Colorado Legislature Passes ‘Landmark’ Expansion of Gun Background Checks

DENVER (TheBlaze/AP) — A landmark expansion of background checks on firearm purchases was approved Friday by lawmakers in Colorado, a politically moderate state that was the site of last year’s mass shooting at a suburban Denver movie theater.
The bill previously passed the state Senate and now heads to Democratic Gov. John Hickenlooper, who is expected to sign it into law within two weeks.
Earlier this week, Colorado lawmakers approved a 15-round limit on ammunition magazines. It is also awaiting the expected approval of the governor.
The bill passed Friday expands cases when a $10 criminal background check would be required to legally transfer a gun. Republicans have opposed the bill, calling it an undue burden on law-abiding gun owners.
“We know for a fact that whatever law we pass criminals won’t care,” said Republican Rep. Jerry Sonnenberg.
The vice president praised passage of the bill.
“Congrats to Colorado House and Senate for passing universal background checks,” read a tweet sent by the office of Vice President Joe Biden from his official Twitter account.
It was followed by another tweet referring to the theater shooting that read, “The families of Aurora deserved a vote and got one. Now U.S. Congress must act too.”
Congress is also considering a number of new firearm restrictions.
Colorado is the first state outside the East Coast to significantly ratchet back gun rights after the theater and school shootings. Colorado’s gun debate was being watched closely because it’s considered a swing state with both a gun-loving frontier past and an unfortunate history of mass shootings, including the 1999 Columbine High School attack.
“Are [we] going to stop all criminals from getting guns? No,” said Democratic Rep. Beth McCann, a sponsor of the background checks bill. “But are we are going to put a barrier there, make it more difficult for them? Yes.”
The move to expand background checks would be one of the most sweeping responses by Colorado to the shootings last year in Aurora and at the elementary school in Newtown, Conn.
In Colorado, expanded checks have been a top priority for Hickenlooper, who called for the proposal during his State of the State address in January.
Both chambers previously approved the expanded checks in slightly different forms. However, both had to agree on an identical bill before passing it to the governor, so a second round of voting was required.
Democrats seemed relieved that Colorado’s protracted gun-control debate was nearing an end.
The GOP unsuccessfully tried some last-minute legislative maneuvers on Friday to sink the background-check measure before it was passed 19-14 by the Senate.
“It won’t help anything, but it makes common everyday actions among friends and neighbors something that’s now illegal in the state of Colorado,” argued Republican Sen. Greg Brophy, one of the GOP’s lead Senate gun negotiators.
Brophy tried to keep background-check talks alive by rejecting a preliminary agreement by the House and Senate to clarify the bill so gun owners can lend firearms to immediate family members without a background check.
Democrats grew frustrated at GOP attempts to imagine scenarios that would trigger background-checks. From 4-H members learning gun safety but needing to borrow a shotgun, to neighbors on weeklong elk-hunting trips, Republicans argued the bill would ensnare harmless gun users.
Democrats insisted that existing exemptions in the bill would cover most scenarios the GOP imagined. The bill’s sponsor, Senate Democratic Leader Morgan Carroll, told Republicans that Democrats had enough votes to pass the measure but extended debate to make small changes requested by Republicans.
“There were many, many changes made to this bill, made in good faith,” said Carroll.
However, Republicans wanted so many exceptions that “we might as well repeal all background checks,” she said.

I brought my modifications from my AR with me and put them on my M4 w/ a 203mm. If they ban these weapons, will the military personnel ie. national guard, army, marines in combat be able to keep and bear accessories that make them harder to kill and easier to kill the people trying to kill them in combat… or will they just give the military basic weapons that are issued?

There have been killers since the dawn of history… Some of them become tyrants and leaders of nations… Others seriel kilers, other mass killers. Most of them did not have access to video games.
There have been attempts on schools and theatres in America’s past long before there was video games.
Infact several studies say more killers read books than watch tv or play video games. So should we ban books?

You gotta have a building already to go and you gotta move equipment. There are major logistical issues for a company that size. But they’re going. Posted on March 15, 2013 at 11:49pmI’m not really sure how they’ll enforce that since they don’t know what you already have or don’t have. I also understand that a number of FFLs will be ‘opting out’ of doing background checks for only the $10 fee since it isn’t worth their time.
Their biggest problem will be the magazine law. Not only does it limit magazines to 15 rounds, but makes it illegal to own ANY magazine capable of being extended. That’s a bit of a problem, because many if not most pistol magazines can be extended. Lots of people have bought the +1 or +2 magazine extensions ($5-$10) for their Glocks… all of Glock’s magazines are capable of being extended… easily… in a minute or less.
So how will that fare for concealed carry folks coming to Colorado from other states? Sure, they can have a magazine of 15 rounds or less… but if that magazine itself is capable of being extended, they are violating the law. I imagine that Colorado will be much less a destination state and more like Illinois a “through or around” state. If I have to go east, I stop to gas up in Missouri, stow any firearms and ammunition per federal law, then drive straight through Illinois without stopping. In Indiana I stop again, top off the fuel and retrieve any firearms/ammunition. If I’m headed to Kentucky or Tennessee, I just take a southern route (longer) that doesn’t go through Illinois. I can see that my trips westward will either be via I-80 in NE/WY or I-40 through NM. Ski in NM or WY onl

Okay so I am restricted to 15 bullets per magazine, what is stopping me from having 10 – 15 bullet magazines. Exactly what did they accomplish? ABSOLUTELY NOTHING. In fact they did me a favor as all i have to do is pull out the magazine and put another full one in. I bet I can do this in the same amount of time it would be to empty a 30 round magazine.
We already know criminals will not abide by the law and neither will I. I will not be out armed by criminals. Suck it Democrats. Ready to sign recall petition. Let me know how.

