolve into anarchy?
      Are you a communist or an anarchist? If you hate this country, the Constitution and hate the idea that American supports the common good, why don’t you go live in North Korea? Or Canada?
      Moron, if I understand your logic, you’re saying that there is no point in having laws. Any law can be violated by a person if he so chooses. So what is the point in having laws? Any laws.
      Is that what you’re saying?
      Unfortunately we in California are faces with a Democrat super majority. They will strip the citizens with whatever rights they feel need stripping. Please say prayers for those of us in California as we will all soon be slaves, and the state will be bankrupt. Businesses are leaving the state at record numbers as are the Jobs. We still have over 10% unemployment and it is a direct result of how the Public Employee’s Unions have such a hold on the State Legislators.
      Meteor,
      The Court’s responsibility to interpret law is not infallible. If the Court chooses to side with a Tyrant, we do not have to agree. Luckily, the Constitution is written in English, a language we all presumably understand.
      That restrictions on the 2nd Amendment are popular or accepted or ruled “Constitutional” by the Court still does not erase the fact that they are illegal. You can not simply reason away and refine “shall not be infringed” to mean “it’s OK to infringe.”
      It was mentioned that no right is absolute, and that is true. We understand that our rights are only ensured if we ensure those rights for everyone. So my rights are infringed only so that I can not infringe the rights of another.
      For the Child Porn example, child porn victimizes the child forced into sexual acts, infringing on that child’s rights. Therefore, child porn can be infringed. My guns have not killed anyone, nor are they likely to do so. My having an AR-15 infringes no one’s rights. Therefore, my right to own it cannot be infringed.
      This is the most basic of our theory and principles of governance. If there are reasonable restrictions on owning firearms, so be it. To make those restrictions legal, all you need to do is convince the President, 2/3 of Congress, and 3/4 of the States to amend the Constitution. Any other method of subverting the Constitution is illegal regardless of how popular or reasonable it is.
      @Sendinthemeteors
      I am not an anarchist.
      I believe in common sense laws.
      Our Country was founded on english common law. Basically, you could do anything you want as long as you didn’t infringe on the rights of another person.
      Speeding wrecklessly is infringing on the safety of others, therefore I believe in laws such as a speed limit, stopping at a red light, etc.
      Theft, Assault, Murder, Rape, Trespass, Breach of Contract and such, are are crimes.
      Those are things that involve violating another person’s rights, and require laws.
      I don’t Believe in laws mandating a purchase of something, unapportioned taxes, how much soda I can drink, jaywalking, riding a bike without a light at night, etc.
      Those are victimless “crimes” and Infractions.
      Hey SendtheMeteors, you said this in reply to GhostofJefferson: “Where your anarchist ideas go astray is that the Supreme Court interprets the Constitution, not you.” I don’t know where you got such a major misconception from. The Supreme Court DOES NOT INTERPRET THE CONSTITUTION. They interpret the law as to whether said law is constitutional or not. Trust me, it was not the Founder’s intent to create a branch of the federal government that decides its own legitimacy, let alone what rights are to be handed down to us “people.” There is no grosser misconception in the history of public education. The Constitution says what it says, it can be changed legislatively; such power is not in the hands of the executive or the judicial branch–if it were, we would have no need whatsoever for the entire Congress. Does any of this make sense to you, or does it go beyond your ability to comprehend? If I’m wrong, show me where I have thunk incorrect please.
      “Whether or not Stalin was Jewish makes no difference.. Most say he was not some say he was.. Regardless him killing and persecuting Jews has nothing to do with his ethnicity.. that is absurd. ”
      I didn’t bring up his ethnicity. What I said was is that the oppressive nature of Stalin’s regime towards Jews in particular hasn’t been forgotten, particularly among Russian Jewish immigrants.
