Alabama Lawmaker Who Wants to Ban Islamic Law…Can’t Quite Define Islamic Law

If you’re going to introduce a piece of legislation to ban something, you might want to be able to define what it  is…

The Anniston Star reports:

A bill introduced Tuesday in the Alabama Senate would ban the use of Islamic law in Alabama courts.

The bill’s sponsor said the measure was designed to protect future generations from erosion of the Constitution. One Birmingham area Muslim leader said the move was an effort to “demonize Islam and Muslims.”

But no one — not even Sen. Gerald Allen, who sponsored the bill — can point to examples of Muslims trying to have Islamic law recognized in Alabama courts.

The bill manages to describe Islamic law thusly:

“a form of religious law derived from two primary sources of Islamic law: The divine revelations set forth in the Qur’an and the example set by the Islamic Prophet Muhammad.”

However, State Sen. Allen not so much:

Allen could not readily define Shariah in an interview Thursday. “I don’t have my file in front of me,” he said. “I wish I could answer you better.”

Salon notes (as does The Anniston Star) that text from the legislation is lifted directly from Wikipedia:

Making the Alabama story even richer, the Anniston Star also discovered that the text of Allen’s anti-sharia bill is lifted directly from Wikipedia. The bill (and Wikipedia) defines sharia as “a form of religious law derived from two primary sources of Islamic law: The divine revelations set forth in the Qur’an and the example set by the Islamic Prophet Muhammad.”

The Anniston Star followed up with the Senator’s staff on that point:

Allen said the wording was drafted by Legislative staff. A source on the staff at the Legislature confirmed that the definition was in fact pulled from Wikipedia.

I think that violates some of the E4 principles (review: Enlightenment, Education, Empowerment and Entrepreneurship).

    Sen. Gerald Allen would be well advised to seek counsel of those who can define ‘shariah’ without falling into the discredit of wiki. May I suggest the counsel of Robert Spencer at JihadWatch.org who can connect you with the ultimate wordsmith (a personal favorite), Hugh Fitzgerald, or Dr. Andrew Bostom at his own website. These individuals can also link you with apostates of Islam who have first hand experience with shariah.

      Non Christian lands have also suffered greatly. China and India have endured centuries of violent Jihad WITHIN their borders. The Jihad targets non-Islamic lands for consumption.     Instead of clowning on his ignorance of Jihad and Sharia, we should instead leap to his defense with all the documentation and historical evidence he needs to outlaw Sharia.

    This is not demonizing Islam its simply telling the truth. Just look at the facts, all the extremist radicals are muslims. muslims want sharia law brought to America’s soil, they want to block our streets during their worship. They treat their women like cattle and the only world to describe it is slavery. They brainwash their boys and girls at an early age to accept this horrible existence and they teach their children to hate christians and especially America. They do NOT belong here in this christian country., They should ALL go back to the MIdele East, its where they belong. What does our cockroach President do about, he constantly praises their contriubtions to America. REALLY ? Can anyone tell me what great accomplishments they have made and what wars they have fought in during our history. Obama wastes our tax dollars to rebuild mosques in the Middle East and he we are on the brink of collapse. He is of them and should be deported himself. WAKE UP PEOPLE!

      Am I the only one who feels a little bad for this Senator? In the information age, you can never have an off moment, a “senior second”, for everything you do is documented online. How many times have any of us been asked a question and for whatever reason, can’t immediately come up with the answer? If his staff “borrowed” from wikipedia, he probably did not know it. How hard it must be to be in politics right now, any mishap is instantly broadcast around the globe. I would venture a guess that he was not quite as ill-informed as that sound bit made him out to be. At least I hope not.

    Shariah Law is pretty straight forward. Buy some books on it…Conservatives did because they like to know what their enemies believe so they can be prepared.
    The first order of Shariah would be to ‘do away’ with any and all homosexuals…Rosie, Ellen and the other ‘weathy’ homosexuals would be the first to be ‘eliminated’. Next, ALL women must cover themselves from head to toe – and not leave their respective homes without their husbands/fathers/brothers, etc. You listening Oprah, Lady GaGa, Barbara, Madonna, Bernadette, Nancy, Michelle, ladies of ‘code pink’, starlets, entertainers (no more bare arms for any of you!).
    For women…should you disobey, there is no ‘law’ against your mate maiming, raping or killing you. That is acceptable in Shariah Law. As for your babies…well, they aren’t really yours. Don‘t fall in love with your children because it is considered the ’highest honor’ for them to have bombs strapped on them, then be sent into a crowd – killing as many ‘Infidels’…or not as possble – in the name of Allah. You love anything…you lose.
    No more divorce, no affairs -married or unmarried-, no make-up, no designeer gowns, no talk shows, no opinions, no voting.
    There you have it. Not exactly a ‘woman’s world’, which is why little girls are strictly for breeding…if they are allowed to live at birth.
    Oh, and Ms. Piven? You are white, don’t wear a burka and opinionated…you‘re chances don’t look too good in your new ‘radical’ world.

