72-Year-Old Suing City of Austin for Seizing His Home and Condemning It for Building Fallout Shelter

Joe Del Rio’s story starts off two years ago. The 72-year-old man from East Austin, Texas, was woken up at 7 a.m. on a Saturday in May 2010 by a local SWAT team and fire department at his door. Why? To investigate a multilevel bunker under his home.
In the years following, Austin’s American-Statesman reports, Del Rio’s home has been condemned by the city as uninhabitable; he’s been served a $90,000 bill from the city to make the street on which he lives “safe” again (his bunker apparently made the street’s structure unsafe); and more recently set out to sue the city for unconstitutional seizure of his property without compensation.

Here are more details on the case from the American-Statesman:
“The ordeal they put me through was unnecessary,” Del Rio, now 72, said the afternoon before the second anniversary of his forced eviction. “I’ve gotten the runaround. I think they want the property. Condemning it is a cheap way to get it.”
The city released this statement in response to the suit: “The City of Austin has yet to be served with a lawsuit from Mr. Del Rio; however, actions taken by the City at 2006 Canterbury St. were done due to a public safety risk caused by the structure located on the property.”
Del Rio said the space in question started out as a Cold War-era fallout shelter — by no means uncommon at the time — which he later expanded into what he described as a work space when he took possession of the family home.

The American-Statesman goes on to note several instances where complaints had been issued by neighbors over the years due to holes in the land as well as construction of a retaining wall. It also points out that war memorabilia and firearms were found in Del Rio’s bunker and home when it was searched. Armed with these findings and complaints during the military veteran’s morning wake-up call in 2010, Del Rio said the police treated him like he was the “Unibomber” over his disheveled appearance — uncombed hair and shirtless nature — which he attributed to just waking up. He says he was interrogated for 10 hours.

The American-Statesman goes on to report local structural engineer Jeffrey Tucker, who constructed the retaining wall, as saying he inspected the house in 2009 and at the time it seemed “structurally safe” with no signs to indicate it would fall in.
Off the Grid Survival reports some of the $90,000 bill Del Rio received from the city was for filling in his bunker with 264 tons of concrete.

Del Rio is seeking compensation for the land that was taken from him, which the American-Statesman reports in 2010 was valued at $172,000.

Not only did he not make others unsafe, he made his own home into a potential hazard. Judging by the pictures, this guy had no idea as to what the heck he was doing. I suggest the city bulldoze the property, the place is a big dumpster. If you are going to embark on a major project like this…do it right or don’t do it at all.

They are a cancer, and they are slowly bringing the entire state into compliance with their various dicta. When I moved to Texas more than two decades ago, Austin was a small city, with essential state offices, a major university, and population that was liberal, but restrained. Now, it’s a big, dirty, ugly city, just like every pesthole of the northeast, and it has adopted all the same miserable habits, ideas, and propaganda. Two decades ago, the catch phrase there was “Keep Austin Wierd.”
Now it seems the institutional left has taken it over and it’s become a haven for big-government thugs.

- FEMA has recommended keeping 2 weeks of food on hand in case of tornadoes, blizzards, hurricanes, earthquakes, …
- Do city building codes cover how far a person dig? Probably should but I doubt they do.
– Last every city is 3 days from total chaos should services fail. When the lights went out in NYC what happened? Widespread looting. If they had stayed off?

Posted on May 14, 2012 at 1:20pmDepending on local code (in some cases) the property owner has mineral rights to the land up to 50 feet down.
Rights to dig do not neccessarily mean the work is done to code. If he did weaken the street, then that was bad planning on his part. Article also says that his neighbors were complaining. Not good. Seems the city should have had to prove he had weakened the street before taking action, however.

I live 40 miles line of site from NYC and have though about a fallout bomb shelter the trick is building one without anyone knowing.

You couldn’t even make a small patio with that small amount of concrete. One cement truck carries about 40,000 pounds of concrete, or 8 cubic yards. What they probably used was 264 cubic yards of cement, which would be about 33 truck loads.

Posted on May 14, 2012 at 12:59pmFilling the hole with concrete was HUGELY wasteful and excessive. Here’s a little perspective. True story, I just finished building a 24‘ X 30’ detached garage. I poured the floor 4″ thick. It took 9 cubic yards of concrete at just over $90.00 per yard! That doesn’t include the footer or the stemwall, just the floor. Now think about complely filling the area of the garage all the way to the roof trusses.

Over educated and also brain washed collage graduates, destroy their own areas, where ever they land after school. Their heads have been filled with progressive ideology, so they vote themself into bankruptcy. When they finally wake up to what the have done, the flee to some other location to avoid their own mess.
Unfortunately for Texas, with a climate more like CA, these progressives want to avoid the likes of gov Moonbeam, but they never change their voting habits, bringing the scourge of progressiveness with them.
Another good example is CO, headed down hill faster then TX, even with a harsher climate.
These progressives seem to have no idea, they are the cause of all their problems, not the tea party.

If that house is worth $172,000, how come I can’t get $162,000 for my almost 3,000 square foot house with hardwood floors, 5 bedrooms, 3.5 baths and a jucuzzi? Austin property must be much more expensive than Garland, TX.