      As for your whole “Caucasian state” non-issue, I really don’t see what your complaining about. For one, Caucasian is a very general term that refers to a large number of groups. Technically speaking, even I fit the very loose definition of Caucasian. Secondly, not one country that you named is even close to being 100% purely of any one race, ethnicity, or even culture. In China alone there are multiple NATIVE languages. Same goes for India. Moreover, there would seem to be quite a number of countries where whites are predominant so why do you need another? Lastly, on what grounds do you think a Caucasian state is even necessary? When the Zionist Jews asked for a state it was because they had been a persecuted minority for centuries and they believed that there culture would die out if nothing changed. The Caucasian group isn’t even a single race let alone a single culture so that argument cannot apply.
      My Response: — Maybe you, “Senator Feinstein” should be focusing more on “child pornography” and the molestation of innocent children first, before attempting to work your ideology further into our free society. As far more children’s lives have been destroyed by this, than any lunatic with a gun! As your logic goes, all the pornography should be scooped up by the federal government too, not just the”Kiddie Porn” Guns don’t kill, people do! But any kind of porn can and does stimulate the appetite of these perverts, encouraging them to commit their vile acts! Taking away our Constitutional Right’s, as law abiding citizens, to arm ourselves against all of the the above very real dangers, such as “pedophiles, lunatics and intruders,” isn’t going to solve a thing. IN fact, you’re sure to make it worse! And you don’t have to be a scholar to see that, Senator Feinstein. I ardently couldn’t disagree with you more.
Actual pictures of child be abused is not because a child was abused to make them.       jeffersonian1776, your post is, I guess beyond my ability to comprehend. Either that or it’s simply nonsense.
      “EQUAL JUSTICE UNDER LAW”-These words, written above the main entrance to the Supreme Court Building, express the ultimate responsibility of the Supreme Court of the United States. The Court is the highest tribunal in the Nation for all cases and controversies arising under the Constitution or the laws of the United States. As the final arbiter of the law, the Court is charged with ensuring the American people the promise of equal justice under law and, thereby, also functions as guardian and interpreter of the Constitution.”
      You make some very good pts. I really don’t have the time to get into the minutia with you.
      I’ll just add so what if Stalin killed Jews? He killed exponentially more Christians.
      My point about the races and I’m sure you already know what I meant was that Caucasian people had already divided the nations into their own spheres of influence. They set up borders in which their cultures thrived. It was when they brought in the Jews that the borders came down and the calls for multiculturalism and diversity begin to ring out.
      My people are already persecuted. And as we lose our majority it will get much worse. Look toward SA for an example. We do not want to become a minority among hordes of brown people.
      I’m not even going to try to get into racial theory with you.. I’m sure you understand because you could just look at your Israel example and see that it applies to other races as well but you don’t care about us.. You overlook our plight because we are unimportant. When 10s of thousands of my people are slaughtered every year that’s ok with you.. No big deal.
      I do revere the Constitution and I understand the role of the Supreme Court. It is 1 of 3 supposedly equal branches. It’s entitled to interpret the Constitution but it is not etitled to its own facts. In the beginning the SC was by far the weakest of the 3 branches.. The Constitution needed no interpreations because it was well understood.
      Again the 2nd amendment is not up for debate. And as we all know the SC today is completely a political tool.
      In reality the debate is useless. this enitre gov’t has failed.. There’s nothing that will put it back togehter again.
      Meteors, I think we already have more than sufficient “reasonable” limitations on the 2nd Amendment; many of the more useful ones aren’t enforced and felons and those deemed mentally deficient continue to have guns.
      Will re-criminalizing criminal behavior make it so super-criminal that criminals will give up their felonious ways and obey the law? That seems to be one intent of the Left’s plan while all it really does is penalize law-abiding citizens for the acts of others.
      “Sorry, Mr Meteor, your new car is governed to 45 MPH because some scoff-laws refuse to obey the 70 MPH speed limit and we aren’t taking any chances on you. And, no, I don’t give a crap about your perfect driving record.”
      So let me get this straight. Miss Finklestein says it is ok for a woman to fight for the Constitution in a foreign war with a gun in her hand and on the front lines, but when that same woman comes back here to the good ole USA, she cannot own a gun to protect herself or her family….interesting….interesting.
