This State Could Be the First to Mandate Insurance Companies Pay for Abortions

OLYMPIA, Wash. (AP) — In 1970, Washington became the first – and remains the only – state in the country to legalize elective abortions by a popular vote.

A generation later, and 40 years removed from the landmark United States Supreme Court Roe v. Wade ruling that extended abortion access nationwide, Washington is once again poised to stand out.

With 21 states having adopted bans or severe restrictions on insurance companies from paying for abortions, Washington is alone in seriously considering legislation mandating the opposite.

The Reproductive Parity Act, as supporters call it, would require insurers in Washington state who cover maternity care – which all insurers must do – to also pay for abortions.

The bill passed the state House earlier this month by a vote of 53-43, though it faces an uncertain future in the Senate. (A similar bill in the New York state Assembly has been introduced each session for over a decade but has never received a public hearing.)

“This is a core value for Washingtonians,” said Melanie Smith, a lobbyist for NARAL Pro-Choice Washington. “We should protect it while we still have it and not leave access to basic health care up to an insurance company.”

The proximate cause of Washington state’s measure is the federal Affordable Care Act. Thanks to language in it pushed by congressional Republicans, insurers selling their plans on the state exchanges taking effect next year will have to segregate the premiums they collect for abortion coverage.

In addition to that built-in disincentive to insuring abortion, the law also invites states to enact stricter rules of their own. Thus far, 16 states have followed suit, barring or restricting insurance companies on their exchanges from covering the procedure. Three of those states are joining the five that have barred or limited all insurers from covering most abortions since the early 1980′s.

Supporters of Washington state’s proposed abortion insurance mandate are careful to stress that it wouldn’t lead to a dramatic uptick in abortions or require carriers with a religious bent to cover the procedure. They also note that a pair of federal plans that will be sold on all 50 state exchanges will be barred from covering elective abortions.

“It’s not expanding abortion coverage,” said Democratic Rep. Eileen Cody of West Seattle, the bill’s primary sponsor. “It’s ensuring the rights of women to get what they’re paying for now and to continue their freedom of choice.”

Opponents counter that the measure would require businesses and individuals to pay for abortion coverage they’d rather not have.

“Washington state would be the only state in the country that would force employers to pay for abortion,” said Peggy O’Ban, spokeswoman for Human Life of Washington.

If passed, she said, it would amount to “the first conscience coercion act in American history.”

Its passage, however, is not assured.

Proponents of the measure say they have the votes they need in the state Senate, but it’s not clear that Senate leaders will allow it to get to the floor.

Ironically, the man bill supporters will likely blame if it fails to get a vote counts himself as a proud backer of the measure.

Sen. Rodney Tom of Medina, a fiscal conservative and social moderate, and one other like-minded Democrat crossed party lines to caucus with Republicans in December, handing a one-vote majority to the GOP. Seizing power for the first time in nearly a decade, elated Senate Republicans reciprocated by installing Tom as Majority Leader.

Last month, Tom addressed about 250 advocates rallying for the measure’s passage on the state Capitol steps.

“I’m down here making sure that my 17-year-old daughter has the kind of protections that we need in Washington state and that all of our kids have those same kinds of protections,” Tom said to cheers.

Moments later, Gov. Jay Inslee, a Democrat and fellow bill supporter, delivered a not-so-subtle challenge to Tom’s political will.

Washington state “deserves a vote in the state Senate on the Reproductive Parity Act,” Inslee said. “We are going to insist that we are not going to let anybody close the door to democracy in this state.”

Another irony: though the bill has proved to be among the most hotly contested of the session, its broader impact if passed may be less than sweeping.

For one thing, most abortions are paid for out-of-pocket. According to the Guttmacher Institute, only 12 percent of abortions nationwide are paid for by private insurers, with 20 percent footed by Medicaid.

For another, because most abortions cost less than a live birth – the procedure typically runs about $500, though late-term abortions are far more expensive – insurers may be disinclined to stop covering them.

At present, all major insurers in Washington state cover abortions, and Cody, the bill’s sponsor, said she knows of no carrier with plans to change. Insurers new to Washington state on its exchange may be tempted to adopt different policies, she said.

No matter its immediate impact, said Elizabeth Nash, states issues manager with the Guttmacher Institute, the bill’s passage would be a watershed event.

“It would be a model for other states to follow,” she said.