SGT is right, this is designed primarily to harass people who own things libs don’t like, as well as extract money from the population.
How would they know? They wouldn’t unless the person used the firearm in self defense. This law literally sets up a situation that if you’re out of the house, your wife or child is committing a crime if they use one of your guns. If you want them to be able to use your firearms you have to take all your guns down to an FFL and have them run a background check on your family member as if they were purchasing the gun from you.
As for extending mags, any moron with an hour worth of experience can TIG weld two mags into one. Might loose a round here or there, but two 10 rounders becomes one 18-19 round mag, three become a 26-28 round mag.
This is all designed to do nothing but harass law abiding gun owners. Once there’s another tragedy they’ll roll out even more restrictive laws. Another tragedy and they’ll crack down more.

Good question. Since we don’t have a firearms registry, yet, there is no way for law enforcement to know where your gun is from. Mags are good to go if they cannot be proven have been obtained or purchased after 7/1/13 by date code or serialization. Yep, its that FUBAR. As far as your guns go, if the magazine can be what the haters call “altered to accept higher capacity” you can own it but never transfer it of leave it to your kids. It would have to be destroyed because it is EVIL. If your 870 or 500 has a screw on magazine cap it would fall into the EVIL category. If your pistol magazine has a removable floor plate it is also EVIL and will be illegal. Do yourself a favor, stay in TX because you might as well stick a fork in us up here. We are done.

Posted on March 15, 2013 at 11:09pmI’m remembering the press conference where the suit said that he agreed with Mao that all political power comes from the barrel of a gun( I think he added that others in the admin. agree, but didn’t name them). The obvious follow up would be to ask if they believe that, why does the administration want to disarm the citizens and make them powerless.
Why wasn’t that question asked ? !
Pravda says our media is acting like state run media, and they would certainly know.
We do have a free press, so why aren’t they acting like it?

This is the same state with legislators that won’t protect their children by passing Jessica’s Law. What a bunch of wimps.

The recall for the Governor is going to be swift and he is got even the Dems in this state mad, a lot of them are gun owners and hunters and don’t support what’s going on in Denver. The Dems have given the Repubs an early christmas present.

Posted on March 15, 2013 at 10:57pmI just bought a 30-06 two weeks ago here in CO and they ran a 2 hour background check. I took the rifle home that day. Does anyone know if I’m now legal to buy any firearm from anyone in CO without a further background check, maybe forever? Or are they going to stick me with a $10 tax per purchase or gift? Can I just show a Conceal Carry Permit? Will they be collecting the serial number from the purchase/gift when the background check is run? That’s the scary part. Them knowing who owns exactly what firearm.

DARMOK, Like MONK said, go get him. I hope you guys are prepared to push these new laws into court too, and take it all the way to the supreme court. Unless Justice Roberts has been turned completely to the dark side, SCOTUS has proven itself recently to be 2nd Amendment friendly.

Thanks for the support. I plan on going in with a class action lawsuit as soon as they make us start paying a fee to buy or transfer a firearm. Going back to the Supreme Court decision, 1965, you cannot tax with the intent to inhibite an individual’s right to exercise a civil right. This transfer fee and background check puts undue restriction on the ability to will, loan, or transfer a legally owned firearm to a law abiding individual. I plan to put Hickenlooper personally on the lawsuit.
I do want to say, you guys are awesome, and I really enjoy our discussions. I do consider both of you friends.

Look into the death tax that is being put on farmland when the farmer dies and wants to will it to his Children. I have a feeling things in that might set a precedent for firearms in the small print.

I have a very liberal friend that stopped by, and we got into a discussion, I also had another friend who is from the same area of the country that he is from, he would never listen when I discuss taxes and how his vision of “Get the Rich” has side effects. Well, my other buddy simply listened to him, and finally said, “My dad has a farm, the same farm I was raised on, and if we sold it today, we might get $200k, but when he dies, and will it to me and my brother, the tax assessment is close to $2 million, at the current tax rate, we would owe not only the debt my dad carries over to run the farm, but also about $800k in taxes. Even if we sell everything on it, we would not be able to pay the taxes.” My liberal buddy actually had a look of disbelief on his face and said “That isn’t right, they can’t just take it?” I said, that is what you want, to get even with the rich, the problem is, our govenment decides who is rich, and if you own property that can be sold to a corporation, and they can get additional tax money out of it, that is what they will push, don’t mind if you arent’ rich, its what they see they or someone else can get out of your assests. He would never listen to me, but as soon as someone else from his area said that, man he was all ears.

This is one of the recall efforts underway. The Governor recall is still at the grassroots level, but I believe these guys are setting up a website. There are other counties initiating their own recalls, but if you do a web search, there may be websites being set up. I know Yoder county is already set a recall in motion against their representative. He is one of the Dems that was dead against these bills, until a call from Biden, and he did an 180.
