LOS ANGELES (The Blaze/AP) — A second teacher pulled from a classroom at Miramonte Elementary School this week was arrested Friday, just days after a third-grade teacher was charged with lewd acts involving photographing nearly two dozen children for sexual thrills, authorities said.

In a related development, a lawyer on Friday filed a claim against the Los Angeles Unified School District stating that he intended to file a lawsuit on behalf of an unidentified girl who ate a sugar cookie laced with the semen of the first teacher arrested, Mark Berndt.

Los Angeles County Sheriff’s Department spokesman Steve Whitmore confirmed the second arrest but would not immediately release any further details on the exact allegation.

The second teacher, who has not been identified, was removed after accusations of inappropriate touching of students surfaced on Thursday, Los Angeles Unified School District Superintendent John Deasy said.

“We are prepared to fire him next week and we’ll do that at the next board meeting for inappropriate conduct and inappropriately touching students,” the superintendent told KTTV.

The Los Angeles Times reported:

School officials reported an abuse allegation by a student against the second educator to the Los Angeles County Sheriff’s Department, according to a source familiar with the case.

Investigators are just beginning to look into the matter and stressed they are still trying to corroborate the allegation, said the source, who spoke on the condition of anonymity because the case was ongoing.

Authorities have released few details. Sheriff‘s spokesman Steve Whitmore said that the special victims’ unit, which handles crimes of sexual abuse, is looking into allegations against the Miramonte Elementary School teacher.

Deasy said the district has seen an increase in the number of complaints of teacher molestation since news of Berndt’s arrest broke, but he provided no figures.

Child-abuse investigators were informed by the district late Thursday night, sheriff’s Lt. Carlos Marquez said, declining to provide details.

Earlier this week, third-grade teacher Mark Berndt, who worked at the school for 30 years, was charged with committing lewd acts on 23 children, ages 6 to 10, between 2005 and 2010. He remains jailed on $23 million bail and could face life in prison if convicted.

Deasy said the allegations had not been previously reported to the district.

Beverly Hills lawyer Raymond Boucher, whose Beverly Hills firm specializes in sexual abuse lawsuits against school districts, religious institutions and hospitals, said the legal claim of behalf of “Jane Doe 1” charges that the district did not take adequate steps to prevent Berndt from repeatedly abusing children after they received complaints about him.

School was in session Friday at Miramonte. After news broke about the second teacher, several parents took their children out of school.

Ida Santana said her sister called her and told her to pick up her nephew.

“It’s hard to leave our kids here,” Santana said. “We can’t trust the teachers no more. Now there’s another teacher.”

Several other parents could be seen walking youngsters away from the school.

Santana said the family is unsure where the boy will be going to school from now on.

The development involving the second teacher was made public a day after authorities acknowledged that 18 years ago a 10-year-old girl claimed Berndt tried to fondle her.

Prosecutors declined to file to charges against Berndt in the 1993 report, saying they didn’t have enough evidence.

The details of that case and other claims by two former students about strange behavior by Berndt surfaced just three days after his arrest.

The allegations also raised further questions about why he wasn’t disciplined by school officials, who have been lambasted by some parents for waiting a year to reveal Berndt was suspected of taking bondage-style photographs of children in his class.

Only parents of children identified as victims were told by authorities about the most recent investigation.

School officials and investigators said proper procedures were followed to investigate and build a case against the teacher.

The incident involving the 10-year-old girl occurred in September 1993 but wasn’t reported by her mother to officials at Miramonte until the following January, after her daughter had seen an “Oprah” show about inappropriate touching, sheriff’s Sgt. Dan Scott said Thursday.

The girl claimed Berndt reached toward her genitals during class and she pushed his hand away, Scott said.

School officials notified the Sheriff’s Department, which submitted evidence to prosecutors. They opted not to file a charge of committing a lewd act on a minor under the age of 14. Berndt was never arrested.

“Based on what I read, it was a thorough and complete investigation,” said Scott, who noted the investigator who handled the case has retired.

Sandi Gibbons, a district attorney spokeswoman, said in a statement the case was rejected because there was insufficient evidence to prove a crime had occurred.

Berndt denied the allegation at the time.

Earlier, two women who said they were former students of Berndt told the Los Angeles Times that complaints were made about his odd behavior as far back as 1990.

Using a cheap camera, Berndt is suspected of snapping nearly 400 photographs of Miramonte students, some with a giant Madagascar cockroach from a classroom terrarium on their faces.

Others were blindfolded or had clear tape over their mouths, and some were given sperm-laced cookies to eat as treats in the photo sessions that were treated like games, Scott said.

Some of Berndt’s students defended him, saying he was a kind and generous teacher.

Angelica Zuniga, a 16-year-old high school junior, was in third grade in 2003 when she had Berndt as a teacher. She said he never asked her or others to do anything strange or to play any inappropriate games.

“They’re calling him `monster.‘ He’s just not that kind of person,” Angelica said. “He was one of the most amazing teachers out there. He’s dedicated his life to us, and I want to stick up for him.”