If you‘re wondering if you’re within the city limits of Austin, just look outside the window of your car or crack your window. If there are people panhandling on all 4 corners of the intersection and you smell pot smoke and BO you’re in Austin. Once you get outside of Austin it’s not so bad but the suicidal, inbred liberals are starting to find their way outside of the city. Like I said, I can’t wait for the day when I can put a for sale sign up in front of my house and probably head for the Dallas area. I grew up in this area and never remember it being this bad. You will be fined if they find you with anything other than a cloth or some other “natural” type of bag. This bunker is just an excuse to move an old man out of a home that is in a very valuable area of town. Beware the infiltration of liberals. They’ll take what you have and line their pockets with the proceeds in the name of safety for the community or any other reason they can find.

#1– 264 pounds of concrete ? Geeez It isn‘t hard to see a Liberal Basement dweller that hasn’t a clue about real world things wrote this article.
If the writer meant 264 cubic Yards of cement , this would be more in line with filling the enormous cellar. Problem is that concrete cost $90.00 a yard in West Texas and likely is $120.oo + pumping at around $50-75 per yard in goofy azzed Austin.
As usual, The Liberal Socialist City council can’t even believably lie with their figures or lie to keep the truth hidden. As Usual.
#2– I suspect this house And so called Bunker was built long before the City annexed the area. Thus the Grandfather clause would apply to the house as it stood before annexation..
#3– Someone here assumed the city was trying to pull an Eminent Domain gig on the property . That’s a possibility considering the excessive use of Eminent Domain by private developer / Gov partnerships. It would cost millions to dig up anytime later for a development project, highway ,etc.

What good is a hole if it collapses taking you, your neighbors and a good chunk of a city street with you. I lived there one time, a friend of mine moved from Austin to Houston, I asked him why, and he said “ I would like to be able to support my family”. Austin has a high cost of living. Many students at UT do not move away after graduating, and they keep the workforce in high compitition which keeps wages low. While these kids end up being pretty liberal. Before I moved away, if I wanted to put a deck in my backyard, the permit would cost me $1000.00. The City of Austin also owns the Electricity supply in the City Limits as well as water and Sewage, which they are not afraid of charging you. Many times in the summer my Electricity bill was over $500.00/month and this was in the 80‘s and early 90’s. Austin is a nice place to live if you want to remain poor.

Garland is still mostly conservative, but Dallas is, like they said, east-California. My brother in law is a big liberal, and he couldn’t stand living in Garland, had to move to Dallas. He loves it there. Bet he won’t when AT&T starts their lay offs due to Obama’s policies, or he loses his health care because they’d rather pay the fine than provide insurance to everyone. The best thing Texas could do is get an immigration policy like Arizona, then all the illegals would leave.
And I like the comment about Oklahoma sucking and keeping Texas from falling into the gulf….funny.

Unable to staff the growth of his company locally, Dell started importing employees from Silicon Valley. The prices on real estate became ridiculous. For a while, Austin TX was the 3rd most expensive real estate market IN THE COUNTRY; San Francisco, Washington DC and Austin. And it was because of the Californians who left the sh*thole that is The Golden State. But, it seems to have been mostly conservatives who left the mess wrought by the socialists. The left wingers are still in Cali sucking on an almost dry teat.

Technically, if you were putting in a fence or flowerbed and found and 100 pound diamond, the city or more likely the developer of the land would be the “lawful” owner of said mineral and they could sue you for it in an instant and win. It was a dull and ignorant move to separate property and mineral rights. Extremely stupid move indeed. If we had never made this move as a nation, then nearly every homeowner would receive a royalty from nearby oil and gas wells.
Also, under an allodial title, the landowner is the sovereign and no foreign entity (government or otherwise) can come onto your land and act with impunity. Just look at the King Ranch in Texas. It is held in allodial title and you will never see a trespasser or the police on that property without a written invitation. It is too bad that Texas is the only state left that allows for real ownership of land via the allodial title.

What we can cut in our back yard and use to build is problably safer than these stamed peices of wood you buy at the local lumber yard, our 2×4′s are true. You can not possibly be responsible enough to build your home? So says the govenment! After all we want our homes to crash on us while eating dinner. The guy is 72, I am sure he is smart and wise enough to protect himself, making sure it is sound.

The drying process and planing of the dried/treated board reduces it to an industry standard 1.5 x3.5″. DYI’s can cut, dry or plane (or not) as they wish, but boards can then have different dimensions and have the problems associated with that when used in building something. The cut size vs finished size has been standardized in the construction industry for obvious reasons.

Building Departments usually slap a notice of violation when certain uninspected work has been done to one’s home, Generally a permit is required, in this case a structural engineer will have to certify the work (make sure the shelter is safe. If it isn’t, the owner is required to bring it to code. Generally, if one doesn‘t pull permits or do work necessary the city isn’t empowered to seize private porperty. Officials have their ways to get offenders to comply, like making one;s property impossible to sell or finance. If the building is provably some kind of threat to public safety then county officials can step in and do what is necessary to protect the public good. It doesn’t sound like the structure (house or shelter) have any problems whatsoever, it was oked by an engineer in this article. Either the story isn’t accurate or there is something strange going on that the city/county condemned and took possession of this man’s property. I didn’t see anyting about a court order or lawsuit. I say Fishy!
