Alabama Gov. Signs Country‘s ’Toughest’ Immigration Law

MONTGOMERY, Ala. (AP) — Alabama‘s governor on Thursday signed a tough new illegal immigration crackdown that contains provisions requiring public schools to determine students’ immigration status and making it a crime to knowingly give an illegal immigrant a ride.

The bill also allows police to arrest anyone suspected of being an illegal immigrant if they’re stopped for any other reason. Alabama employers also are now required to use a federal system called E-Verify to determine if new workers are in the country legally.

Gov. Robert Bentley said the law is the nation’s toughest, and groups including the American Civil Liberties Union and the Montgomery-based Southern Poverty Law Center agree. The groups say they plan to challenge it.

The legal director for the Southern Poverty Law Center, Mary Bauer, said Thursday that she expects a lawsuit to be filed before the provisions of law are scheduled to take effect on Sept. 1.

“It is clearly unconstitutional. It’s mean-spirited, racist and we think a court will enjoin it,” Bauer said.

Bentley, who campaigned on passing the toughest anti-illegal immigration bill possible, said he believes the measure can withstand legal challenges.

The House sponsor, Republican Rep. Micky Hammon of Decatur, said the bill was written so that if any part of it is determined to be unconstitutional or violate federal law, the rest will stand.

Alabama’s measure was modeled on a similar law passed in Arizona. A federal judge blocked the most controversial parts of Arizona’s law last year after the Justice Department sued. A federal appeals court judge upheld the decision, and Arizona Gov. Jan Brewer has said she plans to appeal to the U.S. Supreme Court.

Neighboring Georgia also passed a law cracking down on immigration this year, and civil liberties groups have filed a lawsuit trying to block it.

      Yes, here they come. If we think about it a little bit we can see that the government will not help states by making tougher federal immigration laws because the liberal communists need to import votes so they can continue to get reelected. Obama is in trouble because he has pissed off, for the most part, the moderates who were one of the main reasons that he got elected in the first place. The majority of the U.S. population is oriented around the 5:30 mark on the ideological spectrum. Plus, unemployment hovers around 9%. I really do not think that the communist regime is working very hard for this because again, the more people who are out of work will become beholden to the government for help. Thus, making government bigger. YIKES!

    YOU GO GOV! But now you have to figure a way to expatriate them back to Mexico, because if you turn them over to ICE, they will just let them go. Might I suggest leasing a 737 every month on a 1 way all expenses paid mexican vacation trip to Mexico city. It has to be cheaper than emergency room, school lunches, welfare fees, and medicaid.

To further add an incentive to businesses, if they hire an illegal alien, no write-offs should be allowed for any expenses, i.e., salary, etc. As for self-employed illegals, lets start asking for green cards before hiring these folks. If anyone can’t speak English, it should be a clue that they are not Americans.

    Some companies hire illegals on the basis that with all the regulations and workmens comp cost they are stuck. And in order to stay up and running they hire cheap labor. Now I don’t agree with doing that but people who put certain people in the law making careers have created this mess indirectly on their own.

      Of course they have rights. Rights are granted by God and they exist with or without recognition by any government. A proper government will recognize rights and protect them as we have done in this country with our constitution. But a government cannot grant rights.

      What most people are thinking of are privileges such as taxpayer funded healthcare and education. These are most definitely not rights and we start calling them such we open up a can of worms.

      We were already at a very dangerous place with our state budget before the tornadoes hit Tuscaloosa and Birmingham. There are many businesses that were destroyed that will not be paying state taxes this year, so the state coffers will be down even more. We simply cannot afford to keep laying off teachers and other much-needed state workers in order to pay for all of the social services that these leeches suck up. God bless Gov. Bentley and our newly-elected Republican-majority state legislature. And God bless you all in Tuscaloosa. I’m praying for you and making contributions.

      We need to divert the resources that the illegals have been stealing and route it to those citizens who have lost everything they had.

      The opportunity for the american dream came first. It’s what drew the attention of all those that want to come here. There is a process for doing that legally for citizens and non-citizens alike. If the AMERICAN dream is only for Americans and those abiding by our laws then it is definitely a selling point for getting citizenship. If on the other hand, you don’t have to follow the rules to get a job/education/food/medical, then why would you become a citizen? So cut off the head of the snake, a.k.a. the people providing the service illegally. BOTH the illegal immigrant AND the company are breaking the law. BOTH should be punished. Multiple offenses should result in steeper fines and penalties up to and including the shut down of your company if you are found complicit.

      You can’t be serious! Do you really believe they are all here to work? There are ways to legally attain a work visa. They come for the free food, housing, education, medical care, job training, daycare, prison, cash assistance, attorney fees, utilities, etc. The list of freebies goes on and on. When it becomes policy to give these entitlements to Americans only, I’ll consider the idea that people are coming here illegally for jobs. It should be illegal for our government to take our money to pay for the free life of non citizens. That’s aiding and abetting the criminals. We give enormous amounts of money to other countries for humanitarian reasons. These people need to stay in their own countries to benefit from our generosity in that way. It is their responsibility to ensure that the money given to their government from us is actually being used to help those who need it.