The latest investigation of Berndt began last fall when a film processor became suspicious about the photographs and turned them over to Redondo Beach police, who on Dec. 2 handed them over to the sheriff’s department, Scott said.

Berndt, who taught at Miramonte for more than 30 years ago, was removed from classwork in January and fired within the month.

The case also prompted Deasy to fire a high school teacher who is being sued over allegations he had sex with students. The Los Angeles Times reported Friday that Vance Miller, 59, was pulled from his Hamilton High School classroom in 2010, before Deasy became superintendent.

A police investigation didn’t result in criminal charges. But two former students, now adults, said the music teacher had sex with them while they were students at Hamilton. Deasy reviewed the case this week and decided there was enough information to fire Miller, who has been paid since his removal.

    Don’t be afraid to homeschool your children. Rearrange your life and time to do it if possible. Your children are the most important thing in the world. My wife and I (mostly my wife) homeschooled all four of our children. They have all turned out to be moral, intellegent and patriotic. They are not easily swayed by peer pressure and are a good influence on all their friends. I am so proud of them.
    The schooling years of my life were some of the worst years of my life. There was no way I was going to subject my children to what I knew was going on in the schools. I’m glad we made the right decision for our children.

    Look at California’s liberal attitudes towards teaching Children about sex in school and the real surprise is that anyone is surprised this happened.
    The only reason the LA school district is doing anything is because they got caught.
    If it was the NY school district the teachers would remain on the payroll working on “projects” in an isolation room away from kids.

      I remember catching my 7th grade science teacher Mr. Bidwell, at Goddard Jr. High is SoCal (~1970) feeling up Sherri during class one time. She looked like she got it a lot from him. It was in the interior hall, reserved for staff movement, mostly.

      This kind of thing goes on all the time. And, apparently has been grandfathered into the benefits.

    I don’t know how it is in your state, but in mine these perverts don’t get enough time in jail. And when they get out, they can move in right next door to you and there is nothing you can do about it. They are supposed to live so many feet from a school or a park, but what about the children living right next door? No protection for them. In my state, the addresses of convicted sex offenders are posted on a map. It’s astounding how many of them there are. There is almost nowhere one can move to get away from them, and then they could move in next door anyway. I read that 80% of the population lives within one mile of at least one convicted sex offender. Liberals are so concerned with the “rights” of these perverts. How about the rights of decent citizens to not have to be next door to one! They are known to be basically incurable, but we have basically zero protection from them.

      Not at our school. We already warned them if they teach anything of the sort, we will pull our son out & home school. They need us more than we need them. This is a very small school that does not necessarily endorse or facilitate all of this state’s mandates. We are watching very carefully. Our son tells us everything that goes on at school. One word about homosexuality & they know he is gone. His teacher for the next three years is a former pastor’s wife with children who has remarried & is most definitely heterosexual. We screen our teachers very carefully with full background checks & we meet them prior to the school year starts to evaluate their appropriateness. We talked with the lesbian & her partner for at least six months before we agreed to have him try their Montessori program & we actually visited her class in progress beforehand to observe her teaching methods. I don’t agree with all of them, but there was no problems & the kids were very happy & well-mannered & boisterous & obviously well-cared for. Keep your fingers crossed because this is only the 4th grade so far & they are passing their mandates for the 5th grade.

This is true no matter HOW you examine it – either by comparing absolute number of children preyed upon; or by comparing molestations per Priest compared to molestations per teacher, or per church vs. per school, or per choirboy vs. per student, etc etc. In ALL metrics the schools are, and have been, WORSE hotbeds of pedophilia than the Catholic Church ever was.

    MORE DISGUSTING IS THAT, UNTIL RECENTLY, THE PUBLIC SCHOOLS REACTED IN A WAY ALMOST IDENTICAL TO THE WAY THE CHURCH REACTED – by shielding, not prosecuting, the sub-humans. School districts even coined the phrase, “Taking out the trash” when a pedophile teacher, upon being caught, was transferred to another school district …. the standard response.

      I didn’t say I liked it, but I watch these individuals very carefully. My music teacher in junior high was gay & she did not push her sexual agenda onto anyone else. She was more like an earthy hippie than anyone else, but she is still a human being if she chooses to act like one. There are theories that state homosexuality presents itself in situations of overpopulation… I don‘t know if that’s absolutely true or not, but it makes me stop & think that I don’t know everything. I judge people based on the color of their character, not what might be going on in their bedrooms in their own homes. If they keep their gay lifestyles to themselves… Then I don’t have to see it or hear about it. I still don’t understand it, but who said I had to understand everything that happens in this world?

      The problem is, we can all name a gay teacher who was a bad influence on the young folks. We had a gay female gym teacher in town that watched the girls take showers and recruited from the school. I never knew so many gay girls than in this town. It was this one teacher’s influence over many many years.

      It’s tough nowadays with both parents usually having to work to maintain the lifestyle they want.

      I would urge all parents to cut back in the type of lifestyle the demand, in order for one of the parents to be able to home school their children.

      Combining the fact that there are some major perverts in public school, your kids aren’t getting the education they need and so what, you may have to live in a little bit smaller house, but your kids need to actually gain knowledge, something that is lacking in public schools these days.

