ACLU Forces TX School District to Change Policy on Standing During Pledge

Samuel Brooks is the president of the Sweeny, TX (near Houston) school board. He’s a fan of the American flag and the Pledge of Allegiance. But after two high schoolers complained about the district’s policy requiring students to stand while reciting the Pledge, the ACLU stepped in. And after that happened, the school district felt it had no choice but to change its policy.
“They were refusing to stand up for the Pledge, and then it got around the whole school,” fellow student Cherissh Garrett told KTRK-TV. But despite the protest, the students didn’t face any repercussions.
“There was no disciplinary action taken. It was just a request that they stand for the pledge,” Superintendent Randy Miksch told KTRK. That didn’t matter to the students, who complained anyway. When the ACLU got involved, the district capitulated:
“Our bill of rights and American tradition protect dissenters and the majority just the same, and the right to express disagreement is a patriotic value that all Texans should fight for,” the ACLU said in a statement.
Despite changing the policy, those responsible for doing so aren’t happy about it. Brooks, the school board president, is one of them.
“I don’t agree with [the ACLU's position] personally, I still think that we should be able to, in our district, we should be able to set a standard of behavior that we require for our students to show,” he told Fox News. “And part of that should be showing respect to the flag of our nation and our state.”
He explained that the district will change the language in its policy to suggest standing, and may even still “require” it in a round about way:
At issue in this case isn’t necessarily the requirement to say the Pledge. Currently, Texas law requires students to recite it every day. According to KTRK-TV, students can be exempted “but only with a written request from a parent or guardian.”

Posted on April 25, 2011 at 1:50pmUH, here’s the deal. THE MORE you fight these people, the more they resist. We stand and put our hands over our hearts when the PLEDGE is made; WE Stand for the National Anthem. I really don’t care what others do…I won’t have anything to do with them socially…but they can do whatever. My kids, my grandkids, my friends and relatives STAND out of respect. WE can’t spend time/$ trying to force people to respect something. WE can make them feel like the dopes they are by ignoring them and doing what we KNOW IS CORRECT.
TRUST ME…if the teacher, the principal and the kids just did their thing and went on, those goof-balls who remain seated are going to feel so uncomfortable the lesson will stick with them always. This is a public school. IF you can put your kids in private schools you may get the standing at attention, but then you get bad things there. THE POINT? EACH OF US HAS TO DO WHAT WE BELIEVE IN DOING. IF everyone did that, we’d be in great shape.

Posted on April 25, 2011 at 1:48pmMore of the same old leftist push to remove saying the Pledge from our public schools. I just saw this:
“It’s an organization that mocks Christianity, an organization that will stop at nothing to remove the Pledge of Allegiance including the phrase “under God” from public life. The Freedom From Religion Foundation is pushing hard to strike the Pledge from public schools. After a significant loss at a federal appeals court, the organization is now asking the Supreme Court to take the case and declare the recitation of the Pledge in New Hampshire schools unconstitutional.
The American Center for Law and Justice is fighting back. We have just days remaining to prepare a critical amicus brief to urge the Supreme Court to reject this case, to let the lower court decision stand, a decision that correctly concluded that the Pledge embraces patriotism and does not endorse religion.”

Stop pretending to be a racist, sexist conservative. We aren’t buying it. Just go back to huffypuff or mediamatters or which ever left wing nutjob rag you came from. And spout your hate filled rhetoric there where those who think like you are welcomed. Someday you may learn enough to realize that the Tea Party isn’t about hate, isn’t about division. It IS about allowing all Americans the opportunity to lift themselves up to a better place based on their desire and ability to do so.
Now about the wacko‘s that didn’t want to stand for the pledge. Hey fine what ever. Take their names down and put them on a watch list. Oh wait I’m sorry. It‘s only LOYAL Americans who are put on the watch lists now isn’t it. Those dangerous 80yr old grandmothers who the left claim want to start a second civil war. News flash for you “progressives” The democrats were the racists back then. As well as during the civil rights movement. Just ask Al Gore who‘s daddy proudly stood spouting off racist crap defying equal rights in the 60’s. Oops truth hurts don’t it! And incidentally the two punks wouldn’t have been made to stand where I went to school either. Of course they would have gladly stood the next time they came to school. After the rest of the students encouraged them and they were able to stand again.

Yet, you would advocate for no respect in the school districts even though there may be a conduct (behavior) policy already on the books, and enforcable. You are lawless, and you advocate for lawlessness. You would be happy, I’m sure, that the world were run by emotions only and not the rule of law.

I agree with you, the issue is choice, the prior rule removed choice from the equation and compelled the students to take an oath, no choice. The new policies allows for choice, this is not Stalin’s russia and citizens have the choice whether or not recite the pledge. This has nothing to do with lawlessness and everything to do with the freedom of expression we enjoy as citizens.

