Recent Grad Faces Trespassing Charge After Getting Shot While Stumbling Into Unlocked Home

(The Blaze/AP) — A 21-year-old woman who was shot in the hip by a Colorado homeowner after police said she drunkenly wandered into a house now faces a felony trespassing charge, prosecutors said.
Zoey Ripple, who graduated from the University of Colorado earlier this month, entered a couple’s Boulder home through an unlocked door at around 3:30 a.m. Wednesday, police said.
Ripple apparently ignored warnings from the couple that they had a gun and walked into their bedroom. Homeowner Timothy Justice fired one shot in the darkness, police said.
When Justice and his wife switched on the lights, they saw Ripple on the floor with a gunshot wound. They later told police they did not recognize her as anyone they knew.
Officials said preliminary tests showed that her blood alcohol content was above 0.2 at the time of the incident, The Daily Camera reported ( http://bit.ly/JRdmJc ).
Ripple was hospitalized with a fractured hip but has been released and is able to walk, defense attorney Colette Cribari said Saturday.
Cribari said the incident was “out of character” for Ripple, who has volunteered in soup kitchens in Boulder County, helped organize a campus coat drive last winter and spent the summer of 2010 teaching English to children in Guatemala.
“She didn’t enter the house with any intent of committing a crime or harming anyone,” Cribari said. “We’re thankful she was not killed or more seriously hurt, but we’re disappointed they decided to file charges on top of all this.”
Prosecutors will likely file the charge against Ripple next week, the newspaper said. They don’t plan to file charges against Justice – Colorado law allows residents to use deadly force against trespassers who intend to use force.

Justice and his wife, Doreen Orion, are both psychiatrists. According to a 1999 online article in Psychiatric News, Orion was stalked for at least a decade by a schizophrenic woman she treated briefly at an Arizona hospital. The woman followed her to Colorado and moved into the same Boulder neighborhood, the article said.
Boulder County District Attorney Stan Garnett said his office usually prosecutes about a dozen cases a year involving drunken trespassing.
The main goal in prosecuting such cases is to get defendants treatment for their alcohol habits, he said. The felony trespassing charge can carry a sentence of one to five years in prison, but Garnett said prosecutors often opt for treatment or lesser pleas instead of prison time.
“We try to help the person get the treatment they need for their drinking,” he said.

If being so drunk that you end up getting shot for being in the wrong house doesn’t send you a wake up call, nothing will.

It was at 3:26 am in the morning, my dogs go nuts. Next thing was there was a young man in our bedroom (no shirt) trying to talk to my dogs (one was trying to “attack” from under the bed). It was clear that he was no threat thus I did not use force. Just tried to calm the dogs. He then walks out.
We checked the house but he had left. And yes we had left the door unlocked. Our mistake. I call the sheriff’s office and had deputies out there within minutes. Seems after he had left our house, he went two houses down and was ******* on the steps of a neighbor. That guy was up (due to back pain) and came out to ask if the young man “needed assistance”. He called the sheriff as well.
As best I can figure out, he then went down into a ravine which has coyotes running through it all night. He was picked up by the deputies in the next subdivision (he walked about a quarter mile). BTW, he was over one mile from his apartment. And appeared to be between 0.2 and 0.3 drunk. He woke up in jail with no memory of what he had done.
I did a little research and found his parents phone number. Had a little talk with his mother (former military). The young man was lucky that he went into my house as I am trained in threat assessment. Had it been one of the more liberal folks in the area, they would have freaked.

You have a Guardian Angel, that situation could have turned really bad, really fast.
Anytime your dealing with someone under the influence, be it alcohol or drugs, their demeanor can change like the wind. And it could just as easily went the other way.
And if I where in your shoes, I would be on the phone to your Sheriff’s Department, and find out why it took that Deputy so-long to get to your house…..

She graduated college, but no one will hire her with a felony record, at least not for any decent job. She has hopefully learned her lesson, being wounded and now realizing what she faces should wake her up. The family could refuse to prosecute and if the state wont allow charges to be dropped they can still refuse to testify thus saving her the total ruin of her life. Being so young she deserves a second chance. The lack of compassion so prevalent in this nation justifies God’s refusal to show any Himself.

People keep using through worse situations, such as those who smoke through their throat. I’m sure this woman has been through humiliating situations before and if we leave her to her own devices, she will surely hurt herself/others again (she hurt others as the shooter has to live with having had to shoot her and this couple will likely never sleep soundly again).

The Justice Department is actually investigating our univerisity for how they handle rape cases involving alcohol. And our area has one of the highest DUI problems in the nation. She was in jail for being drunk and “high”, while driving home at 4am (weaving-etc…) . The first time, about a year-ago, she was immediately bailled-out…So this time she “demands”, over the phone-from-jail to be bailed out again, so she can continue duping her parents-and-friends…over-and-over(…). The wife suggested she NOT be bailled-out, this time, until after hearing and trial…and maybe not if she even goes to prizon for whatever small time. AND when she “finally gets out” she’s on her own. Stubern is as stubern does…maybe [real-life] dose, she needs.