      Makes you wonder if the teachers themselves should have to pass stringent tests to see if they even know anything. Their jobs should be merit based–no unions, no rubber rooms. Oh, and background checks would be a nice touch.

    This is one of the sickest reports I have ever had the misfortune of reading. I get the distinct impression the teachers’ union was protecting these individuals… Big mistake. We have already pulled both our sons from regular schools & public education. The oldest went to three different elementary schools & ended up in a home school situation in high school. The youngest is currently in an experimental public Montessori setting in a small rural school & we have already warned the teachers that we will yank him out if we feel they are teaching anything inappropriate. One of the teachers is a lesbian & we actually like her & her partner & have no problems with them as long as they don’t teach their alternative lifestyle in class (For all you who think we are so biased that we are intolerant as well), but he is slated for home school when he reaches high school. We are done with public school corruption. DONE. We are teaching our sons that they have options & do not have to subject themselves to adults who do not conduct themselves appropriately. It is most certainly a hassle & Thank God I have the aptitude for teaching & the foresight to become a certified teacher’s aide. My sons have done well & they are somewhat free-thinkers & my life is interesting to say the least… But I know they are safe in school when they are not here. My oldest now mixes online college courses with training seminars & he has some Navy nuclear training behind him & he will do fine.

    I am reminded of the “witch hunts” back in the early nineties where teachers were being accused and investigated for sex abuse left right and center. I don’t know if this batch is guilty or not; however it does look sensational.

    That said I wouldn’t leave my children unsupervised with strangers; and yes, school teachers count as strangers in my book. One of the most dangerous things a parent can do to their child to put to put them in the care of strangers 8+ hours a day. You wouldn‘t let someone you didn’t know or trust drive your car, so why let that person teach your kids. I’m sorry. The magic bachelors’ degree in childhood education and “priestley” state teachers’ certification does not qualify someone as safe to be with children.

    This is just another condemning example (among a myriad of others) as to why socialized schools are bad for children. It’s another one of my reasons why I home school.

      I said “socialized schools”, and I meant it. Public education and socialized education are one and the same. While some public schools are more conservative and parent cooperative than others, they are all paid for by the state dollar and subject to the state’s regulations, agendas, and gross neglect.

      Well this might shock you… A high school phys ed teacher was a good friend of my dad’s & my family knew his family & his youngest son was my age & his wife was the school nurse. This teacher had an affair with a high school student & ruined his life. Wife divorced him, family broke up, school fired him, everyone who knew him avoided him… Except he married the high school student eventually because she was the only one he had left who would talk to him. He isn’t the same man we knew & he looks like he was hit by a semi-truck at one time & never recovered entirely while she revels in her conquest. Sickening, is it not? Free will can be a real b***h. Oh, the youngest son failed in his first marriage & I don’t know what became of him then. Consequences can be a real b***h, too.

      I totally support homeschooling, but really people. Don’t you understand that not everyone can do it?

      I get so annoyed when I read these posts that say homeschooling solves the problem. Take your kids out and homeschool them if you can, and I do think that more people can do it than they think. Many families don’t NEED a two income household, they just want the stuff. Put your children before your material wants. Really, you don’t NEED many things you think you do. But also understand that many parents have no other choice but public school so we are out there fighting a very difficult war for our children’s souls. It would be nice if you all just understood that.

      You and me might home school for slightly different reasons(besides the fact that there are some psycho teachers out there.)

      I just don’t think kids are getting a good education in public school anymore.

      Too many kids, too many bad teachers who are overworked during the school year and sometimes underpaid, too many devices that the school can’t regulate like phones,etc.

      I just don’t think kids are getting enough focus on their education especially when it comes to math and science.

      We’ve been so concerned with kids passing, that we didn’t make sure they were passing with actual knowledge.

      It’s become about churning them through the system, so they can get into debt by going to college, and then have to get a job they hate to pay off their students loans….so they can get a mortgage…that they can pay off over decades.

      Plus in school, they are so busy teaching you what to think, that they don’t teach you how to think. How to apply common sense and logic, or critical/outside the box thinking.

      It’s “think this way because I’m telling you to.”

      A lot of the problems with our society is because we’ve fallen into a consumer driven lifestyle where we have blurred the line between “need” and “want” where people don’t save up to buy stuff they want and pay it off in full.

      Any economy is doomed when it’s driven by 70% consumerism.

      Anyways, end rant.

      Removing a man’s ability to fornicate does NOT remove the hatred. Many CONTINUE, if given the chance, to find new and inventive ways to destroy little children.

      Actually, I was thinking lobotomies might be in order for some. I would prefer simple executions, but then I would actually shoot someone who tried to touch or hurt my sons in that way. I understand molestation more than you know & I abhor that our society has become so unconcerned to deal with it. If you castrate someone correctly, they lose the will to do a lot of things. I am a student of medical science & it is possible to eliminate most of the drive by eliminating the source of the driving hormones. I’m not talking about just relieving them of their testicles, but the whole equipment area. With extreme cases, you could just let them bleed out after the procedure. I am sympathetic to victims, not criminals.