    Who cares if they have or have not applied to the courts. Sharia violates the basic tenets of the U.S. Constitution and should be outlawed int his Country in every corner.
    Stoning, subjugation of Women and mutilation of all is against the law already. There should be no discussion as to exceptions! This is eric Hole-ders job. The lowbowma admin must go and the cabinet, czars and soros minions with him..

    You can buy the freakin hadith and quo’ran on amazon. It isn’t that hard. Also, it’s nicely bound and plainly explains how to oppress and kill non-muslims while overthrowing governments. If you can not empathize with the enemy, you can not destroy him. That’s universal law. Stop peeing in the wind and read. We need more Allen West’s.. the reality pool is shallow in DC.

      The deceptions of Jihad are 1,400 years old. Most do not even see them or even know they exist.

      Lots of people still think God and Allah are the same.

      Reading the “holy” texts of Islam is not nearly as instructive as reading some military history. Because doing that, once quickly sees that it matters not where in time or space one chooses to look, where Islam and non-Islam interface, there is violent Jihad.

      Do an internet search for “History of Jihad” and you should find plenty of historical accounts of brutal Jihad slaughters on non-muslims for the last 1,400 years.

    He’s a clown but the wikipedia thing is meaningless. Everything on wikipedia is plagurized from other uncredited sources. If they actually lifted text from wikipedia then they’re even dumber, but it’s more likely that whoever cut and pasted the stuff on the wiki page just got it from the same source the drafters of the bill did.

      On that note: The loons have a re-definition staff doing exactly that. I have had many occasion to see their own using these adaptations as references. I can only imagine how the Ministry of re-education is pushing the new wiki-definitions through our schools and as material for ‘standardized (progressivized)’ tests.

    HE needs to contact the State Senator from TN who wants to ban SHARIA LAW. Don’t sweat it ALABAMA… help is coming. GET a copy of “THEY MUST BE STOPPED” by former Muslim Brigette Gabriel and look at the footnotes and the documents within. It’s SHARIA LAW you wish to prevent and you want (as the first posters said) to make sure your law is written by the best legal minds in the country. WHY not contact Jay Sekulo (sp) at ACLJ (American Center for Law and Justice)…. I’m sure he has plenty of info. on this. ALABAMIANS and all SOUTHERNERS…help out… STOP THIS GREATEST THREAT TO THE WORLD and OUR NATION…NOW!!!

      That is the point you stupid fools, it’s to prevent this from happening in the future. Although I agree with what many are saying and that is even if you ban Shariah it isn‘t going to stop them from doing what they want because they don’t live by our laws it is still a start and protects us in some ways from this becoming protected in society. The real answer to the Muslim problem in the country is plain and simple and that is that we need to cut off Muslim immigration to this country! That is the answer until they ban Islam in this country because the teachings from the Quran represent a Criminal threat to your life, liberty, and the pursuit of happiness.

    There are Religious arbitration OPTIONs available, which cannot themselves be banned. The place to start is by banning the use of recognized [religious] arbitration opinions as a source for regular court precedent [if it isn't already].
    On the state level a law should be written [if it doesn't already exist] overtly establishing One Law, IE “Equal Protection”, [Not Disparate Treatment] on religious or racial grounds. That of course would interfere with current federal law establishing “Disparate Treatment” along the lines of racial “Victimhood” [of course not in that language],

    Islam is a political system first, religion second! in the Qur‘an and the Haditha it clearly lays out the following of it’s political structure even to non-muslims. There is NO tolerance in Sharia… but the scary thing for all of us conservative Americans is that Sharia is completely socialist! It demands that basic necessities are provided ( housing, clothing, food) and that State ownership trump all private commitments. This is what the Islamic clerics are preaching to the leftists….they say Sharia is actually the second bill of rights ( the holy grail of progressivism from FDR) and allows all religions equal treatment. This is purposely deceptive, while providing for “all other religions” the basic needs….NON-MUSLIMS are to be treated as second class citizens, in hopes that there own hardships and emptiness of pocket would accelerate their conversion. Homosexuality is a capital offense by the way, so all of the bleeding heart gay leftists who are cheering on Islam might want to rethink that. Oklahoma passed an anti-islamic law with 92% of the vote and it was immediately stricken down by a liberal circuit judge…..where is liberty? where is the will of the people???Under Sharia Law to dissent is to die a cruel death in a public square as an example of Allahs love…and we wonder why these people still live in the stone age!!

