‘Extremist Legislation’? Transgender Bathroom Proposal in Ariz. Sparks Controversy
PHOENIX (TheBlaze/AP) — There’s an epic battle brewing over transgender rights and whether or not these individuals should be allowed to use bathrooms that correspond with genders other than those they were born with.
While some lawmakers across the country have long argued that such allowances make members of the public uncomfortable, human rights activists have posited that transgendered Americans should have this right.
In Arizona, the debate is heating up, with some lawmakers pushing to prohibit anyone not associated with their birth gender from using public restrooms, showers and dressing rooms in the nation’s latest tussle over equal rights for transgender people.
The proposal comes less than a month after the city of Phoenix passed a human rights ordinance prohibiting gender identity discrimination in public accommodations.
That measure and the proposed Arizona law represent opposite sides of a growing national debate over equal access to public restrooms for transgender people.
In Arizona, Republican Rep. John Kavanagh wants to make it a misdemeanor for a person to use a public facility associated with a gender other than what’s on his or her birth certificate. The Bill, SB 1432, would constitute a Class 1 misdemeanor, costing offenders up to $2,500 in fines and up to six months in jail.

Rep. John Kavanagh, R-Fountain Hills, wants to create Arizona’s first law governing restroom privileges. Under Senate Bill 1432, someone would be guilty of disorderly conduct if he or she uses a bathroom, locker room or dressing room that’s not designated for the sex listed on his or her birth certificate. Councilman Tom Simplot, who is openly gay and pushed the reforms, said if SB 1432 becomes law, it would criminalize the “very nature” of being transgender, a term used to describe people who identify as a sex different than that they were born as.
“They’re creating a solution to a problem that doesn’t exist,” Simplot said of the proposal. “This kind of extremist legislation is exactly what brings criticism to Arizona and compromises our work to make Phoenix an accepting and competitive city.”
National transgender advocates say Arizona’s proposed law would be the toughest standard in the nation if it passes.

Posted on March 20, 2013 at 9:19amI think all bathrooms should be open for everyone. What’s the difference if a gay man is in a men’s bathroom as opposed to if a man is in a womans bathroom. Why should I have to go into a bathroom or a shower room knowing that a person that could be physically attracted to me might be watching, but then tell me that I can be arrested for going into a woman’s bathroom. Or if you want Gay rights so much, why would you open up the possibility of a Gay man being forced to use a men’s bathroom knowing that it may put him at risk of harm?

I understand your feelings about privacy. But, honestly, aside from some rather obvious crossdressers using the bathroom, how would you spot a male to female transsexual (MtF TS)? If you live in, or near, a large city you may have already encountered a TS in the ladies room and not even known it. I don’t know about you but when I use the restroom I am in there to relieve myself and / or touch up my makeup.

I’m not trying to make trouble for trannies, I’m trying to protect the vulnerable.
I actually make my little boys go to the bathroom together when we are out in public because I’m aware of boys being assaulted by perves in a restroom. In one instance, I heard about a six year old boy was raped and strangled in a mens room with his aunt waiting outside the door.

It is people of your type thay make me ill. How would you even know if a member of the opposite sex came in to use the restroom? Are you the self-appointed police that are going to pull down men’s pants or women’s underwear to check their genitals? Why do you want to “beat the snot” out of someone? Are you afraid of being approached or propositioned? This can happen regardless of physical gender. You obviously fear for the safety of your daughter, and as a parent myself I do not blame you for that at all. However, if a man is going to molest someone in a ladies room, he can do it now without the expense and trouble of a disguise. Another writer, “3monkeysmomma” had an excellant suggestion of sending her children to the restroom together. To help relieve your fears send your daughter to a restroom with someone else such as a friend, another adult, etc.
Beating someone to a pulp will only get you arrested for assault, especially if nothing troublesome (caused by the transgender person) happens. Then again try assaulting a transgender person. I do know some who have Concealed Carry Licenses. You might get a surprise that you did not expect and that you may come to regret.

These ignorant graspings of “absolutes” makes me ashamed to be connected to some conservatives (however, the alternative of hanging with liberals is completely out of the question).
What you do not know or understand is that physical sex and gender do not always match. Ask yourself this question: if you are a man but one morning you wake up as a woman. You see yourself in the mirror and you realize that something is wrong. Your mind and the way that you see yourself is not in tune with your body. This is what a transsexual (TS) feels everyday. It affects their outlook on life, their relationships, their emotions…in short every aspect of their lives. At sometime in your life have you ever been in a situation that was not right for you? It truly affects your outlook on life. Does that mean you are suffering from mental illness?
A TS is born with a birth defect as real as physical ones, such as club feet or cleft palates. Their defects are not visible to the naked eye therefore, “normal” people think the TS is crazy and deranged in need of professional attention. We can think we are dogs all day long, but that doesn’t change the fact that we were born human. Would that person’s lack of a dog tail simply be a physical defect and simply requires a surgically implanted tail?
Gender is not a physical defect – quite the opposite – to deny one’s gender is a mental defect.

