Alleged Armed Officers Shut Down Mass. Ice Cream Stand Indefinitely

If you’re the owner of an ice cream stand in Massachusetts and you make building improvements without asking the state for permission, you may find yourself on the receiving end of a prohibition-style shutdown.

An ice cream stand in Great Brook Farm State Park, MA (of course), was shut down by state officials this weekend after it was discovered that the owner had made building improvements without the appropriate permits, lowellsun.com reports.
“Mark Duffy, who has operated the dairy farm at the state-owned park for 26 years and has a lease with the state to run the stand, said armed Environmental Police officers showed up at stand on Friday evening and stood guard throughout the weekend, turning away customers,” lowellsun.com’s Chris Camire reports.
And as if having the stand shutdown wasn’t bad enough, the park officials did it over Mother’s Day weekend.
“Edward Lambert, commissioner of the Department of Conservation and Recreation, said the stand was closed after it was discovered construction had been done without local or state permits,” Camire reports.
“The work, which expanded the stand, included construction on a barn built in 1910 that is adjacent to the stand,” the report adds.
Lambert’s excuse? He’s protecting the public until the state is positive the improvements are 100 percent safe.
“I like ice cream as much as anybody, so it pains us to even temporarily close what is an iconic property, but we have to make sure people eating ice cream there are safe,” said Lambert.
However, according to Duffy, who lives on the nearby farm with his wife, he has made plenty of improvements over the years and this is the first time the authorities have thrown a fit.
“The reason I’m here and the purpose of having me here is to improve the facility and operate a commercial dairy farm,” said Duffy, “I make improvements every single day and have for 26 years.”
And along with Duffy being put out of work there are also the 13 high school and college kids who worked there. They’re unemployed as well.
You can’t see it but authorities also posted a sign that says “Santa isn’t real.”

The ice cream stand and the dairy farm are situated on a 1,000-acre park where people come to hike, mountain bike, tour the dairy facilities, and, of course, eat ice cream.
“On a diversified farm like this, the only way to stay in business is to make all the pieces work together,” said Duffy. “I have expenses. I just don’t have that income anymore. It’s a seasonal business, but this was done on Friday at 6 p.m. on a beautiful Mother’s Day weekend.”
Lambert said he‘s not sure when he’ll allow Duffy to reopen the stand.

I was in the Navy, and I’m not required to follow an order that is not legal. And making it a law doesn’t make it legal according to the US Constitution. If the government takes my house because I didn‘t file for a certain permit that I don’t know I need, they’ll have to take it by force. I’ll chain myself to the front door. We wanted to do everything right and we went for town permitt, the town took some money and sent us to the county board of health and they took some money who then sent us to a dig safe organization (we were not digging) and they took some money. Before we could build the town inspector would not allow us until the dig safe marked the ground, who ever the dig safe guy would not mark the ground until the board of health (septic inspector) had posted a permitt, but sadly the board of health would not issue the permitt until the town issued the permitt. We played this game for 4 months and decided to just build it. Way too much government

If while traveling thru Oklahoma don’t get upset by all the people with side holsters with a gun in it. I can’t make up my mind weather to carry my Ruger 30 cal. or my .45 cal. My 3 sons have the same problem but my 3 daughter in-laws have already decided to carry their Judges with .45 and 410 shotgun shells. This is something else: pure intimidation by government functionaries. Polititcians and dirty diapers need to be changed often, and for the same reason. So should government functionaries.

Make a regulation for all of those and try to enforce it. It will cause the farm/ranch to fail immediately. What the hell do you think you have to do to take care of cows? They break stuff like crazy – trash fences, break feeders, etc. If you knew a single ******* thing about animals you wouldn’t be saying **** about this guy. Do you really think that the government knows animals half as well as ranchers? 1/10 as well? 1/1000th as well? I will invite any – even Pelosi – bureaucrat to come stay out here at my place for one month to work with animals like I do just to prove how little they know about animals. Hell, I’ll take Obama out here and let him stay. I’d even put up with all the security ********. I would happily let him stay for one month, and he could do what I do and then try and say how much he thought these regulations help. The regulations mentioned aren’t safeguards; they’re bureaucratic BS by a bunch of “elite class” dumb***** who think they know everything about my job better than I do.

In addition most every one of the forces have various teams (SWAT, Antiterror, etc.) that train to do what? Mostly to put down opposition to their lords and masters; government. Conservatives do not ever think we are above the law, but common sense should always in full force when making the laws of the land. That is obviously not the case in MA. If the ground is covered in nails and the building is being held up by duct-tape.. then yeah it should be closed down. But if he did some painting and fixed a few siding boards that were loose then I do not see a problem. Tell the guy “Hey, I seen that you did this updating. Could you please go pull the permits for the repairs?” More than likely, he would have said “No Problem.” and did it. But he was closed down by armed officials. Happy Mother’s Day indeed…

Building codes have to be followed for the safety of the employees and the public. Not knowing he was doing the work himself or a contractor was befuddles me at the moment. I would think that a contractor would refuse to do the work if permits were not obtained.
Report Post »Still, it’s a shame for the public and the employees. And, I can see how this mistake could happen if the business had been there for so long. Usually, today such a permit in a park like this will come with two or three books of rules to follow and are about as impossible to understand as the federal tax code. These were not likely delivered over that many years. Still, I can’t see armed guards like a swat team showing up to act like jack booted thugs though.
I know several of the city and town inspectors around here and they have the power to shut down a construction site on the spot until what ever violations are corrected. They are not armed and I have never heard of any problems from any of them. To me, this is like nuking an ant bed. Where is the civility from the state?

Posted on May 17, 2012 at 12:24pmI guess that depends on what you call a law. Building codes are actually ordinances and not laws. You have a right to appeal and disagree with an ordinance. Until the last two days I had never heard of armed police officers enforcing building codes. Usually you get a notice of non-compliance or a written complaint and a certain number of days to respond in writing prior to being taken to court. Businesses can usually only be shut down with a court order.

How sad that your comments seem the only sensible ones under this article. Others trying to justify the actions or those simply complaining that the government is overdoing it are so weak. It seems that even most of those on the right just don’t really get it. Government is totally out of control but so is the mindset of those that would agree to one more law or act or even one more tweak on an existing law or act. Only dismantling the vast majority of these will bring back the country as we knew it; the country for which so many died.
About a year ago, I was stunned to hear myself say aloud, “I just don’t like this country anymore.”