      So now in the great state of Caliponia where porn is produced more than anywhere else in the country and women are paid for Rape type situations, then those women cannot own a gun in case they might be raped because men think that is what they want. And lets not forget that children are fed semen in some Calipornia schools.
      The Liberal movie stars who are ruling the middle and lower class there are the ones who will have fully Armed Protection when they would like to be in public because they made a movie that glorify guns. If I were the typical black living in Calipornia then I would be terrified of what my screwed up state is doing to me and if it feels like you are being oppressed, you are being oppressed and you can blame the president as well. Hopefully we can get a bunch of conservatives in the Whitehouse, who believe in the Bill of Rights and the 2nd amendment. Until then it looks like they are steadfast on taking away more more of the rights of “We the People”……
      We need more Bill of Rights loving people in the White-house, not liberal idiots who love Hollywood more than the people of America…!!
      Perhaps your fire in a theater analogy says it best. It came from one of the broadest censorship decisions (later overturned) ever brought down by the Supreme Court. The case, U.S. v. Schenck, was about espionage and wrongfully jailed peaceful, anti war activists and protesters. So you were close but in this case it would be peaceful, law abiding citizens sent to jail for possessing these vile, scary “assault weapons.”
      So I guess you would err on the side of restriction of liberty? Is that what you mean to say?
      Telling ‘fire’ does not take away my freedom of speech…it only punishes me for using that freedom improperly or innappeopiately.
      We have laws against using our ‘arms’ improperly or inappropiately – what she is talking about is completely taking our right away.
      Senator Cruz asked a valid question.
Unlike The Feinstein and yourself where the equivalent proposed legislation would be like cutting the tongue out of person who yelled “fire” or whom was deemed “mentally unstable” so that people would not be able to put others in danger…right?? Because you care so much about the security of other that if you could save just 1 person from harm when someone yelled “b-omb” and caused a stampede that people loosing their tongue would be such a small cost to society…
Clearly a case of someone who is ineligible to carry concealed herself or even be around a gun.
      Meat! How’s this for reasonable?
      “Today I swung my front door wide open and placed my Stevens 320 right in the doorway. I gave it 6 shells, and noticing that it had no legs, even placed it in my wheelchair to help it get around. I then left it alone and went about my business. While I was gone, the mailman delivered my mail, the neighbor boy across the street mowed the yard, a girl walked her dog down the street, and quite a few cars stopped at the stop sign right in front of our house. After about an hour, I checked on the gun. It was still sitting there in the wheelchair, right where I had left it. It hadn’t rolled itself outside. It certainly hadn’t killed anyone, even with the numerous opportunities it had been presented to do so. In fact, it hadn’t even loaded itself. Well you can imagine my surprise, what with all the media hype about how dangerous guns are and how they kill people.
      Either the media is wrong, and it’s the misuse of guns by PEOPLE that kills people, or I’m in possession of the laziest gun in the world. Alright, well I’m off to check on my spoons. I hear they’re making people fat.” That was recently e-mailed to me. Not sure where it came from!
      She’s a career politician. Her little foray into her experience is one of the big things that’s wrong with Washington.
      As far as restrictions go on the 2nd Amendment, there already are more than enough of them in place. But Feinstein has shown in the past that she doesn’t like the 2nd Amendment, period. She has said she wants to take away all guns (if only she had the votes).
      Sendthemeteors- Sometime you amaze me. Anybody can go into a theater and yell FIRE. I could, you could or a group of people could. But because of laws we would have to pay a price for our ACTION. IT IS THE ACTION THAT IS ILLEGAL NOT THE WORD “FIRE”. If the use of word FIRE was band that would be a violation of our First Amendment. Just like our Second Amendment right. The action of murder by any type of “arm” (rifle or a baseball bat”) is illegal, not the tool.