Anyone can think that the are different or want to be someone/something else, i.e. I think I want to be Aaron Rogers of the Packers (or pick any athlete) or I think I look as great and as sexy as Beyonce. Well, as much as you THINK it, the realty is that no one will ever be someone/somehing else that they are not. Also I have never heard of transspecieism.
When it comes to gender, this is somethng that is felt in your heart, your mind and in your soul. Regardless of what you do the fact of being the wrong PHYSICAL gender never leaves you. TS’s do try to supress these feelings for most of their lives. Eventually these feelings come back and play havoc with your life. Some people cannot handle this conflict of emotions. Unfortunately some TS’s commit suicide, even those who have had mental therapy or who are seeing a therapist. I agree with you when you said that to deny ones gender is a mental defect although I suspect that you meant it in a different way. TS’s are trying very hard to align their physical sex and their gender. Doing so brings a tremendous peace into their lives. For some it’s the first peace that they ever experience in their lives. I work with many transsexuals. All they want is personal peace and to fit into society. Their path to self acceptance, much less happiness is very long and difficult. It does not matter what you cut off or have sewn on. It does not matter what hormone treatments you undergo. It does not even matter how you feel, even if you really really want it with sugar on top. To my knowledge, you cannot change your chromosomes, and therefore, you cannot change your gender. “Transgender” does not exsist. There are only people who for some reason have felt a need to drastically alter their physical appearance.
Just cause I get a haircut, or any other cut for that matter, doesn’t mean I have the right to use the ladies room.

First I thought…holy c*** this lady doesn’t know she’s in the mens room until the person spoke. I really do not understand you. Here is a transgender person, dressed as a woman but is obviously male, according to his speech. Nearly everyone here wants the transgender person to use the restroom appropriate to their birth gender. This person did exactly what everyone is demanding, he was using the restroom that matched his sexual gender. Then REDFISH you turn out the lights on him! I find your behaviour to be revolting and cruel. Someone needs a restroom for relief! Where is he supposed to go…the alley, right out on the street, in a park?

Just because a person “feels” or wants to “believe” he is a she or she is a he doesn’t make it so. We used to be able to put identity disordered people in a mental hospital.
So when some parent decides to give in to the kid who thinks he is a kitty cat or enough perverts deem themselves to be kitty cats, are you going to require litter boxes in all public places & schools to show “compassion” to the poor deluded soul who isn’t “comfortable” using the toilet because he has deemed himself a cat.

I am a Catholic and a Libertarian. What bothers me more than anything, and why I comment here is that all of the “kindness” that I see displayed towards anyone deemed to be either “confused, sick, defective, deranged, deviant, psychopathic, etc., just because they feel differently within themselves is that these self-professed Christians are extremely quick to pull the “judgement” trigger. There are times I feel that I am witnessing the Inquisition 600+ years later.
I have known transgender people; their struggles, fears, doubts and misgivings. They struggle with enough garbage in life. 99.9% are good people that will not hurt anyone nor bother anyone, yes there are some who truly are in need of intense help. Misplaced righteous anger is a terrible thing. For some transgender it might be enough to push them to suicide. Do you care to have that on your consience?

If you’re out and about dressed differently than your gender and might get the snot beat out of you if you go in the wrong bathroom, common sense suggests to hold it and go when you get home. Why does the majority have to bend to the whims of a very tiny minority????
Jeeze. Find something spiritually fulfilling to obsess about instead, something that contributes to the greater good and not your small-minded all-about-me thinking. Remodel your bathroom. Or help your neighbor with theirs. Donate blood. Volunteer for Meals on Wheels. Counsel troubled teens. The rest of us tend to admire that kind of thing.

Michigander, you are quite correct. People should use discretion. I have encountered many GLBT people. There is no problem with gays, lesbians and bisexuals using a restroom as they are in the restroom they should be using. Most of the transsexuals that I have met prefer to blend into society and not to standout. This generally applies to the older ones. I know some younger transsexuals who are “in-your-face” activists and they DO want the attention and to cause a scene. Personally, I think that they are absolute idiots.
I can only say this concerning bathroom use. How would feel if you are in a ladies room and female to male TS comes in…looking like a man. My first reaction would be discomfort. I can take care of myself so I would not feel threatened. However, some women might run out and call for Security or the police. The same if a male to female TS goes into a mens room dressed as a woman. How would you feel? My guess is that this individual would be in physical danger of assault, verbal, and possibly, physical. A transgender person needing a bathroom break is in dire straits.
As you said, apply common sense and discretion…the best advice I have seen yet.

If that is the criterion for admittance to the state’s finest mental hospitals, then most of us in American society had better line up. You’re referring to sex, not gender. Gender is in the mind; sex is the body type.

I hate to burst your bubble, however there are small subsets of Americans that we do lock up. Those individuals that have some sort of serious mental defect, as determined by the American Psychological Association, can be medicated and released to go about their lives, some however must be locked up and forcibly medicated to prevent harm to themselves or others.

We need to focus on the real problems – not this distraction. God makes us who we are. I also believe that God does not make mistakes. Why there are transgender people is a mystery. I do not pretend to know or to understand the mind of God. This is something well beyond my qualifications.
Unfortunately, there are many people in society who have tried to live a normal life in society. I have also known people trying to live a live expected of them by their parents.Not all of them are transgender. Have you ever lived up to someone elses ideal of how your life should be? Have your parents wanted something for you that wasn’t your cup of tea? That is what transsexuals go through in their life. Eventually, the stress of this situation causes enormous physical and emotional problems.
This world is not black and white Snowleopard (I love your name BTW). Your physical sex is what you are born with. Your gender is of the mind. Many times the gender matches the sex. Unfortunately, there are people whose gender does not match their sex. The majority of transgender people are not perverts nor are they deviants, yes, there are exceptions. However, there are also many deviants in “normal” heterosexual society. I have read up on this subject and have learned many surprising things. I implore you to open your heart and educate yourself before criticizing this part of society.