      @NOTAMUSHROOM Actually 1,000 of people from housekeepers and Physicians and it really isn’t that tough to verify SS number of immigration status. Trust me merely asking several questions related to such information scares them away. As far as the chicken or the egg you missed the point as it wouldn’t matter is they could not get jobs. Yes I blame the small and medium “businessmen” who knowingly hire and exploit them. The same types who take cash payments so they can avoid paying taxes. As far as Welfare and Medicaid, I certainly think they should be thrown off those programs yesterday. For the record I am neither a liberal, conservative or progressive. I can actually have an intelligent discussion and decide things on their merits, not ideology.

If companies actually verified status and states did not give them Welfare and Medicaid, why would they come here. Your analogy shows you do not understand the concept. I agree totally that they are indeed illegal and thus have committed a criminal offense. But let’s not kid ourselves how many small business guys are employing them simply because they can exploit them with low wages, no benefits and no payroll taxes.       The start really needs to begin in WASHINGTON but you can never expect anything like this from the gutless Senators and Representatives we elect. You could NEVER expect Barry Soetoro to endore such a plan or the Mamby-pamby Supreme Court to allow it to pass.

      If the existing immigration laws were enforced as they should be, states would not have to bother with these laws. Let us bring home ALL our troops from Germany, Japan and every country that is capable of defending themselves and as troops are released from Iraq and Afghanistan, place them all along the border with Mexico.

      The illegal imigrints have no respect for our laws as evidenced by the numerous fatalities caused by drunk driving accidents. Some of these were 2nd and 3rd offenders but yet these illegals weren’t deported after the first offence.

      I love the part about not giving them a ride too. It should be illegal because if you knowingly give a ride to an illegal alien, you are harboring a felon and you should be treated as such. It is way past time to take the kid gloves off!

      Anyone who is found guilty of aiding and abetting an illegal alien should be fined 50K with a mandatory jail sentence of 10yrs or government imposed exile for the same amount of time. No public services should be given to illegals. At least one parent should be an American citizen in order to be a natural born citizen. No work or student visas should be issued by the U.S. Government until unemployment reaches 3% or less.

      It is there fault. Had they stayed in their home countries and not snuck across the border like thieves in the dark of night, this wouldn’t even affect them.

      If the government won’t uphold the laws, the states need to keep doing what they are doing and pass tough illegal alien laws. Even if the laws are challenged, the illegals are going to know that they should avoid certain states. If enough states have illegal alien legislation on the books, eventually there will be no sanctuary states anywhere and perhaps then, the feds will do something to close the borders because the illegals will start staying HOME.

      My interpretation of the “illegal to give them a ride” rule is probably to target the employers who pick up truckfulls of illegal aliens who are standing on certain streets and street corners looking for work for the day. This happens in AZ all the time. You need a couple of carpenters? Go to the corner of A and B street and pick up some day laborers.

      I doubt they are talking about picking up hitchhikers here.

      my question is, what does it have to do with race? The law doesn’t care what color you are, if you are illegal, you are illegal. That’s like saying outlawing country music would be a racist law. No it wouldn’t be, white, black, brown, you would be violating the law if you listened. Just because it affects one race more than another doesn’t make it a racist law.

      Its every aspect of our system that is being exploited by ILLEGALS, here in Washington they immediately go to the nearest DSHS (where state workers are not allowed to even ask if they are legal citizens) and sign up for every program that pays them for being here. They get child care provided so the can go to work and many times the child care is provided by other illegals that in turn receive my tax dollars to pay for the care of illegal children so there illegal parents can go to work…. They then get a housing allowance for the remaining illegals that may be out of work, and I pay for that and next they go for a drivers license( again where being illegal has no bearing on whether you can apply or not) so they can buy junk repaired cars from other illegals and drive as uninsured drivers on my tax dollars paid for roads to make sure that they can take their kids to daycare and get to work…..Oh and just a note, every time I have gone to my local hospital emergency room I find thirty or so HISPANICS waiting around for JOSE to be seen by a doctor that I am also paying for because god forbid they need that cold looked after before they infect the rest of the ILLEGAL work force….Oh and please fly the MEXICAN flag why you are staying in my country so I can be reminded of what a great NEIGHBOR you have been to MY COUNTRY….

      All of them are breaking the law. A business that will pay the illegal aliens low wages in order to avoid giving a citizen a job & the illegal alien. I’m a teacher in Alabama & I am curious to see if the Justice Dept. jumps in over Alabama stopping the students from being able to get in school. The way the federal law is written now we cannot even report them if we suspect it.

      There was a newstory this past week at local Georgia newsstation.

      Farmers say Georgia’s new immigration law has scared away illegal immigrant migrant workers.
      Georgia’s new anti immigration law is already having an impact on agricultural productivity.

      And when crops die in the field, that’s money down the drain for a farmer. Large farms depend on lots of labor. A lot of those workers are migrant workers, and some of them are illegal aliens.