I was biking with friends in northern IL on a bike path at night and we were hit by a terrible lightening storm while still several miles from town. I rode like crazy to get back and out of that lightening. As I flew up the street to my pal’s house (I was visiting from out of state), I threw my bike onto the lawn and ran into the house through the unlocked front door. The living room was dark, but something seemed wrong. I couldn’t find the light switch, and the room just didn’t look right. Suddenly I realized I was in the WRONG HOUSE! I exited quickly and quietly (the owners WERE home and probably getting ready for bed) and ran next door to the RIGHT house. The fear and adrenaline were working overtime as I felt like a complete fool and was damned thankful I didn’t get shot.

She could have entered into a the wrong home or area of town and wound up dead by far worse means than being shot. She should be grateful to be alive even facing the possibility of jail. Drink if you want to drink, that is your business just be able to care for yourself. Drunk or sober you have to be responsible for your actions.

Too bad we aren’t all that perfect. In the real world me forget to lock things sometimes…I can‘t remember a time that I was so drunk that I walked into someone else’s house though. Looks like they live off the beaten path a little so it doesn’t seem as though she opened the wrong apartment door. Knowing this ahead of time, you are still responsible for all of your actions when you get drunk. Too many people seem to think that if someone is drunk then they shouldn’t be held responsible, especially if they are college students. Some seem to think “well they’re young and college students do things like that”. Consider this as part of her education. She got drunk, walked into someone’s home, and entered their bedroom after being warned that they were armed, and got shot. It’s all her fault. Yes this could be true. I still say that this comes back on the people that she was hanging out with on this night. I think they thought they were playing a harmless joke and look what happened. She wound up shot.
It could have turned out much worse. I say that further investigations need to be followed through. Find out why she was there and if it is determined that her so called friends were the ones that dropped her off then they need to be charged with attempted murder. Simple as that.

Where did you come up with the idea that this was a stalking issue. I do not care what the issue is, I only know that a person does not walk into someones bedroom in the middle of the night.
You seem to think this is a stalking issue and I can only speculate, but think it was her friends trying to be funnly and knowing she was drunk dropped her off and told her she was at home. This seems more than likely the scenario in my opinion. I really think that her friends that put her in this position are the ones that need to be charged with attempted murder. They are the ones that placed her in harms way.
She just didn’t wind up in that neighborhood without some others playing a part in this.

Wow, you are a very compassionate person aren’t you. I am sure that the home owners did what they needed to do in this situation. I know that I would not want to be in a position to shoot anyone.
When I turned on the lights and saw that I had just shot a young woman I would feel horrible. I would be thankful that she is still alive but I would never second guess what I did in the first place.
I personally think you are nothing more than a troll and seeking to agitate people. You sir, have no moral character or honor. You sir are, how do you say it, dispicable.

That is a good question. You have to wonder if some of her friends thought they were being funny and dropped her off in an area knowing she was drunk. Probably told her she was home and then drove off while they were laughing all the way home.
Never considering that they put their friends life in jeopardy. That is a good question and maybe her friends need to be looked at and charged as well. They are the ones responsible for her well being. If she had been killed, I wonder how funny that would have been to those that thought they were playing a practical joke. She didn’t just wind up there on her on I suspect.

They heard the noise outside, then they heard something inside and someone entered there bedroom and he shot. It is sad for the alcoholic, but people need to feel safe in their own homes and with the OWS and other nuts out there… you just cant be sure who is going to attack.

The woman was drunk and got shot. I believe this lesson taught her more than the court system is capable of doing. Another hot shot prosecuter trying to get a conviction on his record when she pleads guilty to a lesser charge. His record should reflect that he doesn’t have the brains to charge the proper charges. IDIOT!!!!

How dumb can you be Chips1. I would wonder what your thoughts would be if you woke up in the middle of the night and found a stranger in your bedroom. On second thought I realize who you are. You are an agitator with no coherent thought.
This young girl needs to be thankful that she is still alive. Chips1, why don’t you try her stunt sometime and break into someones home and them open the door to their bedroom.

Posted on May 27, 2012 at 2:21pmI don’t take it personal. I can’t count the number of stories on this blog that point out the fact that the government goes to the extreme. How about Faraghann threatening the President and they go after Ted. They aren’t interested in justice, only harassment. Look at the number of stories about criminals with pages of rap sheets and the posts complaining about why the criminal was walking free. This case of a drunk girl have a record, but not the highest crime they can squeeze into the system. If it happens again, the record will be there for the next prosecuter to hang his hat on. Prior convictions will have more weight than a drunken mistake.

The facts are that she was only shot once, she was drunk, the shooter didn’t know anything about the intruder(age, weapons, size)only that they were threatened by an unknown danger. Also nothing in the story allows me to judge her demeaner, her words, or the manner she responds to questions. Can‘t make a decision on facts that aren’t there. Only on facts that are presented in the story. Nothing more, nothing less.

If I get so hammered that I stumble into someone else’s home late at night I expect:
A) to be shot
B) to be arrested — and charged with BREAKING AND ENTERING (a felony), not some piddly misdemeanor like trespassing.
Congratulations to this girl for her soup-kitchen work; though I cannot fathom its relevance.
This loser should be healing up in jail for B&E, thanking her lucky stars it was her hip and not her heart.