So if you have a daughter, you should be able to buy a repo rider… Obviously I am talking about a Reproductive rider that would cover your daughter’s abortion should she need one/want one… This would only affect daughters because the female has all the rights… They have the right over their body and they have the right to choose life or death… Therefore it stands to reason they should bear all the financial responsibility… I shouldn’t have to cover it: 1) too old 2) Vasectomy 3) I keep my pickle in my pocket…

I personally believe that God breathes a SOUL INTO A LIVING HUMAN BEING AT CONCEPTION. Even if you believe that the soul is not there UNTIL the delivery of the child, and you believe in abortion, it only means that you have MURDERED A FUTURE HUMAN BEING. Does birth control or condemns Not work? If anyone, besides a victim of violence, gets pregnant outside of protection…no one, but the carefree individuals.. sexually involved, should be footing any bill besides caring for the life they created. Life begins at conception and should be treated as such. If the cradle to grave welfare state dependency ends, children with a bleak future may actually have a chance at a good one. Choice matters..choose life.

Pregnancy is a choice. People know how to not get pregnant. HIV is a choice, people know how to avoid getting HIV. It will not be my choice to pay for these medical situations nor their prevention.

  Autism is correlated with pregnancy related diabetes. I mention this to pint out that the pregnancy clock for both males & females is not solely related to Down’s syndrome. That is the only thing you have to worry about is not if you are female & over 35 or especially 40.
  
  To my Sandra Fluke represents a lifestyle choice of hedonism. Life even in a industrial society where we are not affected by famine like a century ago is deadly serious. The best time to get pregnant is maybe 18 to 30 and that is fall all the kids. But liberals treat this as adolescent play time. I spent a good hour looking up an article about the war in the womb between babies and mothers & how it affects autism. Unfortunately, I did not find the article in my search of Discover magazine articles. One has to wonder how more vicious (unconsciously so) this war in the womb is at age say 42 than say 22.
  
  Now autism is not a single disease but a whole spectrum & is very complicated. But is is correlated with age & nutrition (like gestational diabetes). Is Sandra Fluke (age 30) going to wait another 10 years? Is she going to recommend bacchanals until the latter 1/3rd of reproductive life until giving casual consideration of having the perfect child?
  
  I believe in birth control as does the Roman Catholic church (although their methods are rather more limited), but Planned Parenthood vacuums & hypodermic needles of death are not it.
  
  Abortion as birth control. What a crock!

If I were pro-life and living in Washington State I would move….It is bad enough that abortion has been made legal but now the STATE is mandating complicity in the murder of innocents.

…they will soon be requiring Catholic hospitals to perform abortions.
Likely they will use Medicare and Medicaid as threats.
If you do not perform abortions in your hospital we will not reimburse any medicare or medicaid patients. They will force you to choose between faith and money, the question is.. which master does the church serve?

Other employers may just drop insurance all together, or go out of business.
Then they will raise the penalty to make it cost prohibative to not have insurance.. choose going out of business to your faith.

  Do not underestimate Pope Francis. He would order all Catholic Hospitals closed before abortions are performed. I would rather not have ANY health care available to me and my kids than to be complicit in the murder of children.

A supplement should be added for each individual want and then the individual should pay for themselves. Each policyholder should understand each policy before buying.

To a lot of us conception is the first development and on to natural death. one cell starts the development and continues growing to birth and development goes on growing to getting bigger and learning more at each stage of life. We don’t kill at age one because they aren’t as developed as a ten year old and so on. God Bless each cell in our body and peace of mind be with you all.

This is not a water shed event, State Legislatures and the US Congress can bake it illegal to terminate pregnancies, nothing it is written in stone. It’s cheaper than a live birth you say? It would be cheaper to just give every male in your state a couple of tubes of KY jelly, why are we expected to pay for the decisions of your women?

Women are stupid to have abortions? Or women are stupid to pick their partners without any thought at all? Thank you Church of Scientology, Hollywood, and by the way, we will never pay your stupid insurance premiums – when its time for us to go, we got a choice too?

Don’t expect us to pay for your retirements in the future?

Women have rights, but so do the unborn!
Are we so blind??

No good will come from this legalized action.
Maybe insurance companies will take a stance and not do business in Washington State.

  Yes, we are blind! The founding fathers never intended we should be godless, only that the state not interfere w/religious rights. In becoming godless, we have forfeited God’s protection. He hates human sacrifice and will throw down the civilization that practices it. Abortion IS human sacrifice! Our days are numbered as a civilization. We will be thrown down by a people more wicked than we — islam will punish us and rule us w/an iron hand.

If women would just say “no”, there would be no conceptions. Also, men could control themselves and not let lust control them.
But women continue to practice sexual bulimia, where they binge on sex and purge the baby. Men like abortions because they can have sex and not have to pay child support for eighteen years.