      The migrant workforce are the people who have been most dependable and able to come in as needed.
      Not anymore, they are bypassing Georgia and going to safer states.

      Webster is a farmer in Waynesboro, Georgia, and works for the Farm Bureau there. He says it’s a reality in the agricultural industry.

      “The migrant workforce are the people who have been most dependable and able to come in as needed,” he told News 12.

      Webster says if the migrant workers don’t come to Georgia, everyone will be able to feel their absence.

      “It will ultimately–it will cost the consumer more at the grocery store,” he said.

      Governor Nathan Deal sent a letter to Agriculture Commissioner Gary Black. He wants Black to survey farmers about the impact this law could have and how it has affected them thus far.

      That law takes effect July 1st. The Georgia Fruits and Vegetable Growers Association says about $300 million worth of crops could be at risk.

      JR you make a good point but the truth is you don’t see too many Americans begging for the type of jobs which they were doing… Maybe if you take their tails off of all the Welfare then that scenario may change.

      It is not totally the illegal aliens fault, like you say the people who hire them and others like that should be held responsible as well. However, the person did come into this country illegally and broke they law by doing that. No matter who or how many people are held accountable, they still did break the law and they are illegal aliens. Just because they are not the only ones that should be held accountable like you mentioned doesn‘t mean that they shouldn’t be held accountable as well. Besides with your daughter-in-law, she is not an alien she began as an immigrant and became a naturalized citizen.

      it takes more than having one parent thats american to be a natural born citizen. one must have two(2) AMERICAN PARENTS AND BE BORN HERE to be a natural born citizen. having only one american parent makes that person a citizen but not a natural born one. were you government schooled or are you an idiot on your own. anyone with one parent who from another country is a duel citizen and is excluded from being prez or vice prez.

      MS-13 doesn’t come here for the jobs. I agree with punishing those that entice illegal immigrants to break the law is good, but punishing the illegal immigrants is also important. Not all illegal immigrants are hard working people that just want to make a better life. Like cancer, criminals spread wherever they can go.

      I would also like to see our government make legitimate immigration faster and easier, without lowering the standard. We need good immigrants that want to come here and be team players with us. Those who come here to be an integral part of our great country I very much welcome.

      I live in Alabama and I am very pleased with this law. I have had 3 friends in recent months get into car accidents with illegals and they were just let go. My friends got screwed paying for car repairs and medical expenses and even though all three accidents were deemed the fault of the illegal unlicensed driver, the cops said ther was nothing they could do. Our clinics and doctors office are overrun with illegals getting free and medicaid paid medical care, costing our state millions. Our schools dish our millions to provided education and free meals to children of illegals. We have 9% unemployment and have many local legal citizens who get underbid by illegals doing maintence and construction/roofing work and have to close their businesses. So I say good for you Gov. Bentley and our Republican lead Congress. We have had enough. Take this State and Country back. You wanna come here, do it the legal way or better yet, go take your countries back, quit helping flush mine down the toilet.

      JROOK, I have to disagree with you on part of what you say. I agree, business should pay, if they hire illegal aliens. They are breaking the law and should be prosecuted. As far as it not being the illegal aliens fault, Wrong! Illegal is illegal! They broke the law and came into this country illegally. If they stay in their own country and come here legally, there won’t be a problem. Once they enter the US, illegally, they are wrong and deserve to be run out of our country.

      I agree with penalizing businesses who employee illegals. I say take their business licenses away! But I also fault the illegals because they have broken the law the second they cross the border illegally, or stay beyond their visas when they agreed they would leave in writing in their native language.

      Compare this topic to the relationship between drug dealers and drug users. The users break the law when they buy the drugs, but the Dealer wouldn’t be in business without clients, so they take the risk.

      When law enforcement catches drug dealers or their clients, they’re both arrested. Remember equal treatment under the law? That applies to anyone in the country – even foreign nationals who break our immigration laws.

      “The legal director for the Southern Poverty Law Center, Mary Bauer, said Thursday that she expects a lawsuit to be filed before the provisions of law are scheduled to take effect on Sept. 1.”

      The SPLC is a tax exempt organization that is not supposed to be involved in politics in any way, but especially as an advocate. In this case, they’re showing a bias for illegal immigrants, which is part of their open borders policy, which is a political advocacy.

      That they haven’t been challenged by the IRS yet reveals the extent of corruption in that organization. The IRS itself should be abolished altogether and replaced with a flat tax.

      That will never happen, of course. It will take a march on the castle with pitchforks before the miscreants are held accountable for their crimes.

      In the meantime, the crooked SPLC will continue on with their flagrant violations until they too look out their window one day to find many people outside calling them out for an intense discussion session.

      Nothing in this country will be set straight until the people themselves force remedial action.

      The more states’ Governors that endorse tis kind of laws, the stronger they stand against the fed and the COMPLETE FAIL DOJ. Enough states that enact these laws, the stronger it will stand against a Supreme Court judgement, and if they fail to judge correctly, then they all stand together to enforce the FEDERAL laws they in fact are enforcing.