      Very good, I see you’re making an argument. Albeit an invalid one. Comparing limitations on speech like yelling fire in a theater to limitations on the second amendment is invalid.
      Limiting the type of fire arm, as defined, I can buy because of a crime I may commit or someone else may commit is the same as forbidding me or anyone to use the word “fire” because I might yell it in a crowded theater. Or someone has already yelled fire in a theater. It’s absurd.
      My right to own a fire arm does not injure you. No matter the fire arm. You cannot limit my rights under the constitution because of a crime that I may commit much less a crime someone else has already committed. No ambiguity whatsoever.
      And don’t waste your time typing extreme, invalid exceptions like you did above with ricin etc. I am not guaranteed the right under the constitution to keep deadly poisons, bombs etc.
      I appreciate the effort to make an argument but unfortunately the invalid arguments you made are a s good as it gets for gun control. Emotional and invalid arguments is all there is.
      The courts have ruled that felons can be denied at least some rights under the constitution. The right to vote, the right to own a fire arm. I would assume you would not limit a felon’s 2cnd amendment right before he committed the felony? Guilty until proven innocent? Pre-Crime!
      It’s not the word “Fire” that is illegal. Remember, the only valid restriction on rights is if the use of the right infringes on the rights of others. Also, having a right to do this or that does not excuse you from the consequences of exercising it.
      Yelling “Fire!” in a crowded theater to cause a panic infringes the rights of those whom you are trying to incite to riot, therefore the right to shout it can be infringed. If someone carries a gun into town, waves it about and threatens to shoot people, then the gunman is infringing rights and can thus be infringed upon.
      It takes a little it of discernment to reason through this, but it does not take a Constitutional law degree.
      She, and anyone else who wants to, can ban anything they want. Freedom is a choice, always has been, always will be. It 1000 BC, freedom was a choice. In 1000 AD, freedom was a choice. In 2013, freedom is still a choice. Regardless of who triumphs and who loses in these political meanderings, in 2050 freedom will be a choice.
      Some choose to be free. Others choose to subject themselves.
      So you can ban my guns, but I swear on my own soul that I will die a free man. Hopefully I die a free man at 85 years old, but I will not sacrifice my freedom for longevity. Freedom isn’t the capacity to be able to live to be old, freedom is pursuing your own happiness. So she can go ahead and ban our guns, it’s just too bad she won’t be the one who comes to try and them because it would be good for her to witness how a free man dies.
      I have the shot all lined up. Beautiful 10 point buck at about 80 yards. I control my breathing… The scope settles on the kill zone… I slowly squeeze the trigger… BOOM!! My 30-06 comes to life in my hands… The shot was perfect! Suddenly I hear an eerie whistling sound followed by a slight pop and then silence. The buck looks calmly at me and wanders off. Damn imploding bullet again!!!! I REALLY hate it when my bullets implode!!!!
    Translation: I could care less what the Constitution says, this is what we progressives want and we’re going to get it come hell or high water. We won’t let the people or the law get in the way neither will facts or reason. If we’re going to take apart the Constitution this is a big step.
    We the people need to get off our duffs and start moving on these people. Get them out of office, grass root campaign efforts to get these politicians that seem to have tenure in their seats. Force term limits on them despite the laws they pass benefiting themselves. The list is endless and we are unorganized.
      Voting does not work anymore….. I bet you think Chitcongo Moohamhead won the election fairly.. It’s not who votes BUT those who count the votes. She admitted voting twice in the presidential election last November, and now, Obama supporter Melowese Richardson has been indicted for allegedly voting at least six times. She also is charged with illegal voting in 2008 and 2011.
      The 58-year-old veteran Cincinnati poll worker, indicted Monday, faces eight counts of voter fraud. Two others, one of whom is a nun, have been charged separately.
      Gentleman,
      If you think voting is going to solve the problem, you are delusional. I say this respectfully with many years of political observation under my belt. They will never quit until we make them stop. They are being driven and manipulated by forces outside of the USA. So, do not ever expect term limits or other such nonsense. It will NEVER happen. Get your stuff ready and be prepared. Any small spark will get it going. Especially national insolvency, which is the most probable catalyst.
