Justice Ginsburg on Egypt TV: ‘I Would Not Look to the U.S. Constitution’ to Craft Modern Law Document

Justice Ruth Bader Ginsburg Visits Egypt, Tunisia to Praise Arab Spring

WASHINGTON (The Blaze/AP) — The Supreme Court‘s midwinter break is often used by justices to fly off to sunny vacation spots or European capitals where they address an audience or two on someone else’s tab. But this year, Justice Ruth Bader Ginsburg is on a different sort of visit to two North African countries where popular uprisings helped topple longtime leaders. And in one of those countries — Egypt — she raised eyebrows after saying, during a television interview, that she “would not look to the United States Constitution” as a blueprint for crafting the nation’s new constitution.

Ginsburg wrapped up a State Department-sponsored visit to Egypt on Wednesday with a public seminar at the Cairo University law school. The 78-year-old Ginsburg told students she was inspired by last year‘s protests that led to the end of Hosni Mubarak’s regime.

“This is the most wonderful time in which to live and be among the young people who are helping your country and bringing about change during this exceptional transitional period to a real democratic state,” Ginsburg said, according to the U.S. Embassy in Cairo. “Think of the people who lived before you and did not have this opportunity because they lived under a dictatorial regime.”

These comments come as many fear the Islamist influence that will come to the region, as the Muslim Brotherhood and other radical groups seize power.

The justice, an appointee of President Bill Clinton, and her daughter, Jane, a legal expert on intellectual property, spent four days in Cairo and Alexandria meeting with judges, legal scholars and students. Egypt is set to start rewriting its constitution next month.

“This gives justices, folks who are writing legislation, folks who are working on court regulations a chance to talk to the most senior American justices and members of the judicial branch about their experiences of a lifetime of working on these kinds of issues, about various ways to solve the problems of checks and balances,” State Department spokeswoman Victoria Nuland said. “And it is a chance for some of these folks, who have less experience in a democratic system, to learn a little bit more about how we do things.”

Ginsburg, though, inspired controversy following her comments, as she seemed to be urging Egyptians to avoid the U.S. Constitution as a model for crafting their own document. The Huffington Post has more:

…while Ginsburg’s interview, posted on YouTube on Wednesday, lauded the Founding Fathers’ “grand general ideas that become more effective over the course of … more than two sometimes-turbulent centuries,“ she also said she ”would not look to the United States Constitution if I were drafting a constitution in the year 2012,” given its original exclusion of women, slaves and Native Americans.

Since World War II several other models have emerged that offer more specific and contemporary guarantees of rights and liberties, she said, pointing to South Africa’s constitution, which she called a “really great piece of work” for its embrace of basic human rights and guarantee of an independent judiciary. She also noted Canada’s charter of rights and freedoms and the European Convention of Human Rights.

“Why not take advantage of what there is elsewhere in the world? I’m a very strong believer in listening and learning from others,” she said.

Last week before leaving, Ginsburg met with Secretary of State Hillary Rodham Clinton to discuss the trip.

From Egypt, Ginsburg continued her work with the State Department by heading to Tunisia, where the Arab Spring protest movement had its start. Tunisians recently marked the one-year anniversary of the revolution that ended the dictatorship of Zine El Abidine Ben Ali and sparked uprisings around the Arab world.

      Explain to me why this senile old moron is a Supreme Court Justice?? She was completely unqualified when the Horndog-in-Chief appointed her and she has only gotten more senile and stupid since. Why is she allowed to go to the Middle East and embarass the country this way. She should be impeached from the Court and put in a home for her own safety…..Just sayin’

      A real democratic state is actually what it is. A REAL democratic state run by the mod mentality. For conservatives, this is a terrifying thought – the breakdown of law, justice, and freedom in the wake of the current desires of the most persuasive and vocal groups. For liberals like Ginsburg, Carter, Obama, etc, this is a utopian ideal – but not the end game. No, the “real democratic state” they are so happy to see is the last step in a true progressive takeover.

      Now, with the grinning idiot image portrayed by Sotomayer, their iconic image has entered into the realm of of the bizarre and darkly sinister, but they need a couple more flakes, oddballs or misfits in order to make a full-fledged transition to a pictorial representation of Satanism in order to more completely overshadow the others there who are normal.

      @SMITHCLAR3NC3 – Correction, we are supposed to be living in a Constitutional Republic. However, with the morphing of our country during the 20th century and the fast-tracking of our country on the path of socialism and authoritarianism during the last decade (esp. the last two years) we’re now more of a Corporate Fascist State than a Constitutional Republic. However you would interpret our current system, the key element that has led to the fundamental change in our country away from its intended system is a movement away from Constitutional authority as the absolute law of the land.

      No people can expect to retain any consistent level of liberty without a strict adherence to a constitution as the absolute law of the land. When there are no absolutes, when everything is relative, liberty and freedom are relatively valued and devalued.

      As an attorney, I have to ask myself does Justice Ginsberg live in a cloistered nunnery or does she simply have her head up her hind end – yes I said it. What in the Hell does she think the Arab spring was, and what does she know about the Muslim Brotherhood? I ask God, what in the world were you thinking when you permitted a woman as daft and narrow minded as she to ascend to a position on The Supreme Court of the United States? Have yet to get an answer on that one.

      Whether she is aware or not that our State Department under the direction and tutelage of Obama and Hillary were planning and orchestrating the Arab Spring, who knows? Can she be that blind to not only was the way being prepared for the Muslim Brotherhood to take over leadership and power positions in these governments, and that the Muslim Brotherhood was led by radical Islam, which promoted and implemented Sharia Law? She would almost have to be ignorant of these things and was obviously not briefed by the State Department to any degree of truth or reality, as Sharia Law and the implementation thereof is as far from Democracy, at least as we know it, for any freedom loving people, at least with respect to what we would deem freedom to be, would not in any way want to be subjected to Sharia Law.

      This is likened to watching the Emperor parade down Broadway in his pajamas and all the while the people were clamoring and conversing about his colorful, ornate kingly garments, which were obviously not so.

All cases to be reviewed by SCOTUS should be put on hold too. How can we trust/ have faith in how she will rule on SCOTUS cases now knowing this!!!???

      For a Supreme Court Justice to speak in this manner is frightening. She is suppose to be the defender of the Constitution and here Ginsburg is advising another nation to model their system off of a some other countries like Canada and South Africa?!!       I noticed that in every comment in this thread about Justice Ginsberg, not one of you had any angry words to say about your Republican Senators who voted to confirm her appointment by a whopping 96 to 3 vote.
      Since not one of you hold a seat in an elected office, I assume that what you’re really saying is that you guys know better than your elected representatives do? If THAT’S the case, then if I were you, I would start plotting the systematic removal of these traitors from office “By Any Means Necessary” and have a good’ole fashioned lynching. Certainly, she is unAmerican in her outlook concerning the law. Social justice and legal redress are not the same. In fact, I’m not sure there is any social justice. I am a small town, middle income female and I am willing to bet that I would not be welcome with the Bar Harbor crowd. Not even the OWS crowd. I never eat goat cheese. That may be social injustice; but, is it legally reprehensible?

      I agree with her on parts concerning slaves, etc. that were prominent at the time, but not to rule out the constitution altogether! If she does not believe in the constitution which she is suppose to defend, why do we need her? Havent we done away with slaves, do not women have the same rights as men? She should have said yes, but make sure you include the right for amendments as we have today. People just get to the point that they think they know it all. If Egypt is not careful they will have jumped from the frying pan into the fire! Sad for such a proud people.
