WASHINGTON (TheBlaze/AP) — Senate Majority Leader Harry Reid has decided that a proposed assault weapons ban won’t be part of a gun control bill the Senate plans to debate next month, the sponsor of the ban said Tuesday, a decision that means the ban stands little chance of survival.

Instead, Sen. Dianne Feinstein said she will be able to offer her ban on the military-style firearms as an amendment. Feinstein is all but certain to need 60 votes from the 100-member Senate to prevail, but she faces solid Republican opposition and likely defections from some moderate Democrats.

As The Atlantic puts it, “offering the assault weapons ban as an amendment means it would require its own vote — which would almost certainly fail.”

“I very much regret it,” Feinstein, D-Calif., told reporters of Reid’s decision. “I tried my best.”

Feinstein, an author of the 1994 assault weapons ban that expired after a decade, said that Reid, D-Nev., told her of the decision on Monday.

There are 53 Democrats in the Senate, plus two independents who usually vote with them. And as The Atlantic points out via Gallup, support for a measure such as Feinstein’s has waned:

An assault-type weapon was used in the December massacre at an elementary school in Newtown, Conn., that revived gun control as a top issue in Washington. Banning those firearms was among the proposals President Barack Obama made in January in response to those slayings.

The assault weapons ban was the most controversial of the major proposals to restrict guns that have been advanced by Obama and Senate Democrats. Because of that, it had been expected that the assault weapons measure would be left out of the initial package the Senate considers, with Democrats hoping the Senate could therefore amass the strongest possible vote for the overall legislation.

Having a separate vote on assault weapons might free moderate Democratic senators facing re-election next year in Republican-leaning states to vote against the assault weapons measure, but then support the remaining overall package of gun curbs.

Gun control supporters consider a strong Senate vote important because the Republican-run House has shown little enthusiasm for most of Obama’s proposals.

Feinstein said Reid told her there will be two votes.

One would be on her assault weapons ban, which also includes a ban on ammunition magazines that carry more than 10 rounds of ammunition. The second would just be on prohibiting the high-capacity magazine clips.

Many Democrats think the ban on large-capacity magazines has a better chance of getting 60 votes than the assault weapons ban.

The Senate Judiciary Committee has approved four gun control measures this month, including Feinstein’s barring so-called assault weapons and high capacity magazines. The others would expand required federal background checks for firearms buyers, increase federal penalties for illegal gun trafficking and boost school safety money.

      @WarMunger_Al You are correct we should get rid of all the BS laws that really do nothing to provide even reasonable control of guns. What we need is very simple. 100% background checks, 100% registration of guns and criminal and civil liability for owners of guns if their gun is involved in a criminal act, unless they report the gun stolen within 24 hours. For example, Ms. Lanza, if she had not died, should have been held both criminally and civilly liable for her sons use of her guns. As there is no way that 4 guns should be that accessible to anyone but the owner. When she was at work her guns should have been under lock and key.

      Anyone who thinks this is a victory for the right to bear arms is a fools.These commies pushed this big agenda knowing they were not going to get all that they wanted, but they got what they expected, to walk away with another piece of the 2nd Amendment. If they walk away with a national background check, registry or even a ban on magazine sizes it is their victory. And just remember your NRA is helping these fools craft these laws by making agreements. There should be no agreements. The 2nd Amendment states SHALL NOT BE INFRINGED, and that is the principal that we all should stand on. The US Supreme Court, The US Congress and the states and cities have NO AUTHORITY what so ever anywhere in the US Constitution to Amend the 2nd Amendment except as prescribed by the US Constitution. And to date, the 2nd Amendment has not been amended.

      Harry Reid is up for re-election in 2014.
      The Feinstein bill can be tacked on to another bill such as “children’s healthcare”,
      and then they’ll dare the republicans to vote against it.
      The anti’s are not going away. They know they have the republicans on the ropes

      @ JROOK…The fact of the matter re: Ms Lanza, is there has been no determination made as to the manner in which her weapons were stored. You assume too much. Too bad she died. You would have her brought up on charges for having had the gall to exercise her constitutional rights. A constitutional right is just that. It is God given not ordained by the government.. One need not pass a test in order to exercise it. This is not Cuba or Venezuela, it’s America. ObaMao hasn’t totally destroyed it. Not yet.

      Don’t get too excited about this. It is a tactic with a longer range plan. Reid is intelligent enough to realize how the Democrats had their ass handed to them in the ’94 election shortly after both Brady Bills went into effect. The results did not take out Clinton, but gave the Republicans both the House and Senate after more than forty years of Democrat domination. A possible plan is if this should pass under what they may make to appear reasonable the expected regaining of the House by the Dems will in their hopes lead to a the so called assault weapons to be added as an amendment. Its not a win for our side, but a tactic by their side.