      Progressiveslayer……….They have been working on gun control/ban for years and just like Obamacare/socialized medicine finally happened after decades of effort so will a gun ban. A gun ban WILL happen and with Obama in office now seems to be their time.
      My question is how do you or any of you guys think they can accomplish this? Confiscation will not work as there are too many willing to fight back against such a tactic. Laws requiring us to turn in our guns will not work because people would ignore the law.
      They might imprison or kill many but the rest are willing and ready to fight back.
      How will they control millions of gun owning, freedom loving Americans? I keep turning that question over in my mind and have a few ideas but am curious what others might think.
If the balloon ever went up and the fight ensued against tyrannical govt she knows in the end her and her ilk would be overrun. So label them all crazy and disallow them to have firearms. make them all look bad so it makes it harder for them become leaders in the community & future govt.
I can see the progs inflicting heavy taxes on guns and ammo and they’ll work every angle they can think of to infringe on our right to bear arms. For now all we can do is try to make sure elected officials adhere to the constitution and when they don’t vote them out of office.       She attempted to belittle Ted, by reminding him how long she’s been in Congress, hoping that fact would automatically presume she is above him in all ways, but she only proves how ignorant and childish she really is on these issues. Ted was taking her argument apart, and she knew she had to silence him somehow. What better way then to tout about your career in politics?
      I felt sorry for Cruz as much as I gained more respect for his fearlessness. He is surrounded by politicians who do not represent the people, but represent a specific set of ideas that gain them political and financial advantages. I literally felt like Ted was the ONLY one in that room who was thinking about the safety, the liberties and freedoms of we, the people.
      ‘Imploding’ bullets are a fiction, just like much of her alleged argument. It is made even more of a farce by the fact that the authorities were eventually compelled to report that none of those kids were killed with any sort of ‘Assault Rifle’ at all (it was left behind in the car).
      Now if our representatives really want to argue that the Bill of Rights is fixed in 18th century technologies, then her Congressional Franking privleges are limited to mail that’s delivered by horse…and no use of email or laser printers either: it must be quill and ink, or a Gutenberg press…oh, and she also loses her right to vote, being a female too.
      Now this doesn’t mean that there aren’t some legitimate issues to discuss, but to propose additional burdens on the law-abiding citizens in our Society is diametrically in the wrong direction.
      The Senate Judiciary Committee has approved a hugely controversial ban on assault weapons and high-capacity ammunition clips, but the measure faces nearly certain defeat on the Senate floor.
      The proposal, authored by Sen. Dianne Feinstein (D-Calif.), bans 157 different models of assault weapons, as well as magazines containing more than 10 bullets.
      The vote was 10 to 8, with all Democrats supporting it and all Republicans opposed.
      “There are plenty of weapons out there,” Feinstein said during Thursday’s hearing. “The whole point of this bill is to reduce over time the supply, purchase and transfer of military type weapons.”
      @ civilwarcometh
      I wonder what she would say if the AR manufacturers stopped providing weapons to the military all together and forced them to use only the weapons that she proposes be “exempted” from the proposed ban?
      Answer: She’d want to ban those too under the same BS guise.
      The only way to keep our rights is to exercise them frequently so they aren’t forgotten or diluted. This “ban” is nothing more than an overt power-grab by the elitists who are in search of some r’tarded utopian ideology.
      As a California resident (or inmate as it were), I am already writing my last testament to explain to our posterity why I may have to do what the government is forcing the free patriots still remaining to possibly do…..to resist on moral grounds the tyranny they propose and inflict.
      In the beginning of the next conflict, patriots will all be initially martyred as terrorists in the media and in the classrooms. In the end, the truth will become apparent and the patriots will be CORRECTLY recognized as the runners of the tyrannical gauntlet just as the founders intended.
      This is why the Second Amendment SHALL NOT BE INFRINGED.