Posted on April 25, 2011 at 3:56pmInteresting, they chose not to stand for the pledge. People around them stood and pledged. The word got around the school that they were not standing. Okay. They were IGNORED for their lack of respect. That wasn’t what they had in mind, so they called the ACLU and complained.
Wow! Like wow! Like I‘d even considering hiring these doofuses because they can’t respect others to the point where they have to call in the ACLU to fight their battle for them. Oh the pain! Oh the suffering of sitting there IGNORED for 15 to 25 seconds. How outrageous.

I thought the Tea Party was about all about freedom, being compelled to take a loyalty oath sounds facist. The Jevoha Witnesses have a religious problem with pledge an oath, should they also be forced. Again, this is the Beckerheads putting symbols above the true meaning of America.

Some one show me where in the constitution does it force or compel its citizens to take loyalty oaths. Forcing a citizen to take such an oath is against the spirit of the Founders and unconstitutional. I hear Hitler, Stalin and Mao loved to have their citizens repeat like robots loyalty oaths.
Again the Tea Party favors symbols over the truth.

The Democrats don’t take a loyalty oath because they do not know the meaning of allegiance or loyalty. All they know is control, control, control, and gimme, gimme, gimme!

Posted on April 25, 2011 at 4:14pmMAULMAN, like that idea. A short civics class everyday: 1. demonstrate the proper way to say the Pledge of Allegiance. 2. Know all the words and say them slowly and clearly 3. Everyday, a small part of the pledge is broken down and explained or other small points of flag, military, etc. gone over 4. exam at the end of each quarter. Don’t stand up or say the pledge correctly counts against your grade. Parents who opt their kids out of this course get sent back to Mexico and the kid still gets a failing grade if all requirements are not completed.

Let’s look at crime statistics, prison number statistics, you “patriotic” people come in second place on those statistics, and in first place for using up welfare programs in Calif.
So one of your kids join’s the Army the other 5 ride the system, in prison, welfare costs, and bleed the Calif. medicare system dry, that’s “patriotic” ?

Posted on April 25, 2011 at 4:52pmIt seems to me that some people posting here have no idea what the first amendment is and what the definition of Freedom of speech is. The definition of freedom of speech is as follows: noun;
Report Post »the right of people to express their opinions publicly without governmental interference, subject to the laws against libel, incitement to violence or rebellion, etc. Ok, so when did a school start to have governmental authority? More importantly, what opinion was being expressed by these students that was not allowed to be vocalized? Freedom of speech of the other students was violated through the school by the ACLU, these kids were trying to incite a rebellion….which violates the other students rights to speech. So someone tell me which constitutional right did the school actually violate? The ACLU is trying to use thuggery to strip the rules and regulations of a school district and preying on our children to “change” America. Quit making-up “rights” and “adjusting” the Constitution to fit your agenda.

I had hope there for a second that you knew what you were talking about, alas you have no clue.
First, it was a public school, public schools are government bodies. Second the public school mandate students stand and recite the pledge. Third the SCOTUS, during WWII, has already ruled that such a policy is a violation of the first amendment, and ruling since then have upheld that their is a first amendment right to dissent. The new policy no longer mandates students to stand and recite the pledge, they are free to choose for themselves. Again, your points have no basis in the facts presented and are nothing more than a factless rant against an organization you have been told and conditioned to hate.

Report Post »How is this a ruling against your freedoms, the pledge is no longer manditory, now those that stand for the pledge do so not because they are forced to, but because they want to. To many here are seeking to protect symbols at the expense of the true meaning behind our principals. Fascist nations force, under threat of punishment, their citizens to take loyalty oaths, citizens of free nations have the choice.

Posted on April 25, 2011 at 8:57pmIt is not that they do not want to stand but what kind of message does this send to children. Where are they going to learn to follow rules much less laws if they are allowed to do whatever they want. Not following some rules has big consequences later in life. If they are allowed not to follow rules then that will progress into not obeying the law. I feel sorry for the parents of these kids in that school. The parents of those children are children themselves maybe not in age but in mentality. Oh well we get what we deserve in the long run. I see problems ahead for this nation. Big Big Ones.

Posted on April 26, 2011 at 2:23amSUGGESTION: Go get a member of the VFW and a Flag and print up some hand outs and ask the teacher in whatever class if you can have 5 minutes. THEN let the VFW explain to those kids why the FLAG is important. Then pass out flyers of books they can read to verify his statements etc.
WE have to NOW get to the point that if we don’t like something, we have to DO something. WITHOUT MALICE, without vengeance but with the understanding that these kids have NEVER BEEN taught AMERICAN History…they have virtually NO traditions to fall back on, no communication about how great our country is. IF the one on one doesn’t work, go to the SCHOOL BOARD and ask for an assembly for the whole school and get other parents to join with you. I‘ve never met a kid that LOVE didn’t get to. LOVE and the TRUTH. I mean this.

Did all you hear the last words from that guy? He said he won’t be able to PUNISH the students. Isn’t that sad. Here in America, we should punish people if they don’t want to pledge their allegiance. Aparently that’s called freedom you want. Personally I love America because we have the freedom to say what we want, it’s called the first amendment. Aren’t you Beckerheads supposed to support the Constitution. Try starting with the first amendment. Or maybe you want to live in China.