      So that leaves what? Enhanced background checks? The Feds don’t prosecute illegal attempts to buy now. Nor do they rigorously prosecute felons in possession…. This really is about disarming law abiding citizens. Fast and Furious?…. Long forgotten and Holder gets a pass. Do you think the trial lawyers, the ACLU and the American Psychiatric Association will ever agree to include whack jobs in the data base?

      WHAT GOOD DOES DEFEATING GUN BAN ACCOMPLISH?

      Cheaper than Dirt, Cabela, and gun stores no longer sell semi-auto rifles. Cheaper than Dirt sold many different models but in October marked all of their inventory as OUT OF STOCK. Now with news the Gun Ban will be defeated, stores that claimed they were out of stock no longer list them. How can we have a 2nd Amendment if we cannot buy guns, buy ammo, buy powder, or even buy reloading tools. Somehow the Government was able to take guns off of the market. If the Government can do this to guns, it can do this to food, generators, cars, and anything.

      However….

      What flabbergasts me the most is that the “democratic” process can be so controlled by one man, that debate can be so easily squelched…I know, I know, it’s been happening for centuries, but what a sad, sad state of affairs this country has fallen into when one person can determine what can/cannot be debated amongst duly (?) elected officials who supposedly represent us…

      Just like our FFs had in mind when they cooked up the whole thing, right?

      My father is a WWII vet who luckily missed the fighting in Okinawa, but still had mop up duties. He still has his faculties, and tells me almost every time we talk about what has happened to this country, “and I was ready to give my life so crumbums like the ones in the nation’s capital can do and say everything they do now?”

      He also says, “Well, at least I won’t have to be around much longer to watch it go even further down the tubes.”

    You’re right Ben. She’ll propose to take a “quick vote” on on a very broad ammendment just before end of session and hope to sneak it through (probably on a Friday) when all these folks are caring about is a “cold one”.
    I think John McCain welcomed Woodrow Wilson into office (ha) right?. We can add Boehner, Shumer, Graham, Durbin, Reid — oh hell -all the moss covered politicians.

      They may hope that people become less vocal with the AWB removed . . . and will slip it in with an ammending of the law. Definitely stay on top of them about this. The liberal elite want your firearms, . . . . not just “assault weapons” either. Just like Colorado, they will make every attempt to get people limited to a single shot firearm, if even that. It is much harder to control people, with impunity, when the people are armed.

      I’ve lost not one, but two cousins to felons in two states. The only thing that might have saved them is if they’d been armed at the time.

And a man like Charles who stopped and helped the woman being beaten by some huge guy. I think they would think twice about wanting to ban any law abiding legal U.S. citizens from owning weapons.

    Reid at the least is trying to prevent a vote on a bill that will not pass ONLY to protect those who will vote for it from the repercussions they will suffer in 2014 election. Its a game of chess right now.

    Feinstein has been waiting for years to get this bill in she will not allow it to just die and mark my words there will be another mass killing (NOT SHOOTING, stop calling them shootings) to re-ignite things. One was just averted in FL, the loons feed legislators with all they need to push their agenda.

      Keep in mind that we’ve just demonstrated that Save The Children is now powerless. That’s pretty significant if you think about it. With rows of dead beautiful children they were still unable to ghoul themselves out enough to convince people to give up their rights.

    This is good news for American human rights but we must not give the Libs anything on chipping away our gun rights in the Bill of Rights. NOTHING! Looks like Reid wants to get re-elected. It will be interesting to see if the rest of the Dems get the message. Next month will cover a lot of ground, including the continued investigation into the cover-up at “Sandy Hook Line and Sinker”. The Libs are scared. They are very scared. That Sandy Hook coroner has a lot to answer for. Just like Benghazi, the debate is not over! Freedom rocks!

    Watch out for the backdoor, they will be pushing harder for a universal gun registry and universal background checks as a compromise to not even voting on the ban. Keep your eyes open people.

      Watch the other hand. Progressive Progress Forwards 101 ~ write an extreme bill that includes what you really want, then cave to the demands of the extreme bill. Cut out everything except what you really wanted now – a foot into the door to build on. People will wipe there foreheads that the first version of the bill did not pass – then accept the revised bill because it now does not seem so bad.

      We need to fight any proposed bill over gun rights and the 2nd Amendment. Take names and help defeat these Elitists in Congress. Starting with John McCain. How many Popes have the world seen since McCain took his first term?
