‘Absolutely Ridiculous’: Middle-Aged Couple Reportedly Spends 23 Hours in Custody After Dancing at NYC Subway Platform

Caroline Stern, 55, and her boyfriend George Hess, 54, reportedly spent 23 hours in police custody after dancing at a nearly-empty subway station in New York City.

“I’m a dentist, and I’m 55, and I got arrested for dancing,” the woman told the New York Post. “It was absolutely ridiculous that this happened.”

It was nearly midnight when Stern and Hess, a film-industry prop master, headed home last July from Jazz at Lincoln Center’s Midsummer Night’s Swing. As they waited for the train, a musician started playing steel drums on the nearly empty platform and Stern and Hess began to feel the beat.

“We were doing the Charleston,” Stern said. That’s when two police officers approached and pulled a “Footloose.”

“They said, ‘What are you doing?’ and we said, ‘We’re dancing,’ ” she recalled. “And they said, ‘You can’t do that on the platform.’ ”

The cops asked for ID, but when Stern could only produce a credit card, the officers ordered the couple to go with them — even though the credit card had the dentist’s picture and signature.

When the couple tried to film the order, Stern says the officers called for backup.

“That’s when eight ninja cops came from out of nowhere,” she said.  Her boyfriend was allegedly tackled to the floor, and then both were handcuffed.

The initial charge was reportedly disorderly conduct for “impeding the flow of traffic,” but Stern argued that “there were like, three people [on the platform].”

The New York Post has the latest on the story:

The charges, including resisting arrest, were later dropped. The couple has filed a Manhattan federal court suit against the city for unspecified damages.

“If you are surrounded by good musicians, that’s going to make you want to dance,” Stern said. “The musician who is playing is legal, but . . . we’re illegal?”

The avid hoofers frequently go out on the town to boogie.

“When you’re waiting for the subway late at night, there’s not much to do but dance and celebrate life,” she said.

The city Law Department is reviewing the court papers, a spokeswoman said.

Between limits on smoking, trans fats, soda, and now dancing, apparently– what is New York City coming to?

      Bloomberg was a Democrat before switching to the Republican Party in 2001 in order to run for Mayor. He also ran as an Independent Candidate. In New York, you can run for the same office under more than one party designation, and combine the votes. He then left the Republican party in 2007, and then successfully campaigned for an amendment to New York City’s term-limits law. He is then won a third term in office, running as an independent in 2009.

    MAYBE we have too many COPS? Me? I’d rather see more people dancing!! What about the impromptu (but heart rendering) opera, music or dancing expositions that happen “spontaneously”??

    I hope there are many people on that platform dancing every day from now on. GEES people!! Huge place, no other people around? Dancing early in the AM? Arrested??? GOOD GRIEF!!! DANCE AMERICA!!! YOU ARE FREE!!! DANCE!!! (of course people won’t do that when it would hurt anyone)

The government at all levels is concerned with 3 things, increasing their power, control and funding, robbing you of whatever wealth you still have and making sure that they don’t get the blame for any of the bad things that they have created. Fortunately for them, they control the media and entertainment complex so this has been very easy for them to accomplish.

    I think given the current state of NYC and the direction that the mayor has been going, dancing should be outlawed with fines, taxes, jail time. These were most likely two “free loaders” to the system. Sarc off. This is why anyone should stay away from NYC. What a stupid town. I can say this now because I don’t live there, however, mayor Bloomandday wants to most likely do a sting operation where I live to show me dancing and have some type of charge arranged.

      I know, dang it.. is it too freakin’ hard to just tell the couple to stop dancing.. Why does everything have to go to the ultimate level with theses guys.. Honestly I blame the criminals. They have gotten so bad that the cops think EVERYONE is a criminal now. I swear this whole idea of busting into someones home to arrest them is ludicrous. Or arresting folks for dancing on the subway platform. And why are they so afraid to be filmed. The highway patrol, State and County prisons, and most city police have dash cams or someone filming(during cell extractions, etc) to protect them. Why can’t citizens do the same. IF they have nothing to hide then what’s the problem. Act like the civil servant that you are and stop acting like some commando warriors. And don’t even start with me. 2 of my children are cops.