      A lot of Muslims want Shariah Law wherever they are in the world. I don’t believe this bill is an adequate defense against it, since radicalized Muslims will stop at nothing to implement Shariah Law in the USA. They don’t respect our laws or our way of life..think harder.

      Any legislation proposed in this matter has to be carefully worded, and defined within the framing made of cast iron plate and titanium to survive the inevitable challenges on the constitutionality of it.

      Any law that is unconstitutional is unconstitutional. Thus illegal. If you discriminate against women, if you restrict rights based upon gender, it is unconstitutional. If you discriminate against another’s religion, unconstitutional. So on and so on…..

      What is there not to understand? Could we pass a law rescinding the 19th amendment or15th amendment? How many people would scream if we started chopping off thief’s hands, or stoning adulterers to death, beheading murders (they scream when the lethal injection drug is tainted). So as far as the left defending this, bring Iranian justice to this country as see how much the scream. The ACLU would be the first ones tongues that would be cut out. Simple, if you want to see Sharia law, look at Iran, Iraq, Afghanistan, etc…and see how it works first hand.

      Amen. I’ve said it before in this forum. This kind of proposed law is unnecessary. There are laws already on the books about anything bad within Shari’ah. We need to quit trying to overcompensate. Defend our liberties on Constitutional grounds only, and trust that by doing so, we’ll ultimately have stayed true to our American selves while allowing the full seductive effect of liberty, which I have full faith in, to convert all comers to this great land.

      I was thinking along those same lines. I had not begun typing so the words had not formed into a sentence. “U.S. Constitution” came to mind…and “what kind of law do you write for that(?)” when anything unconstitutional is illegal.

      What I am afraid of is that in not too many years down the road, there will be so many radical Muslims in the U.S. that we could very well get a Muslim Congress. We already have a Muslim POTUS (putative), and look at the mess we are in!

      The contributors and team leaders are outstanding. The file is in my opinion, one of the best I’ve ever read.

      He should talk to the experts like David Horowitz, Jamie Glazov, and Robert Spencer. In particular Robert Spencer is an expert in the Koran. At the very least they should have bought and read his book. “The complete infidel’s guide to the Koran”. This guy needs a new staff.

      Simple………

      The LAWS of the Constitution of the United States are the ONLY LAWS that will be recognized to be used in the USof A.
      All other laws of a Foreign or Domestic nature are NOT recognized.

      I think the muslims wanting sharia law here is using it to keep all other muslims in line as a fear tool.

      Seems like consulting with the States Attorney of AL would be a good place to start. I wrote Rick Scott about that and got a “thank you very much for your letter, please get in touch with the state representative in your area” letter.

      it would seem the fool can easily recognize that islam is evil and dangerous. i am familar with the quran and hadiths and sharia law but i would need actual written info with me to review and explain what i have read.

      AZDEBI, your list of the top 10 reasons not to have Sharia Law is sobering. It also begs one to wonder why Hollywood leans so far left when most of the women would have been beaten or stoned to death in the first month. Being a Christian is not exactly a safe haven either when confronted by Islam. Maybe someone should do a “real time” movie about Sharia and get “hard left” stars to play the parts. Maybe, just maybe, a light would go on in their liberal heads.

      I look at this and others stories in the media as smoke screens thrown up to keep people from looking at the real issues at hand, getting cuts to the budget, a limit on spending, and the removal or reversal of the health care con. The real issue at hand is to eliminate the appropriations that were hidden in the health care bill. To assume that the legislators didn’t know about this when they voted for the bill calls for a gullibility of epic proportions. I sincerely hope that Sean, Glenn, and Rush, (our only real voices in the media), don’t fall for the lefts attempted sidetracking of these vital issues. Let’s face facts, the American people were duped out of their children’s money by the socialist politicians and Obama by trickery included in the bill. Our three spokesmen need to be shouting from the roof tops how the Obama administration has snookered our citizens. Don’t address any of the smoke screen issues and pay attention to the slight of hand going on!

      This guy is wasting the taxpayers money simply to appeal to his uninformed and not too bright base. We have a well developed legal system in this country, based on the law and precedent. I suppose a judge might decide to base his decisions on another basis, but his decisions would be overturned and he’d lose his job pretty quickly.

      This is the state of American politics today: appeal to people’s prejudices for political gain.

      Rather than outlaw Shariah Law, which would spawn a series of lawsuits from any “religion,’ that felt a need for protection, states need to require only U.S. law be the law of the land. Keep on point. Keep it simple.
